PROPOSED DANCE REGULATIONS Mayor Fulkerth recommended that Council postpone the second reading of an ordinanee regulating dances in the City of Redding until the representatives of �/// the three Boards (Board of Supervis'ors,� City Councils of Anderson and Redding) � meet to work .out the details of an acc�eptable ordinance that would be county-wide. It was hoped_the.se,�se'commendations.would be ready by February 18th, he said. MOTION: Ma�e by Dr. Martin� seconded by Councilman Chatfield that action be postponed on the second reading of an ordinance regulating dances. The Vote: Unanimous Ayes. Stolbrand, 611 Azalea Avenue, presented Claim for Damages under date of January 28th. � . �'Z� MOTION: Made by Dr. Martin, seconded by Councilman .Chatfield that Claim of Mrs. C. J. Stolbrand be denied and referred to the insurance carrier and the City Attorney. The Vote: Unanimous Ayes. Protest re Public Funds � The Shasta Auto and Machinists Local No. 1397, R. J. Whitlock, President, protested that public funds were being given to the Redding Chamber of Commerce. "This action was decided by the membership on the basis that the Redding Chamber of Commerce is a partisan organization'', the letter states. Dr. Martin sugges.ted the City Clerk be directed to write Mr. Whitlock asking how many persons belonged to this organization, how many members were �'p.,,,,. .,,;. resent"at`th�e time'"this objection was corisidered, and was this a quorum. In other words, how many persons were agairist' tliis rather than a statement the organization was against it. ' /'1� Councilman Kriegsman stated he was of the opinion that because someone does not agree with tlie Chamber of Commerce was no reason the City Council should even consider this type of complaint. City's contribution to the Chamber was considered at the budget sessions based on whether they were, or were not; doing their job. � Councilman Chatfield said whether the Chamber was a partisan organization had no bearing on the City Council. MOTION: `IVIad'e by'Councilman Chatfield, seconded by Councilman Moty this item be tabled until budget sessions, and the Shasta Auto and Machinists Local No. 1397. be so informed. The Vote: Unanimous Ayes. Filing of Petitions - Adams Tract Randall J. Presleigh, Attorney at Law, presented Petitions signed by property owners and renters of property objecting to being annexed to the City of Redding. The petition states: � "We are propert�r owners and residents in that area bounded to the west by the A. C. I. D. Canal; to the north by the present City limits of Redding; to.the east by the Sacramento River and to the s outh by W yridham Lane. " The following persons wrote protesting any annexation: �-'� � Ramona Kaplan A. H. Strange, Jr. W. L. Riley � Cathe rine Riley Mr: Presleigh stated this was in excess of 75°jo of the ar.ea known as the Adams Tract; that petitions were filed in anticipation of an election and it was hoped their area would be deleted from ultimate consideration by�the voters. P.lanning Director Evans stated a petition for annexation had been given to him, however no official request had been given that it be filed. He was waiting additional information from the Juniper School Board whether their area would, or would not be included in the boundaries of the area proposed to be annexed. The Adams Tract represented about 20% of the total area proposed to be annexed. zos Mr. Evans briefed council on annexation procedures: I.- Petitioners informally request City CounciL to consider annexation 2:� City Council refers matter to Planning Commission to consider continu•ity and boundaries: as proposed 3. Planning Commission reports back to council their findings 4. City, Council adopts resolution of intention to annex area 5. Referred to County Boundary Commission for report Annexation then becomes a matter of inechanics, involving several months of legalities. Notice sent to property owners in the area; tHe Public Hearing at which written protests are received, etc. It was stressed the petitions opposing annexation covered only the area to WynLlham Lane, not any area to the south. Until �report had been received from the School Board there was no way of knowing what area would be involved in any proposed annexation. Report from the Board was expected within one week. Recommendations of the Recr'eation and Parks Commission Ovid L. Holmes, Chairman of the Recreation and Parks Coinmission submitted recommendations that acquisition of land in the area known as Turtle Bay be investigated at once. The letter dated January 29th states: "A unanimous decision of the Recreation and Parks C.omm;s'sion after a two month's study of 17 prospective areas_and:'.1.9.pro�spective ��� facilities-is:--tha:t::th�e�top.priority parks and recreation acquisition at ' this time is the Turtle Bay property alongside the new freeway entrance to downtown Redding. " A map was attached indicating the locations of the prospective parks ' and recreation areas. Councilman Chatfield stressed the necessity the City go forward with this acquisition as rapidly as possible, as the Division of Highways had let their contracts and this will be a new. entrance to Redding. MOTION: Made by Councilman Chatfield, seconded by' Dr. Martin that City pr.oceed with the preliminary steps for the acquisition of all the remaining private property north of the freeway to the Posse Grounds on the south side of the Sacramento River, and what remains of the land to the south; to investi�ate the use of open space funds from the HHFA; that feasibility studies on the development of this as a park are a be made' with estimate of cost. The Vote: Unanimous Ayes. � . , _ Citizens Adv. Committee on �C. I. Recommendations A_communication dated_ February 1 st was submitted to all councilmenfrom the Citizens Advisory Committee on Capital Improvements. It states the preliminary report was prompted by the existence of the Federal Accel- erated Public Works Program and the possibility of City projects being qualified to benefit from the program. � The recommendations are as follows: 1. We recommend that the City Council set an election date .asking the electorate to authorize a General Obligation Bond issue in the � �� amount of one million dollars to be used for such purposes as: � sanitary sewer improvements including, but not limited to, land acquisition for a new treatment plant site; financing the City's share . of the cost of constructing a second grade separation; and the acquisition of additional land for future park needs. Bond interest and redemption cost would be financed by using approximately . $60, 000 annually from City sales tax capital fund sources. (De- pending upon the bond market, the annual cost to amortize one million dollars in General Obligation Bonds will vary from $54, 000 to $60, 000. ) 2. It is further recommended that another bond proposition be included on the same ballot providing for the issuance of one million five hundred thousand dollars in General Obligation Bonds to be used in 209 the construction of a $2, 500, 000 Civic Auditor7um. Bond :interest and redemption cost for the City's share of the project cost would be financed by using approximately $90, 000 annually from City. sales tax capital fund sources. , (Depending upon the bond market, the cost annually to amortize one million dollars in General Obligation Bonds will vary from $54, 000 to $60, 000. Accordingly, one .and one . half million dollars would require from $81, 000 to $90, 000: annually. )' The Federal Government under the Federal Accelerated Public Works program would allocate approximately one million dollars from Federal,funds to complete the project if the project gualified and Federal funds are available. Issuance of .the one and one half million dollars in General Obligation Bonds would be contingent upon the Federal allocation of one million dollars: If no Federal grant was forthcoming, the bonds would not be issued. . 3. We further recommend that the City Council apply to the Federal Govern- ment for Federal funds under the Federal Accelerated Public Works program and for such other Federal funds as may be available to assist in financing the recommended and other capital improvements. The memo concludes: "This report is not a complete or final report of the Committee but it is a.repo�t which we believe necessary at this time. Prompt action will be required if the City of Redding is to benefit from the Federal Accelerated Public ' Works program. The Committee's.final report will be made in April of this year. " There vvas considerable discussion on the grade separation and the various , methods to finance this project, with participation by the State, the Federal Government, Southern Pacific Company and the City. Councilmen were advised that representatives of the Southern Pacific Company had stated their contribution would be on a negotiated bases; they were anxious to increase the speed limits through the City, and the amount of their partici- pation would not be based entirely on street closings, Mayor Fulkerth advised the Southern Pacific Company would not enter into any agreement with the City of Redding until Engineering Report had been received; that it was not possible to go to the State for funds until location, , plans, etc. are completed. City Manager Cowden stated he would submit report and recommendation at the next meeting of the City Council on the employment of an engineering firm to prepare feasibility study on a second grade separation, to include location, plans and.preliminary cost studies. It was stated the Federal government had allocated 900 million dollars for , the Accelerated Public Works Program of which projects in the amount of $440 Million dollars had been approved. The Federal government hoped to complete allocations by the end of this fiscal year. PUBLIC HEARING The hour of 8:00 P. M. having arrived, Mayor Fulkerth opened the Public Hearing on the application for a vehicle permit to operate four taxi cabs within the City of Redding - Freeman Hackett, Redding Cab Company. �C� � Mayor Fulkerth, requ,ested postponement of this hearing to a later date as Mr. Lopez, attorney for the applicant had been ill; Mr. Bull will not be in town on February 18th. MOTION: Made,by Councilman Moty, seconded by Councilman Chatfield public hearing on the application of Freeman Hackett, Redding Cab Company be adjourned until 7:00 P. M. Thursday, February 7th. The Vote: Unanimous Ayes. 1 210 Communications (Cont'd. ) Citizens Adv. Com. for C. I. (Cont'd. ) MOTION: Made b}r Dr. Martin, seconded by Councilman Kriegsman to approve recommendation No. 1. • The Vote: Unanimous Ayes. Dr. Martin suggested�that staff and City Council give consideration to � � setting the date for an .election at.the next meeting of the City Council. Civic Auditorium -- ` - Councilman Chatfield stated a partial recommendation had been received ' from the'Citizens Advisory Gommittee regarding the construction of a civic auditorium. That he favors a concrete propbsal such as ''City of Redding should build an auditorium of this size". • . �.: �. . _.. . � . :�C ,.. � � y Dr: Martin sug"g'ested�that it might be the architects bn a no fee basis would redesign the proposed auditorium to one that might cost 1 and 1/2 ,million dollars. That site studies be made and there�be a newly appointed �auditorium committee. MOTION: Made by Councilman Chatfield, seconded by Councilman Kriegsman this subject be tabled for two weeks. City Attorney Murphy informed council a legal question would arise if the Federal government made �500; 000•availab'le for an auditorium under- the , Accelerated Public Works program, under the"present recommendation � of the Capital Improvement Committee. ` " ' • � Request - Extension of-Time Harlan Carter ' Mr. Harlan Carter requested an extension of time for moving from 701 Rio Drive due to storm conditions. (D-r. Martin leaves the council chambers. ) Mr: Carter stated he was ready to vacate the house on one days notice however due to the weather and the condition of the newly constructed ' road, this was not possible. He requested extension of time to move from his home and an additional extension of time to move the materials from the yard. � �Z�'C/ Councilman Kriegsman suggested storage�space be made ava•i-lable to Mr. J Carter in the fire cache building, if the storms persisted; this was satis- factory to Mr. Carter who said he would take out aclditional fire and theft insurance to cover this location. MOTION: Made by Council.man Kriegsman, seconded by Councilman Chatfield to allow Mr. Carter an extra ten days to move his household. furniture, then space be provided him in the fire cache building; that he be allowed thirty days to move all the material from his yard. Department of Water Resources � The Department of Water Resources, State of California; submitted a copy �.�� of the Summary Report on Bulletin No. 111, entitled "Sacramento River Water Pollution Survey". - The report states "that water quality of the Sacramento River is eminently satisfactory for present beneficial uses. " � Claim for Damages � � Mrs. Faustine Rockwell, 1839 Sonoma Street, submitted claim foi damages February 1, 1963. � � <� i� MOTION: Made by Dr. Martin, seconded by Councilman Kriegsman that we do not approve'the claim; and refer same to the City Attorney and to the insurance carrier. The Vote; Unanimous Ayes, Request for�Municipa.l Code � Mr. Bob Burchfield, Shasta County Probation Officer, requested a compli- � mentary copy of the City of Redding Municipal Code for use in his office. Now temporarily located at 1415 Court Street, the copies of the code in the District Attorney's office and the law library are not readily. available. ��� MOTION: Made by Councilman Moty, seconded by Councilman Kriegsman the request of Shasta County Probation Officer Burchfi.eld be approved. The Vote: Unanimous Ayes. � Protest - Cutting Down of Tree Mrs. Maude McCarty, 2930 Placer Street, advised a tenant .of hers.was brough't in to small claims court to try to collect on a cedar tree that was cut down and disposed of on property she owned at 3244 Veda 5treet. She advised her tenant told the judge the City of Redding men had cut down �'Z� the tree and hauled it to the dump. "I now feel the City shoulc� p�.y me for the tree as well as the �expense I have been out regarding it" she states. The tree�was inside the yard `and in no way could have been a menace to the street. � Director of Public Works Arness �nade the following report: A City of Recicling employee rentecl this home; during the storin in October a tree was uprooted and�leaned across the driveway,� making the driveway impass- able. He proceeded to cut the tree down, cut it in the proper lengths and placed it in the� street. The City�St'reet crew removed the tree and debris from the street and brought it up to the dump. The tenant; in cutting down the tree, clid not act as an employee of the City of Redding. That Mrs. McCarty had brought the tenant into Small Claims Court and the claim had � been denied. .. • � .. . , . .. It was requested the insurance carrier for the City of Redding be notified y of 1VIrs. `McCarty's letter and the report of the Director of Public Works. ' Re Dance Regulations Vernon C. Russell, Business Agerit and Financial Secretary`and Howard Yell, President of the Internatiorial Woodworkers of America, Local 3-433 AFL- '--! j CIO advised they had gone on record to oppose the contemplated action of the City Councils and Supervisors toward teenage dances. 212 APPROVAL OF CLAIMS & PAYROLL MOTION: Made by Councilman Martin, seconded by Councilrnan Krieg"sman that Accounts Payable Register No. ;15, warrant Nos. 3450 to 3580 inclusive, in the amount of $54, 804. 12 be approved and paid; that Payroll Register No. 13, salaries January 13 thru 26, 1963, warrant Nos. 10003 to 10209 inclusive, in the amount of ((,� � $43, 576. 76 be approved. Report placed on file. PLANNING DEPARTMENT - Additional Personnel Al Thies, Chairman of the Planning Commission, submitted a memo to all council- men dated January 30th recommending a full-time draftsman in the Planning Depart- ment. The memo states "Briefly, the Commission maintains that the entire /� � planning program can be revised and revitalized to include not only the administration of the Zoning and Subdivision Ordinances and hopefully of the-propos�ed Plan-Line Ordinance, but a dynamic Advanced Planning Program (Research and Development). This goal can be accompli�ecl by the planning department with coordination from the , other allied departments by the hiring of preferably a full ,time sub-professional ' , draftsman. -----. " Referred to Councilman 1VIoty, Aixports Committee, Councilman Chatfield, Planning Committee and the City Manager to meet with the Planning Director and report their recommendations. PRELIMINARY REPORT - Riverview Project Area Pl�.nnin� Director Evans submitted "Preliminary Report on the 5tatus of the River- view Project Area" dated January 31 st. - The memo states "On his recent trip on Monday, January 28, 1963, Merrill Watts of H. H. F. A. informed me that the Federal Government would definitely frown on any aid to Redding if the City does not see� the current project through. We might have considerable difficulty for instance in obtaining grants under the Accelerated Public Works Program. " MOTION: Made by Councilman Chatfield, seconded by Councilman Kriegsman to withhold any further action on Urban Renewal until April 1, 1963 and feasibility studies be made on the formation of an assessment district in subject area. Director of' Public Works Arness stated it would take approximately two weeks to prepare the estimate of cost and tlie petitions for this �;z v project;: about three or four weeks to circulate the petitions. That if -� 70 or 80% of the people of the area signed the petitions for the formation 3 L-5 of an assessment district, there would then be the final drafting of plans and specifications, the public hearing, and the calling for bids. Robert Hill, Chairman of the Redding Redevelopment Agency, stated it � was his feeling this would not hurt the urban renewal program; the Survey and Planning application was recertified February 28th, which gave the City a year on the new application. The H. H: F. A. seemed to be of the opinion the project was being stalled for no apparent reason, that apparently it was the opinion of previous councils and commissions this was not a feasible area for an assessment district. However, Council would not be necessarily approving the project if a man was hired for a professional survey and study of the feasibility of .the project for the ultimate and best use of the area. , 213 CounciTman Kriegsman stressed there had never bee'n an attemp't to ' form an assessment�district in this area: That some years ago three • - areas in Redding had quaTified for urban renewal; they were re'sideritia'1'"" in nature and 50% of the residences were blighted. It had appeared tlie Riverview area served the best purpose and had the most to gain from � redevelopment. H. H. F. A. had concurred with the City at this time, however had stated we could choose any of the three locations. Drainage, sewers, streets would naturally better the area. ''This is p'rogre"ss" he concluded. - � Frank�Wilson, speaking as an interested citizen and also as a p'roperty owner within the'district, said he thought urban renewal a worth' while project. That a great deal of valuable time had been�spent to date-on this proposed redevelopment and after tl3ree years City was no further along. That he did not think an assessm�nt district will cure a blighted area;; this was valuable property right in the heart of town. Councilman Chatfield spbke on the implementation of the Housing Code, stating tliis does correct blighting and that "we have the tools to do it". He requested report prior to April lst from the Building Departrnent or the Director of Public Works on the Uniform Building and the Uniform Housing Code, and how it could be applied. Mr. John Roach, a member of the Redding Redevelopment Agency but speaking for himself, stated he would like to clarify sorne points on urban redevelopment. That Federal subsidy through Urban Redevelopment means the establishment of government control over land use and private property. That to declare an area blighted is an infringement on a persons constitutional declared right to own property. � Voting was as follows: Ayes: Councilmen _- Chatfield, Kriegsman, Martin, Moty and Fulkerth Noes: Councilmen - None Absent: Councilmen - None CENTERVILLE COMMUNITY SERVICES DISTRICT Vice Mayor Martin, Water Corrimittee, submitted legal opinion of Martin McDonough, City of Redding's water attorney, regarding the Cityts right to extend water services to the Centerville Community Services District. � It was Mr. McDonough�s opinion that City does have the right to extend water ser- vices to the Centerville Community Services District, however any such agreement between the City and the District should clearly indicate that the District will only receive water from the City so long as the �'ity has "surplus water"�available for ��y such service. ' That if this provision is included in the contract "to furnish water that the City can discontinue service when "surplus water" no longer exists. �A memo from City Manager Cowden dated January 31st states"1VIr. McDonough also concurred in my opinion that if the District elects to receive "surplus water" from the City of Redding that the District should ap�ply to the Bureau of Reclamation for a stipulated amount of water to be delivered to the District by the Bureau of Reclamation, witli the City serving as the "wheeling agent" on behalf of the Dis- trict. The amount of water .that the District would apply for to the Bureau should, of course, be based upon an engineering survey as to what their ultimate require- ments might be: " ' The contract s that Mr. McDonough is preparing for the City to use as a basis for its negotiations for water with the Bureau will be presented to the City not later than March 4th, the City 1vIanager concludes, ' (Legal Opinion of Mr. McDonough on'file in the office of the City C�erk). Dr. Martin referred to the Counc�il minutes of December 17th wherein the Water Committee of the City Council made certain recommendations; this report of Mr. McDonough is a result of these recommendations. 214 MOTION: Made by Dr. Martin, seconded by Councilman Chatfield the City Attorney be empowered to negotiate with the Centerville Community Services District with .a contract in mind to deli.ver.water to the District, subject to . - � certain conditions relating to "surplus water"; that they, negotiate as soon as possible with the Bureau of Reclamation for a stipulated amount of water to be delivered to District�by .the:Bureau, wi.th City to serve as "wheeling Agent". . . . . , ., Councilman Kriegsman stated he wanted to go on record as opposing, entering into a contract to serve water to the Centerville Community � , Services District or to any other area outside the City limits; the City has no obligation to these people, he is sympathetic with them but feel we .should not be swaye.d.by the mercy angle. I-Ie called attention to the fact we could le.gally only furnish "surplus water";� that this does not make good, common sense for there was� an �answer for them through annexati.on, , , Councilman Chatfield said it was his opinion we are in a position to furnish Centerville Community 5ervices District water from the Bureau . of Reclamation; the only logical means for it to be transported is through the conduits of.the City of Redding; this does not violate any principles of City government in any way. � He has never advocated the serving,of water to an individual; he is advocating the serving of wholesale water to another legal entity. "I see no problem" he concluded. Dr. -Martin reaffirmed this is,not the approval of a contract, just the _ ,,�. . pre�liminary ,negotiation.for the.drawing,up of a.contract, the�only , feasible method of getting them water on an equitable tbasis. ''We�are , not trying to give away ;City's rights" he said.
