The Pledge of Allegiance to the Flag was led by Finance Director Courtney. Reverend Glen Parks, Pastor of Redding Assembly of God Church, offered the invocation. The meeting was called to order by Mayor Moty at 7:00 P. M. with the following Councilmen present: Chatfield, Denny, Doherty, and Moty. Absent: Councilman Fulton. Also present were City Manager Cowden, City Attorney Murphy, Finance Director and Personnel Director Courtney, Planning Director Harris, Public Works Director Arness, Police Chief Vanderpool, and Assistant City Enginee r Lang�. , APPROVAL OF MINUTES MOTION: Made by Councilman Doherty, seconded by Councilman Denny that the minutes of the adjourned regular meeting of October 23, 1967 and the minutes of the adjourned regular meeting of October 30, 1967 be app,roved as mailed to each Councilman. The Vote: Unanimous Ayes C OMMUNICATIONS Boy Scouts of America A letter of appreciation da.ted October 24th was received from J. Hurley Hagood, Deputy Regional Executive of the Boy Scouts /�.,6 of America, for the hospitality extended by the City to the Boy Scouts who stayed overnight in Redding on their return home from the World Jamboree. Shasta College A communication dated November .2nd was received from a Shasta College representative requesting permission to have the . Shasta College Homecoming Parade on November 4, 1967 from 11:00 A. M. until 12:30 P. M. in downtown Redding. The City Clerk.advised that because of the time element she ascertained that the parade had the approval of officials of Shasta College �3� and that the proposed route had the approval of the Redding Police Department. The City Clerk then polled� the Councilmen by phone regarding this matter and the four Councilmen contacted app roved g ranting the reque st. Councilman Fulton was out of the City and could not be contacted. MOTION: Made by Councilman Denny, seconded by Councilman Chatfield ratifying Council action re approving the request re Shasta College Homecoming Parade. The Vote: Unanimous Ayes Congressman Harold T. (Bizz) Johnson A communication dated .November 3rd was received from Congress- man "Bizz" Johnson concerning Resolution No. 3954 adopted by � J� � Council in support of a tax sharing program. 314 APPROVAL OF CLAIMS AND PAY:ROLL MOTION: Made by Councilman Doherty, seconded by Councilman Denny that Accounts Payable Register No. 9, warrant nos. 289 to 451, inclusive, in the amount of $412, 871. 62 be approved and paid, and Payroll Register No. 9, warrant nos. 12232 to 12472, inclusive, salaries in the amount of $67, 221. 73 for the period October 15, 1967 through October 28, 1967 '�; �, be approved. Noes: Councilmen - None Absent: Councilmen - Fulton SETTLEMENT OF CLAIM FOR DAMAGES City Attorney Murphy advised Council that the Claim for Damages filed by Susan Hulander on September 20, 1967 was settled by the City Insuranc� r"' ' Carrier in the amount of $299. 56. ; ORDINANCE - re mobilehomes and travel trailers and �camping MOTION: Made by Councilman Chatfield, seconded by Councilman Doherty that full reading of Ordinance No. 947 be waived, and the City Attorney be instructed to scan same. The Vote: Unanimous Ayes. Councilman Doherty indicated that he has some concern as to whether the standards set in this ordinance �reflect the standards of the industry. `�c�� Planning Director Harris stated that owners of mobilehome and travel trailer parks were invited to the Planning Commission public hearing on these ameridments to the Code and the one representative who appeared requested adoption of the ordinance. Mr. Harris also noted that the pro- posed amendments had been submitted to the State Agency which enforces State regulations of mbbilehome parks and the Agency found no objections to the amendments. Councilman Chatfield said that he has not withdrawn his objections to this ordinance which he stated at the Council meeting of October 23rd with respect to the minimum 5 and 2 acre lot restrictions, as he does not believe such restrictions are realistic. Mr. Chatfield believes Council should adopt the ordinance recognizing that there may be requests from some persons for variances in this regard. MOTION: Made by Councilman Denny, seconded by Councilman Doherty that Ordinance No. 947 be adopted, an ordinance of the City Council of the City of Redding amending the Redding City Code, 1959, as amended, by repealing Chapter 7 thereof and substituting a new Chapter 7 pertaining to mobilehomes, travel trailers, and camping. Voting was as follows: Ayes: Councilmen - Chatfield, Denny, Doherty, and Maty Noes: Councilmen - None Absent: Councilmen - Fulton Ordinance No. 947 on file in the office of the City Cle rk. The Vote: Unanimous Ayes Councilmen Chatfield and Doherty reiterated their concern re adoption of this ordinance as stated with reference to Ordinance No. 947 above. 315 MOTION: Made by Councilman Denny, seconded by Councilman Doherty that Ordinance No. 948 be adopted, an ordinance of the City Council of the City of Redding amending the Redding City Code, 1959, as amended, by adding to Chapter 30, Section 30-16. 1 and Section 30-16. 2 pertaining to mobilehome and travel trailer parks. POLICY RE. DEDICATION OF OPEN SPACE LxND TO:CITY Councilman Chatfield submitted the Council Committee Report, dated November 6, 1967, re policy on dedication of open space land to the City. The report indicated that there are approximately 2150 acres of land within the City unsuitable for residential development which con- ceivably could be dedicated to the City as open space land. Councilman Chatfield summarized that justification for City owned open space land - must be .demonstrated; i. e. , if the land can be used for recreational purposes or for peripheral or collector streets, then public ownership can be justified as a public benefit. Mr. Chatfield pointed out, however, _>��� that dediaation of these lands to the Cit involves certain liabilities Y ,��i Q and maintenance responsibilities with relation to fire hazards, erosion, and drainage which could affect adjacent land owners. The Committee feels that the first step toward a policy determination should be a study of the possibilities of this land for public uses and its relationship to the Gity General Plan. It recommends.that this be re- ferred to the Planning Commission for a thorough study and recommendation re possible public uses, what areas the City should consider and_what should;be done about those areas which are not recommended for public use. The Committee feels that with the report frozn the Commission, and con- - sidering.factars of maintenance, liability, etc. , the Council would be in a better position to evolve an open space policy. The Committee also be- lieves that Mr. Woods, who instigated the idea of open space land dedica= tion,; should be= encouraged to submit a revised lot split including only the area on which the tentative map has been filed , and those areas which he had proposed for open space could be held by him until such time as these policy deliberations are complete. The .Vote: Unanimous Ayes PUBLIC HEARING - Appeal from Revocation of UP-10-66 . ,�, , - . � The hour of 7:30 P. M. having arrived, Mayor Moty opened the Public Hearing re the appeal f rom revocation of Use Pe rmit /��4�:�1 Application - UP-10-66 ��� :The fol�lowing document is on :file .in the office of the City Clerk: Affidavit of Mailing - Notice of Public Hearing .The City Cle:rk advised that no written protests had been re.ceived, and the Mayor ascertained there were no protests from the floor. 3I6 Planning Director Harris reviewed the action of the. Planning Commission with regard to UP-10-66, stating that.at a public hea ring on Septembe r 26, 1967 the Gommis sion voted to revoke the Use Permit, inasmuch as all of the conditions of approval _ had not been complied with and that further, the building itself was unsafe and apparently did not meet building and fire-safety requirements. . Reference was made to a memorandum from the Building Official to the City Attorney dated Octobe r 3 rd which cited building and fire-safety violations. It was deterxnined that the lessee operating under UP-10-66 does not intend to continue with the operation of the Teen Dance Center ar,d that the need for UP-10-66 no longer exists. The Vote: Unanimous Aye s MOTION: Made by Councilman Denny, seconded by Councilman Chatfield denying the appeal from revocation of Use Permit Application UP-10-66. The Vote: Unanimous .Ayes In reviewing the revocation of UP-10-66, there was a discussion of City water service connection to portions of the Kutras Park area. In a memo to Council dated October 20, 1967, Public Works Director Arness submitted a recommendation whereby certain portions of Kutras Park that are generally commercial in nature; i, e. , the Peppermint Palace, Golf Clubhouse, Dance Hall, and Beach House, could be connected with City water with remaining - portions to be connected at a later date. The basis for computing connection charges under this arrangement is outlined in this memo. This would make it economically feasible for Mr. Spaid to obtain City water for these specific areas. In answer to' Councilman Doherty's inquiry as to whether this approach has been the practice in the past, City Attorney Murphy stated that the City has done� this in two or three instances in the past where only small portions of large parcels were improved. In Mr. Spaid's instance, he has several portions of property which are improved� commercial areas at the present time and other portions that are improved but are not directly producing revenue , such as the beach area. Mr. Murphy said that the Chapter allows the procedure proposed by the Director of Public Works as a discretionary action of Council by providing for the division of large parcels into logical divisible portions. � Mr. Spaid indicated that he is interested in obtaining City water for the aforementioned areas ultimately, but for the present hopes to be able to continue using his well as a source of water supply. � ', Councilman Denriy said he is in agreement with the recommendation of the Director of Public Works and believes that Council should authorize the City Attorney to prepare the necessary agreement with Bob Spaid or Kutras Recreational Park which would permit the development of existing areas as described in the memo of October 20th. Mr. Denny thinks the policy of the City should be one that would encourage some open space areas which are not.bccupied densely by commercial interests, and he believes that the pro- posal of the Director of Public Works would accomplish this. 317 ' �1Vlayor Moty concurred with Councilman Denny, as did Coun- cilman Chatfield who added that he thinks eacli request for water. c�onnection sfiould stand on its own merits. . Councilman Doherty admitted that Mr. Spaid's problem is unique but he is concerned that developers in the future would be interested in payi:ng a connection or front footage fee only for that portion of their property that they intend to develop. Mr. Doherty said he favors proceeding with Mr. Spaid's case as reeommended but would�wish to examine future requests ver.y carefully. - MOTION: Made by Councilman Denny, se'corided by Gouncil•man Chatfield approving tlie recommendation of the Director of Public Works and instructing the City Attorney to prepare an agreement between the City'and Robert'Spaid as outlined in �the memo'of the Director of Public Work's dated' October 20; 1967. It was the recommendation of the City .Attorney that this public hearing.be continued until the meeting of November 20th, inasmuch as escrow has been opened in the office of Attorney Lee Lopez for the sale of the Redding Cab .Company, owned by Freeman Hackett, to Edwin and Aretta.Webb,. providing Council agrees to the transfer of the five vehicle pexmits. Mr. Murphy said he will have.addition- al information by November 20th for Council consideration and it may be possible to abandon the public hearing at that time. City Manager Cowden reported that a representative .of the, International Association of Chief of Police will definitely appear before Council on �.��'� December 4th to give a.detailed report and recommendation re the Redding Police Department. LEASE OF CITY PROPERTY - Wendell Carpenter MOTION: Made ,by Councilman Denny, seconded by Councilman Chatfield approving Lease with Wendell Carpenter for use of City-owned property ,���,) located at the new sewage treatment plant site, and authorizing the Mayor ' to execute said lease on behalf of the City. The Vote: Unanimous Ayes LEASE OF CITY PROPERTY - Alton Chatham MOTIOIV: Made by_ Councilman Cha.tfield, seconded by Councilman Doherty � approving Lease with Alton Chatham for use of City-owned property located �� at new sewage treatment plant site, . and authorizing the Mayor to execute said lease on behalf of the City. The Vote: Unanimous Ayes DEMOLITION OF BUILDING - �New Sewage T reatment Plant Site Finance Director Courtney requested permission to demolish a City-owned structure, known as the "strawberry shed", located on the old Metz Ranch. The building is not being used at the present time, and it is of poor quality. Mr. Courtney advised Council that Mr. Elvie Garrett has submitted the proposal that he will� demolish this structure, remove all salvage material �, � "� and debris from the area, and, in addition, has agreed to.pay to the City '� of Redding the sum of $30. 00. Assistant City Manager Stewart joins the Director of Finance in the recommendation that the offer of Mr. Garrett - be accepted.� .- - MOTION: Made by Councilman Doherty, seconded by Councilman Denny approving the recommendation of the Einance Director and Assistant City Manager re demolition of the "strawberry shed". The Vote: Unanimous Aye s 319 BUCKEYE COUN.TY WATER DISTRICT ; Finance Director Courtney reported that a Trust Account in the amount of $247, ,6.8,0 has been established ,at.the Bank of America pursuant to the terms of. LAFC.O. Res,olution 67-,1 concerning.the, proposed reorganization of the Buckeye County Wa,ter District. Mr. Courtney stated that it was the opinion of .both th.e Bank of,America Trust Officer and City of Redding's Bond Counsel. that Section 3 of.the Joint Resolution mu,st be sati_sfied with the deposit of 100% of the funds ne.eded to re,tire the, princi,pal and interest of the. two outstanding bond issues of ,the Buckeye, County Water District which is calculated at,:$247,.680. :The difference between the un.matured principal in the amount of $1.72, 000 and $247, 680 is interest. Mr. Courtney pointed. out, however,. that the in.tere,st increment of this $247,,680 will be roughly self-liquidating because of the interest income,resulting from the investment of this trust deposit, which will be remitted to the City of Redding .on a monthly.basis. The .principal portion will be returned to �f.�'� the City through the water ,rate base. In answer to Mayor Moty's inquiry as to whether the bonds have an accelerated payment clause, ,Mr,. Courtney said it has been the.thinking that th:ese bonds will be. r.etired as they c.ome, due. Re.garding the re- maining life of the bonds, Mr. Courtney said the las,t bond;r.etirement is scheduled for the 1985-86 fiscal year. Mr. Courtney requested Gouncil to ap,p_rove the transfer of funds from electric utility for this Trust Account. . ,. . Inas- %/�� much as price alone is not the determining factor for award of this bid, repr,esentatives of each company bidding, on this �:sign were inv:ited to make a presentation before Council regarding their proposals. SE WAGE TREATMENT PLANT Public Works Director Arness advised Council that a communication dated October 31, 1967 has been received from the Regional Water.Quality Control Board enclosing a revised tentative resolution which, when adopted, will establish �requirements coverning the nature of waste discharges from ��� the City of Redding. The requirement's set forth in this resolution are � presently under review. A communication was also received from the State Department of Public Health, Bureau of .Vector Control, re gnat control in the Redding Sewage Lagoons. .. _ . 323 RESOLUTION - Legislation re Economic Opportunity Act Mr. Ed Warren .of the Shasta County Community Action Project requested Council to adopt a resolution in support of a Bill before Congress which would authorize the continuance of existing programs under the Economic Opportunity Act. Mayor Moty declared this matter an urgency item. Mayor Moty said he feels progress is being made in the local programs under this Act and urged members of Council to give this matter favor- able consideration.
