The Pledge of Allegiance to the Flag was led by Mr. Maurice Finn. Reverend William He ndrix, Pastor of Christian Church, offered the invocation. The meeting was called to order at 7:00 P. M. by Mayor Moty with the � following Councilmen present: Chatfield, Denny, Doherty, Fulton, and Moty. ��. Also present were City Manager Cowden, Assistant City Manager and Purchasing Director Stewart, Cit.y, Attorney Murphy, Finance Director and Personnel Director Courtney, Planning Director Harris, Public Works Director Arness, Assistant Civil Engineer Hastings, Recreation Director Nelson, and Associate Planner Nebon. APPROVAL OF MINUTES MOTION: Made by Councilman Chatfield, seconded by Councilman Fulton that the minutes of the regular meeting of June 19, 1967, and of the ad- journed regular meeting of June 30, 1967 be approved as mailed to each Councilman. The Vote: Unanimous Ayes With the approval of Council, Mayor Moty scheduled an informal meeting to be held at 4:00 P. M. , Friday, July 14th to hear the presentation of � Mr. Maurice Finn, Business Representative, Building Services Employees International Union, Local #22, re proposals for salary increases for City employees he represents. COMMUNICATIONS Republican Central Committee of Shasta County MOTION: Made by Councilman Doherty, seconded by Councilman Chatfield approving the request of the Republican Central Committee of Shasta County to use Lake Redding Park on August 13th for a fund raising event as outlined in their letter of June 29th, subject to the �-a`'� usual requirement re filing of certificate of insurance with the City Clerk. The Vote: Unanimous Ayes 170 The Active 20-30 Club of Redding MOTION: Made by Councilman Chatfield, seconded by Councilman Doherty approving the request of The Active-20-30 Club of Redding to sell beer at the Redding Softball Association Tournament to be held on July 22nd and 23 rd, as outlined in their lette r of June 20th, ���Z subject to the usual requirement re filing of certificate of insurance with the City Clerk and subject to the condition that the Club immed- iately clear away the debris after the close of the tournament . The Vote: Unanimous Ayes Central Valley Regional Water Quality Control Board A communication dated June 26th f�rom the Regional Water Quality Control Board states that the discharge from the City's sewage treatment plant is in compliance with the Board's requirements, according to a recent inspection. Also received was a copy of �`�� Resolution No. 67-171 as adopted by the Central Valley Regional 111ater Quality Control Board which rescinds the Cease and Desist Order issued previously. Buckeye County Water District In a letter to Council dated July 5, 1967, a group of interested citizens posed the following questions regarding the Buckeye County Water District: �/�� l. Would the Redding City Council be in favor of annexing the entire Buckeye County water and sewer district? 2. Would the Redding City Council be in favor of annexing only the area in the Buckeye County water district, which includes only the Twin View Sewer District? . 3. Would the Redding City Council be in favor of only annexing the Twin View Area to the City of Redding? Mayor Moty said his answers are "Yes" on all three possibilities. Councilman Chatfield said his answers are also "Yes" on all three questions, but he would want one qualification; i, e. , in the case of annexation of the entire District that the water district be dissolved and in the case of partial annexation that the water district be de- tached. Councilmen Doherty and Denny stated they would be agreeable on all three questions, providing there is an understanding on the part of the people desiring annexation that there are certain limi- tations as to the City's ability to immediately extend electrical , power and other city services because of budget limitations. Shasta County Sheriff's Posse-ettes MOTION: Made by Councilman Fulton, seconded by Councilman Doherty that the request received from the Shasta County Sheriff's Posse-ettes dated June 20th for the use of one block of Butte Street between Market and California Streets on Thursday evening, .August /�� 24th and all day Friday, August 25th, be returned to the Posse-ettes with a request for more details for plans for Friday and statements from the merchants on this portion of Butte Street that they are in favor of closing the street as requested by the Posse-ettes. The Vote: Unanimous Ayes 171 West Coast Shows Communications were received from West Coast Shows and from the _Village Plaza Merchants Association dated June 29th requesting permission for West Coast Shows to operate 10 amusement rides for a period of 5 days, July 26th through July 30th on a portion of the extreme south end of the Village Plaza Shopping Center. Mr. Bill Kennedy, President of the Village Plaza Merchants Association, appeared before Council and answered questions regarding this re- _,��� quest. MOTION: Made by Councilman Ci�atfield, seconded by Councilman Denny approving the request of West Coast Shows to operate 10 amusement rides at the Village Plaza Shopping Center for the per- iod July 26th through July 30th, subject to the time limits and other conditions specified in their letter of June 29th ancl subject to care- ful control of the disposal problems. The Vote: Unanimous Ayes PUBLIC HEARING - Appeal of Use Permit UP-41 -67 The hour of 7:30 P. M. having arrived, Mayor Moty opened the Public Hearing re Appeal of Use Permit UP-41 -67 The following document is on file in the office of the City Cle rk: Affidavit of Mailing - Notice of Public Hearing � The City Clerk advised no written protests had been filed and the j���/� Mayor ascertained there were no protests from the floor. The City Clerk advised Council that a communication hacl been received advising that the Applicant was withdrawing the applica- tion for the Use Permit. MOTION: Made by Councilman Fulton, seconded by Councilman Denny that the Public Hearing be closed. The Vote: Unanimous Aye s MOTION: Made by Councilman Doherty, seconded by Councilman Chatfield formally accepting the withdrawal of the Use Permit Application without prejudice. The Vote: Unanimous Ayes COMMUNICATIONS - continued Cypress Street Bridge Widening A communication was received frorn the California Highway Commission dated June 29th advising that the Commission had ���� voted that the re be included in the State Highway Budget funds for the State's share of the cost of widening the Cypress Street B ridge. 5th Annual Invitational Parade of Counties An invitation to participate in California's 5th Annual Parade of Counties in Griclleyon August 26th was received. /��l"h MOTION: Made by Councilman Doherty, seconded by Councilman Chatfield that this invitation be acknowledged , stating that the City of Redding will be unable to participate this year in the interest of economy. The Vote: Unanimous Ayes 172 Redding Police Association A communication from the Redding Police .Association dated July 6th re salary increases and working conditions was filed ���� by Council for study and it will be considered later. If Staff � members have any rebuttal to this communication, Council would appreciate hearing them at the appropriate time. Hazel Millen - Linden Avenue Improvements Planning Director Harris briefly reviewed a communication received from Hazel Millen, stating that she is interested in developing he r prope rty located s outh of B enton Field at the western end of Linden Avenue, in connection with a low-cost housing rent supplement project propo'sed by the Central Labor '��s, Council. Mr. Harris said it is his understanding that HUD has indicated the improvement of street access into the area is needed and Mrs. Millen is now ask�ing Council if the City will participate in improving Linden Avenue. Mr. Harris recommended that the � letter be referred to a Council-Staff Committee for study and recommendation. MOTION: Made by Councilman �Denny, seconded by Councilman Chatfield approving the recommendation of Planning Director Harris. The Vote: Unanimous Ayes Mayor Moty appointed the following persons to the Committee: Councilmen Chatfield and Fulton, City Manage r Cowden, City Attorney Murphy, Finance Director Courtney, Planning Director Harris, and Public Works Director Arness. Redding City Fi remen A communication from William Braun, Attorney representing Redding City Firemen, re salaries and working conditions was �� filed by Council for study, and Staff inembers were advised that Council would appreciate hearing any rebuttals at the appro- priate time. Applications for Cab Driver Permits City Attorney Murphy submitted applications for Cab Driver Permits for Cindy Thomas and Henry Haselbusch, explaining that although the provisions of the Redding City Code stipulate that such applica- tions must be approved by Council in writing this procedure has not been followed; however, the Clerk's office has required that each applicant be fingerprinted and cleared through the Police Department prior to issuing a permit. This ,procedure has resulted in applicants �(`� having to wait from two to four weeks to obtain their permits, until their fingerprints cleared. Mr. Murphy stated that both he and the Chief of Police are agreeable to using the application form prepared by the City Cle rk and is suing the pe rmit afte r approval by Council, subject to the condition that, if a check of the fingerprints reveals that any false statements were made by the applicant, the permit will be revoked and the applicant will be prosecuted. During a discussion of this matter it was suggested that the City Attorney redraft Chapters 18 and 28 of the Code to provide proper controls re issuance of vehicle and cab driver permits. 173 MOTION: Made by Councilman Doherty, seconded by Councilman Denny approving the applications for cab driver permits for Cindy Thomas and Henry Haselbusch with the condition that the permits will be withclrawn and the applicants prosecuted if a check of their fingerprints reveals that any false statements were made on the applications. The Vote: Unanimous Ayes Buckeye County Water District A communication dated July 7th was received from the Local Agency Formation Commission advising that the Commission meets on July 12th and stati'ng that the City should be prepared to advise th'e Commission re its position as to the percentage of current indebtedness which will be attributed to•the incorpor- ated area of the Buckeye County Water District and assumed by the City. ��, City Attorney Murphy submitted a memo to Council dated July 7th in which he recommended that Council authorize its represen- tative to present a position to the effect that the City is willing to stand by its original representations (assume 23°jo of the bonded indebtedness, based on assessed valuation of the property in the incorporated area) as contained in the original Joint Powers Agree- ment, but that the City agrees with the LAFCO approach (assume 8% of the bonded indebtedness, based on water usage) and that there- fore the LAFCO amended reorganization resolution should remain unalte red. In a discussion of this item it was brought out that the original offer of the City was based upori th'e total terms and'conditions of the original Joint Powers Agreement, which was signed only by the City, and therefore constitutes an unaccepted offer. Mr. Murphy stated that the Board of Supervisors has the right to propose an amendment'to the LA�FCO Resolution and refer the matte�'r back to"i;AFCO and, as th�ey=have asked LAFCO to clarify the'above matter, it is possible that the Board will recommend that the LAFCO Resolution be amended to require an assumption based upon assessed valuation rather than upon water usage. Mayor Moty said he� feels the City has answered the question by accepting the LAFCO Resolution. He stated that the City's position is spelled out in the LAFCO Resolution as it now stands and that any chariges made to this� resolution would have to=come back to Council for consicleration and approval. Planning Director Harris submitted the recommendation of the Planning Commission that a portion of the Freebridge and East- side Road Annexation be rezoned as shown on Exhibit PC-1. The area is bounded on the north by Cypress Avenue, on the west by the A. C. I. D. Canal, on the south by Radio Lane, and on the east by the Sacramento River. Mr. .Harris reviewed the. proposed zoning on the Vu Graph, stating that the zoning was initiated by the Planning Commission; however, in April 1967 a petition was submitted to the Commission requesting that a portion of the Eastside Road Annexation be given urgent consideration for zoning. Assistant Civil Engineer Hastings .b.riefly review.ed the project, stating that the petition for the Assessment District contained a 100% signup and that the original cost estimate for the project was $5, 060 but, because of favorable contract prices, the total cost was reduced to $3, 720. 26. Planning Director Harris. reviewed ,the recommendation of the. Planning Commission that the zoning of. the subject property remain in the R-3-15 classification and that the application submitted by i��� Martin Kaufman be denied. The area involved was shown on the Vu Graph. The recommendation is based on the following points: 1) The existing R-3-15 zoning acts as a buffer between the more intense zoning to the north and to the south; 2.) Zoning the front half of the property to GO-BR would violate the gene ral planning principle of not splitting a lot by zoning; 3) Approving the request.for CO-BR at thi,s location would create -- a c.ontinuous stri,p zone�,from the north. end of Athens along Pa'r.k Ma rina ID rive s outh tb the inte rs e ction of Pa rk Ma rina and Washington and would further intensify the problem of commercial zoning across the street from R-1, single-family zoning. - - � Martin Kaufman appeared before Council and said he ,objected to the restriction --. he is hemmed in on both sides by CO-BR zoning: He ,further,.stated h.e,has no. othe.r use for the property a,s he has built as m�uch .multiple housing as the area wi11 absorb. He pointed out that a natural lagoon separates the requested CO-BR zoning from the multiple units. 176 Councilman Fulton inquired� as to what use he would .make.of. the property if it were zoned CO-BR, and Mr. Kaufman replied that he would be able to develop the prope rty in office buildings of some type, something that would blend in with the residential attitude. • • Mayor Moty sa.id it appears that Council made a mistake when it approved CO-BR zoning across the street from R-1. � Councilman Fulton said that in view of Mr. Kaufman's presenta- tion he thinks Council is denying him the use of his property. Also, in view of the fact that Mr. Kaufman presented to the City, free and clear, a strip 30' wide for widening of Park. Marina Drive, he would like to recommend that Council overrule the Planning Commission recommendation and that the area be rezoned CO-BR. Councilman Denny said he agrees with Councilman Fulton and that he can't grasp the value of the reasons offered for denying the application. It is his feeling that this type of development is app rop riate f o r rive rf ront p rope rty. City Attorney Murphy advised Council that it has the power to consider rezoning the two parcels presently zoned CO-BR or instruct the Planning Commission to consider rezoning these parcels as they are unimproved. The Planning Commission did not discuss this possibility. Councilman Doherty asked Mr. Kaufman if he had a definite plan for buildings on this property and Mr. Kaufman replied he has definite plans but will build the units as he knows the demand exists. Councilman Doherty asked Mr. Kaufman if he had any objection to controlled building, stating that he had in mind R-4 zoning which would allow office uses by use permit. City Attorney Murphy advised Council that the most practical method of control would be to leave it in the present zoning and the applicant could apply for a variance or to zone the property R-4 which requires a use permit for office uses. � Councilman Chatfield said he would object to R-4 zoning in this area as�it does not limit height or require architectural control. He also commented that he does not think Thames Drive is suitable for R"-1 zoriing. : MOTION: Made by Councilman Denny, seconded by Councilman Fulton that the Public Hearing be closed. A 'discussion ensiied as to the City's liability in � ��3 instances of this type and the City Attorney was requested to ascertain from the Insurance Carrier their reasons for denying the claim. Councilman Doherty said that before taking any favorable action on this type of claim he would like to know if the City could get coverage for exposures of this type. . , � _ . SWIM SIGNUP - Councilman Fulton asked Recreation Director Nelson for an explanation of the difficulty encountered in the signup for swimming�clas'ses this year, Mr. Nelson explained that there were many contributing factors, including an increase in the number of people signing up for classes, lack of ade- ��� quate publicity regarding the signup, the desire of individuals for favor- able positions, and the policy of the Department in giving tickets and re- ceipts. REDDING TEENCENTER DANCES John Ealy appeared before Council and requested permission for the L/� �/ Redding Teencenter to conduct dances on Friday nights from 9 to 12 � P.
