Section 1. Title 18 {Zoning)>�hapter 1$.43 {Standards for Specific Land Uses}�
Section 18.43_180 is amended tc� r�ad in its entirety as fc�llaws:
1�a43.180 Sh+�rt-Term Rentals
A. The purpr�se of this Section is to establish an appropriate permitting process and standards
for Short-Term Rental of dwelling units thrc�ughaut tke City;t�prc��ide a visitor experience
and accommoclation as an alternative to the typical hotel, mc�tal, and bed and breakfast
accommodations customarily permitted in the City; tc� minimize pc�tential negative
secondary effects af Shc�rt-Term Rental use on surrounding residential neighborhaocts; ta
retain the character of the neighborhoods in which any 5uch use c�ccurs; and ensure the
payment of required transient c�ccupancy taa�es.
B. Typ�s of Short-Term Rentals. Fc�r purpc�ses of this Section, the following Short-Term
Rental facilities are established:
1. Hr�sted Hottr�estay, An owner-�ccupied "Dwelling Uni�," �s defined by Sectian
18.61.0�0 under "Residential �tructure Types" and excluding apartment units and
duplex�s, with more than one habitable rc�om, where, fc�r compen5ation, individual
overnight room accornm�dations are prt�vided for a peric�d of less than thirty (30)
days.
2`. t�ac�ztic�n Rental. An entire"Dwelling Ur�it,"as defined by Sectian 18.b1.02(}under
"Residential Structure Types" and excluding apartment units and duplexes, where,
for cornpensatian, overnight accommodatians are provided for a period of iess than
thirty (30) days and the t�wner may or may nc�t reside within the dweliing unit fcrr
the term af the rental.
C. 5hor�-Term Rental Perrnit Requirements.No persan shall use, aduertise, t�r market for
use, any dwelling unit on any parcel in any zoning district for�hort-Term Rental purpases
without�rst obtaining approval as required by this Section:The following appraval process
is established';
1. Hosterl �Ivmestrryz This use is permitted within all zoning districts subject to
obtaining a I;etter of Determina#ion from the I�irectr�r and providing an affidavit
certifying that the owner understands; agrees to, and is in �ompliance with the
requirements of thi� Sectian. Applicants may be required to provide a site plan or
other informatic�n determined necessary by the Directar to determine complian�e
with this Sectian and shall pay an applicatian fee as may lae established by
resalutian of the �ity Council, Permifs for Hosted Ht�mestays shall expire twelve
{12) manths frc�m issuance and are subject ta a requirement fc�r renewal in
accordance with this Section.
2: Vuctctir�n ltental. This use is permitted within all zoning districts subject to
obtaining a Site Development Permit issued by the Director in accordance with the
provisions c�f Chapter 18.11, Commc�n Procedures and Ch�pter 18.13, Site
Developrrt�ent Permits af this Code, except that Site Develapment Permits for
Vacation Rentals shall expire twelve (;1Z) months fram issuance and are sub�ject to
a requirement for renewal in acccrrdance with this 5ectic�n.
D. D►istricts in Which Perrnitted.T'he regulatians of this chapter apply to Short-Term Rentals
in all z�ning districts:
E. General R�quirem�r►ts -Hastecl�Iornestay.
1. I�To more than one d�velling unit on a lot may be used at any t�ne time.
2, A maximum of two rc�ams may be available for rent at any time,A flc�or plan shall
be subrnitted with the affidavit indicating the rooms for rent.
3, C?ccupancy shall be limited ta a maximum c�f two {2) persons per rented bedroom.
The rental shall be limited tc� a ma�imum of l80 rental days per calendar year.
4. The ovvner shall be the applican�; and other than for purposes of daily rvutines; the
a�plica:nt must occupy the residence at all times when rooms are being provided for
rent.
S. At the time �f permit ren�wal, the prc�perty awner shall attest they understand and
agree tc� the Hosted Homestay requirements by signing the Ht�sted Homestay
Affidavit avaiiable at the I}evelopment �ervices Department and any payment due
rnust�e r�mitted.
6. Except as set fc�rth in Section 18.43.060 as it relates tc� licensed bed and hreakfast
inns, na owner shall caoka prepare or serv� fc�r cansumption �`ood of any kind for
consumption by the Short-Term-Rental t�nant.
7. The applicant shall state in the applicatic�n the number of on-site parking spaces
available to tenant�,but in no case shall it be less than two on-site spaces. Short-
Term-Rental tenant parking spaces shall be within the primary driveway or other
t�n-site location. No tenant parking in excess c�f this number of on-site parking
spac�s is permitted. No tenant is permitted to park on the street. External changes
ta a prc�perty su�h as converting significant ar�as of front yard la�dscape for
purpc�ses of ineeting parking r�quirements is nc�t allc�wed.
8. A11 reguired on-site parking spaces {including garage parking if identified at time
of approval) shall be accessible and available to Shai-t-Term-Rental ten�nts at all
times durii�g the rental periods:
9: Short-Term Rentals shall meet all applicable building, health,fire and related safety
codes at all tim�s, including provision c�f working snnoke and caxbon monc�xide
detectars.
10. The applicant shall post emergency evacuation instructions and ��house pc�licies"
within each Shc�rt-Term-Rental tenant' bedroam. T1�e hause pc�licies shall be
included in the rental agreement, and shall be enfarced by the applieant, At a
minimum,the hause policies should:
a. Reinforce the �ity of Redding's Noise Standards{RMC Section 1$.40.100}
by establishing outdoor "qu'ret hours" between 10:00 p.m. and '�:00 a.m. to
minimize disturbance to neighboring residences. Outc�t�or ��tivities are
prohibited during ``quiet hours."
b. Require that Short-`I'erm-Rental tenant v�hicles be parked �n the premisesg
not the street in compliance with this Section.
11. The prr�perty sha11 not be used to host non-applicant related �veddings,parties, and
c�ther similar events.
12. fln-sife advertising signs or other displays indicating that the residence is being
utilized as a Shart-T�rm Rental are prohibited.
13, l�tc� persan shall ad�ertise a ihc�rt-Term Rental an any media platform �vhe�� such
advertis�ment c�r notice cc�ntains an inaccurate or mi�leading st�tement c�f ti�e
requirements of, ar indieate amenities not allowed by the Redding Municipal Code
including the number of parking spaces,
14. All �dVertisements shall include the number�f permissible parking sp�:ces.
15. A �ity business license shall be obtained asid transient occupancy tax�s paid in
a�cordance with Chapter 4.12 as required. All advertising for any Shart-Term
Rental sha11 inelude the City �f Redding transient �ccupancy tax number and the
City of Redding business license number assigned to the applicant. With submittal
c�f transient accupancy taxes, the applicant s�iall also submit a statement indicating
the number of Short-Terrn-R.ental tenant stays, and the number of"Short-Term-
Rental tenants for the reparting period.
16. The permit is not transferrable tc� � subsequent property owner or to another
prope�ty.
17. This ordinance shall nc�t be construed as waiving or c�therwise impacting the rights
and abIigatians of any individual, graup, or the members of any homeowner's
association, as defined, tr� c4mply with ar enforce CC&12's and no perrnit shall be
issued when it is demon�trated by substantial evidence that issuance of a permit
will be in contradiction to any recc�rded CC&R's �r other record providing record
notice of a restriction an th�use of the property.
F. �eneral Requiremen�ts -�acation Rentals.
l, With the exception of iterns 1 thrQugh b listed in Section 18.43:1$0(E} abr�ve, the
General 12equirements pravisians for Hosted Homestays shall apply to �acatic�n
Rentals.
2. The fallowing additic�nal provisions sha11 alsa be applicable ta Vacati�n Rentals
whi�h may be supplemented by requirements establish�d by the Directt�r with
approval of the required Site I?eveloprnent Fermit as necessary ta maintain
cQmpatibility of the use vvith the surrountiing properties.
a. A Vacation Rental shall not be permitted onproperties as follows:
(1) Containing an Accessory Dwelling Unit wit� a building permit
�.pplieation submirted on ar after January 1,2(}20 in cc�mpliance with
Gavernment Co�e Sectian 6b323, as may be amended frc�m time to
time; or
{2} Within a six hundred (6{}0) faot radius af an existing per•mitted
Vacatson Rental except that, at the discretion af the Directar t�r
appellate body as the case may be�within a three hundr�d(300j foot
radius ofan existing Vacatian Rental when there is a buffer such as
an arterial, rail right-�f-way, flac�d cc�ntrol channel, stream corridor
or apen spa�e easement between the Vacation Rental units.
b. The total number of Vacation R.entals in th� City shall not exceed four
hundred(4{l0)rentals at any one time,
c. The awner sha11 be the applicant and any nat�ural person signing an
application on behalf of an owner shall have legal authc�rity tc� bi�d the
owner.
d. A Va�ation Rental shall nat be rented to multi�le separate parties
concurrently.
e: The applieant shall keep on file with the City the name,telephone r�umber;
and email address of a local contact person who shall be respon�ible far
responding ta questions or concems regarding the operation ofthe Vacation
Rental. This infarmation shall be pasted in a conspicuous location withir�
the Vacation Rental dwelling. The local contact person shall be available
tw�nty-four (24) haurs a day, seven (7} days a weelc, to accept messages
and respond physically ta the Vacation Rental within forty-five (45}
minutes, if necessary. The name and cantact information of the lc�cal
contaetpersan will be made available tQ the public.The contact information
shall be kept current at a11 times.
f. Occupancy shall be limited tc� a maximum of two (2) persans per rented
bedroom.
g. The maxim�m number of persons an the property at any tim� shall be
limited to sixteen(1�)persons,
h. Fric,r to issuance c�f a permit, a physical inspectiori of the dwelling unit and
property shall be conducted by City staff.
i, Each operator shali maintain a record of each Shart-Term-Rental tenant's
vehicle(s�, 'The record sha11 minimally consist of the rental period, the
license plate; make, model, and color for each vehicle. The rec�rd shall be
made available at any time upon request by the City.
j. Notwithstanding Subdivision B(�), an apartment unit or duplex located in
the Doumtown Redding Specific Plan area may be permitted as a�lacation
Re�tal, subject to the following:
(1) Far any parce� lc�cated within the I�owntown Redding �pecific Plan
Core District, the requirements listed in Subdivisions E(?), E{8),
E(10)(b), E��4},F(2)(a)(2), and F(2}{i) shall not apply.
(2} Fc�r any parcel Iocated within the Downtown Redding Specific Plan
1Vl�xed-Use I�istrict and adjacent tc� a Residential Single-Family
District,the requirement listed in Subdivisi�n F(2}(a){2)shall apply,
but only as rne�sured to Vacati�n F�entals located in that Residential
Single-Family Di�trict.
{3) For any parcel located within the Downtown Redding Sp�cific P'lan
Mixed-Use District with a legal nc�n�c�nforming apartment or
duplex use, the off-street parlcing requirements listed in
Subdivisians E{'7)>E(8),E(1 t7){b),E(14�,and F(2}(i}shall not apply;
G. Application 12equired.
l. V�here a Site Development Permit is required by this Section, applicants for a
"�hort-Term Rent�l use shall pay th�application fee established by resolution of the
City Council and apply far a permit in accordance with the prt�visions of Chapter
l$.I 1 (Commc�n Procedures),exce�t that notices ofthe Vacation Rental applicati�an
shall be �ent to ali owners of real property within six hundred (600} feet Qf the
applicant's property for a ten(10)business day notificati€�n period.
2. In inaking a detern�inatiion to �pprave, conditionallY aPprove, ar denY �Y
applicatit�n, including an appiication for renewal, for a Hc�sted H�mestay or
Vacation Rental, the I)irector, or appella�e body as the case may be, may alsa
consider any factc�r pertinent to the health, safety and welfar� of th� immedi�te
neighborho�d or public generally including, but not limited tc�, ability ta comply
with the provisions set forth in this Sectian,evidence af aperation in vialation with
this Section, complaints of neighbors; code enforcement activity, tirnelines� of
business permit renewal, timeliness or non-payment c�f transient c�ccupancy tax,
proximity af the property to group homes, residential care facilities, and other
neighborhood and site characteristics.
3: Appeal of any determinatic�n to approve ar deny any application, including an
application for renewal, shall be in accc�relance with Sectit�n 18,11.090, except for
the appeal period shall�e ten{10}busin�ss days.
H. Suspension and Termination.
1. The Director; ar appe�late body, shall apply the �riteria set fc�rth in Section
18.43.1$0(G}(2} in determining whether any permit issued pursuant to this Section
shall be suspended or terminated,Notice shal�be prc�vid�d ta the applicant pursuant
tc�the procedure set forth in Sectior� 1�.11.(}60.
2. Appeal of the suspensit�n or�errnination by the Direc�or t�f a�acatit�n Rental Permit
shall be in accardance with the requirements c�f Section 1�.11.090.
3: Ap�eal c�f the suspension or terminatic�n by the L}irector of a Hc�sted Hc�mestay
Perrnit rnust be ma�e to the Plat�nin.g�ommissic�n within ten�10}calendar days of
s�rvice c�f the Director's decision,and appe�l af the Flanning Cc�mmissic�n decision
to the �ity Cauncil must be made �vi�hin ten (1{}) calendar days c�f service af the
Planning C�mmissic�n's determination. L?eci�ions crfthe City Council ar�final,and
aIl challenging a decision of�he I7irector must exhaust all r�medies set:forth in this
Sectic�n 18.43.1�fl(H){3) prior tr� bringing a challenge pur$uant to Code af Civil
Procedure section 1094.5.
4. Service shall be deemed effective up�n the earliest of: l} ant�.ouncement by the
approving ar ap�ellate bady of the decision in the presence of the appellant; 2)
personal service on the appellant of a written notice of decision; �r 3} deposit of a
written notice of decision in the United States Mail.
I. Legat Nan-Canfo�mfng Uses
1. Continuatzon and abandonment �f short-term rentals which are Iegal
nanconforming uses shall not be governed by Section 18.46.020; The sale
allowances for cQntinuation of a 1ega1 non-conforming use as a short-term rental
are by timely renewal of a valid and current shart-term rental permit or as foilows:
�. A temporary hardship allowance of nat mor� than six (6) months may be
granted by the Direct�r c�f Development s�rvices, c►r designee, if: 1} a
medical conditian of the permittee, spouse, domestic partner, or immediate
family member je�pardizes the ability c�f the owner tr� operate the Shc�rt�
Term Rental; or 2} the death of a spouse, damestic partner, or immediate
family member of the permittee jeopardizes the ability of the permittee tc�
operate the Short-Term Rental.
b; A long-term rental allowance may be granted by the Director of
L7evelopment Services, or designe�, if th� permittee provides praof of a
lc�ng-term lease of twelve (12) months or langer priar to the expiration Qf
the �hort-Term Rental permit. This allowance may be repeated if the
conditians set fc�rth in this subsection are met. Th� length crf an allowance
shall n�at e�ceed the term c�f the lease ar twenty-faur(24):months,�vhichever
is shorter. If an allowance is granted pursuant tc� this subdivision, the
existing permit sha11 terminate per its term. However; the Directar c�f
Dev�lopment Services shall consider said permit to be "active" solely for
the purpose of allawing the permittee tc� reapply fc�r a permit after the
allowance granted pursuant to this subdivision has lapsed:
J: Enf�rcement and Fterneciies. Enforcement c�f the provision:s af this Section include the
civil and equitable remedies as permitted by state law, the issuance crf a citation and fin�,
ar c�ther legal remedy as provided by Chapter 1.12 through 1.15, inclusive, of the Reddzng
Municipal Cc�de. Upon n�tification by tl�e City; any Short-Term Rental operating in
vit�lation of th� r�quirements af this Section must terminate �perations immediately.
Furkher, a Site Developrnent Permit issued under the authority of this Sectic�n may be
revoked in accc�rdance with the pracedures established in Chapter 1$.11 {Common
Procedures}:
�ection 2: The C�uncil hereby finds and determines that;the enactment of this Ordinance
i�exempt frc�m review pursuant to the California Envir�nmental Quality Act{Public Resources Cod�
section 21{?00 et seq.)'("CEQA")because it has no�otential to result in either a d'zrect ph�sical change
in the environment or a reasonably foreseeable i�clirect physical change in the en�irorr�mm�nt. This
(�rdinance is exempt from�EQA pursuant to the"cammon sense"exemptic�n(14 CCR 1SOb1(b}(3)),
as it can be seen with certainty that there is no��ssibility that the adoptic�n af the Ordinance will ha�e
a significant effect on the environment,
Secti�n 3. Severability; If any provisi�n o�this t�rdinance or the application thereof to
any person or circumstance is held invalict;the remainder of the Clydinance and the application of such
provision will remain in effect ta the extent permitted by Iaw.
Section 4, This t}rdinance shall take effect thirty{30) �alendar days after the date nf its
adc�ptir�n, and the City Clerk shall certify to the adc�ption thexeaf and cause publication according to
law.
