The Invocation wa� led by Reverend Ellis Martin, Pastor of the First
Christian Church.
The meeting was called to order by M:�.;r�r M,_�ty w:th the following
Councilmen present: Chatfield, Denny, Do��erty, Fulton, and Moty.
Also present w�re City Manager Cowden, A�sistant City Manager and
Purchasing Director Stewa.rt, City Attorney Murphy, Finance Director
Courtney, Public Works Director Arness, Planning Dir�=ctor Keyes,
Recreation Director Nelson, and Traffic Engineer Freeman.

Halloween Date Cnange
A communication was received from the Reverend Robert Noble,
A.11 Saints Episcopal Church, protesting the changing of Halloween
by Recreation Director Nelson from �Octobex-: 31 to : October 30.
He stated that this change resulted in crippling the effectiveness
of the UNICEF effort. Communications were also received from
Camille Baxter, KQMS Radio Station, and Mrs. M. A. Bailey
� �� supporting the decision by Mr. Nelson re Halloween.
� �' � Mayor Moty expressed regret over the incident and recommended
that in the future any change of dates of holidays be cleared f.irst
with Council before staff takes action, - and that this be made a
policy of Council. He requested Council to authorize him to write
a letter of regret to the Reverend Noble.
MOTION: Made by Councilman Denny; seconded by Councilman
Doherty that the recommendation of Mayor Moty re holiday date
changes be adopted and the Mayor be authorized to write a letter
expressing regret to the Reverend Noble. The Vote: Unanimous

Building Service Employees International Union
A communication dated November 5, 1965 was received from
Building Service Employees International Union, Local No. 22
re membership of City Employees in said Union. Mr. Maurice
Finn, Business Representative of Local No. 22, appeared before
Council and amplified his letter. Mr. Finn asked Council to
appoint a Committee to meet with representatives of the Retire-
ment Fund to see what can be done to include members under the
�•��j � Social Security Act if they so choose. He stated that organ.ized
labor feels Social Security is one of the best protections the
working man has today and said that Redding is the only City he
knows of north of Sacramento that does not include its members
under the Social Security A. ct and that Redding is the only City
under this Social Security District that does not include its
members under the Social Security system. Mr. Finn asked that '
the item in the letter dealing with health and welfare not be con-
sidered until clarification of this program is obtained. In summary
Mr. Finn said his Union is active among ReddiizgCity employees and
intends to remain so.

Mayor Moty referred this communication to the Council Committee
(Councilmen Chatfield and Fulton) appointed at the November 1 st
Council meeting (to study suggested rules of procedure concerning
administration of employer-employees relations .and similar matters)
with a request that the Committee give this letter thorough and com-
plete study and return to Council as soon as possible with a recom-
mendation. A. communication from the Five Counties Central Labor
Council dated November 9 was also referred to this Council Committee.
City of Redding Employees
A petition signed by 101 City employees was filed, stating that such
employees are not interested in joining Local No. 22, Building
Service Employees Union or any other union at this time. Dal
Graham acted as spokesman for the group and emphasized that this
petition is not in any way connected with the City of Redding
Employees' Association, inasmuch� as it was not voted upon by
the membership of the Employees' Assn. Mr. Graham submitted
an additional petition containing 14 signatures. .
Mr. Finn questioned the allegations made in the letter accompanying
the petition and the right for Mr. �Graham to speak on behalf of the
employees of the City of Redding, some of whom are members of
Local No. 22. Mr. Finn stated that three members of the union had '��� �i
signed the petition because they felt if they did not sign they would be
discriminated against by the persons submitting the petition. Mr.
Finn feels this is a form of subtle coercion. Mr. Finn said he would
like assurance from Council that it does not view the petition as a
petition from all of the employees of the -City of Redding and that this
petition will not have any e.ffect in dealing with Building Service
Employees Union, Local 1Vo. 22. � �
Councilman Chatfield said he believes Council can only.consider the
petition as being the views of the people who signed it; that they have
taken �this method of conveying a message .to_Council.- . Mr. Chatfield
further stated if there are signatures of inembers of the Union on the
petition; Council can disr.egard these signatures. : He said it is not
unusual to have people sign petitions both pro and con.
The petitions signed by employees of the City of Redding were referred
to the Council Committee appointed November 1 st (Councilmen Chatfield
and Fulton) for study and recommendation. � �-
Redding Chamber of Commerce
A. letter was received from the R�edding Chamber of �Commerce
thanking Council for the adoption of Resolution No.: 3572, a resolu- j�'>�
tion commending the Chamber for its efforts re the recent sewer
bond election. • � �
Fine r Living, Inc.
An application was received from Finer Living, Inc. , for permission
to install TV receiving antennas on Hill 900. Mayor Moty appointed
the following coinmittee� to work with Finer Living, Inc. , and return �j��,i
to Council with a recomxnendation: Councilman .Chatfield, City
Manager Cowden, � and Public Works Director Arness. :
Planning Director�Keyes mentioned tha.t lie believed Hill 900 is in
the Parks�and Re,creation Plan as the location.for. a scenic lookout.
Mayor 1VIoty suggested the Committee work with Parks and Recrea-
tion on thi-s matter.
Northern California Water Conference '
Notice was received of the North`ern California Water Conference
to be held� in Redding 'on November 18th. - Gity Manager 'Cowden advised
that Publ'ic W orks'Dire ctor A rne s s and A s si starit-City Enginee r Lang �� ,
will attend. Mr. Cowden will check with members of Council re '-'J��
attending this Conference.

PUC Commission Hearing re Telephone Rate Increase
MOTION: Made by Councilman Chatfield, seconded by,Councilman
Fulton that the City Manager attend the PUC Commission Hearing
re telephone rate increase to.be held Novemb.er 16th in the
. Shasta Union High School Auditorium and to take the stand that
the position of the Council as a matter of principle is to oppose
� �� the rate increase.

Councilman Doherty stated that as he does not know all of the
ramifications of the request for the rate increase, he does not
feel qualified to oppose it. �
J. W. Spence Appeal on UP-50A-65 and LS-7-65
Attorney Alvin Cibula filed an appeal on behalf of his clients, J. Vt'.
and Marian C. .Spence of the Planning Commission decision denial
of UP-50A-65 and LS-7-65. .

Doherty that a public hearing be ;set for 7:30 P. M. , December 6,
1965 on UP-50A-65 and LS-7-65. The Vote: Unanimous Ayes
CONTINUATION OF PUBLIC HEARING - RZ-15-65 - Kutras Park Area
Councilman Chatfield abstained from discussion and voting on this item.
The hour of 7:30 P. M, having arrived, Mayor Moty continued the
Public Hearing re Rezoning Application RZ-15-65, Kutras Park
A rea.
The City Clerk advised there were no written protests.
Mayor Moty. requested Planning Director Keyes to review the
recommendations of the Planning Commission prior to hearing
persons from the floor.
�f Mr. Keyes reviewed the Commission recommendations and
�'-t '� cited the following areas of controversy which s�i:ll exist between
the Commission and the applicants:
(1) Residences on the westerly .side of Thames Drive requested
to be zoned C-1 -P are recommended to remain R-1.
(2) In all areas recommended for C zoning, north_of South Street,
the applicants object to the F combining district recommended
by the Commission ,
Mr. Robert Sondag, Engineer with the firm of Clair A. Hill and
Associates, appeared before Council representing the interests
of certain property owners within the boundaries of the rezoning
application. Mr. Sondag said his clients are against the F com-
bining district and R-1 zoning on the west side of Thames Drive.
He stated that originally they had requested C-2-P zoning through-
out this property in order. to develop it along the lines proposed
before Council for many years; however, they have corne`;to�.a::general
mutual agreement with the Department and Commission as to what
can or cannot go into many areas. Mr. Sondag said he feels the
Commission's actions in the area on the west side of Thames
Drive are based on tract restrictions and, as the City does not
enforce tract restrictions, it should not deviate from good land
use in making recommendations concerning that area. The

applicants feel the proposed four lane arterial will .damage the
values�and amenities of their properties and create a dangerous
situation for small children. They believ.e that C-1 -P zoning
will be necessary to.avoid losses on future property sales.
Mayor Mo�y .asked Mr. Keyes the basis for the.Commission's
recommendation supporting R-1 zoning on the westerly side
of Thames Drive.
Mr. Keyes advised that the. Commission!s.minutes did not
summarize a11 of the te.stimony .and reasons but that.it was an
extreme over-simplification of the case to represent that sole
ju�stification was the matter of tract restrictions.. He said the
Commission took into account that if the.area w.ere .zoned .
C-1 -P, on some property there would be constructed block
structures in front of .existing homes, and use of such property
for both home sites and business purposes would re,sult in.a
highly incompatible land use situation.
Mr. Sondag said his clients object to the F combining district
because it does not spell out what regulations are to be imposed.
He said that F district regulations are unnecessar.y because every
use in a C or M district is .required to have architectural approval.
Mr. Keyes and City A.ttorney Murphy agreed that the F district
provisions as_now written are vague. They said that the regu-
lations would have to be amended in order to accoxnplish the pur-
poses the staff�and Commission desire. Mr. Keyes said.that
basicaZly the F distri�ct regulations.are intended to oontrol `� ���
aestheti:c design and not land use or site planning. _The staff and -
Commission are interested primarily in establishing. some rules
of the game for site design -- not building design.

Mr. Tom Glunt who lives at South Street and Thames. Drive stated that
at a public mee�ting at Cypress School last spring where th�e:proposed
arterial street was discus.sed it was inferred that the land fronting
this arterial could be rezoned for commercial purposes in order
that property owners could recover their land values. Mr. Glunt
said that 18 of the 25 property owners have signed a petition re-
questing comme.rcial rezoning and two. other pr.operty owners have
orally supported this request. ,
City Manager Cowden said that at las.t spring's meeting of the
property owners in tlie Kutras district, the matter of the possible
location of the Butte-Thames-Washington arterial street was dis-
cussed and several possible routes explained. Mr. Cowden said
it was agreed that the proposed route was the most desirable and
fur�ther that all indications were that the presently unimproved
land in the area would undoubtedly be developed commercially
and/or for high=rise apartments, .etc. ;,.within.the next] 10 to 15
year.s.: This �development, in Mr. .Cowden's opinion, w.ould raise
the value of the residential property so developed at this time and
� the residential tract would undoubtedly at some time in the future
be redeveloped for commercial purposes. .

such studies and, as the conditions affecting this parcel have not
changed, an extension of the interim zoning is recommended. In
answe.r to Councilman Chatfield's question as to what ,the effect
w.ould be.if Council, does not approve continuing.the R3.-15..zoning,
Mr. .Keyes said.the pro,perty would revert to the. original zoning
and it,would be possible�for the �.pr,operty owner to.establish
commexcial usage within one of the apartment houses. now on the

Councilman Denny offered Ordinance No. 824 for first reading,

Planning.Director Keyes: s�howed on.the Vu-Graph the area
proposed to be rezoned and reported that the Planning Commission
rec.ommended disapproval of C-1-P z:oning for the area by a vote
of 4:0.
In answer to a question by Mayor Moty, .Mr. Keyes said t�he de-
termining factors considered by the Commission in recommending
di.sapproval we.re .the; protests_from::the adjacent property owners
and also it was felt this area. should remain zoned for multiple
family purposes until there is a definite determination as to how
the City area located across �the .street is to be developed.

Mr: H. W. K. .Wittner. s.aid his reason for making._application is
that Mr, Kirker, who owns a neighb.orhood market in the same block
had asked for a variance to remodel his store, and Mr. Wittner
thought�it would be�a good.time to ask for comme rcial.zoning. He
said he is only asking for something Mr. Kirker already has --
comme_rcial zoning. Mr. Wittner said that Mr. Kirker has stated
he wants .to.build .an apartment;at some future�date .on the land now
occupied by the market and Mr. Wittner contends that he can still
build an apartment under C-1 -P zoning. He stated ;that other pro�
tests against :rezoning were because it would .raise taxe.s; how.ever,

Mr. Keyes said that in addition to the aforementioned factors, the
Commission took into consideration Mr. U�ittner's .statement that
he wanted the area rezoned because it would benefit him economically.
Mr. Wittner said he did. not know this could not be brought up at the
meeting. � .
City Attorney Murphy advised that Mr. Kirker's p.roperty is not
zoned commercia�; that his market exists as a non-conforming use,
and all of the area is. zoned R-3. .
Mr. .Kirker.:said.he;:believes there is sufficient,. commercial property
that is not being used and he would like the area to remain zoned
as it is to avoid paying higher taxes.

Mrs. Louise Branscom of 837 State Street said she would appreciate '
it if the property: could remain zoned as. it is at present.and not be
zoned for commercial usage. . . . .

PETITION - re proposed Linden Street�Sewer Assessment District
A petztion.was submi�tted from property owners in the area adjacent to
Linden Street from West Street to the west end of:Linden Street, re-
questing assessment district proceedings be initiated for construction
of sanitary sewers. .
Mr. Leroy Anderson of 1934. Linden Street appeared before �Council and
_�;� ;; � reported that a meeting was�held last.month regarding .this. proposed
district and he wished to compliment the City Officials on what has been
done thus far. Mr. Anderson said he had been chose� as spokesman for
the proper.ty owners. . .
MOTION: Made by Councilman Denny, seconded by Councilman Doherty
that the petition re assessment districtfior the Linden Street area be re-
ferred to the Depart�ment of .Public Works for further handling. . The Vote:

COMMUNICA. TIONS - continued
Shasta.County - re ininimum security facility �
In a communication from Shasta. County, _date.d November 12th, it
was requested that Council appoint a committee to work with the
County Comrnittee to study the availability�of some ;city-owned
land east �of the Redding Municipal Airport on which to.�locate a
minirnum seeurity. facility. .I.t was pointed. out that if such a.
facility is constructed, trusty labor would be available to work
i ' j) on such projects as landscaping at the Redding.Municipal A.irport
� and other menial labor tasks..
Mayor Moty appointed the following Com�mittee. to work with the
County Committee and the A..irport Commission to see if some-
tliing can be worked'.out .re�use of City owned land near :the
Municipal A.irport on which to locate a minimum security facility:
Councilmen Fulton and Denny, and City Manager Cowden.

W intu Pumping Plant �
A communication was �received from�the Unite'd States Department
• of the Interior, Bureau of Reclama'tion r'equesting that the plot of
land upon which the Wintu Pumping Plant is being constructed be
excluded from the boundaries of the City of Redding.
City Manager Cowden reported that the P. G. & E, will wheel power
: to the`Wintu Purriping Piarit under th'e general terms and conditions
of the Bureau of Reclamation's wheelirig�agreement with the P. G. & E ;
however, a probl'em exists as long as th�e area of the pumping plant
is withiri the City limits. IVIr. Cowden suggestecl that this be re-
ferred to the Local Agency Formation Comrriission witli tlie 'request
that it be expedited to the best of their ability and, if possible,
that the City comply with the Bureau's request.

Councilmari Chatfield expressed the belief that if we comply with
the request we would be creating an` island that would be in violation
of State Law.� Mr. Chatfield said he is sympathetic with the problem
but is not in favor of creating a problem for tlie City. '
City A.ttorney Murphy said he would try to get an Attorney General's
Opinion�re the legality of such an action but believes it should be
referred to LAFCO.
Councilman Doherty suggested ari alternative action might be
explored. '
Councilman Denny suggested that the City enlist the assi's'tance
of the legal department of the P. G. & E, in addition to the
Attorney General's office because I:,AFCO will need help as the
circumstances are very unusual.� Mr. Denny said that until the
Reorganization Act of 1965 which was�rriade effective ixi Septe�m.ber
of this year, LAFCO was not concerned with detachments and,
as a result, LA�FCO Yias never worked with a detachment. He stated
that LA. FCO is without legal help and because of this is not well
prepared to deal with the s'ubtleties and complexities of this new
law. . : _ '
Councilman Denny informed Council that Dr. 'Ferreira is the new
Chairman of the Local Agency Formation Comrriissiori' and his
term of office is for� a two year pe'riod. � ' -

Doherty that the request of the Bureau of Reclamation re excluding
the site of the Wintu Pumpirig Plant from the bounda-ries of the City
of Redding be referred to the Local A.gency Formation Commission
and to the City Attorney for review and recommendation. The Vote:

recommended because of the increasing vehicular volumes on Placer

PARKVIEW DITCH - Co-op Drainage Project with A. C. I. D.
Public Works Director Arness submitted a proposal from the Board of
Directors of th�e Anderson-Cottonwood Irrigation District to participate
in the installation�of additional drairiage facilities in the Parkview Ditch,
downstream from their canal. The proposal is for' the City of Redding to
%t � ,� furnish 72" concrete pipe�and the A. . C. I. D, would cause this pipe to be
� � installed at their expense. A. map �,�as submitted showing the location
where the pipe would be installed, and Mr. Arness explained that with
the installation of such pipe it will provide a facility which will cause
less backwate.r' to the pe�ople lying west of the A. C. I. D. Canal and wiTl
reduce the .eror�ion potential of tlie existing Pa.rkview Ditch, east of the
A. C. I. D. Canal. �
There wa's a discussion re the best location for this line arid it was the
consensus of Council' and staff that the line should run from the junction
of the Parkview Ditch and the A. C. I. D. Canal in a northerly direction
terminating just north of Pa.rkview Avenue and east of ,the A. C. I. D.
CanaL Ter-rnina�ing trie pipe in this area would give staff sufficient
time to study the general drainage requirements for City owned lands
lying north of Parkview Avenue. Mr. Arness said an amended map
sFiowing the line as outlined herein will be submittPd to the City Clerk
fo:r filing. The estimated cost of this project is $13, 000 and, as there
is already $6, 000 budgeted for a second crossing of the A'. C. I. D.
Canal, it will require a $7, 000 fund transfer.

that the Pa.rkview Ditch Co-op Drainage Project with A. C. I. D. be approved

REDDING CHAMBER OF COMMERCE - Amendment to Agreement
City Attorney Murphy submitted an Amendment to Agreement between
the City of Redding and the Chamber of Commerce covering the supple-
mental appropriation of $868. 00 for advertising brochures, Mr. Mur.phy
stated that Council approved the appropriation at the October 18th
Council meeting.
MOTION: Made by Councilman Doherty, seconded by Councilman
Chatfield that the Amendment to Agreement between City of Redding i� `/
and the Greater Redding Chamber of Commerce for advertising funds '
be approved, and the Mayo,r be authorized to execute said document

ASSESSMENT DISTRICT NO: 1965-4 - HOWARD SUBDIVISION
This matter was declared un. urgency item.
City Attorney Murphy submitted a resolution re filing of Amended
Engineer's Estimate of Cost in Assessment District No. 1965-4,
Howard Subdivision. Mr. Murphy explained that the total cost has not
changed, but that certain costs had been charged against the water
system which should have been charged against street improvements
and the amended Engineer's Estimate of Cost reflects this change.

LAWSUIT - Defense Attorney Fee
This matter was declared an urgency item.
City Attorney Murphy submitted a bill in the amount of $1, 000 from
Attorney William J. Braun, which is his fee for representing Police-
man Charles Turner Y�n the recent $325, 000 suit against Charles
Turner and the City of Redding. Mr. Murphy told Council that inas-
much as he represented the City, it would have been a conflict of /
interest had he also represented Charles Turner, hence Attorney '�, � (/
Braun was retained for Charles Turner. The City and Policeman
Turner were exonerated in this case. Mr. Murphy recommended that
Council approve payment of this fee and authorize the Finance Depart-
ment to pay it without waiting for the next warrant register.
MOTION: Made by Councilman Denny, seconded by Councilman
Doherty that Council approve payment of the $1, 000 fee submitted
by Attorney William J. Braun for representing Charles Turner in
the recent trial against Policeman Turner and the City of Redding,
and that the Finance Department be instructed to issue the warrant
immediately. The Vote: Unanimous Ayes
Councilman Denny suggested that Mayor Moty write letters to the
Chief of Police and to the attorneys commending them for the out-
standing job that was done at the trial. Other Councilmen concurred
with this suggestion.

SUPPLEMENTS TO CITY CODE
The City Clerk advised Council that yearly supplements have been
furnished to purchasers of the City Code at no cost. However, the
cost of these supplements has increased steadily and it is the
recommendation of the City Clerk and the City Manager that purchasers
of the Code be billed for future supplements at the actua�l cost thereof, -
and that agencies who have been issued Code at no cost will continue
to receive supplements free of charge,
MOTION: Made by Councilman Chatfield, seconded by Councilman
Denny that Council approve the recommendation of the City Clerk
and the City Manager that purchasers of the Redd'ing City Code be
