The Pledge of Allegiance to the Flag was .led by Planning Commissioner Greenleaf. The Reverend George Lindsay, Pastor of the Pilgrim Congregational Church, offered the invocation. The meeting was called to order. at 7:05 P. M. by Vice Mayor Chatfield with the following Councilmen present; Anderson, Denny, Fulton, and Chatfield. Reddin� Chamber of Commerce A. communication, dated July 31 , 1969, from the Redding Chamber �-> of Commerce regarding the Convention Bureau Budget was referred �=�✓ ,�-' to the Auditorium Committee for review and recommendation at the � �� meeting of A.ugust 18, 1969 • Redding Chamber of Commerce Sid Cowgill submitted a Promotional Program prepared at the request of the Redding City Council by the Chamber of Commerce Advertising �L�%� Committee. The Program, which is divided into three sections, was reviewed in detail by Jack Cain, Chairman of said Committee. With the approval of Council, Vice Mayor Chatfield referred the matter to the Council Advertising Committee (Councilmen Chatfield and Denny) . Economic Development Corporation of Shasta County A letter of appreciation was received from the Economic Development :��/J Corporation of Shasta County for as sistance in helping make the Mountain Lakes Industrial Park a reality. The Vote: Unanimous Ayes A.PPOINTMENT - Recreation and Parks Commission On behalf of Mayor Moty, Vice Mayor Chatfield submitted the name of Clyde 5ma11 for consideration as a member of the Recreation and Parks Commission, replacing David Passarell. The � Vote: Unanimou� A.yes , a 135 PUBLIC HEARING - Rezoning A.pplication RZ-5-69 The hour of 7:30 P.M. having arrived, Vice Mayor Chatfield opened the Public Hearing on Rezoning A.pplication RZ-5-69 • The following documents are on file. in the office of the City Clerk: � A.ffidavit of Mailing - Notice of Public Hearing � Affidavit of Publication - Notice of Public Hearing � Planning Commission Recommendation dated 8/ 1/69 The City Clerk advised Council that no written protests had been received. Planning Director Harris reviewed the recommendation of the Planning Commission which proposes that the zoning in the area be changed to R-1-ST, R-2-RT, R-3-15, and C-1 , as depicted on Map Exhibit PC-1 , dated July 8, 1969 . The subject area under considera- tion for rezoning is located on the north side of Lake Boulevard, ex- tending east from Poinsettia Avenue to the Southern Pacific Railroad tracks . A small portion of the area lies on the south side of Lake ��/�� Boulevard, just to the east of Lake Boulevard Subdivision. Mr. :A . E. Koehler, who owns property on the north side of Lake Boulevard in the parcel proposed to be zoned R-3- 15, said that he objects to the proposed R-3-15 and R2-RT zoning because his deed restrictions limit him to R-1 . � City A.ttorney Murphy said that the City has an established policy , founded on law, whereby deed restrictions , either pro or con, cannot be considered in a zoning matter, as such restrictions are a matter of private contract between buyer and seller and are not � one of the established criteria used in determining a particular � zoning.: Upon being que.stioned by Vice Mayor Chatfield, Mr. Koehler said he would have no objection to the proposed zoning if his deed re- � strictions could be changed. � Mr. Carmona, who imposed the deed restrictions , said he would not object to changing the deed restrictions if all of the property owners were in accord. Mr. and Mr s . Ed Kowalew ski, who re s ide on Poins ettia Avenue, would prefer to have the proposed C-1 zoning changed to CO-BR. Mr. Eugene Michelson, who resides at 834 Lake Boulevard and whose proper.ty is proposed .to be rezoned R-3-15 (south side�of Lake Boulevard), would .like to have his p.ro.perty z_oned CO-BR. The property to the east of Mr . Michelson is zoned CO-BR, and he stated that he was advised by two realtors that his property would be more valuable if it were zoned CO-BR and that the property fronting on.Lake Boulevard is no. longer suitable for ; residential use because of the heavy traffic. He further stated that the topography of his property makes it unsuitable for a multiple family dwelling. Mr. Michels on said that Mr. Houston Sapp, .852 Lake Boulevard, shares his views and would like, to have I his property zoned CO-BR. � . . . ' Mrs. Kowalewski submitted a letter from Mr. and Mrs. Allan Barichero, 3769 Yuletide A.venue, in which it was requested that the ar,ea fronting on Lake.Boulevard (north side) between Poinsettia and St. Nicholas Avenues be zoned CO. ; Mrs. Jones of 3746 Yuletide Avenue also prefers CO-BR zoning over the proposed C-1 . I I i � 136 Planning Dir.ector Harris reported that when this zoning was � considered, Mrs. Kowalewski and Mrs . Banchero stated that they did not object to the C-1 zoning. The Commission felt it was most appropriate . Mr . Harris said that C-1 is more flexible that CO; C-1 is designed to backonto single family lots, and he believes the conflict between C-1 and CO-BR are negligible. Mr. Harris said that the area proposed for R-3-15 zoning was recominended by staff, and the Commission concurred in the recommendation. He said he is certain that in the future these uses should be expanded as the density of traffic increases. The R-3-15 zoning on the south side of Lake Boulevard was based on the current residential usage. In answer to Mr. Michelson's inquiry as to what determined the boundary line between CO-BR and R-3-15, Mr. Harris explained that the area now zoned CO-BR (which is adjacent to Mr . Michelson's property) was done at the request of the property owners . Vice Mayor Chatfield asked what the "F" designation denotes on the property zoned C-1-F across Lake Boulevard from the proposed C-1 zoning. Mr. Harris replied that this allows the Commission to control the placement of buildings on the property. Mr. Chatfield said he believes the Commission should have con- sidered C-1-F on the northern piece of property. He further stated that he believes there is sufficient reason to have the Commission restudy this rezoning application. Mr. Carmona requested that the parcel proposed to be rezoned R2-RT be rezoned this evening. He spoke of having a client interested in this parcel of land and said he would probably lose the sale if the matter were delayed. In a discussion of this rezoning application, Councilman Fulton recommended that the R-3-15 zoning on the south side of Lake Boulevard be changed to CO-BR. Councilman Denny commented on the fact that the property owners were given an opportunity to present their arguments for and against the zoning at the pub- lic hearing held before the Planning Commission, and he can see endless delays if the procedure allows new arguments, and • that this makes the Planning Commission hearings useless. City Attorney Murphy said that in a rezoning matter, the Council's position is one of holding a trial de novo, and it is proper for persons to appear and protest the proposed rezoning if they feel it is improper. Councilman Anderson favors considering new arguments at Council public hearings on rezonings, although he can see merit in Mr. Denny's position re delays. Councilman Chatfield said he believes there should be some serious effort made to try to bring the deed restrictions into line with what- ever areas are to be rezoned. MOTION: Made by Councilman Denny, seconded by Councilman Fulton that the public hearing be closed. The Vote: Unanimous A.yes .'q _ I 137 Councilman Denny offered Ordinance No. 1008 for first reading, an ordinance of tlie City Council of the City of Redding amending Section 30-3 of the Redding City� Code, 1959, as amended, relating to the rezoning of certain real property in the City of Redding. (covers only parcels to be zoned R- 1-ST and R-2-RT in RZ-5-69) PUBLIC HEARING - re Weed A.batement The hour of 8:00 P.M. having arrived, Vice Mayor Chatfield opened the Public Hearing re Weed A.batement. The following documents are on file in the office of the City Clerk: Affidavit of Mailing - Notice of Public Hearing ' A.ffidavit of .Posting - Notice of Public Hearing . ; The City Clerk ad�vised.that several.written communications had been received pertaining to this weed abatement program which were referred to the Fire Marshal. Fire Marshal Wade advised Couneil that originally there were 260 parcels in this weed abatement program but that only 140 parcels remain to be declared a nuisance. Joe Gregory appeared before _Council and prote_sted having to ��— abate the weeds on his property located on Bechelli Lane_extension, � � contending that property belonging to the State of California (right-of- way along the freeway and excess State land which the City is in the process of acquiring) should be abated also. Mr. Gregory was ad- vised that the City will abate the weeds on the excess State land upon acquisition but does not have jurisdiction over State owned property. Mr. Gregory was told that if he prepared a fifty yard firebreak between his property and that of the adjoining land owner , that ; would be sufficient. CIVIC A.UDITORIUM - Seating Contract City A.ttorney Murphy submitted the contract between the City of Redding and Holsinger, Inc. , for Council consideration. This contract provides for the rnanufacture, construction, and installation of a seating system for the Redding Civic Auditorium, providing a total of 2,221 seats at a cost of � $263,000. J�•�� MOTION: Made by Councilman Denny, seconded by Councilman Anderson approving the award to and contract for the :�:?nanufac't�ure , construction, and installation of a seating system for the Redding Civic A.uditorium as � outlined herein, and authorizing the Vice Mayor to execute said contract on behalf of the City: Voting was as follows: A.yes: Councilmen - A.nderson, Denny, Fulton, and Chatfield Noes: Councilmen - None A.bsent: Councilmen - Moty RESOLUTION - Prohibiting Parking City Attorney Murphy submitted a resolution prohibiting parking between the hours of 2:00 A..M. and 6:00 A..M. in all City of Redding Public Parking Lots for Council consideration. Mr. Murphy said that this action was recornrnended by Captain Joe Kohn of the Redding Police Department and �`�;� has the approval of the City Manager. The Traffic and Parking Comrnission �.:� ,� was polled regarding this matter and the Chairman of the Commission indi- � �!, cated he does not favor the resolution. / ��� Officer Westrip of the Redding Police Department commented that the parking problem in the public lots is from 10:00 P.M. to 2:00 A..M. , and not from 2:00 A..M. to 6:00 A.M. In a discussion of this matter it was determined that it would be difficult to prohibit parking prior to 2:00 A..M. because of the use of the parking lots by theater patrons , et al. A. discussion ensued re the practicability of closing the City parks at a given hour each night.
