SUBJECT: 4.11(d)--Award Bid Negotiation No. 5609 Canter Court Sewer Project
Recommendation
Authorize and approve the following actions relative to Bid Schedule No. 5609 Canter Court
Sewer Project:
(1) Award to Axner Excavating Inc. in the amount of$273,456;
(2) Approve an additional $89,500 to cover the cost of administration and inspection fees;
(3) Approve $142,000 for project development costs;
(4) Approve $40,000 to provide construction contingency funding; and
(5) Authorize the City Manager, or designee, to approve additional increases in either the
construction management or construction contingency amounts up to a total of$25,000.
Fiscal Impact
The Canter Court Sewer Project (Project) is being funded by the City of Redding's (City)
Wastewater Utility. The Wastewater Utility has a sufficient capital outlay budget in fiscal year
2024-25 for this project and funding the project wi11 not impact other activities or projects.

Project cost components are estimates and some shifting of the project development,
construction management, and construction contingency funds may be necessary to balance the
project within the approved budget.

Alternative Action
City Council may choose not to award the bid for the project and provide staff with alternate
direction. If the project is not awarded, then the service life of the sewer main could be reduced,
decreasing reliability for City customers and increasing potential risk of sanitary sewer overflows
into Churn Creek.
Background/Analysis
The current sewer main crossing under Churn Creek is made of an acrylonitrile butadiene styrene
(ABS) material susceptible to becoming brittle, cracking and breaking over time. This could lead
to leaks and other problems in the sewer system.
The project incl�udes rehabilitation of the sewer manholes, incl�uding coating the interior with
epoxy, replacing the ABS sewer siphon main with High density polyethylene pipe (HDPE) pipe
and repairing the a11-weather road to provide access to the manholes. HDPE pipe offers
excellent durability, resistance to corrosion and chemicals, flexibility, strength impact resistance,
and long service life.
Attached is a tabulation of bids received and opened on J�uly 17, 2025, for construction of the
project. The low bid in the amount of $273,456 was received from Axner Excavating Inc. of
Redding, California. The engineer's estimate was $238,370. Total project development costs are
estimated to be $142,000. Project development costs include engineering, right of way and
environmental for the project.
EnviNonmental Review
This action, bid award, is not a project as defined by the California Environmental Quality Act
(CEQA). On October 15, 2024, City Council adopted the Mitigated Negative Declaration and the
Mitigation Monitoring and Environmental Commitment Program; and approved the Canter Court
Sewer Project, thereby satisfying the requirements of the CEQA Guidelines §15074. No further
action is required.

Recommendation
Approve and authorize the following actions relative to the City of Redding Canter Court Sewer
Proj ect:
(1) Adopt the Mitigated Negative Declaration and the Mitigation Monitoring and
Environmental Commitment Program; and
(2) Approve the Canter Court Sewer Project as described, thereby satisfying the requirements
of the California Environmental Quality Act Guidelines §15074.
Fiscal Impact
Approval of the Canter Court Sewer Project (project) along with adoption of the Mitigated
Negative Declaration (MND) and the Mitigation Monitoring and Environmental Commitment
Program (MMP) allows the project to move toward the final design and construction phases.
There is no f scal impact as a direct result of adopting the MND, MMP, and approving the
proj ect.
The project is estimated to cost approximately $290,475 and as budgeted, will be funded th,rough
the Public Works Wastewater Utility fund.
Alternative Action
The City Council (Council) may choose not to adopt the MND and the MMP, and not approve
the project as described. Without approval, the project would not be able to proceed as a City of
Redding (City) project, as it would not be in compliance with the California Environmental
Quality Act(CEQA).

Background
This project will replace two, 6-inch sewer siphons along Churn Creek in southeast Redding.
Replacement of the siphons are needed to address the deteriorating and failing pipes. The project
is located on City-owned property west of Canter Court and east of Cambria Drive.
This project consists of the removal and replacement of the two existing 348-foot-1ong, 6-inch-
diameter concrete-encased sewer siphons. The siphons would be excavated and replaced in the
same alignment. An open-trench method requiring a work area approximately 20-feet wide and
an excavation depth of approximately 12-feet is anticipated be used along the entire length of
pipe to be replaced. The total length of the trench is estimated to be 348-feet in length, including
an estiinated 83-foot Churn Creek crossing. The two existing 6-inch-diameter acrylonitrile
butadiene styrene siphon pipes will be removed and replaced with new 6-inch-diameter high-
density polyethylene (HDPE) pipes. Work also includes the removal, replacement, and
rehabilitation of three manholes.
The existing 10- to 12-foot-wide maintenance access road accessed via Cambria Drive will be
improved by adding gravel to create an all-weather maintenance access. Additionally, a 120-
foot-long by 25-foot-wide permanent easement will be obtained to accommodate a portion of the
improved maintenance road.
An Initial Study (IS) was prepared to satisfy the requirements of CEQA. It describes why the
Project is being proposed and the potential impacts to the existing environment. The IS shows
that the proposed Project could have a significant effect on biological resources, but with
implementation of mitigation measures, those impacts will be reduced to a level considered less
than significant. The mitigation measures and conservation measures to be implemented are
common practices and include but are not limited to biological pre-construction surveys, in-
water work windows, impact minimization, exclusionary fencing, and erosion control.
Based on the conclusions made in the IS, an MND was prepared. The MND describes the
project, including mitigation measures, and makes the determination that there will be no
significant effect on the environment provided that the defined mitigation measures are
implemented as part of the project. In addition, an MMP has been written and incorporated into
the MND (CEQA Section 21081.6). The MMP will be used by City staff, contractors, agencies,
and monitoring personnel during and after the project to ensure effective implementation of the
adopted mitigation measures outlined in the MND.
The IS/MND/MMP documents were sent to the State Clearinghouse for a 30-day public review
period and distribution to pertinent state agencies. They were sent to local resource agencies, the
Shasta County C1erk, and posted on the Public Works Department website. A public notice was
also sent to landowners in the vicinity of the project and posted in the local newspaper. No
comment letters were received during the state ag�ncy or public review periods.
Environmental Review
Pursuant to CEQA, the City is the lead agency for the project. As the lead CEQA agency, the
Council is authorized to adopt the MND per Redding Municipal Code Seetion §18.24.070.E and
state law. Upon adoption of the iVTND and approval of the Project by the Council, a Notice of
Determination will be filed with the Shasta County Clerk's Offiee and the State Clearinghouse,
completing the environmental review process.

NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION FOR THE
CANTER COURT SEWER PRC}JECT
Notice is hereby given that the public is invited to review and comment on the Initial Study (IS) and
proposed Mitigated Negative Declaration (MND), pursuant to the California Environmentai Quality Act
(CEQA), for the proposed Canter Court Sewer Project (project). The proposed Mitigated Negative
Declaration does not si�nify approval or disapproval of this projeet. The City of Reddin�will consider the
proposed Mitigated Negative Declaration together with any comments received during the public review
process to de�ermine whether the proposed project should be approved as proposed, if additional studies
are required, or if the project sllould be deferred.
The project is in south-central Redding, Shasta County, California. The project site is located along the
existing City access easement on the west, on the west and east side of Churn Creek, and withii7 the Churn
Creelc streambed. The projeet sites are located in the Redding Quadrangle at Township 32 north, Range 4
west, Section 31; Township 32 north, Range 4 west, Seetion 8 (latitude 40.552698°,longitude 122342549°
at the approximate center point of the project sites).

PROJECT DESCRIPTION
The City of Redding(City)is proposing the Canter Court Sewer Project in the City of Redding, Shasta
County, California. The purpose of the project is to replace two existing sewer siphans that run under
Chur�1 Creek. Replacement of thes�siphons is ne�ded to address age-related deterioration.
The project would consist of the removal and replacement of the�wo existing 348-foot-long, 6-inch-
diamcter concrete-encased sewer siphons across Churn Creek. The siphons would be excavated and
replaced in the same alignment. An open-trench lnethod requiring a work area approximately 20 feet wide
and an excavation depth of approximately 12 feet would be used along the entire length of pipe to be
replaced. The two existing 6-inch-diameter acrylonitrile butadiene styrene siphon pipes would be
removecl and replaced with new 6-inch-diameter high-density polyethylene pipes in the same alignment.
New pipe sections would be placed iis the trench, fused together, and connected to inanholes on both ends
of the pipeline. When completed,the trench would be backf'illed with slurry and a eoncrete eap to prevent
erosion during high winter flows. The disturbed stream channel bed and bank would be returned to its
original contours and seeded witl�a local native seed inix. Work also includes the removal af one
manhole,the replacement of one manhole, and the rehabilitation of a third manhole. The old siphon pipes,
the removed manhole material, and th��xcavated earthen materiai would be talcen to a landfill.
Construction is expected to require one construction season(July 1 through October 31}beginning in
suminer 2025.
ENVIRONMENTAL SETTING
The project area is located in a narrow band of open space and is centered on Churn Creek, an intermittent
stream.Natural riparian habitat is situated on either side of the stream. The op�n space is bounded by
residential neighborhoods to the east and west. Each neighborhaod includes a connection road to the open
space and project area.
FINDINGS AND DETERMINATION
The Ciry of Redding conducted an Initial Study(attached)that det�rmined that the proposed project could
have significant environmental effects on biological resources. Impleinentation of specific mitigation
measuras identified below will avoid or mitigate the potentially signifieant environmantal effects
identified, and the preparation of an environmental iinpact report will not be required. If there are
substantial changes that alter the eharacter or iinpaets of the proposed project, another environlnental
impact determination will be necessary.

Prior to approval of the project,the lead age�ncy may conclude, at a public hearing,that certain mitigation
measures identified in the Mitigated Negative Declaration are infeasible or undesirable. In accordance
with California Environmental Quality Act(CEQA) Section 15074.1,the lead agency may delete those
mitigation measures and substitute other measures that it determines are eQuivalent or more effective. The
lead ageney would adopt written findings that the new ineasure(s) is(are) equivalent or more effective in
mitigating or avoiding potential significant effects and that it wouid not cause any potentially significant
effect on the environment.
1) Based on the whole record(including the Initial Study and any supporting doculnentation) and tl�e
mitigation measures incorporated into the proj�et,the City of Redding has determined that there is no
substantial evidenc�that the proj�et will have a significant�ffect on the environment.
2) The Mitigated Negative Declaration,with its supporting doculnentation,reflects the independent
judgment and analysis of the lead agency, which is the City of Redding.
DOCUMENTATION
The attached Initial Study documents the reasons to support the above determii�ation.
MITIGATION MEASURES
The following mitigation measures will be incorporated into the project to minimize potential effects on
biological resources:
MM-1. All in-water work shall occur during July 1 �o Oetober 31 to avoid poak times wh�n listed
juvenile anadromous fish would be present.
MM-2. Before dewatering,there will be a visual inspection for fish presence. If fish are noted, they will
be herded away from the work area,using seines if possible, and pi-evented from i-eturning to the area
using block nets.
MM-3. Enviraiunental awareness training for construction personnel will be conducted by a quali�ied
biologist prior to onset of work to brief theln an how to recognize Northwestern pond turtle and the
appropriata avoidanee measures.
M1VI-4.Twenty-four hours prior to initiation of ground disturbanee or vegetation removal, a qualified
biolo�ist sllall perform a pre-construction survey for western pond turtle and�heir nests. If westenl pond
turtles are encountered in the project area durin�construction and could be har�ned by construction
activities, work will stop immediately in the area and the individual turtles will be allowed to move away
on their own aceord. If a Northwestern pond turtle nest is found, a qualified biologist(in consuitation with
the CDFW and USFWS)will determine the extent of a eanstruction-free buffer zone to be established
around the nest.
M1VI-5. Tf construction or vegetation removal occurs during the nesting season, February 1 thraugh
August 31 for birds and November 1 through July 15 for raptars, a qualified biologist sha11 conduct a
preconstruction survey to locate aetive nests.Th�pre-construction survey will ba performed no more than
7 days prior to the implementation of eonstruetion activities. Tf a lapse in construetion activities oceurs for
7 days or longer, another pre-construction survey wi11 be pe�•formed. If an active nest is found, a qualified

biologist(in consultation with the CDFW)wi11 determine the extent of a buffer zone to be established
around the nest.
MM-6.To the extent practicable,removal of large trees with cavities, crevices, or snags shall occur
before bat maternity colonies fornl(i.e,,prior to March 1) or after youn�;are volant(i.e.,
after A�ugust 31). If eonstruetion(incl�uding the removal of large trees) oceurs during the bat
non-volant season(1VTarch 1 through August 31), a quali�ed professional shall eonduet a
pre-constructian survey of the study area to locate maternity colonies and identify measures
to prot�ct colonies from disturbance. The preconstruction survey will be performed no more
than'7 days prior to the implementation of construction activities. If a maternity colony is
located within or adjacent to the study area, a disturbance free buffer shall be established by
a qualified professional, in consultation with CDFW,to ensure the colony is pro�ected fron�
project activities.
MM-7.To the extent practicable,removal of riparian brush will occur outside of the maternal
denning period(i.e.,July 1—Apri130). If vegetation removal is to oecur during the maternal
denning period(May 1—June 30), a qualified biologist will conduct a preconstruction survey of the study
area to locate inaternity dens and identify mcasures to protect the maternity dens from disturbance. The
preconstruction survey will be performed no more than seven days prior to the vegetation removal.
MM-8. High visibility�encing,flagging, or markers will be installed along the edges of the work zone
near cuiturally sei�sitive zone to prevent damage or unauthorized access.

MITIGATION MONITORING PROGRAM CONTENTS
This document is the Mitigation Monitoring and Enviromnental Commitment Program(MMP/ECP)for
the Canter Court Sewer Project(project). The MMP/ECP includes a brief discussion of the legal basis for,
and the purpose of,the program, discussion, and direction regarding complaints about noncompliance; a
key to understanding the monitoring matrix; and the monitoring matrix.
LEGAL BASIS OF AND PURPOSE FOR THE MITIGATION MONITORING PROGRAM
California Public Resources Code Section 21081.6 requires public agencies to adopt mitigation
monitoring or reporting programs whenever certifying an environmental impact report(EIR) or a
mitigated negative declaration(MND). This requirement facilitates implementation of all mitigation
measures adopted through the California Environmental Quality Act(CEQA)process.
The MMP contained herein is intended to satisfy the requirements of CEQA as they relate to the Initial
St�udy/Mitigated Negative Declaration prepared for the project. It is intended to be used by City of
Redding(City) staff,participating agencies,project contractors, and mitigation monitoring personnel
during iinplementation of the project.
Miti�;ation is de�ned by CEQA Guidelines Section 15370 as a measure that does any of the following:
■ Avoids im�pacts altogether by not taking a certain action or parts of an action.
■ Minimizes impacts by limiting the degree or magnitude of the action and its implementation.
■ Rectifies impacts by repairing,rehabilitating, or restoring the impacted environment.
■ Reduces or elim.inates impacts over time by preservation and maintenance operations during the life
of the proj ect.
■ Coinpensates for impacts by replacing or providing substitute resources or environments.
The intent of the MMP is to ensure the effective implementation and enforcement of adopted mitigation
measures and permit conditions. The MMP will provide for monitoring of construction activities as
necessary, onsite identification and resolution of environmental problems, and proper reporting to City
staf'f.
In addition to meeting the CEQA MMP requirements,this document incorporates environmental
colnmitments, standard practices, conservation measures, and best management practices (B1VIPs). The
environmental commitments may be part of the project design, standard contract specifications, City
requirements, or conservation measures. These commitments are part of tbe project,but they do not
constitute mitigation under CEQA as they have not been incorporated to reduce a potentially sigt�ificant
im�pact.

NONCOMPLIANCE COMPLAINTS
Any person or agency may file a complaint asserting noncompliance with the mitigation measures and
commitments associated with the project. The complaint shall be directed to the City in written form,
providing specific information on the asserted violation. The City sha11 investigate and determine the
validity of the complaint. If noncompliance with a mitigation measure has occurred,the City shall take
appropriate action to remedy any violation. The compliant shall receive written confirmation indicating
the results of the investigation or the f`mal action corresponding to the particular noncompliance issue.
