APPROVAL OF MINUTES
MOTION: Made by Councilman Fulton, seconded by Councilman Denny
that the minutes of the adjourned meeting of January l lth be approved as
mailed to each of the councilmen. The Vote: Unanimous Ayes.
COMMUNICATIONS
Protest. - Business License Fee
Letter dated 1/8/65 from James R. Milhem, owner of Randy�s
Beauty College, protesting the flat $50 Business. License Fee set
for Beauty Colleges. Mr. Milhem appeared and questioned the
reason for this fee which he considers excessive.

This matter was referred to the City-Attorney and City Manager
for a review of the Minutes when such fees were established and
also for a review of Section 17-35 of the Code. Councilman
Hummel was asked to sit in on this review and make a recommend-
ation at the next. regular Council meeting on February 1, 1965.

Southern Pacific - Automatic Crossing Gates
Letter dated 1/4/65 from Southern Pacific acknowledging request
for meeting with the City re automatic crossing gates.
City Manager Cowden reported that due to recent storm damage • �� �
all top men of the Southern Pacific Company were in the field and
that Mr. Robinson of Southern Pacific would set a date for a
meeting as soon as poss ible.

Mayor Moty reported.that the 5pecial Council Committee requests
written opinions of all Councilmen on the proposed draft of the

Letter dated 1/15/65 from Economic Development Corporation of
Shasta County inviting City. Council to.a meeting February 8th. . ���
Council agreed they could attend the meeting on February_8th,
and the City Clerk was directed to write a letter accepting the :

Robert Emerald
City Attorney Murphy requests that the Robert Emerald Claim for
Damages dated 8/19/64,_ which was rejected by Council at the
f�1�, January 4th regular meeting, be placed on the Agenda for the
February lst r�egular mee.ting for reconsideration. City Attorney
Murphy was not present at the January 4th meeting and wants
all of the facts presented and reviewed.

City Attorney Murphy reported notice has been received from Carl A.
Williams and Sons, Inc. , that the Patrick DeLange Claim was settled in

ORDINANCE NO. 782 - Establishing a C-O Office District �
City Attorney Murphy submitted a report re the enactment of C-O District
, I/ Ordinance. Councilman Chatfield feels that Items (1), (2) and (3)
�`��/ of Section 30-7. 11 of said Ordinance are not enforceable and should be
deleted. �
MOTION: Made by Councilman Fulton, seconded by Councilman Chatfield
that C)rdinance No. 782 be referred to the Planning Commission for re- .

RESC�LUTICoN - Traffic Controller
MC�TION: Made by Councilman Denny, seconded by Councilman Chatfield
that Resolution No. 3390 be adopted, a resolution of the City Council of
�; the City of Redding authorizing the installation of a semi-traffic actuated
� � controller at the intersection of Court and Shasta Street in Redding and. .
��'`� authorized the transfer of funds to provide for the cost. of said traffic

EMERGENCY WATER SUPPLY �
City Manager Cowden submitted a recommendation that Council make
available to the 5ummit City, Buckeye, and Shasta Dam Public..L�Jtility
Districts water from.the City of Red'ding�s Municipal System for drinking
purposesj Mr. Cowden.stated that the City has three .flusher�/t�.nkers
available to supply such water. Authorize.d�personn�El -o£ the�dis.t;rie�ts, wouL.d drive the
,, ;' vehicles. Mr. Cowden further s.tated there sh�uld be no need for`thes.e
,'' �) � flushers for this purpose after April or May, and the City. would- not�have
need of them until after that time. A letter of agreement will be made
incorporating the statement that the City of Redding can wrthdraw these
vehicles at any time. The utility:distric.ts would be responsible for tlie equipment.
Mr. C. W. Erickson, a Buckeye Water District director, raised the
question of liability as far� as the drivers are concer'ned and also what
sanitary rules will be observed. �
It was brought out that the Utility Districts are under no obligation. to
accept the offer; this recommendation will give the City Manager the author-
ity to contact the Public Utility District Managers and make the offer to
supply water. The City Manager and�the City Attorney will act for� the City.
MOTIQN: Made by Councilman Hummel, seconded by Councilman Denny
that water for drinking purposes be made available to the Summit City,
Buckeye and Shasta Dam Public Utility District from the City of Redding�s
Municipal 5ystem as outlined in the City Manager's recommendation.
The Vote: Unanimous Ayes.

Councilinan Hummel requested City Manager Cowden to write and"thank
Congressman.Harold T. Johnson for cooperation given to the' City of
Redding by the Congressional Sub-Committee with regard to recent
flood damage.

The hour of 7:30 P.M. having arrived, Mayor Moty opened the public

(Unclassified) District to an Interim C-3-P (Heavy Commercial and Light

US E PERMIT APPLICATIQN - Britt Vail
Planning'Director Keyes submitted the recommendations of the Planning
Commission re Use Permit Application UP-70-64 (Britt Vail) requesting �`�
Council consideration bf relocating utility pole within a 13� area to be
dedicated for Hilltop Drive. Mr. Keyes pointed out that although the
,
recommendations did include the'condition that t�e City share the expense
of relocating the utility pole with the Pacific Telephone Company; subse- �
quently it was determined that s uch cost would amount to approximately
$2550 because of the intricacy of the wiring. �
Public Works Director Arness stated that .the Pacific Telephone Company
intends to go underground with their wiring and, when this is done, the pole
would �ie abandoned. It is anticipated that this will occur in about one
year. �

MOTION: Made by Councilman Chatfield, seconded by Gouncilman Denny
that Council grant the developer the �right of establi.shing..two 20' driveways,
centered on the pole,, with.5� in be_tween with the.understanding that the s.treet
will not be improved until the pole is removed, and that the City will remove
the pole when the;Pacific Telephone Company abandons it. The Vote: .
Unanimous Ayes.
REZf1�NING-APPLICATI�N R.Z-7-b4 (Donald Bracken)
Planning Director Keyes gave a brief resume of previous action�taken
on the rezoning application No. RZ-7-64 of Donald Bracken, ie. , Planning
Commission previously recommended.that the .rezo,ning not. _be approved;
a publia hearing was held by the City Council, and the rraatter again referred
to the_ Planning Commissic�n. The,Planning Gommission recommendation ,
at this time is that further study be made for,future location of m.ultiple-
family, single-family, commercial, and tourist commercial facilities in
the general,ar�ea before action is taken on .this application. It, is envisioned
. that subject area will be heavily populated in years to come and Planning
� Commiss ion feels that spot zoning is not the;,proper approach to.the.overall
�, �_.� . , ,
zoning of the area.
The Planning Commission has given the Planning Department until��the first
meeting in July to produce further studies, and it is their .recommendation
that City Council disapprove zoning application,No:. _RZ-7�-64,without pre-
judi�ce. Mr. Bracken has agreedas a matter of record to waive his rights
re the statutory,reguirements that relate .to zoning so,that this s.tudy can
be made and presented to the Commis.°s:,ion in July.
City Attorney Murphy felt the proper procedure was to hold the application

in abeyance with Mr. Bracken waiving his, rights r:e statutory requirements.

Mr. Bracken appeared before Council and advised that he would agree.to .
waiving his rights but stressed the fact that the delay thus far had�caused
him to lose two or thre e sales of the property and he is very anxious for
a decision. �

that, with Mr. Bracken waiving� his statutory rights,, application No. RZ-
7-64 be held in abeyance to�a date no later than the� second Council meeting

PEDESTRIAN SAFETY ISLAND5 - Eureka Way _
Traffic Engineer Freeman presented a report of the Traffic and Parking
Commission re possible solutions .to the pr-oblem of students crossing
Eureka Way at Orange Street and,Magnolia,Avenue,, It is the Commission�s
recommendation that Couneil approve the pedestrian crossing safety
�� ;� islands plan propos�ed by the Traffic'Engineer and that, prior to installat-
l ion of said plan, both.intersections be lighted tr� a degree compatible with.
the best.traffic engineering safety. standards., ,The islands are 5� wide and
24� in length, and if ins_tall,ed, parking,will not be allowed on .the south
side of Eureka Way for a distance of 205� west of Magnolia Avenue and 105'
east of Magnolia Avenue. , . ,

Traffic Engineer Freeman presented the recorrimendation `of the Traffic
and Parking Commission re 'parking in .the vicinity of the 2800 and 2900
blocks of Pioneer IJrive. '
MOTION: Made by Councilman Denny, seconded by Couricilman Hummel
that the Traffic"and Parkirig Commission.recommendation be approved ' ���j
that No Parking Zones be est�.blished as outlined on the map submitted
by Traffic Engineer Freemari, said map being on file in the office of the
City Clerk, and that the Citp Attorney be dix'ected to prepare the;necessary

that the recommendation of the Traffic and Parking Commission be approved
re designating:Shasta Street as one-way westbound betweeri Pine and:Market . ��`-�
Streets, 'and the City'Attorney be directed to prepare the necessary resolution.

The Traffic and Parking Commission asked to be placed on record as
commending very highly the work of staff, and, especially, .the Department

of Public Works, in its highly successfUl ef�ort s to make passable` the
streets of the City of Redding through the last period of excessive snow.
LAND USE REQUEST - Redding Gun Club �
Airports Manager:McCall presented .the. recommendation of the Airports
Commission that the request of the Redding Gun Club for use of additiorial
land at Benton Airpark be granted. He stated that the land requ�sted does .Jj � ;�
not interfere with.the operation:.of Benton Airport.

that the area requested be added to the present lease of the Redding Gun
Club, subject t'o>the same terms and conditions, and the City Attorney
be directed to prepare the necessary document. The Vote: Unanimous

Councilman Chatfield r,tii�sed the point that, inasmuch as .the Redding Gun
Club lease is so nominal, perhaps the Gun Club could be open to the public
on weekends pt�ior t'o� huriting season each year. He felt this might dis=
courage target practice in open areas. City Manager Cowden was requested
to check into this matt�r. `
TRUNK SEWER EXTEN5ION - Rosaline Avenue �
Mr. 'Hastings of the City Engineering Department gave a report on the
Rosaline Avenue 'Trunk 5ewer Extension which wS.11 provide 930 feet of' � � .�
8 inch sewer line at a cost of $11, 000, with a return of $8, 000 in trunk
sewer fees. Mr. Hastings stated that monies are available for this �

Mr. Semon of the City Engineering Department gave a report on the Lak� � �/
Redding Boat Lauriching Facility. I�e stated that it is financed entirely by
the State of'. Calif'ornia; the City of Redding furnishes the land and�maintains
it for a period of 40 years. '

City Attorney Murphy s.ubmitted proposed Ordinance No. 787 establishing

local sanitation requirements for restaurants, itiner_ant restaurants,
vehicles and vending machine operations. Mr. Murphy said that State
law expressly provides permission to .gene�al law cities: to adopt an .. _
ordinance of this type with,food handling standards more strict than the

� State's in the field of restaurants, etc.

Mr. Lou Grush, 1735 Barbara Road said�that he objects to the section re
immediate compliance. He said it is not always possible to immediately
correct such items as floors, dishes, etc. , when told_to do s.:o by Health _
Authorities, that monies are not always available for such, improvements_.
immediately.
Both City Attorney Murphy and Dr. John Keye, Sr. , County Health Officer,
emphasized that there is no requirement in this ordinanee that is not
included in the State Restaurant Act, State Health and Safety Code. This . .
ordinance gives Dr. Keye examination .and enforcement tools� not found

in the State law. . _ : _ . _
Mayor Moty stated that the items brought up by Mr. Grush are covered by
the State Code over which the City has no jurisdiction.' , .

Councilrnan Denny offered for first reading Ordinance No. 787, an
�rdinance of the Gity Council of the City of Redding amending the Redding
City Code, 1959, as Amended, by adding Chapter 22A, pertaining to the

Councilman Denny feels that the action .taken on this application and many
others du�ring the past few years constitutes an admission by the City of
failure-to tnaintain its zoning map in ,current status and,:.if.this. practice is ..
continued it will evolve .into an impossible situation.. Mr.. Denny.pro.poses
����� that the Planning Commission, Planning Department, and Council cons ider
the advisability of adopting a practice of.judging an application on.its, merits._
Hebelieves that a decision.base�d on less than complete knowledge and "
research is better than proerastination -m that procrastination is not only� '
the thief of time but the thief of the economic life of Redding. � Mr. Denny
said his remarks are not in criticism of any particular department any more
than of the Council.

expressed doubts .about.the wisdom of interim zoning.

Planning Director Keyes restated the action taken on RZ-7a64 application
and pointed out .that from the outset it wa.s the recommendation of the
Planning Commission .that this application be disapproved. ' Mr. Keyes
expanded on the views of the'Planning:Department and Planning Commission
relative to spot �zoning and.also to interim zoning.

Request dated 1/1/65 from the Active 20=30 Club for permission �to sell
beer at Lake Redding Park on July 4, 1965. _

City Manager Cowden stated he believed the 20-30 Club had sold beer
last year on July 4th in Caldwell Park and that it did not interfere with
the Redding Junior Cham°ber of Commerce selli�g bee�r in L;ake Redding
Park. Bud Maddalena, treasurer of the Junior Chamber of Commerce
�i��� said that the 20-30 Clu�b did not sell beer in�the park; that the JayCees
were granted sole permission by the City Council to sell beer and run
other coricessions. Mr.-�IViad`dalena said that beer sales represented
better than.50°�0 of tlieir`profits at 'the park on July 4th, 1964, and if they
are to continue to sponsor the fireworks display they will have to �have
the sole right to sell beer.
Councilman Chatf'ield feels the� organization tha't'spbnsors the fire-
works should have the exclusive right to sell beer` -- whether it is
the JayCees, the 20-30 Club, or some other organization.

M`r. Joseph Redmon;requested permission to address Gity, Council
re storm water damage caused by storm waters backed up:at_.the
ACID Canal siphon in December, 1964. Mr. Redmon represents
20 home owners and residents who live in the,�vicinity of the Parkview
Ditch, ACID Canal and the siphon which :carrie.s storm water to,the
river. , ., _
Mr. Redmon read to Council an article which:ap,pea.red in_ the Record
Searchlight on January 20, 1954. This article stated "Flash:flood
threats to homes .riear the Ariderson-Cottonwood irrigation canal and / �� �
the city storm channel south of Redding may soon be lessened by � J�
joint action of'the city council and the AC.ID Bbard of Directors. " ,
The article went on to outline the cost of correcting the cause of the
flooding conditions which was set between $50, 000 and $100, 000.
Mr. Redmon presented,this -article to illus.trate that since ..1..953 there
have been .four ser.ious floods �-- 1955, 1959, 1962: and 1,9�64. He .-:
said that the persons liVing in _this area.have been waiting for 11 y.ears
for a solution _to this problem; that flooding conditions affect everyone
in the Parkview Ditch area. These p�ople are not able to get flood ._
insurance and they look .to the City for help. Mr. Redmon said he
feels the City should not only. pr,o,vide police and fire protection�but
also adequate sewer and stor.m drainage facilities. He further stated
that, although some elaims for damage w'ill be filed because these,
people are not able to r.eplace and rebuild the losses.,:incurred:by:the
latest flooding,, the peopl.e he represents mainly want a solution to
their problem rather..than�repar.atione Mr. Redmon stated his clients
want action; if money isntt available to correct.the situation, it.
should go to a bond issue. . .
Mr. Redm.on said it was .his understanding that Counci l had:budgeted
money for increased siphon capacity and asked why nothing had been
done. Mr. Cowden said that.$6500 had been. allocated for a_new
siphon which.the ACID was .to install but they have suffered s.evere
bank damage and dontt have.the funds or manpower to do the install=
ation. He further stated..that.the new siphon would not be the complete
answer to the flooding groblem as it would transfer the problem from
west of the canal to east of the canal. Mr. Cowden .said that correct-
ing all sto'rm drainage pxoblems. in the City could ruri into the .
millions. . . . .
Councilman Chatfield said it is importarit to•_realize that this area .
isn�t the only one in the City of Redding where storm drainage
problems exist; .there are many areas so affected and eventually
they will have to be corrected in�all areas. Councilman .Chatfield
asked Mr.� Redmon i�f the ACID had been approached on this inatter
or if he intended to do so. Mr. Redmon stated that he does intend.
to go to the ACID but the �people look to the:City of Redding for
help. When asked if his clients were in the ACID district, Mr.
Redmon said they were.
City Atto'rney Murphy asked Mr. Redmon if he•intended to file claims
with the ACID•as well as with the City of.Redding.. Mr. Redmon
� said he believed that�this would be done. .

only item on the agenda would be the'matter. of automa�tic�crossing gates
at the five railroad� c`rossirigs in the City.' .He�:requested City IVlanager
Cowden to review what had be�en done to date in regard to this subject.
City Manager Cowden submitted _his report which contained the following
background in£ormation relative to automatic crossing gates; ''The'pro- ��•
posed crossings would be located at Shasta, Tehama, Yuba, Placer, and
Soath Streets. The �total- cost�of installation of�the autorriatic gate.s=would.
be approximately $112, 000, one half of such cost to be borne by the Southern
Pacific Company and one half by the City of Redding. The Southe rn Pacific
Company would��pay�a�11� gate°maintenance costs•.after:'installatiori� is�c'ompleted.
Mr. King concurred•with�_:all but the:last. statement, -adding that there is
legislation nending which may apportion the maintenance costs�betw:een ..
the City and the Sou"the rn Pacific.

The Southern Pa�ifi"c� C�ompany�is.prepared 'to �pro'ceed with the installation
of planking and upgr.ading�the.:cr•ossings (which includes-,the track�s and 2°
outside of the outer rails) and would like to receive detailed information
from the City of Redding re�any proposed� wid'ening of streets at these .
crossings. It was agreed that this would be furnislied at:an early date.
The Southern Pacific Company estimates they will spend $20, 000 in up-
grading crossings; 'i'n add�itiori to' the ainount specified for�automatic c'ross-
ing gates. It will take approximately 6 months to order the material and

Mr. King' e.xpl`ained.that'the�crossing gates� c'ome down�30 seconds before
the train reaches�the iritersection�.and'th�at th;e si�gnals� start� flashirig approxi-
mately 10 seconds before the gates come do�vn -- giving approximately

When questioned as to what speed the Southern Pacific would consider
reasonable for �tr�,ins.to �go:-"tlirough Redding after the installation of tlie
automatic'c�rossirig g�ates, ' Mr.. King s:aid�that although for tlie £:oreseeable
future a speed of 45 m.iles an hour� would, be agreeable, his Co`xnpariy would
prefer that no definite speed limit be set forth. It was pointed out that the
speed limit is now set a.t 25 MPH by. Ordinance and if the present Ordinance
is amended to increase the speed limit, it would be necessary to specify
in the Ordinance what the new speed limit is. Mr. King was assurred that
this did not mean that the Ordinance could not be amended at a future date
if a chanDe in the speed limit we.re desired by the Southern Pacific. It, ' '
would be a matter to negotiate just as is being done now. Mr. King agreed
that this would be satisfactory.

maintenance costs to be predicated on the Whiteoaks Formula,• and that the
speed limit of trains operated through Redding be changed by Ordinance
to 45 miles per hour at the completion of the gate crossings, and the City
Atto-rney be directed to prep'are the necessary documents.
