Pastor Robert Mortvedt of St. James Lutheran Church offered the Invocation.
The meeting was called to order by Vice Mayor Chatfield with the following
Councilmen present: Denny, Doherty, Fulton, and Chatfield.
Absent: Mayor Moty ,

WRITTEN COMMUNICATTOIVS
Buckeye County Water District
A letter dated September 16, 1966 and an accompanying statement was
received from Mrs. Howard Heath in opposition to acquisition of the
Buck�ye County Water District by the City of Redding. Vice 1Vlay�r
Chatfield advised that this letter would be filed in the office of the City
``��`� C1erk with other public documents relating to the.Buckeye County Water
District.
Robert Frye .
MOTION: Made by Councilman Doherty, seconded by Councilman Fulton
.approving the request of Robert Frye to cancel immediately the contract
�.�( between the City of Redding and Robert Frye re painting house numbers on

Vice Mayor Chatfield stated that the ordinance to be considered for second
reading and adoption at this meeting does not concern the rezoning of any
of the property referred to in the aforementioned letters.

M rs. Gerie re s stated that she had talked to the City Manage r and
the City Attorn'ey, and they said she could request Council to re-
consider their actiori�regarding rezoning study RZ-11-66. She
stated that her property was located within the study area, but was
not included in the proposed rezoning, and she added that there was
only a six day lapse of time between the Planning Commission's
amendmerit to their original recommendation and the time of the
Council meeting instead of the required ten day appeal period, and
that she was appealing from this action and that she wished her
property to' be rezoned as part of this proceeding. {Planning �
Commission held a second public hearing on RZ-11-66 on 9/13
after Council referral, and Council continued its original public
hearing from 8/15 to 9/19/66).
Vice Mayor Chatfield suggested that the four letters listed herein
together with the petition be referred to the Planning Commission,
since the only action before the Council on RZ-11-66 at this meeting
was the proposed second reading and enactment of Ordinance No.
871 which has no effect on any of the property referred to in said
lette rs and petitions.
Vice Mayor Chatfield suggested to 1VIrs. Generes that her proper
procedure at this time would be to institute her own application for
rezoning of he r p rope rty with the Planning Depa rtxrient. Mrs. Gene re s
objected to this and stated tihat it was unfair for the Council not to
include her property in this proceeding before them, and further stated
that for her to file her own application would cost her_a _$50,_ filing fee
and this she did not want to spend.
City Attorney Murphy advised Council and Mrs. Generes that she was
mistaken as to the nature of the proceedings. This was a re�oning
matter, and� consequently the action of' the Planning -Commission was
in no event final and therefore there was no appeal from the recoinmen-
' dations of the Planning Commission to the Council. Upon receiving
the recommendation, Council was required to hold a public hearing and
then make its own decision as to the proposed rezoning. He furtlier
explained that RZ-11-66 was initiated by the Planning 'Corrimission on
its own motion and that the Planning Commission's recommendation
included no proposed rezoning for any of the property referred to in
the letters and petition which are before Council but, instead, included
an express recommendation that the existing zoning on these properties
remain unchanged. .
The City Attorney advised Council that there were three alternative
procedures available in regard to' the requests contained in the
` aforementioned letters and petitions: (1) Council could initiate a
rezoning study of the- area on its own motion. (2) Council could
refer the communications to the Pl�nning Commission, and the
Planning Commission could initiate a new rezoning of the area on
its own motion. � (3) The parties who submitted the letters could be
advised that, as property owners, they may initiate rezoning pro-
` ceedings upon their own applications. � -
Planning Consultant Keyes statecl that the property of Mrs. Generes,
Mr, and Mrs. McLeod, and Mrs. Sergi had been included in the
previous rezoning study of the Planning Commis sion, and was con-
sidered at both public hearing"s of the Commission relating to that
study. He feared that a new rez'oning study initiated either by the
Council or the Planning Commission would result only in more
public hearings with no change in results: '

Councilman Denny stated that he did not favor Council initiating
a rezoning study at the request of a property owner, especially
when the property was part of the subject matter of a study just
concluded. Councilman Doherty agreed with Councilman Denny.
Vice Mayor Chatfield advised Mrs. Generes that Council would
not at this time initiate a rezoning study of her property, nor
would it instruct the Planning Commission to do so.
Mrs. Generes�stated that she had been treated unfairly, denied
he r legal rights, and that she was going to take the matte r to
Court.
MOTION: Made by Councilman Doherty, seconded by Councilman
Fulton, that the aforementioned letters and petition be referred
to the Planning Commission. The Vote: Unanimous Ayes
Petition for Assessment District Proceedings
A petition for assessment district proceedings was submitted
by property owners in the Harrison Tract-Riviera Drive area
re a sewer system. Public Works Director Arness said that
�,���-- this petition was circulated in conjunction with the petition
received last ,meeting from�property owners in the general
south city area. The petition was referred to the Department
of Public Works for appropriate action.
Redding Chambe r of Comme rce
An endorsement of the Redding Chamber of Commerce was re-
��jU ceived re the purchase of Kutras Turtle Bay property.
T. R. Woods
A communication dated 9/26 from T. R. Woods re undergrounding
,��s of utilities in Unit No. 5, Sunset Terrace area, was referred to the
Council Committee for Undergrounding Utilities for recommendation.
Redding Chambe r of Comme rce .
A c:ommunication reeeived f rom the Redding Chambe r of Comme rce
- re the proposed sign ordinance was referred to the Planning Commission
`��G with instructions that it. be brought back to Council at the time the sign
ordinance is submitted for consideration.
Legislation .
A communication was received f rom Judge B ruce S'umne r reque sting
Council support on Proposition 1-A. City Attorney Murphy advised
Council that the League of California Cities has gone on record as
„1 7�2 supporting Proposition 1-A, the most important item of which is the
provision to hold General Legislative Sessions annually rather than
every two years as at present. Councilmen Denny and Doherty feel
that this is a matter of broad general interest and they do not believe
it is a matter on which Council should take any action.

AGREEMENT - Ron Fa rley '
MOTION: Made by Councilman Dohe rty, seconded by Councilman IDenny,
approving a temporary water service agreement between the City of

SEWER REIMBURSEIVIENT AGREEIVIENT - T. R. �Woods ` '
City Attorney Murphy submitted a substitute agreement between the City
of �Redding and T. R. Woods� in�Tieu'of the reimbursement �agreement
��� dated October 15, 1962 entered into betweeri the�'City an'd Mr. Woods.
y�y Mr. Murphy indicated that this substitutiori agreement is necessary be-
cause since the original agreemen.t was entered into, a 'portion of the�
tributary area has been included within the Twinview S'ewer Assessment
District and acreage charges from these areas cann�t be considered as
a source of:funds for reimburserrient. Tliis substitution agreement has
been approved by Mr. Woods and the Director of Public Works.
MOTION: Made by Councilman Fulton, seconded by Councilman Denny,
approving the afo 'rementioned"substitute agreement between 'the City

SHERIDAN PARK YOUTH CENTER
Councilman Denny submitted the report of the�Special Committee re the
��N proposed Sheridan Park Youth Center, dated 9/29. This report presents
the facilities incorporated in the proposed building, and the function it
would perform. Mr. Denny summarized the provisions of the Grant

program which must be met in order for the project to qualify for a
grant. "He saicl that'�one' of tHe questions' raised was the possibility of
consolidat'ing the proposed 'project with se"veral other neighborliood
projects and have one large project to serve the entire community,
Mr. Denriy' pointed out tliat one of the criteria to` be�met under this
type of grant is that the facility must'be a neighborhood project. It
was also brouglit out that the applicant's share of the propos�ed project
is one fourth of the development costs; which 'wouTcl'be $22;245, (total
cost estimated at $88, 980. ), arid the 'value 'of the three 50 ft. lots
owned by th�e City which are proposed as the site of the faciTity cannot
be 'applied as pa'rt or all of the applicant's "share. � ' ' �
Councilman Fulton rais'ed the questiori re the dieposition of tlie facility
in the event it'is no longer needed or used, and City Manager�Cowden
said title to tYie facility would be held at all times by the City, assuming
the City is�the applicant. " ' '

It was agreed that there are several unanswered questioris to! be �resolved,
one of which is the cost of staffing the facility.
It is the recommendation of the Committee that staff be authorized to
p 'roceed with the preparation of an application for Federal Grant to assist
in f'inancing the development cost` of the' Sheridan'P`ark YoutH Center', and
t� determine arid report in as'�much detail�as possible 'related commitments
and obligations that would be incurred by City and other participating groizps
or agencies, and that afte'r con`sideration of such information, Council
decide whether or not to file ap�lication and proceed with saicl project.

Mr. V. M. Robinson, general partner of the Hemsted Village Co. ,
ap'peared before Council' arid indicated "that his' Company"was aware
of the height limitation of signs in'the City bu"t they'were not con-
cerned because originally the�y had planned on a 50 'or 60�ft, sign
and knew that va:riances'liave beeri granted in the past for�such signs.
However, upon checking, they determined th�.t in'order to be seen
from the Freeway, the sign face would have to be a minimum �of�
' 80 ft. in height. ' The additional 25'� ft: -requested is for embellishment
of the sign. Mr. Robinson cited the� Taek of"sigris�on or'acljac'ent to
the Freeway directirig tourists to food; lodging, or gasol�ine. He
also stated he feels the sign should be allowed in order tihat his
Company can make the best use possible of the property.

Vice .Mayor Chatfield asked how fa:r the_.sign would be from the
Freeway .right-of-way and was told it_would be approximately 600 ft.
� Mr. .Virgil ,Covington, , General Manager, of the Economic Development
Corporation of Shasta County spoke in favor of the sign, stating it is
his .belief that well designed si,gns_are,.a necess:ity .to_help bring, people
off the Freeway and to advise, the.m that,.a certain facility .is available
,
for them t�o take advantage of. � He cited the fact that othe.r cities are
granting such variances on an individual merit or need basis and
hopes that Council will give �uch reque.sts economic consideration.
Mr, Maurice Finn, Business Representative of the Building Service
Employees International Union, Local No. 22, and also speaking on
behalf of the Bartenders and Culinary Union, Local No. 470, also
spoke in favor of the sign from an economic basis. Mr. Ed Anderson
of 508 Grove Street, indicated that although he.does. not s;tand.to gain
anything by ;;allowing the sign, he is in favor of high signs to encourage
tourists : ' . . _ . ...
Pastor poherty of the Bethel Assembly of God, and Pastor Hutcheson
of the Church of the Nazarene both said they have no objection to the
proposed Hemsted Village sign. Pastor Hutcheson said that a 40 ft.
sign would be,.hidden by his church_ and, the church board,determined
it was not against the proposed Hemste.d. sign opposite .its.front.yard.

Doherty, the public hearing be closed. The Vote; U.nanimous Ayes
Councilman Doherty said it is hi.s,_belief that we must have a, vital
growing community but, on the other hand, we must have an attractive
pleasing appearance as this is a necessity also, and this is the frame-
work upon which we must resolve the matter.
Councilman Denny said he_fe.els�that..an arbitrary height limit on signs
will be a small contribution to the aesthetics of the community. He
stated he has tried to analyze the signs in Redding in terms of their
beauty; and it is his impression that the.high signs.are.mor.e att,ractive
than the low signs; the low .signs a,re poorly maintained and are. very
numerous, and give a general impression of cluttering the environ-
ment. .. Mr. Denny said_.he believes in.developing commercial areas
to the maximum in the City,and s.ees no. objection to.this.sign and no
objection to the rather extensive enterprise of the rep�resentatives.
Councilman Fulton said he was displeased that no one appeared at the
public.hearing objecting to.the sign. He thinks ,the, City Manager
brought out,a good, point_in his memo.,re�architectur.al,control rather
than height control. Councilman Fulton has no objection to.the ,
Hemsted Village sign. �
Councilman.Doherty believes,the,re should,be,a-limitation on s_ign
heights with an opp:ortunity .to..vary.it under ver..y..un.usual circum-
stances.. He is not certa.in that these circumstances,have been
reached with _respect to the pres.ent s.ign. Before approving this
particular sign, Mr. Dohert,y would like this matter to go back to
the Planning Commission and see if they would approve`something
less than a 105 ft. sign; if not; then Council would have to decide.
Mr. Doherty thinks policy questions should be determined by _ _
Counci,l, , but not the height of each sign -- this is a Planning Commission
function.,
Vice Mayor Chatfield asked if height is the only variance request and
was told that there were three issues before the Planning Commission:

(1) Reguest for exception from the height and area limitations
imposed by Chapter �3 of the City Code, which are 25 ft. in ,
height and 100_ ft. in area. , ,

(2), ,Application,for�a variance from.the height limitation imposed
. by the provisions of Chapter 30 pertaining to all structures in
the CO-BR zone which provides that the maximum height of
any structure shall be� 50 ft. �
(3) Request for a variance to permit location of the sign within
the .i5.ft. front yard requirement for,the �CO-BR zone estab-
lished by Chapter 30.� �
Vice Mayor Chatfield agrees ,with architectural. control but points
out that there is no such provision under the existing ordinance.
Mr. Chatfield can see the possibility of high sign wars becoming
a.problem. but does not believe Council has bee.n supplied with
sufficient information to make a deci�sion_in this. matter. He does
not believe the Planning Commission and Council should be 80 ft.

by proponents for this sign can be advanceci by other developers
for even higher signs because of topography adjacent to the� Freeway.
If Council approves this application based on hardship, Council
may have applications f rom othe r land owne rs who have even g reate r
hardship. Council will be setting a precedent. �
Mr. Robinson objected to Mr. Murphy�s statements on th.e .grounds
that the.public hearing was closed. Vice Mayor .Chatfield-advised
- Mr. Robinson that it was the duty bf.the City, Attorney to advise the
Council on the legal implications of courses of action.

Mr. Joe Redmon, Attorney, stated that. p;e,rhaps a joint meeting of
the Planning. Commission and Council would.be beneficial in resolving
this matter. Councilman Doherty suggested that staff t.ry to work out

AG�tEEMENT - Survey of Police Department
City Manager Cowde�n subniitted his recommeridatiori that Council �
approve�an Agreement between the City of Reddirig and the 'Inter-
national Association of Chiefs of Police, Inc.', 'covering a survey
of the Redding Police Department, and authorize the Vice Mayor
to sign said Agreement on behalf of the City. The"cost of the 'sur=
vey will not exceed $8, 075, $2; 000 of wliich was appr'op'riated'�for

City Attorney Murphy submitted a written,memorandum opinion stating
there is a material irregularity in said election,.. since.the :canvass of
the election revealed 13 votes cast, 7 against and 6_ in favor thereof,
and since the affidavits on file, tog�ther with�a -review of�the .election
proceedings reveal that the published. notice bf election establishing trie
voting�precincts for said election failed to include the portion of General
Election 'P�recinct Bonnyview No:�„2.1'ocated�within the�a:rea _proposed to
be annexed, and that therefore'3;"regis.tered vote.rs qualified:to_vote in
said election received no notice thereof, either by mail or publication,
nor were they,included upon the Precincts Lists of tliose qualified to

The memorandum also recommerided.that the:.Gouricil:.de:clar.e:.the .
election null and void and adopt a resolution of intention to call a
special election establishirig:a' date for a new protest hearing, follow-
ing which, if a majority protest is not made, a new election should be
called. The memorandum stated that this opinion was shared by County
Counsel Robert Rehberg and that IVIr. Rehbert had determined that the
Attorney, Ge�neral's office agree.d with these opinions.

MOTION: Made by Councilman Doherty, seconded by Councilman Fulton
that Resolution No. 3765 be adopted, a resolution of the City Council of
the City of Redding declaring the Special Election of September I3, 1966
in the Eastside Road Annex No. 1 Area, void because of irregularities.

that Resolution No. 3766 be adopted, a resolution of the City Council of
the City of Redding declaring its intention to call a special annexation
election, and fixing a time and place for protest by property owners.

Noes: Councilmen - None

REVISIONS TO CODE - Business License Section
The City Clerk submitted a memorandum to Council concerning proposed
revisions to the business license section of the Redding City Code and
requested that Council review these suggested changes for action at a I��
later date. Action on this item was tabled until the meeting of November
7th.
