The Pledge of Allegiance to the Flag was led by Bryce V�rhite. � Reverend Harold D. Byram, pastor of the Assem�bly of God Church, Redding, gave the invocation. � The meeting was called to order by Mayor Martin with..the following councilmen present: Chatfield, Denny, Kriegsman, Moty and Martin. The Vote: Unanimous Ayes. COMMUIVICA TI ONS ` Improvement Bechelli Lane ' Floyd H. Morgan, Chairman of the Shasta County Board of Supervisors, advised the County proposed to improve Bechelli Lane from its intersection at State Sign Route 44 to the Riverside Country Club and just beyond under y�7� Federal Aid Secondary Program. This is an urban area immediately adjacent to the City and within'an area currently being petitioned to be annexed to the `City. It was requested that City consider participation ` w,,�in t�ii� project, and t` consider the extent to which City may feel a con- , � tributiori �an be made�... ' ` �•. i � , . . � Engineering plans call for the construction of four lanes from State Sign Route 44 to Hartnell Avenue, with an improved two lane section to the �end of the proje�ct, �:. . _ . .. . Director of Public V1Torks Arness stated costs of F. A. S. projects are divided tYiree ways = State, County and Bureau of Public Roads, and that possibly City could pick up costs of the right of way and replacement of the curb ancl gutter, for that area within the City. limits. Mayor Martin asked that Councilmen Moty and Chatfield-and the City Engineer meet with the County Board of Supervisors for further study � of this project. ` ` � ` ' Conference - Chico � ' The State Dept. of Public Health advised of ap ourse on "Planni g for ��/ Environmental Health" to be held in Chico Se tember �3.rd throu h 28th. City Manager Cowden informed council that Carl Arness would attend ` some of these meetings. � � � t . � Protest on Sewerage Charges Herbert R. Meyer, Motel California, protested the charges for the dump- .���< ing of sewerage into the City of Redding sewage system. 380 City Manager Cowden was directed to write Mr. Meyer explaining the . septic tank. charge is in lieu of any regular sewage charge, and to compare cost in relation to the billings to motels within the City. � . . � "Fly-In" Breakfast - Benton Airport The Redding Optimist Club requested permission to hold their annual ��� "Fly-In" breakfast at Benton Airport on September 8th with rain date of September 15th. A certificate of insurance holding City harmless will be furnished. � . � . Councilmen concurred in approval of this request to hold "F1y-In" Breakfast. Petition for Annexation - Sharon Ave. ` ` � , A petition signed by 14 residents of Sharon Avenue was filed on August . � 2nd, for annexation to the City of Redding. ,Legal description and map Lf,.,_. � of the area proposed to be .annexed was filed with the �petition. � < < . . Planning Director Keyes advised this petition had been referred to the Shasta County Boundary Commission, who had approved the annexation this date. Mr. Keyes further stated there was a minor discrepancy in , the boundary description, too slight to hold up the proposed annexation. Re Proposed Ordinance #735 Cable TV ` J. L. Carpenter, Manager of Station KQMS, asked that passage of Ordinance y-� � No. 735 be delayed at least two weeks in order they have time to adequately � research and prepare their comments thereon. - < < Vt�ater"Pollution Control Board � Joseph S. Gorlinski, Executive Officer Regional Water Pollution Coritrol `�� � Board, submitted a copy of their Resolution 63-166 which prescribes waste discharge requirements to cover waste disposal to _the Sacramento River. Re Proposed Motel Tax � �` j Sid Cowgill, Manager of the Redding Chamber of Commerce, advised � their-Boarcl of Directors_had approved the proposed motel tax county wide and will work toward having it adopted area-wide. Re Purchase of Property - Benton Airport Reverend John O'Connor, pastor of St. Joseph's Parish, outlined plans for the new church. That he is aware of the gully to the south of the property, and that City has an easement to cover pipeline that is. in this gully. That should the gully be filled in.to provide parking, that a drainage pipe meeting City specifications would have to be installed by St. Joseph parish. � � � He spoke of off-street parking, advising it was their hope it would be possible to park on the school property directly across the street. � _ Planning Director Keyes briefed councilmen on the cut and fill that may be required, or the construction of a retaining wall. Also, that at some f:u.tur-e: date a road may be constructed between.Benton Airpark and the � church which would necessitate participation by the church based on a formula that would consider the relative benefit to all the parties involved. Councilman Kriegsman said in his opinion all requirements of the City should be formalized in a letter so there is .no misunderstanding at some � future date. � It was further suggested the Church apply, for a use permit before .the purchase of this property, in order to have the thinking of the Planning Commission before obligations were contracted. . 381 Request - Use of Parking Lot , , Mrs. Adell Chatfield, Secretary Redding Youth Baseball Inc. , requested permission to use the city parking lot on Pine and Sacramento Streets /._.3 � for their annual Buck Hunter's Breakfast to be held September 21 st. Breakfast will be served early Saturday morning, and they plan to finish by,10:00 A. M. � Councilmen unanimously approved this,,request. M. having arrived, Mayor Martin openecl the public hearing on the request for the rezoning of certain property from R-1 5ingle�family residential district to R-3 Restricted rnultiple family residential district. � Property located at the intersection of Olive p'venue and Placer Street, �being a portion of Lots 2 and 3, Block 15 of Bostwick's Addition�to �Redding. The following documents�are on file in the office of the City Clerk: � Affidavit of Mailing Notice of Public Hearing Affidavit of Publication Notice of Public Hearing „ Planning Director Keyes� reported on the public hearing held by the Planning Comrnission: He stated the proper.ty is owned by the Christian Church, who have a prospective buyer for the property who would�like to convert _the building to an apartment house. That if -the property were rezoned to R-3 they would realize an additional $10, 000 income from the sale. � � r c.f ' / �` The Planning Commission recommended disapproval of t�e request based upon the conclusion that�the zoning requested would not be appropriate for �he general vicinity and would .therefore represen� a form of "spot zoning'' primarily of benefit to one property only. The Commission wa�s unanimous in �he disapproval. The Planning Department�and .the Planning' Commis'sinn were deeply regretful of their recommendation to not approve this request, however the property owner had been advised it would be possible to divide this lot into three. V., Systems � City Attorney Murphy stated that Ordinance No. 735 �was before councilmen this evening for second reading and possible adoption; the basic reason for the adoption -- of the ordinance as quickly as possible was because it would then be possible to review the applications for a franchise in this �field. He explained the proposed ordinance�provides a�procedure�for the franchise appli- cant to make his application, and the procedural sections of the`ordinance remain unchar�ged by the, propo.sed amendments. The amendments �were suggested by, review,ed and approved.by Councilman Kriegsman, appointed b,y Mayor Martin as the council liaison office,r, and stem from suggestions of those have have informally applied for a franchise, interested parties in the area, comments - of the Record-Searchlight and comments and reviews of the councilmen them- �• selves. . , - ,.. , . _ • . : • ._ . He fur.ther stated he and the City Manager had met in Red Bluff with Jere Hurley, .5hasta County District.,Attorne�'s office, representatives of the City of Red Bluff and Tehama County, the City Manager of Chico�and a member of the City Attorney's , staff of Chico;.p.roposed ordinances had been reviewed, together with the applications for the franchis;e. . That Chico a.s a, charter.city was in a po.sition to process ap_plications for a franchise_at this time, as their charter provides for the pro- . < < cedure of obtaining, a„franchise. � . - •� . � . ... . � - i � - , �� � Councilman Kriegsman concurred it would be advantageous to pass Ordinance No. 735 tonight, as he believed it would go a long way to reducing the time for pro- � cessing the applicants for a franchis,e; that he had understood from the ,.persons with whom h.e had s,poken they.were sati.sfied with .the ordinance�x- +at this time they request a .delay.and;he saw no reason for a delay as it was not�possible�to work in concert in everything. Frank W. Shuman, representing KHSL, Chico, requested a delay in the adoption � . . of Ordinance No. 735; that a two week delay was not of such great moment. He a.sked, that Ordinance,No. 735 and the amendments to Ordinance No. 73�5 be . � . considered as first reading. , He called attention to Section 13. 1-19, Additional Services to Franchise HoTder, that made prior approval by City Council necessary under cer-tain conditions; he mentioned that the last legislature had.passed a 1°jo tax, on pay-as-you-go TV. � : ,. .. . . � : . - . . City Attorney Murphy sa�id he did.not understand pay TV to be closed ci`rcuit TV without any pay features whatsoever; that he was not able�to give 100°jo assurance that City is exempt from the provisions of the State legislation with this section . in, nor tell if City is exempt with this section out. In his opinion this ,ordinance clearly says it does not cover pay T.V; that City was expressly reserving the right to regulate pay TV by another franchise ordinance covering pay TV if and when it comes arid if the Federal or State governments have not entered into the regulation of it. That City could repeal this one section of the proposed ordinance if we find the State has pre-empted the field. � ' ' Mr. John Spann said in his opinion Mr. Shuman's suggestions were valid and merited council consideration. The ordinance affected many people;. many ii�terests; -that the proposed or_din:ance did not have the 30 day clause= on delayed broadcasts, and this was most importarrt to the local stations. He then introduced Mr: V��illiam�B. Smullin, Vice President and Executive Mariager�of Station KRCR; he stated Mr. Smullin had a �life time �of'�experience in radi'o anfl t. v. arid was `on the executive t. v. advisory board "of�Columbia Broadcasting Company. � ' ` �� 3�6 Mr. S`mulliri stated he had a per'sonal interest iri thi�s 'ordinarice; they were�. endeavoring to bring top programs to .this `a'rea via'tw'o'networks, and the �: thirty day delayed `broadcas"t cla�tse does g�ive additional freed'om.' Tliey would be satisfied to do away with the thirty day before broadcast, but did ask for inclusion of the thirty day after.
