No. 1970-1 .

The City Clerk advised Council that protests had been received
f r om the f ollowing pe r s ons:

Denzil Roper
Edward W. Long
A.ssistant Civil Engineer Hastings showed on the Vu Graph the
area included in the A.ssessment District, stating that there was
a sign-up of approximately 69°jo. The original cost estimate was
$79,500; however, tlie lowest bid received was for $85,000. The
assessments were based on a basic benefit per lot of $250. , front
footage charges , and connection charges .

Mr . Hastings pointed out on the Vu Graph the location of
; the properties of the persons protesting.
Mildred Spohn Bagley appeared before Council and said she
was protesting because they intend to put a concrete patio
in their backyard but, because the City has requested a 5 ft.
easement across the back of the property, they would be
unable to do so. After discussion of this matter, Mrs .
Bagley was assured that placing a concrete patio over the
easement would be permissible and it was agreed that she
would be given a letter stating this.
The Ro�;er protest was then discussed. This is a large
parcel which could be developed into three legal lots. Mr.
Roper has beenas:sessedthree basic benefits plus front footage
charges, although the sewer line will terminate at the most
northerly point of his property as no street exists in front
of the property. The property immediately to the east of the
Roper property has been assessed in the same manner. There
, was considerable discussion regarding this matter and it was
� the feeling of inembers of Council that some allowance should
; be made, inasmuch as the sewer line will not be extended in
front of these respective properties at this time.
MOTION: Made by Councilman Denny, seconded by Councilman
A.nderson that the assessment of the Roper parcel be reduced
in an amount equal to half the cost of extending the sewer line
in such a manner that it would touch upon the three legal lots
that could be developed out of his property, and that the same
principle be applied to the property east of the Roper property.
The Vote: Unanimous Ayes
It was determined that Mr. Long's protest was based on his
belief that the property was not worth the assessment.
Bond Counsel Ed Ness submitted the analysis and recommenda-
; tion of bids for construction of improvements in the A.ssessment
District as prepared by Public Works Director A.rness , stating
that as a result of the lowest bid being in excess of the Engineer's
Estimate, it is necessary to continue the Public Hearing until
July 6 , 1970 , as all pr,operty owners must be notified of the in-
c'reased assessment. On July 6th it is the intention of the
Director of Public Works to.recomxnend the award of bid to
J. F. Shea Company, Inc. , the low bidder .

CONTINUED PUBLIC HEARING - Phase V-Curb, Gutter, and 5idewalk
Construction
The hour of 7:3 0 P.M. having ar rived, Mayo r Moty c ontinued
the Public Hearing re Phase V - Curb, Gutter, and Sidewalk
Construction.
A.ssistant Civil Engineer Hastings briefly reviewed the project
and illustrated on the Vu Graph a proposed solution to the
parking problem anticipated by the Native Daughters of the
Golden West if curbs , gutters , and sidewalks are constructed.
Mr. Hastings showed a plan whereby the present three vertical .
parking spaces would be co.nverted to two horizontal parking
��� spaces , yet the present overall total of seven parking spaces
could be retained. In addition, a curb parking space will be
gained, making a total of eight available parking spaces .
Mr. Hastings further reported that the storm drain which is
located under the building of the Native Daughters is inadequate
and the Native Daughters have offered to grant the City an ease-
ment along the south side of their property if the City will install
a storm drain. At present there is a drainage ditch in this loca-
tion and if the City put in a storm drain and eliminated the drain-
age ditch, the area could be blacktopped which would allow
parallel parking along that area.
A.ttorney Frank Shuman appeared on behalf of the Native Daughters
of the Golden West and commented that the drainage ditch had to
be dug to handle surface water because of the inadequacy of the
storm drain under their building. He said that if the City is
unwilling to accept the easement and install the storm drain along
the south side of the property, the Native Daughters will be
forced to barricade their property, thus forcing the surface water
elsewhere.
In answer to Mayor Moty's inquiry, City A.ttorney Murphy stated
that it is difficult to establish how the present storm drain came
into existance; that it may be a natural drainage system. If the
City did not put in the storxn drain or did not approve the design,
it is not the responsibility of the City. Mr, Murphy said that
on the basis of evidence before Council, he would say that the
City does not have a responsibility for the 12" line running
beneath the Native Daughters building. He further stated that

, in the absence of any clear cut evidence that the City has
any responsibility, Council might be making a gift of
public funds to put in a new adequate line. He questions
whether the City has the right to accept the offer of the
Native Daughters .
It was the concensus of Council that the matter of the storm
drain could not properly be handled under this type of procedure
which concerns only curbs, gutters , and sidewalks. However,
Councilman Chatfield did recomrnend installation of a catch basin
on the south side of the property to carry off surface water from
the drainage ditch.
Mr. Buel Hunt, 2058 Sonoma Street, requested additional time
to construct curb, gutter, and sidewalk in front of his home .
He said that City crews had been out resurveying today and he
has been unable to determine the proper grade. It was agreed
that Mr. .A.rness would get together with Mr. Hunt and that 60
days would be allowed for construction after the grade is de-
termined.

� RESOLUTION - Ordering Construction
MOTION: Made by Councilman Denny, seconded by Councilman
Fulton that Resolution No. 4313 be adopted, a resolution of the
City Council of the City of Redding ordering the construction of
certain designated streets in the City of Redding, pursuant to
Ghapter 27 of the Improvement A.ct of 1911 .
Voting was as follows:

RE�ONING A.PPLICATION - RZ-2-70
Planning Director Harris reviewed the Planning Commission report and
recorru-�iendation.re RZ-2-70 as contained .in a merno to Council dated
May 29, 1970 , said memo being made a part of these Minutes by reference.
The Commission concurred with the Council's recommendation to reduce
the area covered by height restrictions but was divided as to their
recomrnendation regarding the buffer strip. It is therefore the recom-
mendation of the Planning Director that Council approve the rezoning
from R1-B1 to CO-BR--F with�the Site Plan Review criteria as approved
by C ouncil on Ma.y 18, 19 7.0.. .

Mr. Carlton, A.ttorney for Mr. Watt said his client remains completely
adamant in his prio.r,views re.garding the width.of the buffer strip and
feels that to reduce,the buffer strip to .less :than_.100 ft. affects the
property of Mr. Watt and that it is an invasion of property rights. Mr.
Carlton further stated that Mr. Watt had talked to Mr. Farley, owner
of the property, and Mr. Farley had told him that he doubted that the
development would proceed because of title problems. Mr. Carlton
thinks it would be imprudent to rezone the property if it is doubtful
that the proposed development will go through.
Mrs. Hoff, 2746 Foothill Blvd. ,. also protested the reduced buffer
strip width.
Mr. Watt appeared before Council and was sworn by the City Clerk.
He reiter.ated that Mr. Farley had told him that he feels quite certain
that the "whole deal is .g.oing to blow up'.' because the bonding company
has his property tied up.
Mr. A.sbill, Attorney for the applicants, advised Council that Mr. Farley
has signed a grant deed to the applicants and that he anticipates and ex-
pects Mr. Farley to carry out this deal. He stated that escrow is open
and that one of the conditions of the escrow is the rezoning.

Mr. Theobold, the realtor who represents both the property owner
and the developers , stated that he has been in contact with Mr. Farley's
attorney and the attorney for the bonding company, and he is confident
that the problems that exist can be resolved and that the development
wi11 proceed. �
In answer to Mayor Moty's inquiry regarding procedure at this point,
City A.ttorney.Murphy replied that Council has the right to go forward
and adopt the ordinance��or defer�action for at least one Council meeting;
or, Council has the right to change its mind and not proceed, based upon
the testimony offered tonight. If this latter action is taken, the matter
would have to be returned to the Planning Commission for consideration
and report.
The question was raised as to whether an air conditioning unit installed
on the roof of a building would have to be under the 702 ft. height limi-
tation. Mr, Harri�s said he interprets the criteria to require that it be
under the 702 ft. figure but agreed that it might be well to reword the
criteria to insure that there is no misunderstanding.
MOTION: Made by Councilman Denny, seconded by Councilman Fulton
to change the wording on Item 3 . of the Site Plan Review criteria to
read: �
"3. Building height limitations for the east half of the property--
two stories and no bu.ilding, appurtenance, or structure to
ex<ceed the 702=foot elevation."
The Vote: Urianimous Ayes with' Councilman Chatfield abstaining.
Councilman Denny said that he would like to have assurance from Mr.
Farley that this rezoning is desired by him, regardless of the outcome
of the proposed development.
MOTION: Made by Councilman Denny, seconded by Councilman Fulton
tabling action on this matter until Council has notice in writing from
Mr. Farley that he desires this rezoning regardless of the proposed
development of Dr. Oler and A.ssociates . The_ Vote: Unanimous Ayes
with Councilman Chatfield abstaining.
It was noted that Council mtxst take action within 60 days from June lst
or the applicatiori will be considered as being denied.
COMMUNICA.TIONS
Leonard B. Burkhardt
In a letter to Council dated May 20, 1970, Mr. Burkhardt
complained about the inadequate flow of water from the
drinking fountains in downtown Redding.

drinking fountains`:in downtown Redding are cleaned an.d
adjuste,'d once a week and, to his knowledge, there. have
been no problems. M,r,. A.rness will write to Mr. Burkhardt
about this matter.
Shasta County She.riffs Posse,-ettes
In a communicatiori received by the City Clerk on May 27, 1970,
the Shasta County Sheriff Posse-ettes .requested permission to
sell beer at the Posse Grounds on Saturday, May 30th, between
the hours of 8:00 A.M, and 10:00 P.M.

Denny ratifying the action taken by Council in a telephone poll

California Council on Criminal Justice
Members of Council were invited to a meeting of the Region
' II Law 'Enforcement A.dyisory Board to be held in Room 31G ,
Courthouse, Reciding on Friday, June 12, 1970 =��'l
Mayor Moty noted that Police Chief Whitmer will attend the
meeting.
PETITION - re drainage facilities along...Clear Creek sewer line
A petition signed by owners of property on and/or near the Pioneer
Lane-Fagan Drive area, located southeasterly from the City of
Redding, alleges that the installation of the sewer line to the Clear
Creek Sewage Treatment Facility was done in such a manner that the
drainage facilities on and along said sewer line were damaged with
resultant damage to the property through which the sewer line runs .

Mayor Moty referred the petition to the Director of Public Works for
investigation and report back to Counci 1. � J ,7

Later in the meeting Mr. Charles Fagan appeared before Council and
emphasized that the area had no water problems until after the in-
stallation of the sewer line and he requested that steps be taken so
that the water can be drained.

Chatfield approving the recommendation of the Parks and Recreation

with the stipulation that people participating in the raft race will not

Traffic Engineer Hamilton briefly reviewed 'his study and :rep_ort on
Court Street traffic conditions which concludes that Court Street is in
good shape and little can be done to improve traffic condition,s. Mr.
Hamilton said that the Traffic and Parking Commission has .endorsed ��� �1
this study. .. A.fter discussion of this.matter. it was agreed that the
Traffic Engineer should keep an eye on the�intersection.of Court and
Yuba Streets with regard to pedestrians. Mr. -Laron Johnson, who
had written to Council regarding this matter, will be sent a copy of
