SUBJECT: 4.11(e)--Resolution Summary Vacation of a Public Service Easement (A-2025-
00333)
Recommendation
Authorize and approve the following actions relative to the Summary Vacation of a Public
Service Easement (A-2025-00333):
(1) Adopt Resolution summarily vacating Public Service Easelnent "B" within Parcel 4 of
Parcel Map (PM-2016-00'7"71) as described in Exhibit A and depicted in Exhibit B;
(2) Find the action consistent with the General Plan; and
(3) Find the action categorically exempt from environmental revietiv under the California
Environmental Quality Act Guidelines, pursuant to Section 15035 - Minor Alterations in
Land Use Limitations.
Fiscal Impact
Adopting the Resolution will have no fiscal impact.
Alte�native Action
The City Council (Council) may choose not to adopt the Resolution and leave the Public Service
Easement in place.
BackgNound/Analysis
Parcel Map PM-2016-00771 dedicated 20-foot-wide Public Service Easement "B" (PSE) across
Parcel 4 to accommodate an 18" Storm Drain Pipe. The owner of Parcel 4 has submitted an
application for abandonment of the PSE in order to accommodate proposed improvements that
would encroach upon the PSE. The owner has agreed to take responsibility for all maintenance
of the drainage facilities and to keep them free and clear of obstructions.

The PSE can be determined to be excess and eligible for summary vacation per Streets and
�Iighways Code 8333 as the facilities are now considered to be private. The summary vacation of
the PSE is consistent with the General Plan as it will reduce maintenance needs of public
facilities; encourage design consistent with the surroundings; and wi11 not preclude uses
consistent with current zoning.
Environmental Review
Staff has reviewed the action and determined that the activity is categorically exempt from
environmental review under the California Environmental Quality Act Guidelines, pursuant to
Section 15305 (Minor Alterations in Land Use Limitations). The Class 5 exemption allows for
minor alterations to land use limitations, as long as the average slope on site is less than 20
percent and would not result in any changes in land use or density. This action will not result in
the creation of any new parcels, nor wi11 it change land use density. The existing General Plan
and Zoning land use designations would remain as they currently exist and the average slope
does not exceed 20 percent. In addition, the project area does not have significant values for
wildlife habitat or other environmental resources. The action has no potential to have a
significant impact on the environment.
The Resolution has been approved as to form by the City Attorney.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE CITY'S INTEREST IN PUBLIC SERVICE
EASEMENT "B" WITHIN PARCEL 4 AS SHOWN ON PARCEL MAP PM-2016-
00771, FILED MARCH 22, 2017 IN BOOK 39 OF PARCEL MAPS, PAGE 46,
SHASTA COUNTY RECORDS(ABANDONMENT APPLICATION A-2025-00333)
WHEREAS:
A. Public Service Easement"B"being considered for summary vacation was acquired by dedication
by Parcel Map PM-2016-00771 filed in Book 39 of Parcel Maps at Page 46,Shasta County Records
and is described in Exhibit "A" and shown on Exhibit "B" attached and made a part hereof by
reference.The owner of the adj acent parcels has asked that the City vacate Public Service Easement

B. Storm drain facilities within Public Service Easement`B"are private;therefore,the Easement may
be determined to be excess and eligible for summary vacation.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS
FOLLOWS:
1. The recitals set forth above are true, correct and are hereby adopted as findings of fact.
2. Pursuant to Streets and Highways Code 8333(c), the City Council determines Public Service
Easement"B"to be excess and is unnecessary for present or prospective public use.
3. The City Council approves the request to smnmarily vacate Public Service Easelnent `B" within
Parcel4 as shown on Parcel Map PM-2016-00771 filed in Book 39 of Parcel Maps,Page 46,Shasta
County Records, as described in Exhibit"A"and shown on the attached Exhibit`B."
4. The vacation of Public Service Easement`B"is consistent with the General P1an. This action will:
reduce maintenance needs of public facilities; encourage design consistent with the surroundings
and will not preclude uses consistent with current zoning.
5. The vacation of Public Service Easement"B"qualifies as Categorically Exempt from environment
review under the California Enviromnental Quality Act Guidelines Section 15305 — 1Vlinor
Alterations in Land Use Limitations. No changes in land use or density will occur and areas
affected contain an average slope of less than 20%. There is no possibility that this action will have
a significant impact on the environment.
6. The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested by the
Clerk under seal,to be recorded in the Off'ice of the Shasta County Assessor/Recorder.
