FREEWAY SIGN PROGRAM Councilman Chatfield reported that he and Mayor Moty met with the Motel Owners Association today and that the Association is very much opposed to cancelling the contracts for the billboards on Interstate 5 , north and south of Redding. They did indicate that they would be interested in a change in the design of the signs and in more desirable sign locations , I if this were possible. Mr. Chatfield said that the Chamber of Comrrierce i��"+ has also indicated that it wishes the billboards continued. There was a suggestion that the blue billboard north of Redding presently supported by the Motel Owners Association be taken over by the City and the contract for the present City-supported billboard north of Redding be terminated. Mayor Moty suggested that the Committee continue working on the Freeway sign program and determine if it is possible to (a) obtain more desirable locations , and (b) work out a better design on the existing billboards , and report back to Council the meeting of November 4th. CONTINUED PUBLIC HEARING - Appeal of UP-46-68 The hour of 7:3 0 P.M. having ar rived, Mayor Moty opened the continued public hearing on Appeal of UP-46-68 by Texaco, Inc. The City Clerk read a letter received from Mr. T. B. Corty, Texaco, Inc . , advising that Texaco wishes to withdraw its appeal ,1��� � to the City Council for a 70' sign at 501 Highway 44, Redding. MOTION: IVlade by Councilman Denny, seconded by Councilman Fulton accepting the withdrawal request of Texaco, Inc. , re appeal of UP-46-68. The Vote: Unanimous Ayes MOTION: Made by Councilman Fulton, seconded by Councilman Denny that the public hearing be closed. The Vote: Unanimous Ayes PUBLIC HEARING - Axnendment to Code re Redevelopment Project Areas The hour of 7:30 P.M. having arrived, Mayor Moty opened the public hearing re amendments to the Code pertaining to Redevelopment Project Areas The following documents are on file in the office of the City Clerk: Affidavit of Publication - Notice of Public Hearing � Planning Comxnission Recommendation dated 10/4/68 �I�' The City Clerk read a letter received from David D. Stephens , owner �0�1 of Powell's Pharmacy, 1458 Market Street, opposing the amendment proposed by the Planning Commission. Mr. Stephens does not own any property in the Project Area but has a lease interest in property in said Area. The Mayor ascertained that there were no protests from the floor. Planning Director Harris reviewed the recommendation of the Planning Commission that a new Chapter be added to the City Code defining when and where Urban Renewal Plans shall take precedence over existing City Code requirements in matters involving zoning, subdivision, sewer , water, street, electrical, building, and plumbing standards . Mr. Harris pointed out that the Redevelopment Plan, already adopted by Council, sets forth standards for development; therefore , in essence this amendment is intended to clarify which Code provisions will apply. 247 Mr. Earl Henson, Executive Director of the Redding Redevelopment Agency, spoke in favor of the amendment, stating that it will simplify ' the administration of the Development Plan in that all items that are covered are identified and will be the responsibility of the Agency. City Attorney Murphy concurs with the recommendation of the ' Planning Corr�snis s ion and Mr. Hens on. i j Councilman Doherty e�ressed concern that the City is abandoning ' ' its responsibility in the Project Area and turning it over to the Agency. City Attorney Murphy assured Mr. Doherty that the Redevelopment Plan approved by Council contains all of the standards referred to and that the Agency does not have the power to adopt any amendments without Council approval. It was suggested that the proposed ordinance be amended to clarify this point. MOTION: Made by Councilman Denny, seconded by Councilman � ' Doherty that the public hearing be closed. The Vote: Unanimous Ayes Councilman Denny ;offered Ordinance No. 982,. as amended, for first reading, an ordinance of the City Council of the City of Redding amending the Redding City Code, 1959, as amended, by adding a new Chapter 11B thereto, pertaining to Community Redevelopment Project Areas . BUCKEYE FIRE PROTECTION DISTRICT In a memo to Council dated October 3, 1968, Finance Director Courtney submitted factual information as to the various services furnished by the City of Redding and the costs thereof. In this memo it was pointed out that the City of Redding makes no special property tax levy for fire protection purposes as this function is financed from general government ' ' revenue sources . This information was compiled in order to provide an � ' answer to the communication received from the Buckeye Fire Protection i � District Board of Directors requesting the probable cost of fire protection yf� if the Twin View Annexation is successful. � �� � MOTION: Made by Councilman Chatfield, seconded by Councilman Doherty ' authorizing the Finance Director to transmit the information included in � his memo to the Board of Directors of the Buckeye Fire Protection District. The Vote: Unanimous Ayes REZONING APPLICATION - RZ-7-68 MOTION: Made by Councilman Chatfield, seconded by Councilman Doherty that a public hearing be set for 7:30 P. M, , October 21 , 1968 ��y on Rezoning Application RZ-7-68 . The Vote: Unanimous Ayes BENTON AIRPARK - Fly-In Breakfast sponsored by Optimist Club Airports Manager McCall submitted the recommendation of the Airports Commission that Council approve the request of the Optimist Club to have a fly-in breakfast at Benton Airpark on October 20 , 1968 with a rain date �;�� for the 27th of October. The Optimist Club has an Insurance Certificate on file with the City Clerk covering this event. � � MOTION: Made by Councilman Chatfield, seconded by Councilman Fulton approving the recommendation of the Airports Commission re the Optimist I I Club fly-in breakfast to be held at Benton Airpark on October 20th with � I a rain: date for _October 27th. The Vote: Unanimous Ayes ; � PUBLIC WORKS PROGRESS REPORT Public Works Director Arness submitted the Public Works Progress„ Report ��Q for the month of September 1968. 2'48 ORDINANCE - pertaining to police dogs Councilman Fulton offered Ordinance No. 9g3 for first reading, anc� ordinance of the City Council of the City of Redding amending the �; Redding City Code , 1959 , as amended, by repealing Section 5-3. 1 ; �ls�� and substituting therefor a new Section 5-3. 1 , pertaining to teasing or harassment of official police dogs . RESOLUTION - Extending Social Security Coverage to City Employees MOTION: Made by Councilman Fulton, seconded by Councilman Doherty that Resolution No. 4137 be adopted, a resolution of the City Council of the City of Redding authorizing execution of application and � agreement with State of California Public Employees Retirement System y)� for modification of State of California Social Security Agreement ex- �!6� tending Social Security coverage to City of Redding Employees . AMENDMENT TO CONTRACT - Board of Admin. , SERS and City Council MOTION: Made by Councilman Doherty, seconded by Councilman Fulton approving the Amendment to Contract between the Board of Administration State Employees' Retirement System and the City Council of the City of Redding, and authorizing the Mayor to execute said document. The Vote: Unanimous A.yes. LEGISLATION In a memo to Council dated October 2 , 1968, City Attorney Murphy re- viewed the communication received from the City of Tehachapi concerning proposed legislation which would represent a proposed amendment to the Penal Code. The request for new legislation is the product of the death of ��`� the Chief of Police of Tehachapi, resulting from gunshot wounds received while serving a warrant for arrest. The communication from the City of Tehachapi does not request Council support of the proposed legislation but is merely informative. No action was taken by Council. F.UBLIC HEARING - re Amendments to Chapters 17 and 30 re special recreation facilities The hour of 8:00 P.M. having arrived, Mayor Moty opened the public hearing re proposed amendments to Chapter 17 and 30 re special recreation facilities . �( The following documents are on file in the office of the City Clerk: ( � A.ffidavit of publication - Notice of public hearing �;��) Planning ComxYiission Recommendation dated 10/4/68 The City Clerk advised that no written protests had been filed and the Mayor ascertained that there were no protests from the floor . Planning Director Harris reviewed the recommendation of the Planning Comrriission re the proposed amendment to Chapter 1? and 30 , stating that its purpose is to eliminate duplication of procedures and facilitate the granting of a permit for temporary uses for recreational activities. Under the present system the ' application for a temporary amusement or recreational use p.ermit inust obta�in' said perrriit from the 3oard of Administrative Review or the Planning Commis sion and also obtain approval from Council. Temporary recreational uses often are not planned sufficiently in advance to enable the applicant to follow this system. The second item of this amendment pertains to Christmas tree sales lots . The ordinance now requires a use permit for any outdoor sales area, and the proposed amendment would eliminate the need for a use permit for this temporary operation but would carry certain re- strictions re curbside sales and off-street parking. 249 MOTION: Made by Councilman Denny, seconded by Councilman ; Fulton that the public hearing be closed. The Vote: Unanimous Ayes i ', Councilman Doherty offered Ordinance No. 984 for first reading, an ordinance of the City Council of the City of Redding amending the Redding City Code, 1959, as amended , by repealing Section � 30-18 and substituting ther efor a new Section 30-18 , pertaining ' � to general provisions and exceptions , and by repealing Section 17- 14. TURTLE BAY City Attorney Murphy reviewed the Auditorium Committee report and recommendation on the offer of Jack Halpin to sell or exchange the Hammon property, and recommendations regarding acquisition � of land rights and rights of ingress and egress necessary for con- struction of the Butte Street on-ramp to the freeway at the auditor- � ium site by the Division of Highways . Such report, dated October 7, 1968, is incorporated within these minutes at this_.point of reference . ' It is recommended by the Committee that: 1) The alternative offers contained in Jack Halpin's letter of August 27 , 1968 be declined at this time . 2) The City Attorney be authorized to work out the details of acquisition of a portion of Parcel 19A of the Kutras property for land rights necessary for construction of the Butte Street ��U on-ramp. i j 3) The City Attorney be authorized to prepare a resolution for the construction of an alternative acces s road for the Haxnmon � � and Kutras property in accordance with the Committee recom- � mendations and to guarantee to the State Division of Highways that : ' the City will hold the Division of Highways harmless from any ' and all claims of damage asserted by the holder of the Hammon � property arising out of any loss of ingress or egress rights ' resulting from the construction of a west bound on-ramp to the freeway at the auditorium site . Mr . Halpin appeared before Council and expressed concern that the City has not made a policy decision as to what it is going to do with property in this complex. It was brought out that the Haxnrrzon property is presently zoned M-2 which would permit construction of a motel, restaurant, and service station. Mr. Halpin said that if the City were willing to leave the property zoned M-2 , there would be no problem; however, he noted that there is a proposal pending to rezone the Hammon property. Planning Director Harris confirmed this , stating that there is a proposal before the Planning Comxnission to rezone this property to C-3-P or more restrictive. Councilman Chatfield said the Committee was aware of the proposed ; rezoning in making its recommendations . Mayor Moty commented that the City has committed itself on a policy decision regarding the use of publicy owned land in this complex by approving the Development Plan for Turtle Bay on July 1 , 1968 . i Mr . Halpin said he couldn't understand how the City of Redding could agree to hold the Division of Highways harmless because if Council takes action tonight as recommended by the Committee, the Harrirrion property will suffer serious damage and the City will bear the full responsibility in the event of a suit. 250 MOTION: Made by Councilman Denny, seconded by Councilman Chatfield declining the alternative offers contained in Jack Halpin's letter of August 27 , 1968. The Vote: Unanimous Ayes , MOTION: Made by Councilman Chatfield, seconded by Councilman Fulton that the City Attorney be authorized to work out the details of acquisition of a portion of Parcel 19A of the Kutras property for land rights necessary for construction of the Butte Street on-ramp. The Vote: Unanimous Ayes Councilman Doherty said that before voting on the Committee's third recommendation he would like a recommendation from the City Attorney. Mr. Murphy said that there is a calculated element of risk but that the Committee felt it was preferra=bie to assume this risk rather than negotiate for acquisition of the Hamxnon property at a price they felt certain would be greater than its utility to the City of Redding. Mr . Murphy said he would be happy to dis cus s the matter in greater detail at an Executive Session, which is permissible as it involvespossibl�e litigation. At the hour of 8:50 P. M. , Mayor Moty declared a rec.ess;-for the purpose of holding an Executive 5ession to discussppssible litigation. At the hour of 9:15 P.M. the meeting was reconvened.
