The meeting was called to- order at 7:00 P.. M.• by. Mayor Moty with the
following Councilmen present: Chatfield, Denny, Doherty, Fulton, and Moty.
Also present were City Manager Cowden,., As sistant City Manager and
Purchasing DirectorStewart, City Attorney Murphy; Finance Director
Courtney;. Public Works Director Arness-,:Assistant City Engineer, and
Acting Traffic Engineer Lang, Airports Manager McCall, .a-nd Planning
Consultant Keyes.
APPROVAL OF MINUTES
MOTION: Made, by. Councilman Denny,, seconded byT Councilman Fulton,

CONTINUED PUBLIC HEARING - Appeal of Use Permit Application
UP -41S-66 and Variance Application

The hour of 7:00 P. M. having arrived, Mayor Moty continued the
public hearing on the appeal of Use Permit UP -41S-66 and Variance
Permit V -11S-66 - Hemsted Village Co. - 105 ft. sign.
The City Clerk advised that communications had been received
from the California Roadside Council, Leon C. Nelson, D. D. S. ,
and Alger N. Johanson, upholding the recommendation of the
Planning Commission.
Planning Consultant Keyes gave a resume of the pertinent letters
and testimony pertaining to this appeal which included the following
information. Hemsted Village is to be located west of the Freeway,
just north of Cypress Avenue, between Bechelli Lane and the
Sacramento River. The proposed sign measures 80 ft. to the top
of the highest sign face, with an additional 25 ft. extending above
for a lighted symbol. The sign includes two sign faces. The top
sign face is 12 ft. x 32 ft. , 384 sq. ft; the bottom sign face is
8 ft. x 32 ft. - 256 sq. ft. The bottom sign face is 16 ft. from the
ground. Mr. Keyes said the Planning Commission recommended
disapproval of the four elements of the application; i. e. , sign in

excess of 25 ft. in height and 100 ft. in area; sign in excess of
40 ft. in height in CO -BR District; location of sign within 15 ft.
front yard requirement in CO -BR District. Mr. Keyes said it
has since been determined that the sign is considered to be a
"structure" and not a ''building", thus the variance request for
a sign in excess of 40 ft. in height in a CO -BR District is not
required. It was later brought out by the applicant that they do
not intend to place the sign within the 15 ft. front yard require-
ment; therefore the variance request can be dismissed and the
only matter before Council is the Use Permit Appeal. Mr..
Keyes reviewed the reasons for the action of the Planning
Commission in denying the use permit application which are
set forth in the Commission's memo to Council dated October
4, 1966.
Councilman Chatfield asked Mr. Keyes if the permit for the
Montgomery Ward sign was granted by the Planning Commission
and was told it was. The height of said sign is 74 ft.
The following persons appeared before Council upholding the
Commission's action. The basis for their feelings is their desire
to preserve the natural characteristics and beauty of the area and
their fear of the erection of numerous other high signs if this
appeal is granted: Bill Woodward, Beverly Arness, Mrs. Robert
Korn, Pastor Mortvedt, Richard Maddalena (read note from Mrs.
Pauline Abbe also), Dr. Vernon Gee, Dr. Kelly Pierce, Ted
Klas.een. Mrs. Korn submitted two architectural renderings, one
showing a multitude of signs and the other without signs. Persons
favoring the high sign who appeared before Council include: Frank
Kennedy, Lee Bray, E. V.. Anderson, Maurice .Finn, and.Ros.coe
Anderson. These persons all voiced the need for getting the tourists
off the freeway. Mention was made of the recent high signs installed
by the .Union Oil and Gulf Oil Company, permission having been
granted by Shasta, County. , _f. 1 - . I. ,
Russell Bales appeared on behalf of the Hems,tedNillage.Company
and submitted a sign elevation study showing visibility of their
proposed sign from various points on the freeway. Mr. Bales re-
iterated that Hemsted Village Company believes the,sign is necessary
to insure the success of its venture. He explained the Hemsted Village
complex which will.comprise a coffee shop and dining room, .a motel
consisting of ---124 units, cocktail lounges, .and iconvention facilities
for 400., The installation will cover approximately 10 acres, all of
which are within the City limits.
James Hull, Chairman. of the Redding Planning Commission, said
that a statement had been made at the last Council meeting that this
application must be judged under the present law; however, if this
high sign is allowed, he feels this decision will weigh heavily on the
Planning Commission in its consideration of the new sign. ordinance.
Mr. Hull commented that other applicants can make the same allega-
tions regarding the need for high signs and it is felt.that all appli-
cants should be treated fairly. The Commission universally is in
favor of advertising and helping the businesses in the City of
Redding but feels it should be done on a community rather than an
individual basis. Mr. Hull further stated that the sub. -committee
of the Commission did recommend a sign 49-1/2 ft. in h.eight for
the applicant but the rappli-cant wanted a 105 ft, sign and indicated
a compromise was not acceptable: , The -Commission does not feel
that what the County.does in.th.e way, of granting permits for high
signs is suitable criteria as to what the City should do. The
highest and largest signs granted by the Commission are located in the
commercial districts of the City, whereas the applicant is in a

CO -BR District. He indicated his belief that it would be improper
for the City to use sign policies in an attempt to equalize property
values.
Planning Commissioner B runnemeie r commented on the surge tank
located on the east bank of the 'Sacramento River and its lack of
beauty. It was estimated that this tank is approximately 80 ft. high.
He feels the applicant has not shown a real need for the 105 ft. sign.
Dr. Brunnemeier feels the beauty of Redding lies in its setting and
it should not be marred with high signs.
Planning Commis sioner�Bailey stated that Redding has been selected
by the State as a "target city", along with Portland, Sacramento, and
San Francisco, and the name "Redding" appears on twenty-one highway
signs coming north to Redding so the tourist is well aware of the City
of Redding.
Planning Commissioner Stathem stated that the Commission was
unanimous in concluding that a substantial hardship had not been
demonstrated for the particular sign and in finding.that approval
would not be appropriate.
MOTION: Made by Councilman Fulton, seconded by Councilman
Denny, that the public hearing be closed. The Vote Unanimous Ayes
Councilman Doherty asked if the Commission had given consideration
to the location near the freeway and to the type of business. Mr.
Hull said yes, and that the Commission has considered that perhaps
businesses might be banded together and one high sign be used;
however, it is difficult to find a criteria that would be fair to everyone
Councilman Doherty asked Mr. Bales if, because. of topography,
they would not gain 10 ft. by relocation of the sign 200 ft. or more
north on higher ground. Mr. Bales and Mr. Robinson indicated
this might be true but it would place the sign too far away from the
ingress and egress to their complex and would require its re-
design.
Councilman Chatfield commented that there is no clear cut pattern
in freeway studies or their effects on business, and he does not
think that one sign for 10 acres is an over- saturation. Mr. Chatfield
indicated that with the variance request being dismissed the three
criteria required under that section of the Code no longer applies and
he feels that the profile demonstrates that the sign proper is no higher
than the Montgomery Ward sign, although the embellishment is ques-
tionable. He questioned granting a 74 ft. permit to.Montgomery Ward
with no appeal and yet denying a permit to this applicant. He feels
the City does have to grant advertising signs adjacent to the freeway
and that the applicant has shown that the sign is necessary due to
visibility.
Councilman Doherty said he thinks the City can preserve the aesthetics
of the area and yet give consideration to the economy of the community;
the job of Council is to find a compromise between the 25 ft. height
limit which is the present law and the 105 ft. sign requested by the
applicant.
Councilman Denny said he felt that the arguments favoring the high
sign had been presented effectively and he had nothing more to add.
Councilman Fulton agreed with Mr. Denny.

Planning Commissioner Stathem said that .even though Council is
not establishing policy tonight, it. is .in fact setting a precedent.
Councilman Chatfield said he was hardpressed to understand that
Council is establishing a precedent when the Commission did not
set a precedent in granting a 74 ft. sign to Montgomery Ward.
Councilman Doherty, indicated that,he felt if Council granted a sign
at this height it would be plowing new ground as under the. existing
law the 74 ft.- Montgomery.War.d sign is the highest sign granted. to
date.

Division of Highways
A communication _from the_ Division of Highways re control of
junkyards along all Interstate and Federal -Aid primary highways /111-51
(AB51) was referred to the Planning Commission and the Building
Inspector.
Conference on Urban Transportation Planning
An invitation was received from the State of California Transportation
Agency to a conference on Urban Transportation Planning to,be held %l03
in Los Angeles on-Octob.&r 26th: It_was determined that Redding is
not urbanized to the point where it is necessary to send a representa-
tive to this type of conference.
Redding Junior Chamber of Commerce
A communication received from the Redding Junior Chamber of
Commerce. re. the proposed.sign.ordinance was referred to:the liGG
Planning Commission with instructions-that.it be brought back to.;,,,
,Council at .the: -.time the sign ordinanceds submitted for- considera
tion.
Regional Water Quality Control Board
A, communication dat ed Octobe r l.Oth f rom -the Regional Wate r
Quality Control Board re waste discharge into the Sacramento��
River was referred to the Dire.ctor.:of Public Works who advised
that the incident was caused by a contractor working on the sewage
disposal project. The person responsible has been reprimanded
by the ,Contractor of Work on this project.
Shasta County Community Action Project
A communication received from the Shasta County Community 1%y
Action -Project:endor.sing the ,conc.ept.of the --Neighborhood Center
in, Sheridan Park area was referred to the Council.Committee work-
ing on this.project.
Electricity Charges
A communication received from Attorney Richard Asbill re
electricity charges against Mr. and Mrs. Richard M. Howell was 2902
referred to City Manager Cowden and staff for study and report.

USE PERMIT APPEAL - UP -18-66
MOTION: Made. by Councilman Doherty, seconded by Councilman
Chatfield setting a public hearing for 8:00 P.M., November 7, 1966
on the appeal of Helen Fay Generes on Use Permit UP -18-66. The
Vote: Unanimous Ayes
PETITION FOR ASSESSMENT DISTRICT PROCEEDINGS - Placer Street
An informal petition filed by property owners requesting assessment
district proceedings be initiated for installation of.water line improve-
ments on Placer Street.between San Francisco Street and Regent Avenue
was referred to the Department of Public Works for appropriate action.
PETITION.RE COLEMAN INN ,
A petition was filed by.interested citi,z;ens andadjoining property.owners
requesting that Council order the City Clerk to revoke ,th.e. license of the
Coleman Inn on the grounds that it is .a public nuisance. The following
persons appeared before .Council and testified as to the deplorable con-
ditions which prevail on Linden Avenue because. of. the existence_ .of the
Coleman Inn: Roy Anderson, Ralph Hoeflich, Ralph Hoxie, Mattie Ingram,
Doris Anderson, and Margaret Bibbens. Reverend Hawthorne of the_
First Methodist Church said that although he couldn't speak for the Council
of Churches on this particular issue, the Council is interested in working
towards solving the open ditch and drainage problem in the area and .he
felt the Council would also be interested in the Coleman Inn problem.
Mayor Moty referred the matter to. the City Attorney and the Chief of
Police for review and recommendation at the meeting of November 7th.
City Attorney Murphy said a meeting is being arranged with the Chief of
Police, the District Attorney, and a representative from the Alcoholic
Beverage Control Board. Mr. Murphy said that at the November .7th
meeting the Committee will -present an outline of procedures available
and a recommendation as to the best procedure to follow. _ .
PETITION RE OPEN DITCH DRAINAGE PROBLEMS - Linden Avenue
A petition was filed by property owners on. Linden Avenue re installation
of a pipe in the open ditch_, into which effluent is draining from the City
dump. A petition was also filed by property .owners in this. area. re-
sc ndi'ng the signatures of persons who had previously signed a sewer
assessment petition, until agreement can be reached between the City
and property owners as to who will bear the cost of installation of ,sewer
lines. The petitioners allege that the cost of drainage and sewer installa-
tion should be underwritten in part by the�.City of .Redding because effluent
from the- City dump.will drain into the sewer lines. Persons who appeared
before Council in support of these petitions include; Hartley Barnard,
Ralph and Albert Hoeflich, and Roy Anderson..
Mr. Anderson said he had been contacted by a representative of the Job
Corps who offered the vehicles and services of.the, men, in the Job, Corps
to clean up the area.
Mayor Moty appointed the following Committee to study these petitions
for feasibility and cost and alternate solutions, and report back to Council
on December 5th with a ,recommendation: Councilmen .Chatfield and Fulton,
City Manager Cowden, and Public Works Director.Arness. Mayor Moty
suggested that the residents of the Linden Avenue area appoint a committee
to work with the Council Committee on this matter.

City Attorney Murphy reported that he had been advised by Bond Counsel
that the draft of the Buckeye Agreement was in good order legally. Mr.
Murphy said the draft has-been submitted to the Buckeye Board of Directors
and the Shasta County Board of Supervisors. The matter -will go before the
I Board. of Supervisors on .Monday, October 31st. Mr. Murphy -has not heard
from the Buckeye Board of Directors. ,

A communication was received from Maurice Finn, a representative
of the Five Counties Central Labor•Counci_l re the Shasta High School
Di.strict•Override Tax Measure.. Mr. Finn requested Council to en-

Council policy to endorse matters of this type. All Councilmen present
(Chatfield, Denny, Doherty, and Fulton) stated individully. that they
are in favor of this measure.
APPLICATION TO OPERATE' AT REDDING MUNICIPAL AIRPORT
Airports: Manage r--McCall7 advised Council that he had received a wire from
a Billie J. Murray requesting.a temporary permit to operate commercial
flights from Redding Municipal Airport. Mr., Murray operates an aero
commander plane .between Ashland, Montague, Weed, Dunsmuir, and
Redding.
After discussion the matter was referred to the Airports Commission for
recommendation and. report.
