The meeting was called to order by Vice Mayor Chatfield with the following council- men present: Denny, Fulton, Hurnmel and Chatfield. The Vote: Unanimous Ayes. WRITTEN COMMUNICATIONS Re Overflowing Septic Tanks John D. Keye, M. D. , Shasta County Department of Public Health, advises they continue to experience difficulty,with .overflowing septic tanks in areas �� � where the public sewers.have been installed for a number of years. The lack of clear cut authority to require home owners to connect their plumbing ��� to the sewers results in hazards to the public health which are entirely unnecessary. He urged enactment of an ordinance which requires property owners within a reasonable distance (200 ' is .commonly used) of a public sewer to connect their plumbing within a reasonable period of time. City Manager Cowden stated City formerly had an ordinance that required hook up within one y,ear, but during recodification of the ordinances this was left out, Referred to Dr. Fuiton and Councilman Denny for report and recommendation next meeting. RESIGNATION - Commissions ,�irport � � 7 Laurence J. Kennedy Jr, submitted his .resignation from the Airports Commission due to pressure of work. Planning Commission `-?L � Joseph Smith submitted his resignation as a member of the City Planning Commission effective August 1, 1964 due to his present and future com- mitme nts. MOTION: Made by 'Councilman Hummel, seconded by-Councilman Denny 3 �, � the resignation of Laurenc�e Kennedy,Jr, from the Airports Commission and Joseph Smith from the Planning Commission be accepted with_regrets and that letters and commendations be sent to them. Shasta County Economic Commission � The Shasta County Economic Commission plan to hold their semi-annual joint meeting of the governing boards of the City of Anderson, the City of Redding and the County of Shasta at,a convenient time to everyone and . proferred the dates of August 10 or Au�ust 24, 7.:30 P. This will provide the necessary lateral support. Councilmen were advised the Planning Commission had set public hearing date for JuJ.y 2$th on the proposed alley.abandonment and City Attorney Murphy suggested the Clerk be requested to hold these letters for pre- sentation and incorporation at the time of the Public Hearing date of the City Council. Regarding the intention to excavate, the City Attorney stated he had already � given his opinion that based on the information at hand he has grave �.oubts there has been any valid council actzon au�thorizing Mrs. Generes to excavate in the alley. That council minute s mention auth�rity to excavate to the alley. There is a letter from Mr. Williams, then mayor, authorizing her to excavate over a described piece of land, and it was his recollection this was the easterly 15 ft. There seemed to be no inforxnation an file indicating any action by council, or by any individual member of the council, to permit Mrs. Generes to exercise any control over the westerly one-half of the alley. . That Mrs. Generes would need a permit from Mr. Arness' office-for- excavation of public property or a dedicated public st�ree:t and'_i't :would be appropriate action to instruct the Director of 1'ublic Works, pending hearing on the abandonment, to issue no encroachment perinit for .any exc�.vation. MOTION: Made by Councilman Denny, seconded by Councilman Huxnmel to instruct the Director of Public Works that no encroachment permit be issued for the removal of dirt until afte.r the public hearing on the alley abandonme nt. Mrs. Generes advised she intended to excavate prior to the date of the hear- ing and this would interfere with her plans. City Attorney Murphy then emphasized he had given his opinion �it was against the law for any one to remove material �from City stre�ts; this would be true even if council had acted as Mrs. Generes feels they acted, their action would be void. However he felt it questionable if councilts action was as Mrs. Generes says it was, as the minutes reflect grading to the alley, not the alley. PUBLIC HEARING - Street Name Change ' The hour of 7:30 P. M. having arrived, Vice Mayor Ghatfield o�ened the public hearing on the' renaming of Acacia Street in the City of Redding to Becnelli Lane. The following documents are on file in the office of the City Clerk: Affidavit of Publication Notice of Public Hearing Affidavit of Mailing Notice of Public %iearing ��y Mrs. Jess.e Grant, 2444 Acacia' Avenue, submitted Petition signed by fifteen pers'ons protesting the riame clzange. The Pe•tition reads as follows: "We, the undersigned property owners on Acacia Avenue, respectfully request the name of our street rernain as Acacia Avenue". � Mr. E. V:�. Anderson, 50$ Groue Street, corner of Grove and Acacia Avenue stated he saw no justification for the name ciiarige. Plannin� Director Keyes stated the property owners contended Acacia Avenue was a prettier name, however were also concerned over emergency responses of doctors, ambulanc�s, the Fire and the Police Departments.
