M. havirig arrive€�, Mayor Moty�opene� the• public hearing on the rezoning application RZ-7'-64 by Donald Bracken of certain property locate�i opposite the mausoleum on Highway 299 W'est, near Ridge Drive, from an R-1 (single family resident:.al) District and an R-4 (multiple family residen- *,`� tial) District to a uniform R=4 (multiple family resideritial) District or other P�� District. The following documents are on file in t�e o£fice of the City Clerk: Affidavit of Publication Notice of Pub?ic I-iearing ' Affidavit of Mailing Notice of Public Hearing Planning Commission rec�mmendations' dated Oct. 19, 1964 Planning Director Keyes stated the request involves some two�acres of land . m with split zoning; the frontage on Eureka Way 'zoned R-4 (multiplz family dwellings) with offices and motel by use permit, with the reair one-half of the property zoned R-1 or single family residential. The area was zoned in 195h and there had been no re evaluation of zoning since that time. Mr. Bracken now has a prospective p�irci�ase.r for this prope.rty who plans the construction of a motel; the reznning request is that the rear one-nalf of the property be rezoned R-4. The Planning Commission in 1964 approved the tentative subdivision map �f the Cerro Cima Subdivision, however at this time it is not known if the sub� division �uould be developed or not. This application as presented would create a 3ifficiilt lot situation for the residential prop'erties with a no'more tha:� 3� ft. street adjoining the rnote� with 100 ft. lots, or a 56 ft. street with > lots about 75 ft. deep. That one of`the bad effects of approving this rezoning � would be that it would create diffic�zlties in subdividing the larid around the property. The rezoning of �his property.would be an open door to motel and office devel- opment in the two mile area of R-4 zoning a�ong Eureka Way, and it was tne Planning Commissionts sug�uestion;- a polic j be determined by the City ,Council and the Board of Supervisors as to the types and loc�.tioris of future c�mmercial facilities they felt would be in the best public interest on Eureka Wa}r between the existing commercial distric4 and V1Thiskeytown Lake. Taking a17. this into c�nsideration the Planning Commission by unanimous vote recommended the rezoning application be denied. Mrs. Helen Generes, spea:cing on�behalf of Mr, Bracken, stated it would be very difficult to utilize the property in any way with R-I zoning in the back, RA4 zoning in the front; she had ciiecked with the majority of the property owners and had received no protests. Mr. BracKen had obtained an encroach- ment permit from the Division of Highways and has graded out the property. City Attorney Murphy advised the rezoning application as it is now involve3 a single portion of a parcel of property encroacning into a large R-1 area. He advised if it was Council1s be�ief that motel development would be appropriate on Eureka Way, in his opinion the correct way to approach the p�roblem would be to indicate their feeling to the Planning Commission and to ask them on their own to initiate a rezoning study; after` c�mpletion of the study to recom- mend to Council the rezoning of a substantial portion of this general area, if in thezr judgment they find it desirable to promote motel development, That he felt it undesirable to engage in spot zoning wheth�r or not the immediate neighbors take any stand, favorably or unfavorably. . � MOTION: Made by Councilman Chatfield, sec�nded by Councilman Denny the hearing be closed, The Vote: Unanimous Ayes. 259 MOTION: Made by Councilman Chatfield, seconded by Mayor Moty this sub- jec� be referred to the Plannin� Commission with the request they restudy and reevaluate the area generally surrounding this one parcel of land, with the possible solution for a larger R-4_�area from the standpoint �of planning, and to submit this recommendation prior to.the ninety day period. A letter had Ueen sent to the �roperty owne`rs and four replies had been re'c�ived from major• land �owners owning more than a major.ity of the asse�ssed valuation 4 of the area, indicating they still would likz annexation to proc�ed; One large pro�exty owner was undecided, his decision should be receivecl within a day or two. One small propert y owner was undecided, two smaIl property owners ob;,i e cte d. - Mr�, Keyes sug�es.ted that without kn.�wing the prefereric� of one of the large land owners at the present time it would be difficult for the City Council tr� deterinine whether it should proceed with the annexati'on. He therefore i�elieved that the Council might request the Loc�,l Annexation Commission to ac� on tne �7,� _ annexation proposal.and thereafter when the prefers�c� �f tnat one large owner is known,, the City Council could dec;.de whether annexation should further c�n- tinue. � � _ . _ _ It was his recommendation that Council request the desigriatiori �f the annexation be changed to Hilltop-Canby Annex 1Vo. 1 and the Local Annexatiori Commission consider the matter and act on it. City Attorney,Murphy stated he concurred with tYie secand half of the recommend- ation; that Mr. Keyes has advised each property owner� iri writing that`as� a result of the college site nat being located in that area it�was n,�t anticipated in the near future any of the impxovements that had been c�nsidered in the Resolution of Intention re the pr`o�osed college site would be made.` This would be an un- inhabited annexation and over 50% of the property owners have indicatecl �ither by letter or pending-letter their desire that City proceed with the annexation. Further, the law provides unless a man protests Uy Ietter his non ac�ion con- stitutes consent and there would be ample op�ortunity to. appear before Counc;:l at�the protest hearing if th� Local Agency Annexation Commission acted favor- ably. For these reasans he concurrec� with Mr. Keyes that we have a representative present at the Wednesday night rneeting of the Local Agericy Fdrmation Commission to re;quest the Commission to proceed with the annexatiori. � . He would recommend that no action be taken at this stage of the proce�iure on the name change as the area > was designated ori maps as College Site No. 1 and if the Gouncil was desirous of the narrie ci_iange it could be done after the Local Agency Annexation Commission acts on the appiication.� Councilman Denny dis�cussed at lengt� his coritention that City`'s position was not c�nsistent in the proposed a�ne�ation; th�.t soine property ownexs were desirous of anne.xation, soxne were opposed. In this particular annexation City is the applicant, and this was done for a specific reason, the accommodation o.f the college. This reason rio longer exists and it was�his opinion the proposal for annexation should initiate from the property owners. -� � s . _ . � ._ Dr. Fulton stated, he, too, saw no need for this particular aniiexation. . The-jT :�or�l��3 like ��� to invite leisure time clubs to apply for the use of this building and from past experience were reasonably�sure that ten to `twenty'worthy group's will indicate an interest in leasing the building. � u � ' � ' - � Dale Stone, representing the Redding Jr. Chamber of Commerce, asked for council considexation for the po�sible leasing of the building. They wou-ld upgrade and possibly fence the area in oz•der to prevent vandalism. Intersection Eureka Way an�i Court Street ' Traffic Engineer Freemari`advised �f the discussions with representatives of the Shell Oil Company who had stated the � c�mpany would comply with the Commission's request for a 20t radius and that Shell Oil Company would assume whatever i � � costs were involved in the modification of this particular � � corner as re.gards to sidewalk, curb and gutter. Traffic Enginee.r Freeznan advised that 95% of the field data had been gathered for the signalization study of Eureka Way with _ Magnolia Avenue and Cypress Avenue and Akard Avenue. � 4. Traffic Engineer Freeman advised the Commission felt there should be a modified plan of the present median strip located on Cypress Avernie west of Grape Street an� east of the Safeway Storets most easterly access. This modified plan wi11=be sub- mitte�. at the next meetinb of the Traffic and Parking Commission. 5, Sidewalks have already been installed on the east side of Akard Avenue between Cypress and Parkview Avenues. `�� 6. The Commission recommended that parking be limited to 2 hours on the east side oi West St. between Butte and Tehama Streets, and on bath sicles of West Street between Yuba and Placer Sts. That 4 hour parking on the north side of Butte St, between . Court and West 5treets be reduce� to a 2 hour limitation and these limitations shall be for the hours between 8 A. M. and 6 �' P.
