� Denny that the�resignation�of Dr. Nicholas Peterson be accepted
with regret and a letter of appreciation be sent to him for the

5enior Citizens Recreation Hall - Soroptimist Club
Mrs. Marjorie Lauerman appeared b.efore Council on behalf of
the Redding Soroptimist Club and submitted the Clubas proposal
to build a_recreation hall for the Senior Citizens of Shasta County.
Mrs. Lauerman explained that the proposed building will have
7700 sq. ft. initially, but will be so constructed as to allow for
expansion in the future. Two plans were subm'itted by the Club;
Plan # 1 would be a shell building; completed on the exterior,
rough vviring. and plumbing, including septic tank� arid leaclzirig
system, roofed including a louvered roof installed for future
heating and cooling; insulated and ready for interior finish which
the Senior Citizens of Shasta County have agreed to do. Plan #2
would be a completed building, including heating, cooling, til'ed
floors, and finished walls. Mers. Lauerman said cost estimates
are $28, 000 for. Plan # 1 and $35, 0.00 for� Plan #2, The Plan"to be
used will depend upon the final amount of money`the Club'is able
. .
to obtain.,:;>Mrs. Lauerman stated.they understand Fede,r"al monies
are available but, before the �lub can apply for,such monies, they
must have a site location. The Club requests the.City of Redding �� /

to contribute the land for this building. `
The proposed site location was shown on the .Vu Graph and is on
the northwest side of the Diestelhorst bridge, adjace,nt to .the Elks
Club, on land acquired by the City several. years�.ago. Mf�s'. Lauerman
said their project will not utilize all of the� space in this City owned land
and the Club is agreeable to having the building and parking lot placed

on said property at the dis.cretion of the Cit ��- - -

Complete details regarding this p.roject are coritairied` in a 'letter
written to Council by the Soroptimist Club, dated July-14, i965,
which letter is on file. in the office of the City Clerk and is made
a part of these minutes by .reference.
Councilman Denny asked if this propos,al had been discussed with
the City Planner or City Manager and was told that ,someone had
ta�lked with Mr. Keyes �and Mr. .Stewart, that Mr. Cowden was out
of tow.n at the time. .
City Manager Cow�den stated he did not feel the proposal has .any
objectionable features as far as the Master Plan.for. Parks is con-
cerned, noting that the Recreation and Parks Commission favors
thi:s proposal. .

Planning Director Keyes said this matter has not been� referred to

the Planning Commission..

Councilman Chatfield asked for an �explanation�of �"coritribiztion of
land"; does the Club have to have title to the land? _
Mrs. Lauerman said they did not need to'liave title='but tHey do have
to have a site that cannot be taken away. Shirley Castor of the
Sorogtimist Club said what is .needed is a',�.s'tatement froxn the City
of Redding that the land is available;. she-as�suines�that �a lorig-term
lease at $1/year would suffice. �
� Councilman Chatfield is concerned about res;trictions re Federal fun,ds
�. - . . and would like more. definite information. -He inquired.as to what
program the funds would be available from.
Mrs, Castor stated that _should _there.be any. restrictions ,that do not �
mee.t with Councilfs approval, the 5oroptimist.Club will withdraw
the application. Mrs... Castor said she,understands funds are available
from six different:. governmental agencies. � �

Mayor�Moty asked if the Club would require an indication from
the City qr a firm commitment. •
Mrs. Castor said the club would need a written statement froxn
the City of Redding that land would be available for a building.
City Attorney Murphy stated that in prior applicatians�for
Federal funds it has been necessary to' make out a description
o�_the site. He asked Mrs. Castor if a one acre site would be
suffi�cient and, if so, a�legal description of the specific site
could be prepared. It was felt one acre would be adequate.

Cha.tfield that the City Manager; City Attorney and City 7.'lanner
, be authorized to wor,k with tlie. Soro�timist Club in deve�loping
an agreement and a resolutio� that could be acted upon by Council
at the next regular ,me�eting; the City .�ttorney to research legal
, . questions that have been raised, and the City Planner to make a
recommendation as to the most appropriate location of the build-

A wire was received,by Mayor Moty from Congressman Harold
T. (Bizz) 7ohnson advising that the House passed the Whiskeytown-
;���1� Shasta-.Trinity National Recreation Area I:,egislation on �uly 12th.
Carson & Barnes Circus
A request was received from the Carson & Barnes Circus for
pe.rmiss�unito have a Circus in. Redding on August 18th and to
rent land in Benton acquisition for such purpose.

City Attorney Murphy advised that Sheriff Balma is agreeable
to patrons parking on the Posse Grounds and to using the Posse
- , Grounds road. Mr. Murphy further stated the conditions under
lj����� �'� which they would be allowed to operate include a $50 license fee,
$50 rental fee for the land for one day, and $100 cash clean-up
bond (refundable if ar`ea is left in good conditi�n), all of which are
on deposit in the office of the City.Clerk. ' It is also necessary for
' �t_,_ the Circus to obtain a use permit from the Planning Commission as
' � it is,not. being sponsored by any localorganization. A Certificate
. of Liability Insurance is also .required to be filed with the City.
MOTI�N: Made by Councilman Denny, s econde'd by Councilman
Doherty that permission be granted to the Barnes & Carson Circus
to conduct the Circus for one Day, August 18t1i,� on five acres of
land in the Benton property acquisition, subject to the conditions

PUBLIC HEARING.- Appeal iTse Permit UP-31-65 - Paul Bunyan
The hour of 7:30 P.M. ,having arrived, Mayor Moty opened the Public
Hearing on appeal of Federal Sign and Signal Corporation for Paul
Bunyan Enterprises on Application for Use Permit UP-31-65.

�.�i Affidavit of Mailing - Notice of Public Hearing
Planning Director Keyes reviewed all of the pertinent data relative
to the application for this L7se Permit and advised Council that
, the sign.was disapproved by the Planning Commission by a vote of
4 to 1. Mr. Keyes stated the applicant'proposes to remove the
present si n located on top of the restaurant and wishes to install
a detache�pole sign 64 ft. in height. H'e pointed out that the Code

provides�that a detached pole or post sign shall not exceed 25 ft .
in overall height nor 100 sq. ft. in area: Signs larger than this
r'equire a special permit by the Planning Commission and may be
allowed if it appears that the "o�tdoor advertising structure or
s-ign which the applicant proposes to erect, construct, or maintain
will not endanger the public safety or welfare and that a substantial
hardship would be .worked upqn the applicant should such application
be denied;rt ' , �
Mr. Keyes reported .that whe� the Planning Commission inquired of
Mr: Schick (Fe,deral Sign;�and� S�gna1 Corporation) what hardship the
applicant would suffer if the sign were disallowed, Mr. Schick
answered that he thought the property owner should haye the right
to advertise his business.

In summary, Mr. Keyes said the reasons for,denying the. applica-
tion were that certain features of the sign were not in accordance
with safe:ty regulatio�is and,;.the Department.could:not,determine a
necessary hardship warranting the sign. _

Mr. Grush stated further than the sign will not be an "eye-ball � ;

grabber" that the globes in the sign are �20 watt, are soft yellow,
and->only 2/3 of them will, be on at:a -time. .. The effect will be
similar to the Bonanza sign. He further stated that the height of

the sign vaill_be such that it will conforrrl to, safety standards i
contained in General C�rder #95. Mr. Grush feels action should ..
be .taken now to. attract .tourists to Redding to counteract the
F.reewa.y which will b}r-pass Redding. � He is hopeful that a plan i
can be put into effect whe,reby some 200_signs :would,.be<.posted

says with.the- adv,ent :of;the Fre,eway, ,towns not:just businesses, ,

Reddix�g and, if it were pos,sible, would flatten_his� restaurant
and .erect-a space: needle restaurant.-� Mr. Grush thinks. the

claim that the.sign mi;ght;be a traffic hazard is..exaggerated,
The height of the sign allows visibility a �long ways�off�and
allows the motorist-time to make lanN changes, etc.:, in advance.
He believes a statement that all of the safety factors will be
complied with should be all that is� required. Mr. Grush sub-
mitted photographs with the sign drawn in,and also a water color
painting illustr�.ting the proximity of the sign to the power pole.

� Councilman Denny; stated the photographs with the sign drawn
in are out of proportion as they sk�ow the power poles to be
taller than the sign. The power pole is 58 ft. tall and the sign
is 64 ft. Mr. Schick and IVIr. Grush said this was not done

Councilman Cliatfield asked Mr. Keyes if the actual sign portion
of the new sign wasn�t lower than the present sign on,top of the
' building and �VIr. Keyes said he bd ieves they are about the same.
Councilman Chatfield�asked Mr. Grush if they planned to .reduce
the height of the sign�to 60 ft. instead of 64 ft. and Mr. G�rush
replied they would do whatever is necessary to comp�.ywith
General E>rder #95.
Mayar Moty asked Mr. Hull, Chairman of the Planning Commission
if he had any ques tions�or comm ents. ' � ' �
Mr.��Hull"-�repo`rted tliat at the hearing. bef.ore -the Planni�ng.Commission
Mr. Grusli was not p�esent but Ivlr. Schick of F.ederal Sign and Signal
Corporation appeared on his behalf. Mr. Hull further stated that
at the'-time of the heari�n�g communications had been receiued from
several agencies citing violations of �safety standards in.the proposed
sign, and he also r�oted that letters�from neighborirag businesses
approving the installation of the sign were not filed with the
Comxrrissian. Mr. HU.11 said Mr. Schick had not indicated that
� �'aul 'Bunyon Enterpr'is.es' would suffe�r�a hardship if the application
were denied.

Mr. Hull•said'�the Planning Commission has endeavored to keep
Redding from becoming a "Neon Jungle'•', has triec� to maintain
standards of reasonable heights in signs and he feels the Commission
has held to tliese standards ancl. has not grant�d'permiss�ion
for high signs except'in unusual circumstances: He cited the
following special grants in the last five years - Montgomery Wards,
Bonanza,'�~Texaco, Thri fty .D'rug, and Hospitality House -- stating
the locations of these signs are away from public'thoroughfares.
Gouncilmari Chatfield inquired as to the height`of the Stardust si,gn
,�a.nd wa`s told it�was 56�6" in rheiglit, 420' sq: ft: in°area and a special
permit was issued.
Mrs. Helen Generes, speaking as a citizen, said she was recently
� in Hawaii anc� they do have a Space Needle Restaurant located in the
.A�a �1Vloana Shopping Genter which is much high'er than the power
poles, and she hopes Redding cari �someday have 'such a restaurant
as� it i.s so eye�cat-ching. She believes the'applicant should
be granted a permit for�the propos ed sign, that Redding should move
fo'rward and needs ali`possible publicity. Mrs. Generes made
' ' reference to the �ssociated Brokers sign which she understands
was erected without a pexmit being �issued,� - -

all`of tlie po"'ints made by'Mr`:�Grush in�hi"s-appeal for permission
to e,'rect the proposed sign a� the Rite Spot R.esta�urant. He emphasized
that althbugh th�e'over�all'height of the �sign i�s� 64 feet; 'the s'ign itself
(illuminated 'fla'shing portion) is` orily 39 1/2 feet -hight. Mr: Asbill
f':eels�the-.r;eas;o:xres for denying approval are not clear; that �:his client
` ' has `a''ssu'red the City the safety rules will�be met.' He said
that the hardsli'ip that exists is that denial deprives Mr.�'Grush of
proper advertisement of his ;busiriess from his own prope 'rt'y.

City Attorriey Murphy pbinted out that a policy -problem exists;
that the Code sets the limits of 25 feet height and 100 square feet
in area for detached pole or.post signs; and the Planning Commission,
based on i`nformation available at the time of the hearing, denied the�
�applicant permi.ssion to erect a sign in exeess of the stated limits.
When this hearing was held->no��evidence was available. from the .
motel owner,s to �he north and south of,.the applicant,as to their
approval, ,and the applicant did not answer the question regarding
' hardship. Mr. Mur.phy said the Commission.must act.within the
rules given to them. �

Councilman Dolierty�said that as a former me rriber of the Planning
Commission he does not think the height of signs and enthusiasm of the
growth of Redding necessarily go hand in hand. He thinks competition
of signscan get out of h�.nd. Mr. Doherty feels the Planning Commissinn
has attempted to modity tTze rules as set out in the Code in line with
good taste and the needs of the applicant but he does not believe

` Counc�lman Chatfield stated he is- confused reg�.rding the criteria
for approval of signs. He feels that the sign that is being replaced
is no larger than the present sign and the only thing that is question-
able is the decorated extension on the top which is not illuminated.
Mr.` Chatfield said that the ordinance rieeds updating as apparently
the 25 feet in height`and 100 square feet in area limits are not
realistic in view of the many permits granted. ,
Councilman Denny agr`ees with Couricilman Chatfield and thinks �`��
the Planning`Com `mission must feel'vulernable in trying to apply
the ordin�.nce. The two conditions that the`City Attorney has
mentioned, i. e. , safe�ty and necessit� of ;applicant to Show hardship,
are,very difficult to enforce. . Mr. Denny also finds it inconsistent
that a s`ign that is` attached to a building is, not subject t'o these
limitations.
