Sect�on l. Redding Municipal �ode Title 2 (Administration and Personnel), Chapter
56 (Cammunity Services Departznent}, is arnended to read as follc�ws:
2.56.010-Definitions.
As used in this chapter:
��City" means the city c�f�.edding,
"City event" means any event under the direct management and cantrol of the department
whereby temparary exc�usive use of park facilities is utilized for those pa�ticipating in city
recreation programs:
"Concession"' means the sale or distributian of goods r�r services approved by a cantract or the
directc�r pursuant ta Section 2.5�.0'7{}t�fthis code:
'"Director'" means the director of carnmunity services.
'�I)�partrnent'" means the community services departrnent'.
"Event"' means any org�nized recreatic�n activity,
"Park facility'" means any body of water, land,trail, open space, archeological site, skate park,
building, structure, other appurtenance orurr�d by th�city and managed,contralled c�r operated �y
the department,including the gro�nds of the Redding civic auditorium.
"Fark facility reservatic�n permit" is a permit issued by the directc�r pursuant to Chapter Z.Sb of
this code to an individual ar grc�up granting permission for the tempora�ry exciusive use of park
facilities for an event which is nat under the management and control �f the c�ty and that may or
may nc�t be apen tc�the general puhli�.
"Regulatic�n" means posted notice governing the use of�rark facilitie�which are not inconsistent
with the law contained in this ehapter and which pramc�te public h�alth and safety and the
preservation of property.
„Specxal event" means an event apprQved with a special events perrnit.
"5pecial event permit"means a permit issued by the city clerk pursuant to Chapter 11.44 of this
cade:
2.56.024 -Responsibility for park facilities.
The directar shall be responsible for overall management, contresl, dev�lopment and use c�f park
facilities.
2.56.030 - Hours af a�eration and closure of facilities.
A: The director may restrict the hours of operation of park facilities based on the fallawing
criteria:
l: Weather conditions;
2. Seasonal recreation activitie� seheduled c�r expeeted to occur at the parks ar
recreation f�ci�ities;
3. Nature or exte�t bf public use t�fthe parks or recreatian facilities;
4�. Cost effectiv�ness of aperation ofthe parks or recreation facilities.
B. The director, or his or her designee, shall have the authority ta close any park facility ar
portian thereof and require th� exit of all persons therein when it is determined that
c�nditions exist in said facility or portion therec�f which present a hazard to the facility or
to public safety.
2.56.040-Priarity of use—Reservati�n of facilities--Special events;
As designated in city's schedule c�f fees and service charges(available in the c�ffice of the city clerk'
c�r �n-line at the city finance department web page), certain park �acilities may be available for
te�nporary exclusive use through issuance of a park facilities reservation per�nit c�r� special event
permit.
A: The director shall be responsible for processing of applications for and appraval af park
facilities reservation perrnits. Any use of a magnitude, scope or nature that will require the
participation�f other city departments shall�ot be eligible fc�r a park facilities reservatian
permit and sh�ll be considered by the city clerk fc�r issuance of a special event� permit
pursuant to Chapter 11.44 afthis c�de.
B; N�thing in this section shail be construed as granting any right or entit�ement tc�exclusive
us� c�f park facilities: The directar may deny any request for a park facilities reservation
permit upon determining in writing that;
l, The proposed activity or use of the park will unreas�nabiy interfer�with or detract
from the gener�I public enjc�yment of the park; c�r
2: The praposed activity or use will unreasanably interfere with or detract fram the
promotion of public health, welfare, safety, and recreatic�n; or
3, The proposed activity or u�e could reast�nably be anticipated to incite violence;
crime,ar disorderly cc�nduct; ar
4, The prc�posed activity or use will entail unusual, extraordinary, or burdensome
expense ar security operati4n by the city, or
S. Th�proposed activity will conflict with a city event; 01
6: The park facilities desired have already been reservecl with anather pazk facilities
reservation permit'.
C. In pracessing any park facilities reservation permit,the direct€�r may impose reasonal�le
conditians c�r restrictions on the granting the request upon the sponsor/applicant;including,
but nc�t limited to, any of the foll�wing:
l, Restrictions on fires, firew�rks, amplified sc�und; decibel rating and distance,
dancing, spor-�s, use of animals, equipment, or ve�iicles, the number of persons tc�
be p�esent, the lcrcation crf any bandstand ar stage, ar any other use which appears
likely ta �reate a risk of unreasc�nable harm ta the use and enjc�yment of the paxk c�r
public space by others, or of damage to public�roperty;
2. A requirement that the sponsor past a reasvnable �ecurity deposit far the repair of
any damage to par� ar public pr�perty, or the cost of cleanup, or both;
3. A requirement that the spansc�r pay any required business license tax or c�ther
required fees,
4, A requirement that the sponsor fizrnish additic�nal sanitary and refuse facilit�es that
might be reasonably necessaxy based on the use or activity;
5: A requirement that the sponsor sha11 be liable for any las�;damage c�r injury to any
perst�n c�r property whatever by reason Qf the negliger�ce of the persc�n c�r persons
to whom the reservation was granted,
6. A requirement that respc�nsibility for the event sha11 nat be transferable without the
written consent c�f the director,
7, Insurance coverage may be required, if in the opinion af the directc�r the size ar
sct�pe require insurance cc�verage.
L}. All park rules and regulations, including the prt�visions of Chapter 10.2Q of this code shall
be ft�ll�wed and deemed incorporated into the canditions of any parl�facilities reservation
permit,unless expressly waived or modified in writing by the direetor in granting the park
faciliti�s reservatic�n permit'.
E: Exhibiting Permit. F'ark facilities reservation permits shall be carried by the applicant and
available at the event.No person shall fail to prc�duce and exhibit a permit he ar she claims
t� have been issued upc�n request of any department employee or any peace officer wht�
desir�s ta inspect said permit for the purpc�se of enforcing campliance with this ccrde.
2.56.OSQ -Boats.
Regulations governing the use af boats within any park facility may be establishec� and posted by
the director, 5aid regulations shall promote th� safety c�f swimmers and boaters,the pratection of
property, and general public enjoyment of the facility.
2.SG.06U=Ap�roval far use of sound amplification equipment'.
A. Within any park facility, except in ct�nnection vvith a city event,no person shall use st�und
ampli�cation equipment without a park facilities reservatidn permit frc�m the tiirector. All
saund amplification a�`speech or music of whatever type or kind is prohibited within the
confines af park facilities; prt�vided, that between the hours of eleven a.m. and t�n p.m,
sound amplification sl�all be permitted up to a maximu�n vc�lume level of seventy-five
decibels of sound registered at a distance of fifty yards from the amplification source, as
measured an a sc�und Ievel meter rn�eting the requirements c�f the Arnerican National
Standards Institute; Standard 51.4-19'71, for sound level meters, vvhich has its frequency
weighting netwc�rk s�t for the "A'weighting and slow response. The director or their agent
may pelmit sound amplification e�ce�ding seventy�five decibels and c�utside of the hours
of eleven a.m. and ten p.m. upon request and dependent c�n the conditions.
B, �t�und amplifieation, as used in this section, shail not be construed as including a standard
automobile radio when used and heard crnly by the occupar�ts flf the vehicle in which it is
installed.
2.56.070—Cc�ncessions and Distribution c�f�ooc�s or Services,
A. The sale or dz�tribution t�f gQods and services, including but not limited to, faod products,
apparel, instructic�nal lessons, and entertainment by persons potenti�lly adversely and
seriously impacts the use of park facilit�e� for use by the general pub�ic for recreational
purpc�se�. Any such sales or dis�ributions must be regulated through the use of cc�ncessian
cc�ntracts, as permitted by the Director, to ensure that the goods and services will promc�te
the beneficial use ofpark fac�lities for recreatianal purp�s�s.
B. A request for consideratic�n c�f a cc�ncessian contract as r�quired by this section shall be
submitted to the community services director fc�r consideration. Nc�thing in this seetion
sha11 be con�trueci as granting any right ar entitlement to a concession contract;
C: The pr�visic�ns t�f this section sha11 not be deemed to apply to the sale ar distribution of
newspapers, books, pamphlets, or other activity constituting pratected spe�ch under the
First �mendment t�f the United States Constitution c�r comparable protections under the
California Cc�nstituti�n.
Section 2. Severability. If any section; subsection, sentence, clause or phrase of these
�rdinance� is fQr any rea�on held by a cc�urt af campetent jurisdiction ta be invaliti or
unc�nstitutic�nal,such decision shail not affect the validity c�frernaining portic�ns of the�rdinances.
The City Council of the City of Redding hereby declares that it would hav�passed this ordinance
and each section, subsection, sentence, clause and phrase thereaf irrespective of the fact that ane
or more sections; subsections, sentences, clauses or phrases may be held in�alid c�r
ui�canstitutic�nal.
Section 3. The passage c�f this c�rdinance is not a"prc�ject" according ta the definition
in the Ca�ifornia Environmental Quality Act,and therefore is not subj ect to the provisions requiring
enviranmenta�review.
Section 4. This C)rdinance shall take effe�t thirty (3fl} days after the date af its
adoption,and the City Clerk shall certify ta the ad�aptian tl�ereof and cause publication according
ta law.

vation permit,unless expressiy waived or modified in writing
by the director in granting the park facilities reservation
permit:

seneral pubtic for recreafional purposes. Any such sales or
disfiributions must be regviated through the use of concession
caniracts, as permitted hv ihe 4irector, ta ensure that the
goods and services w�li promote the beneficiaf use of park
facitities for retreaiional taurposes.
B: A reque5t for consideration of a concession contracf ds
required bY fhfs section shall be submitted to the communitv
services direcior for consideration. Nofhing in ihis section
shall be construed as granting any right or en?itlement to a
concession contract.
C.The provisions of this section shall not be deemed to apply
to�the sale or distribution ot�newspaper5, bo0ks��, pamphl�ts,
or other atfiivitY constituting protected speech under the
First Amendment of the United States Constitution or�ornpa-
rable protections under the California Constitution.
Secti6n 2.5everability. If anY section;subsection,senYence,
clause or phrdse of tfiese ordinances is for qny reason held'
bY a court af competent iurisdiction to be invalid or unconsti-
tutionaF,such dec'rsion shall not affect ihe validity of remain-
mg portions of the ordinances.The Citv Councif of ihe CitY of
Redding hereby deciares#hat it wauld have passed this ardi-
nance and each section, subsectian, sentence; clause and
phrase thereaf Irrespective of flle fact that ane ar more
sections, subsections, sentences, dauses or phrases may be
held invalid ar unconsti#utional.
SeCtian 3.The passage of tliis ardinance is not a "praiect"
accardirrg to the definitian in the Caiffornia Environmentai
Quality Act, and therefore is not subject to the provisinns
req�ui:ring�:enviranmental��review:.
Sectiqn d. This Ordinance shall take effect thirtv t3D)daYs

to the adoption thereof and cause publication according to
law.
