Mr. Murp�hy sbated orally�that in�his opinion, the failure of Mottner and McCutchen to provide names and addresses of subcontractors �as to certain small portions of the work, was not a maferial defect and would merely result in comp�lling MoCtner and McGutchen to do those �portions=of� the �work with their own forces pursuant to the provisions of the California Administrative Code, Section 4106, which is part of tlie Subcontracto'rs Fair Practices Act. Mr. Murphy went pn to state that his earlier opinion dated March 4�, 1966, which had been previously distributed to Council, was based on an error in fact concerning the California license of Mottner and McCutchen. Since the time of that opinion, he has been informed by the State Contractors License Board in Sacramento that Mottner and McCutchen hold a California Class A General Engineering Contractors License and as such are properly licensed 66 to perform all construction pertaining to a sewage treatment plant including any electrical work incidental thereto. David Packard, A.ttorney, appeared in behalf of George R. Osborn Const- ruction Co. ? He gave as his opinion that the City Council should not accept the bid of Mottner and McCutchen as a matter of policy and in consideration of the local contractors. Mr. Packard urged Council to reject the bid of Mottner and.McCutchen and award such bid to his client, the second low bidder, George R. Osborn Construction Co. In the alternative, he urged that Council reject all bids on Schedule B and re-advertise. George R. Osborn appeared in behalf of the George R. Osborn Construction Co. , and urged Council to reject the bid of Mottner and McCutchen. He ex- pressed dismay that Mottner and McCutchen could submit a bid stating they would use subcontractors and then be permitted to do the work themselves. He also asserted that thirty craf�s; are involyed in the job and the job cannot be done economically without subcontractors. Glenn Newton, Attorney, appeared in behalf of Mottner and McCutchen and stated that they have been advised by the State Contractors License Board that they hold a valid license to do all portions of the work bia under Schedule B. Mayor Moty stated that he understands that if Mottner and McCutchen failed to list subcontractors, that it is automatic that they shall perform all the work on Schedule B. Since the bid price remains unchanged, iie does not feel the bid has bee.n modified substantially. Council�~nan Fulton expressed concern that the recommendation of the City Attorney had been changed after a few phone calls, and that the City might be open for litigation. MOTION: Made by Councilman Fulton that all bids for Schedule B, be rejected. The motion died for lack of a second. City Attorney Murphy reminded Council that his original recommendation was based on erroneous facts, not the law. He late.r,�earned': that the license of Mottner and McCutchen is adequate. The only change is in factual information. He stated that failure to award the bid to the low bidder could also leave the City open to litigation. He said the defect is immaterial and he �els that if litigation comes as a result of approving the low bid, the City will prevail. Councilman Denny stated his belief that Mottner and McCutchen has not changed their bid but the law has acted to change the bid. At that point, the contractor had no choice but to say they will perform the job with their own forces. THENS A VENUE - Plan Line , City A.ttorney Murphy reported his conclusions re the possibility of abandoning a Plan Line once it has been approved. In his opinion, the City Council was granted authority to create a Plan Line under the State Planning Act. Council also has power�to amend a Plan Line and this includes power to amend it out of existence. A Public Hearing.would be.neces_s,ary, to consider amendments - or variances. •He advised that if the Council adopts the.Plan Line and later determines it is not possible to carry it through and desires a compromise, it will be possible to change it after consideration at a Public Hearing. Mr. Murphy explained the Plan Line establishes .,property right of way over which s�tructures cannot be'built without variance permits. There is no guarantee of a timetable to do the things projected on a Plan Line. , Councilman Doherty stated he is satis.fied-that enough�flexibility remains for future action to change the Plan Line if necessary, He said the Plan Line %jd� Ordinance has proven�itself as a tool that is sound if it is properly used. A communication from Fleischman of California, dated February 28, 1966, offered suggestions for the widening of Athens Ave, without disturbing to any extent the property owners on either side. Mr. Vic Andriatti, one of the owners of Village Plaza Shopping Center s.tated -the owners.want to cooperate so that the project can be completed. . He stated.the Shopping.Center now has - sufficient parking but when other developments are completed, a parking variance might be needed.
