CHAPARRAL TERRACE ASSESSMENT DISTRICT No. 1964-3
Councilman Chatfield stepped down from his Council seat and abstained from
discussion and voting on this matter. •
City Attorney Murphy reported that most areas of disagreement in the proposed
contract had been worked out by staff and Richard Asbill, ,Attorne.y for_ the
Buckeye County Water District. However, the main point rewho pays the cost
of relocation , when necessary, of facilities owned by the Buckeye County Water
District located in City Street, remains unsolved. He stated such expenses are
O normally borne by a Public Utility District even when District is not responsible
for relocating. He said the BCWD is insis.ting on insertion of special contract-
ural agreement which would overcome the established case law and City would
be responsible for cost of relocation.
Director of Public Works 1rness cautioned that danger of establishing p,xe;ce.de:nr
exists which.could involve future dealings with the Enterprise Public Utility
District and the Cascade Community Services District.
Mr. Murphr said Frank Magaldi (Michaeltron, Inc.) has expended money in
good faith to develop:_ the subdivision, that he has complied with all require-
ments. He further said the law requires a three-way agreement. betwe.en
1Vlichaeltron, The BCWD and the City of Redding. He recommended Council
adjourn the meeting to discuss alternatives with Bond Counsel, Ed Ness and
the B.C.W.D.
