Powe�ll '`s� � , ,. � :. . - _ _ _ _ _ Planning Director Keyes gave a brief summary of the action of the Redding.,�Rede�elopment Agency on this iss_ue; i.e. , 173 adoption of Redevelopinent Agency Resolution RRA66-1 re Federal Assistance for powntown Rehabilitation which states that the downtown area appears, in the opinion of representatives of the Urban Renewal Administration in San Francisco, to be in need of rehabilitation studies. Mr. Keyes explained that if Council wishes to proceed , with a study, an application for a grant for a survey and planning study should be made as soon as possible in order that approximately $500,p00 previously expended by Redding for downtown parking lots could be used as a credit toward a future project. If the grant is approved, the City would proceed with a survey and planning study and, at its conclusion, would determine whether or not it should go ahead with a project. If Council decides not to proceed with a project the money advanced by the Urban Renewal Administration for the survey and planning phase does not have to be repaid. If Council decides to go ahead with a project, the survey and planning study money advanced becomes ,part of the total project cost of which the City pays 25% and, the_ Federal Government pays 75%. Robert Dicker of Dickers Department Store and George Greenleaf, Presid.ent of the Greater Redding Chamber of Commerce appeared before _Council and endorsed the proposed study. Mr. Dicker emphasized that the study would not necessarily be for a mall, but for a study of downtown problems and possibilities. Frank Wilson said he did not oppose the study but did not feel it should come under the Redevelopment Agency. It appears to him that the downtown property owners would be :subsidized and the outlying property owners penalized. . . � City Manager Cowden commented on the��Redevelopment Agency and stated that this study does not preclude Urban Redevelopment ..Agency studies in other areas either concurrently .or later. It was �broug.ht out that credit for certain downtown parking lots can possibly qualify for application in other areas once the._credit-:is "'establis.hecl: and�:.if�:.all the credit is not used in downtown rehabilitation. : - ,+ . MOTION: Made by Councilman Denny, seconded by Councilman Doherty _in-structing the Redding Redeveloprnent Agency -and staff to "prepare a Survey and Planning Application for rehabilitation studies of the downtown area. The Vote: Unanimous Ayes. Councilman Chatfield said he felt a review of the . application should be made by Council upon its completion. PUBLIC HEARING - Zoning Text Amendment ; ; The hour of 7 :30 P.M. , having arrived, Mayor Moty opened the public hearing re Zoning Text Amendment �%�J pertaining to B Districts . 174 The following documents are on file in the office of the City Clerk: Affidavit of Mailing - Notice of Pub�c Hearing Affidavit of Publication - Notice of Public Hearing Planning Commission ,Recommendations dated 8/1/66 The City Clerk advised that no written protests had been received and Mayor Moty ascertained there were no protests f rom the f loor. Planning Director Keyes reviewed the recommendations of the Planning Commission and answered questions re front yard and side yard requirements. MOTION: Made by Councilman Doherty, seconded by Councilman Chatfield the Public Hearing be closed. The Vote: Unanimous Ayes . Councilman Doherty offered Ordinance No. 863 for first reading, an Ordinance of the City Council of the City of Redding amending the Redding City Code, 1959, as amended, by repealing _Section 30-16 thereof and sub- stituting a new Section 30-16 pertaining to zoning regulations for B Districts . CI VI C AUDITORIUM r"� � Councilman Denny requested that Mr. Richard Smart be permitted to • make the presentation re letting of bids for the auditorium seating system.� Mr. Smart stated the architects feel it advisable to advertise for bids on the auditorium seating system at this time in order to confirm costs and delivery dates and to obtain"°detailed shop drawings. It is necessary for the architects to know the type of seating to ,be installed in order to proceed with the basic construction plans. Mr. Smart submitted to Council the ,, Instructions to Bidders which included the Notice to Bidders J�j;� and Proposal. The bid opening is set for August 15th. City Manager Cowden said _it is his understanding that wherever you have an EDA grant pending you' cannot cominit yourself for any expenditure for any portion of the grant. If' such a commit�zent .: is made, that portion cannot be included in the grant. Mr. Cowden was- instructed to determine whether a conditional bid will jeopardize the City' s pending EDA grant. MOTION: Made by Councilman Denny, secorided by Councilman Chatfield that the architects be authorized to advertise for seating bids for the auditorium with the understanding that the bidding will be stopped in the event the City Manager advi�ed that to proceed would compromise the City' s application for Federal assistance. The Vote: Unanimous Ayes. PUBLIC HEARING CONTINUED - RZ-12-66, Eureka Way The hour of 8: 00 P.M. , having arrived Mayor Moty continued the Public Hearing on RZ-12-66, Eureka Way. ;fj I� 175 Planning Director Keyes advised that the Planning Commission had reconsidered its previous recommendations on this re- zoning application and now recommended an amendment which is shown on Map Exhibit PC-2 and described in their memo to Council dated August l, 1966. Mre Orr Chenoweth,.. Mr. .Harold Finkler, who represents Mr. Chenoweth, and Mr. Ron Farle.y representing George Farley, were present at the Planning Commission meeting and objected to the current Planning Commission ' s recommendations. � ; The current Planning Commission.' s recommendation includes rezoning of the Chenoweth p.roperty, on the southerly side of Eureka Way approximately opposite the Seventh Day Adventist Church, to an R-1-B-1 District; and zoning the George Farley- property and �two other small properties on the northerly -side of Eureka Way easterly of the Seventh Day Adventist Church to an R-3-15 District. The Planning Depa'rtment recommends that the Chenoweth property and the George Farley pr.operty,. et al. , be zoned R-3-15-B10; Councilmen Denny and Fulton stated that� they �did not _ feel that the Chenoweth property should be zoned R-1-B-1 because of its proximity ;to a busy highway. . Absent: Councilmen - None COMMENDATION - Redding Voluntee-r Fire Department City Attorney Murphy read Resolution No. 3737 ,in full, a resolution expressing appreciation for the donation of a salvage and rescue truck to the City of Reddinq by the Redding Volunteer :Fire Department. ;'lJ v Mayor Moty presented to Fire Chief Grant an appreciation scroll � �� awarded to the Reddirig Volunteer Fire °Department for their generous and public spirited donation of a new salvage and rescue truck with full .equipment for the benefit of the citizens of Redding. Fire Chief Grant accepted the scroll with thanks. 17�i > EMPLOYER - EMPLOYEE RELATIONS - Resolution No. 3683 Maurice Finn appeared before Council and requested two more public hearings on Resolution No. 3683 re employer-employee relations. Mr. Finn stated that there would be a national union boycott of the Civic Auditorium if Council refuses to amend the � resolution and reiterated the objections of his union to said resolution. -..- . Councilman Doherty asked Mr. Finn the specific objections of union to the resolution, and Mr. Finn replied that the union objects to the section which prohibits police officers from joining a labor union u�less it i:s composed solely of peace officers and to the section which prohibits picketing, demonstrating, or striking where work stopgages are. involved. Councilman Chatfield pointed out in support of the clause ,-. about the police officers, that plumbers .joined .the plumbers union, electricians joined electricians .unions, -etc. , and asked . -:--- - what was so different about having police officers join an organization composed solely of police officers. Mr. Chatfield then stated that the .'_no strike"- cl"ause does h,��'�- not apply to the workers -- it applies to the representatives L of the unions. It states that the Union recognizes� that no person, etc. , has the right to impede or halt a performance � of the functions of government Y�y strikes or picketing. Councilman Doherty said he would like to consider the matter further before agreeing to a public hearing.. . - , � � Councilman Denny. said he did not .think a. hearing .woul�d be a valid method .of deciding the issue. �If Council .feels it cannot be sure that it has made the correct decision, he would hope that a cross section of the opinion of the people would. be obtained. If he could be assured that. .Council could avail themselves of a reliable .sampling of public opinion on this matter, he would be influenced by such a survey. Councilman Doherty agreed to an informal -balloting procedure. Councilman Fulton suggested accomplishing this by printing a ballot in the paper .and requesting that the people mail in the ballots. Councilman Chatfield said he wanted to do what the people of Redding want to have done, -but he -is concerned about the. boycott of the auditorium. I�f Gouncil capitulates on this issue, he wonders if the union will use a boycott at a later date for other demands when they are not met.. � Mayor Moty asked Mr. Finn if a straw vote were taken and if a reasonable -percentage of returns were >received, ..and if this vote showed support of Council `s decision .on .this resolution, would his people then be willing to accept this- as the desire of the people of Redding and forget the boycott. Mr. Finn said "NO" the people of Redding do not speak for the members of his -union. Councilman Chatfield said that if he understood Mr. Finn correctly, the union would completely disregard the vote or the outcome of the public hearings and would proceed with the boycott unless Council modified the Resolution. 177 Mr. Finn confirmed this but stated that he felt sure that if the public hearings were held there would be little or no support of the Resolution as it is now written. MOTI��: Made by Councilman Doherty, seconded by Councilman Fulton directing the Maybr, with the assistance of staff, to prepare an impartial straw ballot to be sent to the registered voters in�the Gity of Red"ding, and the pro and con arguments to be prepared by the Mayor and a representative of the labor council, respectively, and the results shall not be considered representative unless there is at least a 60/ response to the mail out. The Vote: Unanimous Ayes. ,. . . . ._. ELECTRIC UTILITY SYSTEM City Manager Cowden advised that R.� W. Beck and Associates, the City' s •electrica�l system consultant� have submitted the following work orders for approval and execution by the City: #WS-2400-DS- CAD, Design Substation and Transmission Facilities and #WS-2400- DS-DAD, ConstruEtion Inspection. Mr. Cowden recommends approval of these work orders. " MOTION: Made 'by Councilman Chatfield, seconded by Councilman -�, i:% Doherty .approving the above. mentioned work orders submitted ✓ by R. W. Pacific �Airlines • � - A communication was received from Sierra Pacific Airlines �dvising temporary suspension of service into and out of Redding, effective August 5th to September 5th. It was -'i�� brought out that this temporary suspension of service will not affect their lease at Redding Municipal Airport; it will continue in force. BUCKEYE COUNTY WATER DISTRICT City Attorney Murphy advised that the joint commi_ttee of. the Buckeye County Water District and the City Council met on Friday evening, July 29th to discuss the feasibility report and proposed Agreement prepared by the finn ��f Orrick, Dahlquist, ��� Herrington and Sutcliffe. Mr. Murphy said ,the letter and agreement were discussed at length and there was dissatisfaction with that portion of the agreement regarding the City taking over the assets. of .the District . subject, to its liabilities prior 178 to the dissolution election. A legal ruling on that point has been sought from special counsel. Mr. Murphy further stated that an opinion is being sought from County Counsel as to the. feasibility of holding the G.O. bond election with the election for acquisition of the district by the City of Redding. There was also a question raised regarding what would happen to the volunteer fire department of Buckeye in the event of a take over of the water system. It was decided to refer this question to special counsel for an opinion.
