The Pledge of Allegiance to the Flag was led by Planning Director Harris.
Reverend Ellis Martin, Pastor of the First Christian Church, offered the
invocation.
The meeting was called to order at 7:00 P. M. by Mayor Moty with the
following Councilmen present: Denny, Doherty, Fulton, and Moty.
NOTE: Councilman Chatfield entered the meeting at 7:55 P. M. as �

APPROVAL OF MINUTES
MOTION: Made by Councilman Denny, seconded by Councilman Doherty
approving the minutes of the special meeting of June 15, 1968 and of theo
regular meeting of June 17, 1968, as mailed to each Councilman. The
Vote: Unanimous Ayes
COMMUNICATIONS
Resignation from Civic Arts Commission
In a letter to Council dated June 13th, Richard Hornaday submitted
his resignation as a member of the Civic Arts Commission as he

? � � MOTION: Made by Councilman Denny, seconded by Councilman
Doherty that the resignation of Richard Hornaday be accepted
with regret and that a letter of appreciation and a plaque be sent
to Mr, Hornaday. The Vote: Unanimous Ayes
Marion Rose - request re rezoning Del Mar Subdivision No. 2
This request was held over from the meeting of June 17th to
allow consideration by a full Council. Mayor Moty noted that
Councilman Chatfield was not present but stated that even if he
�Y/ were present he would have to disqualify himself from discussion

and voting on this item.
Mr. Rose of 1625 Santa Fe Street appeared before Council and
filed petitions containing 24 signatures of residents in the area
requesting rezoning of Del Mar Subdivision No. 2 from R-3-15
to R-1. These petitions are in addition to the petitions containing
209 signatures previously filed with the Planning Commission.
Mr. Rose also filed letters signed by Joe T, and Betty J. .Arias
and John S. and Helen L. Jennings indicating that such persons
had not received notice of the rezoning of said property from
R-1 to R-3-15. Mr. Rose also filed a copy of Ordinance No. 781

which shows tliat Councilman Chatfield liad voted "Yes" on the
, rezonirig, aTthough the minutes of the meeting indicate that
Mr. Chatfield had abstained from discussion and voting on
this item. On the basis of the documents submitted, and the
claim that the R-3-15 zoning was erroneous and was spot
zonirig, Mr. Rose, acting as spokesman for all of the
� petitioners, requested a public liearing to be held to consider
Irezoning Del Mar Subdivision No. 2 from R-3-15 to R-1.

City Attorney Murphy noted that the minutes clearly indicate .
that Councilman Chatfield abstained from discussion and voting
on this item and that Ordinance No. 781 contains a clerical
error. He further stated that even if Councilman Chatfield had
voted, his vote would not invalidate the Ordinance, inasmuch as
the otYier four Councilmen liad voted in favor of the Ordinance.
Mr. Murphy refuted the claiin that R-3-15 zoning in this area is
spot zoning, stating that the area constitutes approximately five
acres and it also has certain unique characteristics. He indicated
that at the time of the rezoning in August 1964, the R-3-15 clas:si-
fication did not exist, and it was the recommendation. of the Planning
� Gommission at tliat time that this property be so zoned when the
R-3-15 classification was adopted,
Planning Director Harris reviewed the chronological events in
this matter and, in conclusion, stated that it was the unanimous
decision of the Planning Commission that there had been no
changes in the neighborhood and no evidence submitted that the
zoning had been made erroneously, and"therefore the Commission
de�nied_the.r•equest of�the .petitioners:for�a public'hearing to'consider

� Councilrrian Fulton questioned whether residents of the area were
� � notified of the public hearing regarding �the-R-3-15 zoning. The

� � City Clerk stated that there are affidavits of mailing on file and,
in faat;. one notice was returrie�cl a's non-deliverable and that notice
is also ori file>in-the :office of the City�Clerk. .
In answer to Mayor Moty's inquiry as to what conditions have to
be shown or demonstrated to warrant :a .public liea.ring�on rezoning,
City Attorney Murphy replied that Council must find that one of the
two'following� conditions �exist: : -. � .
1. �That�.there has: been a:change:in circums.tances since the
time of the existing zoning.
2. That the zoning on the property by Ordinance No. 781 was

Plan in effect in 1964 was designated for single family dwellings.

Councilman Doherty commented that the General Plan is just what
the name implies, it is gene ral in natur.e and not intended. to .be
anything else.

MOTION: Made by Councilman Fulton, seconded by Councilman
Denny to deny the petitioners' request �for a public hearing to
consider rezoning of Del Mar Subdiyision No. 2, The Vote:
Unanimous Ayes
Councilman `Doherty said he believes the City sliould certainly
keep in mind the fact that the people in that area have resided
the re a cons ide rable length of time and should do eve rything
possible re circulation of vehicular traffic. when considering
development proposals on the now vacant property.
Councilman Chatfield entered the meeting at this point. -
William Rhyne - request for water from Buckeye Service Area
In a letter to Council.dated June 28th, Mr. Rhyne requested water
service for property located in the-Buckeye area west of Lake
Boulevard and outside the boundaries of the Buckeye County
Water District. Mr, Rhyne .stated that he had applied for annexa-
tion to the Buckeye County Water District a few years�:ago and
his application was accepted and apprbved but firial incorporation
was delayed until larger water lines were installed in Quartz
Hill Road, hence his propert}r was never officially made a part
of the Buckeye County Water District. Mr, Rhyne further stated
that if the Twin View Annex No. 1 'election is successful he wishes
'��' to apply for annexation of his property (approximately seventy
� acres) to the City of Redding.
In a discuss'ion of this matter, City Attorney Murphy indicated
that even if the City were physically able to serve water to Mr.
Rliyne's property�, in his opinion, serving water outside the City
limits or outs'ide the boundaries of the former Buckeye County
Water District would be a violation of the existing contracts
between the City of Redding and the Bureau of Reclamation. Mr.
Murphy pointed out that the City is charged $20/acre ft.. for water
served to the Buckeye Service Area.
Councilinan Fulton asked if the $20/acre ft. rate will remain in
effect for persons residing in the Twin View Annex No. 1 if
the annexation election is successful. Mr. Murphy said the Bureau
has indicated some desire to see to it that the existing Buckeye
County Water District contract is protected.
With the approval of Council, Mayor Moty instructed the City
Clerk to put Mr. Rhyne's request on file until after the Twin View
Annex No. 1 election. If the election is successful, the City Clerk
is to contact Mr. Rhyne re possible arinexation of his property to
the City of Redding.
Councilman Fulton and Mayor Moty left the meeting at this point.

PUBLIC HEARING '
The hour of 8:00 P. M. having arrived, Vice Mayor Chatfield
opened the continued public hearing re Russell and Weldon Streets
Sewer Assessment District.

Assistant. Givil Engineer Hastings reviewed th.e .project and noted
that in the original call for�bids the lowest bid receiued was in
� excess of the Engineer's Estimate by about 12°jo. In the second
; call for_;bi.ds, .the lowes�t bid received was for $33, 347. 10,: whereas
the Engineer's estimate is $28, 606.�00. Howeve�r; .Mr, Hastings
said that the low bid includes the�bond discount and by estisnating
' said discount at 5 percent and addirig that figure to the Engineer's
estimate; ...a corriparable fig.ure .of $30, 036. 35 is arrived at, which
. leaves the low bidder's cost approximately 11 percent over the
Engineer's estimate. By deducting Item No. 12 f�rom� the bid.
scliedule'.(a deduetive alte-rnate). and adding._the Engineer's .estimate
for fo'rce`account, this-further: reduces the �low bidder's _price:.to
$30,�947.-10, which is approximately 3 pe-rcent over the •Engineer's
Estirriate. Mr: Hastings explained that Item No. 12 is.asphalt
conc�rete paving patch which c.an be done by City forces. .
A discussion ensued regarding this matte�' and�IVlr. Hastings was
instructed .to,check with .Bond Counsel Ed �Ness and' get his opinion
as to whether this is considered a public project and whether Council
can authorize Item 12 to be done by force account.

PUBLIC WOR_K5 �PROGRESS .REPORT
Public Works Director Arness' submitted the Public Works Progress
Report for the month of June, 1968. Councilman Chatfield asked if
the aerator problem at the Sewage Treatment Plant had been solved,
Mr. Arness said that only three aerators are working at present;
however, a Field R'epresentative of the manufacturer w.as here Tast `�lv
week and�modified the equipment, so hopefully the problem will be
' solved shortly. �

Vice Mayor Chatfield declared .this matter an urgency, item. ,
There was considerable discussion as to the widespread effect such
legislation would have on City government and how it would hamper
the work of committees and discourage: citizens from working- on •

Mr. We,sley Hughes, -.Government Repo-rter on tYte Redding Record ,
Searchlight, expressed his views on the matter, saying. that he favors
the adoption of AB 202. He emphasized that he has no concern wi•th
respect to the City of Redding but pointed out that go�ernin�g bodies-
rely heavily on recommendations of committees .and he-feels that the : -
public should be aware of committee meetings where such recommenda-
tions are formulated. � .. � .

year of service. Mr. Murphy said that this b,�ill would more than e�ve•r
�7z make a sharp distinction between the public safety employees and other
City employees in the field of retirement and he recommended that
Council authorize the Vice Mayor to send telegrams to Senators Marler
and Collier and to Assemblywoman Davis expressing Council's opposi-
tion to AB 730.
Vice Mayor Chatfield declared this matter an urgency item.
