The Pledge of Allegiance to the Flag was led by Parks Superintendent
' Smith.
Reverend William Hendrix, Pastor of Redding. Christian Church, offered
the invocation.
The meeting was called to order at 7:00 P. M. by Mayor Moty with the
following Councilmen present: Chatfield, Denny, Doherty, Fulton, and
Mayor Moty. �
� Also present were City Manager Cowden, Assistant City Manager and
� Purchasing Director Stewart, City Attorney Murphy, Finance Director
, and Personnel Director Courtney, Associate Planner Nebon, Public
' ' Works Director Arness, Airports Manager McCall, and Parks Superin-
tendent Smith.
AYPROVAL OF MINUTES
It was noted that there is an omission in the Minutes of the meeting of
January 2, 1968, and said minutes should be corrected to include the
following after the item r.e AIRPORT.LIABILITY AND HANGARKEEPER'S
LIABILITY on page 9:

In a memo to Council dated December 27th, the Director of Public _
Works reported that an error was made on Assessment No. :45,
� i North Bechelli-Freebridge Areas Assessment District, amounting
� to a $35..33 over-assessment. It is the recommendation of the
� Department of Public Works that a cash payment in this amount
be made directly to the Treasurer. .����,

� � A letter of appreciation dated January 3rd was, received from
' , the Downtown Merchants. Association for the City's assistance ��c
and cooperation in erecting_ and decorating the Christmas t.ree

Athens Avenue
� Attorney Donald Kennedy appeared before Council on behalf
of Larry Singleton, requesting reconsideration of the action
taken by Council at the meeting of December 18th re closure ���
of Athens Avenue. Mr. Kennedy mentioned procedural changes

at the public hearing and said that because the Planning
Commission recommendation supported closure of Athens .'
Avenue there was evidently some misunderstanding by the
public present at the hearing as to the necessity of their
presenting their facts.
Councilman Chatfield said that he has no objection to a new
public hearing but emphasized that there were no procedural
changes at the public hearing held on December 18th.
City Attorney Murphy substantiated Councilman Chatfield's
statement that there were no procedural changes but said
that he didn't think the people realized they should state their
views before the public hearing was closed. �
Councilman Chatfield saicl that this particular case has dis-
turbed him as Council has had no experience with Atheris
Avenue being open since Park Marina Drive was constructed,
and he would like to see the traffic conditions with the street
open. He referred to the instructions given to staff at the
December 18th meeting re traffic counts to be taken prior to
actual physical opening of Athens Avenue onto Park Marina
Drive, and subsequent to said opening. � �
Councilman Doherty said that he did not feel the procedure was
unusual at the December 18th meeting but that there was a mis-
understanding, and that he would favor giving the people the
opportunity to present their facts in the rriatter. -
In answer to Mayor Moty's inquiry, the City Attorney said it
would be necessary for Council to adopt a resolution of inten-
tion to call a new public hearing re Athens Avenue closure, with
which Attorney Donald Kennedy agreed.
MOTION: Made by Councilman Doherty, seconded by Councilman
Fulton that the City Attorney be instructed to prepare a resolution
of intention to permanently close Athens Avenue. The Vote:
Unanimous Ayes '
Councilman.Chatfield reiterated that he feels Council and the
Planning Commission acted without possessing necessary facts
in making their decisions re Athens Avenue and thinks Council
should have the advantage of traffic counts with Athens Avenue
open and closed, prior to the public hearing. - -
A discussion was held re the feasibility and cost of providing
a temporary connection between the paved portion of Athens
Avenue and Park Marina Drive to allow traffic counts, and it
was reeommended that Public Works Director Arness report
back to Council with accurate figures as to the cost involved.
Mr. Kennedy commented that such traffic counts might not be
realistic as it would be for a eornparatively short period.of
time.
As sociate Planne r Nebon said that he, think.s the Planning
Commission also would like the benefit of traffic counts.
Mayor Moty suggested that the City Attorney check with the
Traffic Engineer, the Director of Public Works and the Planning
Commission in setting the date for the public hearing.

The hour of 7:30 P. M. having arrived, Mayor Moty opened
� the;continued public hearing re RZ-8-67 - Kutras property. �
� '
� ' Associate Planner Nebon reviewed the. action of the Planning
Commission re RZ-8-67 and showed on the Vu Graph the
several alternate rezo�ning proposals. considered by the
Gommission, as contained in a memo to Council dated January
12, 1968. Mr. Nebon said it is the recommendation of the
Planning Commission that the zoning be changed to R-3-15
on the south portion of the property and that the existing R-1
; classification be retained on the remainder.
� Mr. ,Paul Caster, representing 214 petition signers fro.m the
Kutras Tract and a portion of the Garden Tract, submitted a
statement, which is on file in the office of the City Clerk, pro-
� testing the proposed rezoning of any portion of the prope,rty
east of the-ACID canal and north of South Street. In this
statement it was pointed out that the Kutras and Garden tracts
are two of the largest residential neighborhoods in Redding ;
and that together they form a large contiguous unbroken area
with a few multi-family units included. The petitioners .feel ���
that rezoning would threaten this continuity and the single
family character of the neighborhood. It was also stated that
apartment dwellings in the area have vacancies, whereas single
family residences.have s,old well and have few if any vacancies.
It is felt that if the area is rezoned it will depress the value of
the single family residences. The petitioners stated that they
have been fighting rezon•ing since 1965 in order to maintain the
desirability of their neighborhoo,d.
Mr. .Castor said: that in 196.5, when the subject�of rezoning
this property first came,up, the Planning Commission stated
that there would be no rezoning,until a realignment of South;
Street was completed. He commented that this realignment �
has. not taken place and the� residents feel ;that rezoning of
any po�rtion of this area would. result in. rezoning a parcel at�
a time until�all was .rezoned. �
In addition to Mr. Caster, the following persons, appeared in .
opposition to the proposed rezoning: Carl Hoots, Rhonda
Singleton, ,and Alice Conne r.
In a discussion of the affect R-3-15 zoning would have on

density, Mr. Nebon gave .the following. statistic re five.acres:

Councilman Doherty asked Mr. , Caster if he felt tha.t R-1 zoning
ac ros s f rom the W onde rwo rld pa rking 1ot was good zoning, and
Mr. Caster replied that he felt it was.
MOTION: Made by Councilman Denny, seconded by Councilman
Fulton that the public hearing be closed. The Vote: Unanimous
Ayes with Councilman Chatfield abstaining.
In a discussion of the proposed rezoning, Councilman Denny
asked what type of transition is considered good planning between
R-1, R-2, and R-3-15 zones. City Attorney I�alurphy stated that
the planning treatises recammend that transition be at the rear
property line, not at street lines.
Councilman Fulton asked if the applicant has shown the property
owners any plans as to the type of apartments intended to•be
constructed. City Attorney Murphy pointed out that Council is
not permitted by law to condition zoning.
In answer to �Mayor Moty's inquiry as to what actions Council
can take in regard to this matter, Mr. Murphy said that Cauncil
can turn down the recommendation of the Planning Commission
and take no further action; it may accept the Planning Comrriission
recommendation and, if so, the ordinance is ready for fi 'rst
reading this evening; or Council may propose an amendment or
charge to the Planning Commission recommendation, and if
Council does this, the proposed change must go back to the
Planning Gommission for review and report.
Mayor Moty said he believes the people in the area have a
legitimate concern re possible rezoning of the entire parcel to
R-3-15 and he doesn't believe that the proposals of the applicant
recognize the problems of the residents of the area. It is the
Mayor's belief that the Planning Gommission recommendation does
off e r reas onable p rote ction to the p rope rty owne rs and he favo rs
the Commission recommendation.
Councilman Dohe rty said he believes the Planning Commis sion
has done a good job and that R-1 zoning on the southern portion
of the property would be more inconsistent than R-3-15.
MOTION: Made by Councilman Denny, seconded by Councilman
Doherty approving the recommendation of the Planning Commission
re RZ-8-67. The Vote: Unanimous Ayes with Councilman Chatfield
abstaining.
Councilman Denny offered Ordinance No. 956 for first reading, an
ordinance of the City Council of the City of Redding amending
Section 30-3 of the Redding City Code, 1959, as amended, relating
to the rezoning of certain real property in the City of Redding.
Mayor Moty declared a five minute recess, after which the meeting reconvened.

Councilman Cliatfield inquired as 'to'h'ow extensive ari investigation
was made in regard to sight distance, and Mr; Fitzgerald said
that sight tests were conducted and that a 50 ft. sign could not be
seen from the Freeway until the motorist is on'the overpass on
Cypress Avenue. Mr. Nebon stated that no specific facts were
p'resented to the Plannirig Commission, on']:y generalized state-

After'a discussion of this matter, Councilman Chatfield, suggested
the public hearing be continued"to allow the applicant the oppor-
tunity to justify the application by coriducting`the n'ecessary field
survey. ' . .

Shasta County Recreation Commission
A report entit'led."Recreation -Resources of the Sacramento River
between Keswick Darri and the' Southern Shasta County Boundary" /�j�
' was rece'ived�from the Sh`asta County Recreation Commission.

Councilman Doherty expressed conce.rn that the report might
be adopted by the County as part of the County. Master Plan,
whereas portions. of the report,pe,rtaining to City land are
not wholly consistent with plans or objectives of the City. It
is his recommendation that Council and Staff. review the report
with this in mind.
National Safety Council , , ,
In a letter to Council dated January 9th, an offer was made„
by the National Safety.Council to p.rovide Highway Safety ,�
Programs Appraisal Service to.conduct a Pilot Proje.ct _,
for the Counties of Shasta and Tehama and the Cities of
Redding, Red Bluff, and Anderson for a fee of $2, 700.
Redding's share of the fee would be $700.
Traffic Engineer Hamilton spoke,in favor of thi^s project and
said that at a,meeting held last week, representatives of the
���G� Counties _and other Cities involyed expressed a,definite inter-
est, although formal approval would have to be obtained. ,
In a discussion of this matter, Mayor Moty and Councilman
Doherty indicated they favor participating in this project. ,
MOTION: Made by Councilman Dohe rty, seconded by ,Council-
man Chatfield approving participation by the City of Redding in
the Northern California Pilot Project to.be conducted by the,
National Safety Council, in the limit of $700, subject to partici-
pation by the other aforementioned entities. The Vote: ,

Shasta-Cascade Wonderland Assn. - re lease extension
In a letter to Council dated January 9th, the Shasta-Cascade

Parkview Avenue.

In a memo to Council dated January llth, the Employer-Employee
Relations Committee advised Council that it intends to submit a formal
�g!L; recommendation to Council no later than the meeting of Febru,ary. 5, 1968
concerning .the .propasal;to amend the City of Redding contract with the
Public Employees'. Retirement System to provide for the addition of social
security coverage.
CASCADE HALFWAY HOUSE ASSOCIATION .
Councilman Fulton reported that it is beyond the jurisdiction of a General
Law City to enter into a donation of City funds to an association such as
Cascade Halfway House Association. He referred to the City Attorney's

Mayor Moty indicated tliat`he will inake a $25. 00 donatian t� the Cascade Half-
way House Association and urged other citizens of the Community to support
this project. .
RESOLUTION - re Civic Auditorium

Denny that Reisolution No. 4004 be adopted, a resolution of the City
Council of the City of Redding establishing plan and schedule for

SEWAGE TREATMENT PLANT - re bids for aera.tion equipment .
� Iri a letter to Council dated January 12th, it was the recommendation of
� Clair A. Hill of the firm of Clair A. Hill & Associates, that Council
� reject a11 b,ids.on Bid Schedule No. 436 for aeration equipm,ent, and a
new invitation for bids be issued immediately,to be opened and awarded
� on January 26, 1968. It was stated. that the bid on whose equipment the
j estimate was .based was received too late for the bid opening and the �
! lowest a,cceptable bid was in an amount more than; 10% _over the, estimate. ,�,��

In a memo to Council dated January 11th, Planning Director Harris
recommended that a representative of the City be present at a public
hearing to be held in Redding on January 29th by the Parks and Recrea-
tion Department of the State of California re. rules and regulations for
the disbursement of funds under the Federal Land and Water Conservation �l�
Act of 1965, in or,der to .present the_City!s viewpoints. , .

reported Shasta County's reasons for placement of curb and gutter on
Lake Boulevard as outlined �in R_es-olution.No. 3997. �At the meeting of `�'3��
January 2nd when said Resolution was adopted, Councilman Chatfield
had questioned the construction of such curb and gutter.

AWARD OF B'ID - Addition to Existing Hangar- at Redding Municipal Airport
Public Works Director Arness submitted the r_ecommendation of the
Department of Public Works' re'award of bid for furnishing and constructing
addition to existing open hangar at Redding Municipal Airport, B�id.=Schedule
No. 435; wh•ich is th�at the bid be� awarded to Detco Steel and Construction,-Inc. ,

"Sources and Correction of Infiltration - City of Redding Sewer System",

City Attorney Murphy reported that the League of Cali�ornia Citie's�� is
proposing an alternate formula for distribution of the Cigarette Tax
which would allocate the tax on a population-and sales tax basis. Mr. '
Murphy pointed out that such a formula would result in a loss of revenue
to the City of Redding of approximately $70, 000. annually. Mr. Murphy
��l(c stated that the Ci�ty�of--Commerce has protested this proposal 'and he
suggested that Councilrmight wish to do likewise.
Mayor Moty declared this an urgency item.

Denny that the Mayor be �authorized to vigorously protest to the League
of California Cities Board of Directors the proposed modification re
allocation of Cigarette Taxes to Cities, and also to appeal to the appro-
priate legislators to continue the present system re allocation. The
