The Pledge of Allegiance to the Flag was led by Mr. Paul Allebech
Reverend Robert Noble, Pastor of All Saints Episcopal Church, offered
the invocation. � '
The meeting was called to order by Mayor Moty with the following
Councilmen present: Chatfield, Denny, Doherty, Fulton, and Moty.
Also present were City Manager Cowden, A. ssistant City Manager and
Purchasing Director Stewart, City Attorney Murphy, Finance Director
Courtney, Public Works Director Arness, 'Planning Director Keyes,
Traffic Engineer Freeman, and Parks Superintendent Smith.

MOTION: Made by Councilman Fulton, seconded by Councilman Denny
that the minutes of the regular meeting of September 20th be.approved
as mailed to each Councilman. The Vote: Unanimous Ayes
COMMUNICA. TIONS
Redding Grange ##446
A communication dated September 21, 1965 was received from the
Redding Grange #446, advising that it will comply with the requests
of the City of Redding; i, e. , it will require sponsors of dances to ` < l
have five officers on duty, will hold no public dances during the �J
school week, and will rriaintain a 12:00 o'clock curfew, except for
the New Year's Dance for 1966.
Mayor Moty expressed appreciation to the Grange for their coopera-
tion in this matter.
Hilltop Drive Annex No. 3 - Petition for A.nnexation
MOTION: Made by Councilman Doherty., seconded by Councilman . ._
Chatfield that Council acknowledge receipt of Petition for Commence- -
ment of A.nnexation Procedures - Hilltop Drive Annex No. 3. The

Doherty that Resolution No. 3561 be adopted, a resolution of the
City Council of the City of Redding giving notice of proposed annexa-
tion to the City of Redding of uninhabited territory described herein

time and�place for hearing of protests thereto.

Shasta County Community Action Project
Mr. Edwin G. War.ren Executive Director, ga.ve an oral status re-
port on the activities of the group sponsoring .the Shasta County
Community A.ction Project, advising that it is supported by funds
supplied by the Federal Government (90%) and the County (10°jo). / Fl�(�
Mr. Warren pointed out that the program encourages local initiative
and the group is working towards three goals: (1) To formulate pro-
grams and policies that suit local needs; (2) to work through existing
agencies by improving effic'iency or supplementing them; and (3) in-
volve persons in the law income groups in policy making -- involve
them in doing rather than being done for.

Mr, Warren said the group has been involved in research in the following
programs: Project Headstart, Remedial Education Program, Homemaker
Service, Family Ser'v'rce Agency (for low income families) and Child
Development Centers.
Joe Aleck, Chairman of the Board of Directors, spoke briefly on the
accomplishments of the group and commended Sid Cowgill for his work
on the committee.
Resignation - Planning Commission
Glenn T. Robinson submitted his- resignation as a member of the Planning
Commission, due to events beyond his control.

MOTION:. Made by Councilman Doherty, seconded by Councilman Chatfield
y�� that the resignation of Glenn T. Robinson be accepted with regret and a
letter of appreciation be sent to him for the service he has rendered to the

Consignment Equipment Sales, Ltd. - Request for City Water
A communication was received from Consignment Equipment Sales, Ltd.�,
dated September 24, 1965, in which it was requested that City water be
supplied to their sales yard located at 4231 Eastside Road.

Councilman Chatfield and City Manager Cowden were requested to inves-
tigate this request and report back to Council on October 18th with a
recommendation.
Veterans of Foreign Wars ' '
The Veterans of Foreign Wars, Redding Springs Post #7169, submitted
a request for permission to sell beer at the Hydro-boat Races at Lake
Redding Park on October 9th and lOth:

Planning Director Keyes showed on the Vu Graph the property pro-
posed to be rezoned and stated it is the recommendation of the
Planning Commission and the Planning Department that this property
be rezoned from R-4 and R-3 Districts to a CO (Office) Dist rict.�

COMPLAINT FILED - Walter P. Schulz
City Attorney'1Vlurphy`advised Council that Walte'r P: Schulz has 'filed a.
complaint against the City of Redding in the Small Claims Court following _.
denial of claim for damages . Mr. Murphy stated that Lega1 Counsel is l 1'-%
not allowed in the Small Claims Court; therefore, the City will be repre-
sented by Parks 5uperintendent Smith and possibly Public Works Director
Arness at the trial set for October 13th.

ORDINANCE - RZ- 17-65 - Eureka Way
Fred Piperio appeared before Council and said he had be'en advised' by
the City Attorney that if Ordinance No. 815 were adopted he would be unable
to reopen his former business,which was a restaurant and bar, (Blue
Heaven) located in the area proposed to be rezoned, u�less it was in con-
junction with a motel. After discussion it was determined that the CO-BR
District does not carry this restriction. However, Mr. Piperio was in-
/��� formed that it would be necessary for him to obtain a Use Permit from
the Planning Commission to resum�.e this operation, either under the
present C- 1 zoning or under the proposed CO=BR zoning. This require-
ment is imposed because rnore than six months have elapsed since the
business was operated.
Mr. Piperio was advised that if the Ordinance is adopted it wil-1 no:t become
effective for 30 days and prior to that he can apply for a Use Perrnit under
the present C-1 zoning to resume his former use of his property on
Eureka Way. He was also advised he had similar rights to apply for a
Use Permit under the CO-BR zoning.

that full reading of the Ordinance be waived, and the City Attorney instructed

MOTION: Made by Councilman Fulton, seconded by Councilman Denny that
Ordinance No. 815 be adopted, an ordinance of the City Council of the
City of Redding amending Section 30-3 of the Redding City Code, 1959, as
amended, relating to the rezoning of certain real property in the City of
Redding. �

Councilman Denny suggested that Council go on record as expressing its
interest and desire that the former use of Mr. Piperio's property be
allowed to continue. Other members of Council agreed with this suggestion.

that the Planning Commission and Staff review that Section of the Ordinance
covering CO and CO-BR Districts which deals with bars and restaurants .

Planning Dir.ector Keyes showe.d on the Vu Graph the property pro-

be rezoned from "U" and R-3 Districts to R-3. and CO-BR Districts.

Doherty that the recommendation of the Planning Commission be
approved re Rezoning Application RZ-19-65, as aforesaid, and
the City Attorney be instructed to prepare the necessary document.

COMIVIITTEE REPORT - Auditorium Site Selection
Mr. Herb Miles, Chairman of the' Auditorium Site Selection Committee,
introduced the other members of this Committee --. Messrs. Lou Gerard,
Sr. , Olando Tognozzi, Jim Curry, and Mrs. Liz Reginato. Mr. Miles
then gave a detailed oral report, accompanied by a graphic chart, which
summarized all of the factors taken into consideration in the selection of
. a site for the proposed auditorium-convention hall. Mr. Miles said the
Committee determined there were no other sites available in a suitable ,/���
location that would equal or surpass several of the four listed sites pro-
posed to.them by Council. All of the information in the oral report�is con-
tained in the written report submitted by the Committee dated October 4,
1965, and such report is made a �art of these minutes by reference.
It was the unanimous recommendation of the Committee that the Turtle
Bay area should be the choice for the site for the .future auditorium-
convention hall facility.
Mr. Blayney of the consulting firm of Livingston and Blayney advised
Council he is in full accord with the recommendation of the Committee;
that the construction of the� auditorium at this location will create an
image upon entering Redding. Also, he believes it is better to utilize
unused .space; rather than an area where it would be necessa�ry to replace
existing facilities, Mr. Blayney commended Council for the material _
they were given to work with in making this site selection, and commended
the Committee for their thoroughness in this project. . •
Mr. Dicker, Chairman of the Chamber of Commerce. A.uditorium Committee
asked if the acquisition of land in the Turtle Bay area would have any bearing
on the bond issue and was assured it would not. Mayor Moty said that
Council intends.,to pass a resolution as soon_as possible prior to the bond
election �setting forth specifi.c information outlining the.expenseslthat will
be involved,. in addition:to those included.in the $1. 8•bond.issue. .
Messrs.�� Carl Williams and Joe A.leck:said they were disappointed with the
selection and requested Council to delay in making a final decision on.the
selection of the site .until the Chamber group and othe.r.s had a chance to
study it. Mayor Moty said time was of the essence and if the public were
to be fully advised of all the pertinent data re the auditorium prior to the
November 16th election it would be necessary to select the site immed-
iately. Mr. Moty commented that the elector.ate would be given an
opportunity to express their views on the site selection at the election.
Mr. Greenleaf, President .of_the Redding Chambe.r of Commerce said he
feels the site.was selected by a-.,well balanced committee following a
charge given to it by the City Council and that people should not let
disappointment re the chosen site overshadow their wishes for a civic
auditorium.
A.fter consi�derable discussion, each member of the Council was polled
as to his views. o n the choice: made, by the �Committee and all were .in
accord that the Turtle Bay area is the best site for the auditorium. ,
Councilman Denny said he:does not favor. purchasing the Kutras property
but presumes the Benton property is adequate for:the :auditorium and
necessary parking, and then the Kutras proper.ty could�.be developed by
private industry for motels, etc.

that the recommendation of the A.uditorium Site Selection Committee be
approved and the site for the proposed auditorium-convention hall shall
be the Turtle Bay area.

COMMITTEE REPORT - Tennis Courts at Sequoia School
Councilman Chatfield submitted the report of the Council Committee
(Councilmen Chatfield and Denny) on the construction of tennis courts
at Sequoia School. It is the Committee's recommendation that the eight
tennis courts. be constructed with the Redding Elementary School District
and the City of. Redding sharing the construction cost on a 50-50 basis,.
after deduction of any donations, etc. , and that no lighting be provided
at this time. The recommendation also suggests that an agreement be
entered into between the City of Redding and the Redding Elementary
���� School District to cover maintenance and opCration of the courts,. etc.

There:was considerable discussion as to the advisability of constructing
the tennis courts at the Sequoia School vs. South City Park. Mrs.
Francesca Frier, President of the Redding Tennis Booster Club said
consideration had been given to having the courts at South City Park
but there were three disadvantages; i, e. , (1) foot traffic to South City
Park is dangerous; (2) there is poor drainage;. and (3.) the Ci:ty needs
the greenery aspect rather than asphalt tennis cou.rts in this area.
Mrs. Frier also said the area at the sequoia School offers good protection
from wind.

Chatfield that the recommendation of the Council Committee re tennis
courts at Sequoia School be approved as outlined above and the City
A.ttorney be instructed to prepare the necessary document. The Vote:

EXCESS LIABILITY INSURANCE COVERA. GE
Finance Director Courtney submitted the report of the City Attorney and
the Director of Finance re excess liability insurance coverage for the
City of Redding. It is their recommendation that Alternate 2 ,of the pro-
posals submitted by Mr. Huffaker (representing the Independent Insurance
Agents) be_e,lected. This provides for excess liability coverage to a limit
�; .� I of $5, 000, 000. at an annual premium cost of $6, 200. The City Ma.nager con-
