C OMMU NI CA.TI ONS � Protest Condemriation - Jacob Gorsek ` Mr. Jacob Gorsek of Yugoslavia protested the p�nding condemnation by the City of the Blue Banjo property, 4118 Highway 99 South. The property is leased to U. S. Plywood Corporation. Fire Marshall Wade submitted copies of correspondence with the owner and lessee. He advised the building is now vacant and it will not disrupt any tenant to make the necessary corrections at this time and to bring the property to an�occupiable condition. He concluded, the Fire Department is now waiting to find out who is the responsible party to correct the deficiency. Redevelopment Agency ; Robe rt R . Hill, Chairman, Redding Redevelopment Agency submitted a memorandum to Council dated December 21, 1964, advising of three pending member.ship vacancies. He said that the pres�ent limitations of staff assistance and the passage of Proposition 14, will require the Agency to re-examine its capabilities and perhaps to concentrate on small scale problems. Mayor Moty obse�rved there is a period of inactivity throughout the State on Urban Renewal and until the recent vote on Proposition 14 is resolved:. in the Courts, there is not much the local Agency can do. He appointed Councilmen�Hummel and Fulton to .contact Mr. Hill an�l study the problem and submit a recommendation to Council. , Parking - Pioneer Drive . Mr. Gwynn A. Bland, 2900 Pioneer Drive, protested the congested parking situation near apartments at 2850 Pioneer Drive. He asked for protection to property owners in the high-class residential section of Sunset Terrace. Planning Director Keyes stated the Planning Commission is aware of the problem and is studying the ratio of off-street parking requirements for multiple fam.ily dwellings, He said staff anticipates a recommendation ' will be made to change the requirements to a range of l. 3 to l. 5. The r.ecommendation will be made within a month. ` Councilman Hummel pointed out the re are two que stions to conside r. 294 l. Determine.future _requirements. . 2. Ordinance No. 780 on file in the office of the;.City ;C:lerk. � -� � RESOLUTION - Abandonment of Alley � City Attorney Murphy submitted memo dated December 18, 1964 re abandon- ment of alley between Pine and East Streets: "On September 21, 1964, Council by a 4-1 vote adopted a motion instruct- ing the City Attorney to prepare the necessary documents for the abandon- ment of the Westerly_half of the .alley.between East and Pine� St-reets in the City,of Redding-,, and that;a;hold,harmless. agreement be secured from the Westerly property owners. This motion followed the recommendations of _the. Planni�ng Commission and staff that the Westerly half of .the alley be: abandoned.�and that�a -ten foot easement for- underground :utili.ties and storm drainage be retained. As I understood the reason •for.�the addition- of the •requirement-that a hold harmless clause ,be obtained, it�was because of the fact that as to the five feet of the Westerly half of the alley on which we would not be reserving an underg�round utility easement, there could be bui�ldings constructed, and-the,Council :wer,e concerned over the poss,ible liability if such structures were dar,�taged as a result. of the cave-in of the bank. Since that time staff,has delayed presenting a Resolution of.Abandonment for your consideration in ordex to .obtain a topographical.survey to as- certain the true location of the almost vertical bank in relation to the centerline of the alley. and also, if possible, to determine the proper location of the ten foot utility easement. The Pu.blic Works De,partment has completed such survey, and we have ascertained that the vertical - bank almost precisely follows the centerline of the a11ey. Staff were unable to locate the exact course of the private sewer line known to�exist somewhere in the alley., For this reason, we have consulted with Mr. Hull, who initiated the .o'r.iginal abandonment application, and have ob- tained his approval to :reserving an underground utility easement over the entire portion of the alley being.abandone,d;;.and December 21 Agenda Item No. 9-6, as presented,• includes a reservation of such a fifteen foot utility.easement. : ,.. , . . . ..If Council, is_ agreeable. to this: amendment,; it.is my recommendation that Council not require the obtainment of hold harmless agreements before recordation of .the abandonment resolution as, in my legal opinion, they are no longer necessary to protect against any p.otemtial liability which could accrue to the .City. I suggest this for�.the reason that since we are reserving an underground easement over the entire area being abandoned, it would be necessary for any property owner to whom this land reverted to obtain the permission of the City before constructing a structure upon the reverted land. The only construction to which this would not apply would be paving for a parking area or a fence. 297 Under the Uniform Building Code permits are required for the erection or construction of any building or structure and the definition of "structure" therein.is broad enough to include any wall. Consequently, it appears to me that each building�or structure which any owner attempts to build on the reverted land should be reviewed at the time of application for the building ,permit, both in relation to the City's easement reserved in the abandonment, '° and as to the need for`hold liarmless` agreements �at such t'ime. � In regard to a blanket requirement for� hold`harmless agreements in relation to - potenti,al caye-ins, .I:am concerned with the inference inherent in such an , agreement fhat the��City would.�issue a p.ermit.for. the construction of a 'structure,�in a loca�tion wherein�such was a possibility. " ' Mr. Murpliy furtfier explairied the easement would show up� in any title report and the building department will be alerted to the problem in the area. Mrs. Helen Generes predicted the easement `xriight be abandoned 'rn `the future as' Pirie St. will be torn up next year and the� sewer line might be relocated in Pine St: . . , , . :�. .�� . . . , � Mr: lvlurphy explained that abandonrrient of the alley without con-sideration creates no warranty as to the soundness'for'constructiori ori tfie land being 'abandoned; that the owner is put on notice of the potential hazard by the existence of the bank and the potential possibility of slippage if too great a weight is built above. Councilmari Chatfield said that�in areas of considerable excavation, City should require engineering plans �for la�teral suppor't ancfi "retairiing walls. He observed that builders do not look far beyond their own property in checking lateral supports. He was advised by City Attorney that he is working with the Director ' of Public Works in preparation of a proposed..Excavation.Ordinance. 1VIrs. Generes� inquired about`tlze storrri drain pipe which flows into the alley and is cutting a hole in the bank causing water to run on her buildings. She said the wate r should be ,curbed so'it�won't cut out'the bank. � � � Mr. Arness reported Mr. Hull has'agreed to'remove the drain pipe in question. Mr. Murphy explained the drain was constructed by private property owner on the westerly Sside of tlie ��15' alley; that-the'discharge point is 8' to 10' above the ground level of the'easterly 15! of the alley; that water drains from the bank onto City prope rty and then sheet flows onto, private land: 1VIr. A.rness stated that in his opiriion, tYie sto'rm_water�s from the� area westerly of the alley, historically have flowed eastward'onto the property owned by Mrs. Generes�and before construction of the parking lot and drain pipe in question. Councilman Denny said the matters urider discussion do not affect the liability of the City re the abandonment of the. 15' alley.
