Anderson to fill the vacancy on Council created by the resignation of Frank Doherty: MOTION: Made by Councilman Denny, seconded by Councilman Chatfield � that Robert C. Anderson be appointed to fill the unexpired term of Frank J. Doherty on the City Council. Anderson for accepting the appointment and he was welcomed by the Mayor and Councilmen. C OMMUNI CA.TIONS Bill Rhyne - re A.nnexation A communication was received from Bill Rhyne requesting annexation of his Quartz Hill property to the City of Redding. Planning Director Harris recommended that this request be referred to the City Attorney, Public Works Director , and ��� himself to work with Mr, Rhyne in developing a proposal which would create a more logical boundary for annexation. MOTION: Made by Councilman Chatfield, seconded by C.ouncilman Denny that Mr. Rhyne's request re annexation be referred to the City Attorney, Planning Director, and Public Works Director for review and then submitted to the Planning Comrriis sion. Hill �vu commended City crews for the excellent job done during the Christmas week snow storm in maintaining all City functions. 9 Del Norte County Chamber of Commerce The City Clerk was instructed to forward to the Redding Chamber of CoxYunerce an invitation received from the Del Norte County Chamber of Commerce to a Crab Festival ��1�'' to be held on February 9th in Crescent City when it was determined that no one from Council could attend. State Division of Highways A. communication was received from the Division of Highways advising that relinquishment of Highway Right of Way (portions of superseded State Highway 44 between ��!-� Hilltop Drive and East City Limits) was recorded in the . Shasta County Recorder's office. Pastor John V, A.lbri�ht, Sr. A. communication was received from Pastor John Albright . requesting that Council appoint alternates for Council repre- ' sentatives on the Shasta County Community Action Project I Board of Directors and also inquiring as to whether Council � desired either a written or verbal report of the activities 1�J,G�,-'�� of the organization. CIVIC AUDITORIUM In response to a request of the Redding Business and Professional Women's Luncheon Club that consideration be given to naming a room in the Civic Auditorium in honor of Owen T. Lyon, the Auditorium Committee recommended that either the north or the south patio, preferably the north, of the Auditorium be designated "City of Redding Memorial Patio" , and therein a suitable plaque installed which would provide room for a Roll of 1-�•��-� Honor on which the names of those citizens of Redding who have rendered exceptional and heroic service to the City, or the State or the Nation may be inscribed. It was further recommended that the first name to be affixed to this Roll of Honor be the name of Owen T. Lyon. 11 MOTION: Made by Councilman Denny, seconded by Councilman Anderson approving the recommendation of the Auditorium Committee re designating a "City of Redding Memorial Patio" at the Civic Auditorium as outlined heretofore. The Vote: Unanimous A.yes a The City Clerk read a communication received from the Redding Chamber of Commerce concerning the Chamber Convention Bureau in which it was recommended that (1) Nye Wilson be retained as acting manager of the Civic Auditorium from now until the auditorium opens , and (2) that Council act on items on which policy decisions must be made , such list of items to be submitted by Mr. Wilson within 60 days . Councilman Denny reported that Nye Wilson met with the Auditorium Committee, the Chamber Convention Bureau, and the Architects last Wednesday, Thursday, and Friday on matters of some urgency that must be resolved to insure that when the auditorium is ready for occupancy the City will have an organization that will function. Mr. Denny stated that up to the present time Mr. Wilson has been meeting at infrequent intervals with the Auditorium Committee but the Committee believes it is .obvious that from here on out the City will need someone to give direction to convention related activities, and feels that Mr. Wilson is qualified and prepared to render this service to the City. It is therefore their recom- mendation that the City' s contract with Mr . Wilson be modified in such a way that he be designated as acting auditorium manager until such time as a permanent manager is employed. Mr. Wilson and the Comrnittee feel that probably about six months prior to completion of the auditorium the City should have a permanent manager employed. Mr. Wilson is working with the Auditorium Committee, the City Manager, .and Finance Director to advertise such a position and will assist the City iri screening and selecting a qualified auditorium manager. The amendment to the employment contract between the City and Nye Wilson was reviewed by Council and certain changes pertaining to Mr. Wilson�'s compensation were interlineated in the document. � MOTION: Made by Councilman Denny, seconded by Councilman Chatfield � approving .the amendment to the employment contract between the City of Redding and Nye Wilson. The Vote: Unanimous Ayes REQUEST TO LEAVE THE UNITED STATES Mayor Moty requested permission to leave the United States for the week 1 of February 2nd to vacation on Queen Charlotte Islands. ; ,�7� MOTION: Made by Councilman Chatfield, seconded by Councilman Anderson approving the request of Mayor Moty to leave the United States for the week of February 2nd . The Vote: Unanimous Ayes with Nlayor Moty abstaining , POLICE DEPA.RTMENT - Reserve Auxiliary Police Program In a memo to Council dated January 9th, City Manager Cowden made a progress report regarding the City of Redding Reserve Auxiliary Police Program. Mr. Cowden reviewed his written report and a supplemental � report made to him by the Chief of Police and Personnel Director , dated January 17, 1969, in which it was stated that the police reserve program '��� has been temporariTy suspended until information concerning police reserve programs in effect in other cities can be assembled and certain program elements can be reviewed and evaluated. j Councilman Fulton askedwhy:the Chief and the City Manager had "scuttled" the program. � . � , Mr. Cowden said the program has n,ot been "scuttled" , just temporarily suspended. j.He further stated that Staff is not�:sure that the program as it is presently constituted is functioning as it should. . In answer to Councilman Fulton's inquiry as to whether any complaints had been received from citizens re the program, Mr. Cowden replied, "No". He added that his final report and recommendation will be put together 12 for Council approval within 60 to 90 days. He said he does not profess to know much about auxiliary police programs and wants to be sure the � City has a proper one. Mayor Moty asked how many cities are being contacted for the informa- tion set forth in the supplemental progress report of January 17th and was advised by the Personnel Director that 28 cities have been contacted. Also, Mr . Robert Whitmer , representative of the International A.ssocia- tion of Chiefs of Police, has been contacted for advice as to auxiliary police programs: Mayor Moty asked the City Attorney if it is not true that, according to the ordinance, the authority to suspend or cancel the activities of the police reserve program rests with the Police Chief and the City Manager. Mr. Murphy confirmed this . Councilman Anderson said he favors a temporary set of rules and� continuing the auxiliary police on duty, rather than suspending the program. Councilrrian Denny' supported the recommendations of the City Manager, Police Chief, and Personnel Director, stating he believes that it would take almost as long to set up temporary rules as to make a more detailed study and recommendations for a permanent program. Mr . Cowden said that, at this point, Staff is not certain that the recommendation will be to contiiiue the program or whether the cost will justify it. Councilman Chatfield commented that he does not think that anything that has been said is a criticism of the Department as a whole or a criticism of inembers of the organization. He said that he believes the ordinance should be reviewed carefully and that there should be some provision for these reserve officers to be known the same as any other policeman, and also that they should be residents of the City of Redding. He sees no provision in the Code for Council to make policy on this at the present time. Referring to certain newspaper articles in the Record Searchlight, he said that Council has to be kept informed by Staff. Mr. Chatfield also believes that the reserve officer program should be a budget item, if only for $1 . 00. Councilman Fulton stated that the presence of an auxiliary policeman with a regular police officer in a patrol car is a good backup, and he does not think it should be dropped for 60 to 90 days . Councilman Denny said he agrees with Dr. Fulton regarding the presence of auxiliary police officers but feels there is an exposure in having an organization whose functions are not clearly defined and made known to the public. Mr . Denny favors proceeding as recommended by the Chief of Police and:Personnel Director. Councilman Chatfield said he thinks it is up to the City Manager and the Chief of Poliee, but they should assemble the riecessary iriformation as rapidly as possible and bring a recommendation to Council at an early date. He would prefer to have the a�iliary officers refrain from active duty for a short period of time. Mayor Moty said this publi city ha s b r ought up in hi s mind the ne c e s s ity of having the i�-ndependent Police Report come out of Committee. He appointed Councilman A.nderson as a member of the Council Police Report Committee to replace Frank Doherty.; arid re�izested the Gori�nitte;e. to• report to rouncil as- to the portions they feel�shoul•d pe• implemented. Mayor�Moty reviewed the history of the reserve officer program,, pointing out.that the original program was initiated in 1940,and that' the ordinance was amended in 1958; but that there was no menti�n of the ordinance in the newspaper , either at the time of the first reading or when it was adopted. The Mayor said that 13 when he was appointed to Council, three of the Councilmen who were on the Council at that time were also Councilmen in 1958 when the ordinance was amended, but that it did not occur to them to advise him of the existence of the reserve police officer program. One of those Councilmen was a reserve police officer. The Mayor said that he could see why the Police Chief felt there was no necessity to inform Council; that he assumed Council knew all about the pro- � gram. He is certain there was no intention to hide this information -- it was just a matter of Councilmen being unaware of it. Mayor Moty thinks the City Manager , Police Chief, and Personnel Director have taken the right step; that it is time to take a hard look at the program to see if it is worthwhile . He does not feel a decision should be made on the future of this program untiT.all of the information is assembled and evaluated. , Pat Patterson, Vice President of the Five Counties Central Labor � Council said he feels that it should be determined whether such reserve police officers are physically and mentally qualified. He � asked who the gentleman was who had the revolver ill concealed (referring to an article in the Record Searchlight). : I ' Police Officer Sam McCall remarked that the police officers are having to take the brunt of charges about the reserve police officer program. ' He brought out the fact that in reports in the Police Department files , in every instance'where a reserve officer is present where an arrest is made, his name is on the report, which indicates that the auxiliary police program was not hid from reporters. Ted Temer , KVCV and CHannel 12 newsman, came forward and said that as a working newsman he was well aware that the organization existed. He said that some time ago he had been approached re being a reserve officer but had to decline as he was out of the City too fre- guently. Mr . Temer said that with only two patrol cars on duty at night and one police officer in each car , if an officer picks up a drunk in an automobile that a problem is presented because, with only one man, the car cannot be inventoried and impounded without help; so � the single officer must radio for help and wait at the scene until help arrives unless an auxiliary police officer is present. For this reason he believes the auxiliary police program was a good thing. A.t this point the reporter for the Record Searchlight, Wesley Hughes , ; stood up and stated that he doesn't regularly cover the police station, but that on the occasions that he did cover it, while he had observed Officer McCall's signature at the bottom of the police reports he did not recall ever seeing Mr. Johannessen's name or the names of other a�iliary police on such reports, Darryl Moulton came forward and stated that he was a member of the auxiliary police and that as such he rode with a regular police officer on the night of April 17, 1968. On that occasion they sighted a suspicious looking vehicle pulling out of a service station so they followed it. Moments later they received a report over the radio that the service station had been � robbed. They pursued the car out of the City with the red light flashing and were able to stop the car only after the regular police officer fired a shot. Mr. Moulton said that although he takes no credit for the apprehen- , sion of the robber, he does feel that his presence helped to prevent the suspect from resisting arrest. He said that the April 18 issue of the ' Record Searchlight mentioned the incident and listed his name as the , reserve police officer in its account, and that later when the criminal was prosecuted his name was listed again in the paper as having been subpoened to testify. At this point Mr. Maur.ice Johannessen came forward and stated that he was 'a reserve police officer and was the person xeferred to in the ' newspaper article as the one carryirig an ill concealed weapon. He � said that he has had a�permit to carry a concealed weapon since 1957. He further stated he has spoken before many groups re�arding the auxiliary police officer program, and the help that is needed by the undermanned Redding Police Department. He mentioned that he spoke � 14 before the Shasta County Committee on Crime and Delinquency, and that this organization fully supports the local auxiliary police officer program. He commented that the reserve officers have been checked out by the FBI and the CII prior to appointment, and that the officers' only function to date has been to ride with patrolmen as that is all they have been authorized to do under this program. Wesley Hughes again stood up and said that the paper never said there was anything wrong with the program but only said that they were alarmed that the special police were carrying guns , were in civilian clothes , and were not wearing badges . He mentioned that the annual budget for the reserve officer program in Berkeley is $9,000, and said it would seem that the City of Redding could do it for considerably less and put the officers in uniform. Mr. Hughes said he was speaking for himself and not for the paper. Terry Miller, Sacramento Bee Correspondent, said he favors the program and urges its continuance. Councilman A.nderson said he favors going along with the recommendation of the Police Chief and Personnel Directo_r but urged that the recomrrien- dation to Council be expedited. Councilman Chatfield suggested that this be referred to Committ'ee as he feels there should be some study by Cou.ncil members as to what poi•tions should be covered by ordinance a.nd what should be coyered by resolution. Also, perhaps the Committee could expedite the matter. City A.ttorney Murphy said that if it is the Council's wish to refer this to the Council Committee on the International Police Chiefs Report that he would recommend that the Committee's study on this be permitted to be carried on simultaneously with its review of the Police Survey as he believes that the International Police Chiefs Report provides other alternatives for solving the problem of being undermanned which exists at present, and that Council should have the opportunity to con- sider the Corr�iittee's reconZrnendations on all of the alternatives at the same time. MOTION: Made by Gouncilman Denny, seconded by Councilman Anderson accepting the progress report submitted by the City Manager and accepting the report submitted to the City Manager by the Police Chief and Personnel Director, and that Council direct the City Manager, Police Chief, and Personnel Director to carry out the study program that has been outlined and make appropriate recommendations to Council at the earliest practical time and, in preparing and submitting such recommendations to give full consideration to related parts of the report that was prepared for the City of Redding by the International Association of Chiefs of Police. The Vote: Unanimous Ayes POLICE DEPARTMENT - re Career Development Program Finance Director Courtney submitted a memo to Council dated January 17th concerning the Police Department Career Development Program - Chico State College Public Administration Courses to be offered in the Redding area. Mr . Courtney reviewed the program, stating that 'it is Staff's recommendation that the City of Redding extend financial partici- pation to the extent of paying for tuition and cost of required t.extbooks for eligible Police Department employees taking authorized courses for �l�lx credit and who receive a passing grade . It is estimated that the cost of � tuition and books per man per semester will be approximately $'125. 00 or a total cost of $1 , 250 . for the remainder of the 1968-69 fi'scal year, based upon an estimated number of ten employees participating in this program. MOTION: Made by Councilman Denny, seconded by Councilman Chatfield approving Staff recommendation re City of Redding extending financial participation in the Police Department Career Development Program as outlined above. The Vote: Unanimous Ayes 15 AWARD OF BID MOTION: Made by Councilman Chatfield, seconded by Councilman Anderson approving the recommendation of Purchasing Director Brickwood that Bid Schedule No. 480 re Pad Type Distribution Transformers be awarded to Standard Transformer Company on / their A.lternate low bid of $5,078.85 , sales tax included. �"�'-� Voting was as follows: A.yes: Councilmen - A.nderson, Chatfield, Denny, Fulton, and Moty Noe s: Councilmen - None Absent: Councilmen - None RESOLUTION - Transfer of Funds re Fitchburg Chipper In a memo to Council dated January 16th, Parks Superintendent Blaser requested Council authorization to purchase a used Fitchburg under Emergency Purchases as defined in Section 22-8 of the Code, There was a discussion re the need for this chipper due to the un- precedented number of damaged trees on streets and other public lands, and Mayor Moty said he had reviewed this request and, as ����� a member of the Ways and Means Committee, thinks it is a good inv e s tme nt. � MOTION: Made by Councilman Denny, seconded by Councilman Fulton that Resolution No. 4171 be adopted, a resolution of the City Council of the City of Redding transferrin� and appropriating funds for the pur- chase of a used C-915 Fitchburg Chipper. ' REDDING MUNICIPA.L A.IRPORT - re A.vis Rent-A.-Car Services MOTION: Made by Councilman Chatfield, seconded by Councilman A.nderson approving the recommendation of the Airports Cornxnission re granting a permit to Interservice Funds, Inc. to operate A.vis ��r�� Rent-A.-Car service at Redding Municipal A.irport for one year , commencing February 1 , 1969, and authorizing the Mayor to sign said permit on behalf of the City. The Vote: Unanimous A.yes BENTON AIRPARK - Lou Gerard Motors Permit � MOTION: Made by Councilman Denny, seconded by Councilman Chatfield approving the recommendation of the A.irports Commission re issuance of a permit to Lou Gerard Motors re car rental service j /� at Benton A.irpark for a period of one year comxnencing February l , 1969, and authorizing the Mayor to sign said permit on behalf of the City. Public Works Director A.rness submitted the Clear Creek Sewage ��_ � Treatment Facility Report for the month of December , 1968. ��� SA.NITATION DIVISION , In a memo to Council dated January 17th, Public Works Director A.rness ; requested C-ouncil approval to call for bids for a load packer, and � approval to purchase one Cushman Scooter and 24 additional containers . ' The cost of the containers is $2, 301.60 as the supplier has agreed to � furnish them at the August 1968 bid figure . Mr . Arness stated that the =����- City is unable to provide sanitation service to the newly annexed Twin View area with the present equipment: Staff:plans to call for an alternate bid for automatic transmission on the load packer. Mayor Moty gave his approval of this request as a member of the Ways and Means Committee. Councilman Chatfield reported that it has been called to his attention that the Division of Real Estate would not approve a recent subdivision located in the former Buckeye County Water District because a 'valid water permit has not been issued by the State Bureau of Sanitary Engineering. The water permit issued to the Buckeye County Water District is rio longer valid because of the dissolution of the District. Members of Council were given a copy of a letter sent to the State l / Department of Public Health from the Bureau of Sanitary Engineering �(.��! setting forth t�ie requirements and recommendations re issuing a water permit to the City of Redding. ��J Mayor Moty declared this matter an urgency item. Councilman Denny offered Ordinance No. 991 for first reading, an ordinance of the City Council of the City of tZedding amending the Redding City Code , 1959, as amended, by repealing Chapter 23 and substituting therefor a new Chapter 23, pertaining to sewers . 17 BUCKEYE FIRE PROTECTION DISTRICT City Attorney Murphy reported that in December he and Chief Grant attended a Board meeting of the Buckeye Fire Protection District at the request of the Board Chairman. At that meeting the Board inquired as to whether or not the City would be interested in providing, pursuant � to contract, fire protection service to the District £or the portion re- maining after the Twin View annexation became effective. ��; � Mayor Moty appointed the following Committee to review the request and return to Council with a recoxruziendation: Councilmen Chatfield and Anderson, City Manager or his representative, City Attorney, Public Works Director, and Fire Chief. RESOLUTION - Approving Acquisition of Site for Proposed Fire Station No. 4 City A.ttorney. Murphy advised Council that Mr. T. R. Woods has offered to convey fee title to the City of Redding a site for a proposed Fire Station No. 4, to serve the Twin View annexation area, in consideration of receiving a credit in the sum of $2 ,865 . 00 on water service gross acreage charges applicable to some 19. 1 acres of land owned by Mr . Woods. The parcel /%'� of property is on the west side of Tamarack Drive immediately adjacent � to and northerly of the Rocky Point Eleme.ntary School, has a.frontage on �� ; , Tamarack Drive of 120 feet with a depth of 155 feet and a total area of . 18, 000 square feet. NOTICES OF COMPLETION , In a memo to Council dated January 16th, City Attorney Murphy reviewed � the procedure re filing notices of completion in public works contracts stating that, in his opinion, there is no risk of double payment by the City arising out of the filing of either an invalid notice of completion or the , failure to file a notice of completion, and such filing in regard to a public works contract is of primary benefit to the contractor and the surety. 7��' He further stated that the failure to file a notice of completion or the filing of an invalid one benefits the laborer or materialman by extending the � time both in which he can file a stop notice and in which he can bring an action against the labor and materials bond. A.LL INDIAN HALFWAY HOU5E � In a memo to Council dated January 16th, City Attorney Murphy stated that his comments concerning the City's legal ability to help support a private Halfway House organization formed as a non-profit corporation, are contained in a legal opinion rendered to Council on January 15 , 1968 in connection with a request of the Cascade Halfway House Association. Mr . Murphy suggested that perhaps the Community Action Project of ��:� Shasta County could be of assistance to this group.
