The meeting was called to order by Mayor Fulkerth with the followina councilm.en.

The Hour, of 7:30 P.M. . having arr.ived, Mayor Fulkerth .opened the Public,Hearing
on the annexation of the T. .R. Woods property to Redding, continued from Council

Mr. Harley Lowden, Chairman of the $uckeye County' Water_District, . advised a
meeting had been held with two councilmen and the City Attorney; they had tlie
legal opinion of their attorney, City had the opinion of i-ts.°attorney. He adv.ised
it would be necessary to get the approval of the Bureau of Reclamation in order to
serve water outside the District. :.He .stresse:d the Buckeye County Water:District
had no objections to the annexation,. providing the obligations to the District are �

not altered and.it would not be construed as relinquishment from_the l�istrict. � ,
Mr. Edward Garrett, Vice�-Chairman of the. Board _of Directors, of the Buckeye. �

County Wa,ter District, stated they had made certain commitm:ents.in .the District; ..
that it was .necessary to protect the tax base and bonding capacity. That certain
improvements were planned in relationship to Trinity,water. "W.e have no :objections
to Mr: 'Woods annexing to the City, �but at the same time we have the, right to protect
our interest in regard to the basic financial obligations :we are planning" he con-
cluded. .

Mayor Fulkerth .stated there appeared to him to.be two alternative.s: . To remain
w.ithin the District. The question was, would City be willing to .enter. into an agree-
ment�with the Buckeye Courity Water Distric�t3 Or, City furnish water at a predetermined
wholesale rate. �.
Mr. T. R. Woods advised if Ci`ty was w`illirig to let the District furnish the water,
he was willing to pay the double taxation and remain in the District. That the sewer
facilities, reduced electric and fire rates, police protection and garbage facilities
would all be a benefit to the area. .
City Attorney Redmon advised there was conflicting legal opinion; that he would like
to have the opportunity to check wi.th the League of California Gities legal staff and '
another attorriey familiar with water districts .
MOTION: Made by Councilman Moty, seconded by Dr. .Martin that public hearing.
be continued until 7:30 P.M. October lst. The Vote: Unanimous Ayes. .
Mr. Lowden advised that no notice had been sent to the Buckeye County Water
District of this proposed annexation, and requested they be notified in the future when
their district would be affected.
City Attorney Redmon stated he would check with the Shasta County Boundary Com-
mission.
CURBS AND GUTTERS � �
Director of Public Works Arness, submitted "Finding of. Fact" dated September -14th ��/
covering the installation of sidewalks, curb and gutters .and,curb and gutters in the
core area of the City. The "Finding of Fact" is a statement by the Street Superintendent � ,
stating that more than 50°jo of a particular,improvement .has been placed in a block.

The City Clerk advised one written pr'otest had been received - James. E. Frisbie,
for Lot 7, Block 2, Higgs Addition. The protest states: "the unde.rsigned hereby;
objects to and protests said order to construct the aforementioned improvements;
for the reasons that said improvements so ordered to be made are in the streets of �-���
said City of Redding and that the cost of the same to_the. undersigned is s:o great a� . ,

Mr. Ivan Dunlap, owner of property Gold and California Street, protested the plan
as submitted. He stated the entire 90 ft. frontage was used for parking and'the ..
lessening of parking area would be unfair to his renters .
Mr. Arness advised it was their plan that a 45 ft. dx�ivewa}z be constructed and to
curb and gutter the remainde.r. However, 'it appe:ared that curb.�and gutter liad� been
installed at one time and a section of the curb had broken off. That although he
would like to see this work done, he would recommend it be dropped. at_this time. _

Hearing be continued on two subject properties, Lot. 7 Block.2 Higgs Addition
(James Frisbie protest) and Gold at California Streets (Ivan Dunlap protest) until -

The hour of 8:00 P. M. having,arrived, Mayor Fulkerth opened .the Public Hearing
on the rezoning of a portion of Boardman Addition, continued from September 4th.
Councilman Moty asked that it' become part of the minutes. of this. meeting that he
had received four letters protesting the rezoning of subject property:

Dave Packard, representing the proponents for r.e.zoning;.; advised he had a
presentation, if necessary. .
Mayor Fulkerth ascertained no additional protests to the annexation had been
received,� and no one in the audience protested.
MOTION: Made by Dr. Martin, seconded by Councilman Moty�the Public Hearing
be closed. The Vote: Unanimous Ayes . • '
Councilman Kriegsman stated he had assumed the leadership in the opposition as
,- he did not like to see the zoning plan thrown out of balance, however he was.willing
t,� stand on the recommendations of Larrp Wis e=, although there were some questions
he wanted answered at some future date.
MOTION: Made by Councilman Kriegsman, seconded by Councilman Moty that
Ordinance No. 691 be adopted, an ordinance of the City of Redding amending Section
30-3 of the Redding C'ity Code, 1959, relatirig to the rezoning of oertain real property.

Dr. Martin explained he abs tained from voting due to a possible conflict of interest.

it not'for the recommenda�ion"of the Planning Consultant; that he would �do;'rr.othing
to deter progress. -
Councilmam Kriegsman called attention to'the� two majo'r problems and th�e recom-
mendations of Mr. Wise regarding sewers and the access road to the subdivision. -
He requested a� copy:of Mr. Wise�s report be made available to the PTanning
Cornm.ission and that�tlie subdivider'be advised of these problerris.

County.Water District Board.of Directors dated September 12th.
Mr. James Taylor, Chairman of the Forward=Buckeye .and 5ummit City,. Inc. ,
advised tlie Tetter sent protesting the annexatiori of the T. R. Woods property
to the City of Redding, pertained also to this annexation. "We are opposed to
any further annexation,north" lie stressed� _' ' -
Mr. Magaldi stated he thought the protests completely out of order. That he
was a taxpayer of the Buckeye County Water Dis trict, the School District and.he � •
paid taxes 'in Redding. Tliat he intended to stay in the Water.' District.arid- in �e

School District - that he was not withdrawing from the District.

Mr. Harley Lowden requested the Buckeye County Water District be given the
same consideration as in the T. R. Woods arinexation. �
Mr. Gar'rett stressed they were just doing'th'ei`r job; they had an interest'in certain
plans. for the district, and other development. That he thought there would be much
better understanding if the proponents for annexation let tlie people of the area
know what they intended to do.

- of Market- arid T 'ririit�y Streets.' He stated he concurr.ed-ddith .this recommendation.

There was cons.iderable discussion. on this item;. the City Attorney advised
he had researched and found while the City can reduce the speed on bridges,
they must follow .the pro:cedure. set by the 5tate Division of.Highways. .
