Depa`rtment'of Justice
A. letter was received frorn the State Department of Justice requesting
Council endorsement of certain legislative proposaTs in the fields of
criminal justice, environmental control, consumer protection, and
the rights and obligations of 18-year olds. • .

Councilman Denny suggested that the 'City shbuld' rely on the'recom-
mendations made by the League of California Cities rather �than
requesting the City Attorney to spend a considerable amount of
time to research matters that don't always pertain strictly to the
City of Redding. Councilman Chatfield said that SB678 and SB556
could affect the City of Redding vitally. The City Attorney was
requested to review the proposed legislation and report to Council.

Denny accepting the resignation of Mrs. Verne Junkans as the City

Chatfield approving the request of the Redding Softball League to c��� �

Kenneth R. Brown
A. letter was received from Kenneth R. Brown, 1154 Link St. , � ..�
Corning, California, requesting an indication from Council that � �
approval would be given for the operation of a card room with
no fewer than twenty card tables, conditioned upon compliance with
all provisions of the City Code.
City A.ttorney Murphy advised that under Section 10-4 of the Code,
the city council may either grant the license required by section
10-2 of this Code or refuse to grant the same when at times such
action is for the best interests of the city and the promotion of the
public welfare.
Mayor Moty stated his opinion that in the interest of public welfare,
the request should be denied.

A.d-Hoc Committee for Bicycle-ways
In a letter dated May 26, 1971, the .A.d-Hoc Con�snittee for Bicycle-
ways requested that Council consider the development of bicycle-ways in -
in the City. They submitted a map showing tentative bikeways . ���
Director of Public Works A.rness advised that he�a.:s been inve'stigating � ����
the possibility of bikeways in the City. He was requested to study the
matter further and report to Council. .
Redding Ambulance
, The request of Redding Ambulance for an additional ambulance permit vS�<3

City Attorney Murphy reported that it is the recoxnxnendation of

by Harvey W. Itzaina on May 24, 1971 in the amount of $76.01,
be denied.

Councilman Fulton requested that action on the claim of Louie

City A.ttorney Murphy advised that the passage of time and non-
action by the council would .constitute a denial of the claim.
City Manager Brickwood reported that he is investigating the
Claims Service as it has been difficult to contact the adjuster.

Planning Commission Recorr�nendation dated June 3, 1971

The City Clerk advised Council that no written protests had been
received.
Planning Director Harris reviewed the Planning .Commission
Recornxnendation re RZ-2-71 contained in a memo to Council
dated June 3, 1971, which memo is made a part of these minutes
by reference. The property proposed for rezoning is located
� north of Lake Boulevard, immediately east of the Southern Pacific
Railroad, and the applicant, First Federal 5avings and Loan, requested
"R-3-15" Multiple Family District, initially. However, the owner
wanted greater flexibility to develop different techniques of housing
than presently allowed.
The Planning Comxnission recorr�nended that the zoning be changed
to "U" Unclassified District as this is the only area where such
flexibility is permitted. The Planning Director explained that the
"U" Unclassified District has been used historically as a holding
zone. He indicated that the only reason the "U" District was
recorr�nended in this instance was the lack of an appropriate zone
which would allow the type of development desired. The "U" District;.
with the use permit does allow the flexibility wanted.

Mr. Harris reported that the staff is studying the third draft of
a Planned Unit'"`D-evelopment Ordinance. He said it may be from
, four to six months before the Ordinance is adopted.
Councilman Fulton suggested that action on the appli.cation should
be deferred until the proper classifications are established in the
code. Councilman Chatfield also expressed concern over the
deficiencies in the zoning ordinance regarding condominium
development. Councilman Denny said that if a project is legitimate,
it shouldn't be subjected to endless delays because our Ordinance
is inadequate. He stated that in the past we have lost sound
' developments because of delays .
Luke Mutchie, 500 Lake Blvd. , inquired as to whether consideration
has been given to the traffic pattern at the Lake Blvd. and Clay St.
intersection. He was advised that Clay St. is to be redesigned.
MOTION: Made by Councilman Denny, seconded by Councilman Fulton
that the Public Hearing be closed. Th'e Vote: Unanimous A.yes
MOTION: Made by Councilman Denny, s econded by Mayor Moty
approving the recommendation of the Planning Comxnission that the
property (RZ-2-71) be rezoned to "U" Unclassified District and
instructing the City Attorney to prepare the necessary ordiriance.

Councilmen shared a general concern for the hardship caused to
the develop�er by the delay. The Planning Di rector was requested to
prepare the Planned Unit Development Ordinance for consideration
and adoption at the earliest possible date.

, Planning Director Harris reviewed the Planning Commission
Recoxnmendation re RZ-3-71 contained in a memo to Council
I dated June 3, 1971 , which memo is made a part of these minutes
by reference. The property proposed for rezoning is located on
the north side of Hilltop Drive, between Interstate 5 and the Hilltop
Restaurant, and the applicant, Joe Gregory, has requested that it
be rezoned from "U" Unclas sified District to "C- 1''' Neighborhood
Commercial District, "R2-RT" Duplex District permitting
mobilehome parks, and !_''Rl-ST" Single Family District permitting
a mobilehome on a lot, or more restrictive districts .
Mr. Harris advised that the Planning Corrunission has recommended
that the zoning on a portion of 182 acres be changed from the "U"
Unclassified District to "R1-ST-F," "R2.=R'T��F.;�:'� ::"C-1-F," and
'''U-F`."

Mayo,r Moty inquired as to.the difference between this. 'rezoning and
RZ-2-71. Mr. Harris explained that since the property is already
zoned "U" Unclassified District, it is possible to proceed with
development by Use Permit A.pplication. He said the Planning
Commission approved the Use Permit A.pplication for multiple
family use on property in the "U" District subject to eight
conditions which he reviewed for the Council. He indicated that
the site plan criteria was more restrictive than the requirements
in the multiple family districts.
Director of Public Works A.rness reported that the area can be
served by the city system and the Twin View Sewer A.ssessment
District. Plans for development would have to include sewer
and water facili�ies-.e He said there is a water line along Hilltop
Drive. I�3e�indi.cated that a sewer line would have to be extended
from the vicinity of. the Casa Blanca Motel to Hilltop to serve
the property. The electric utility is underground on Hilltop Drive.
Marshall Kent of Marshall Kent A.ssociates of Napa stated that his
firm was retained by Orval Ogle to prepare the Land Plan for this
property. He concurred with the recommendations in the staff
report and said this is an unusually good piece of property to be
developed.
Mr. C. W. Erickson, adjacent property owner, said that he approves
this project. He statedthat he gave a 20' eas:e;rnent to the 'Twin View
Sewer A.ssessment District to serve the northeas.t _ portion of the
property and that if the developer does not� intend to use the
easement, he will abandon it. He requested that a fence be con-
structed along the proposed green belt to prevent encroachment on
his property.
MOTION: Made by Councilman Denny, seconded by Councilman
Fulton that the Public Hearing be closed. The Vote: Unanimous A.yes

Chatfield approving the recomrrzendation of the Planning Commission
that the property (RZ-3-71) be rezoned to'R1-S'Ir_F';-" "R2�'=R"T-F';"
"C-1-F," and "U-F" Districts, and instructing the City A.ttorney
to prepare the necessary ordinance. The Vote: Unanimous A.yes
Mayor Moty called for discussion of a communication from Marshall
Kent & Associates, Inc. , dated May 12, 1971, re sewer line
extension. Mayor Moty inquired about the availability of city funds
for the extension of the sewer and when such an extension would
be needed.
Marshall Kent advised that the first stage of the development may be
ready for occupancy by November. He stated that his firm would be
willing to pay in advance, acreage fees which would fund 50°jo of the
cost of the line extension.

Councilman Chatfield said that he does not feel it is fair to create
a hardship to the property owner when it is the City that has been
� lax in not providing the tools necessary for this type of property
development.

, Council urged staff to submit an ordinance for Planned Unit
Development as soon as possible. Councilman A.nderson requested
more flexibility in the code for development of horizontal condominiums.

Lyonr- for winning the second place award in the enterprise series category
from the A:ssociated Press News Executives Council for his articles on
illegal pyramid-selling techniques .

STREET IMPROVEMENTS - Cliff Drive & Sonoma Street
Councilman Fulton reported that he and the City Manager, and the Director �� �
of Public Works have reviewed the request of Mrs. Helen Faye Generes � � S
regarding Street Improvements in the vicinity of Cliff Drive and Sonoma
Street. His recornrnendations to Council are as follows:

1. The City of Redding will replace::the storm drain line and
construct a side inlet catch basin in the general vicinity
of the existing grate at Cliff Drive and Sonoma Street.
2. The City will perform its work concurrently with the
construction of curb, gutter and driveway ramps by the
abutting property owner .
3. Since there appears to be need for more curb and gutter
in the area and since there was some interest indicated
by an adjacent property owner during our field trip, we
recommend the circulation of a petition to install curb and
gutter in an expanded area. The City of Redding would
place asphaltic concrete in accordance with its standard
street improvement policy.
MOTION: Made by Councilman Anderson, seconded by Councilman
Chatfield approving the recommendation dated May .18, 1971 , as
outlined above. The Vote: Unanimous A.yes
LA.FCO - A.lternate Member
MOTION: Made by Councilman A.nderson, seconded by Councilman
�-���� Fulton verifying the reappointment of Councilman Chatfield to serve
as A.lternate Member to LA.FCO for a four year term.

EMERGENCY SERVICES OPERA.TIONA.L PLA.N
City Manager Brickwood submitted the Emergency Services Operational
Plan which is an upgrade of the previous Civil -Defense Plan. He advised
that the upgrading is required before July l , 1971.in, or.der that State or
,� � Federal funds may be available to the City of Redding in case of any
disasters or emergencies that may occur.

Anderson approving the City of Redding Emergency Serviees Operational

BUDGET
Finance Director Courtney submitted the 1971-72 Preliminary Budget.

Fulton approving the extension of lease between the City of Redding a I `f
and the Shasta Union High School District covering the fire cache
building for an additional term of two years , to expire on June 30, 1973.

NCPA - Report
In a memorandum dated June 1, 1971, City Attorney Murphy advis ed that
the NCPA. adopted the following resolution On May 27, 1971:
"Be it resolved that the officers of the NCPA. be authorized to
execute a contract for and in behalf of the NCPA with the U.S.
Gov-e.r.nment., :obligating the NCPA. to a total contract cost to NCPA.
not':iri::'exce"s.s:�:of�$2-:0',Q00 to make ioad flow studies to determine
the impact upon the Pacific Northwest Intertie resulting from the
transmission of the proposed power to be geothermally generated
by NCPA, in the Geyserville area in relation to the load flows of f
the other users of th'e Intertie, and that the officers of the NCPA. / � � �
' be authorized to execute. a contract with R. W. Beck and Company
in�the sixxri of not more than� $14;000 to provide engineering services
in•relation to the deve�lopment of the required NCPA. load flow data
needed as input in the Federal contract in order to accomplish the
required study, both authorizations subject to the following two
conditions;
(a) That the Executive Committee of NCPA. first be satisfied as to
the availability of sufficient geothermal steam to generate the
projected power generation.
(b) That each Commissiorier shall have obtained from the City
Council of his City consent to apply that city's previous
contribution to the�special assessment made heretofore for
- an advance planning program to the payment of the aforesaid
contracts, it being the view of the Coxnrnission of the NCPA. that
these studies are necessary to the proposed geothermal contract
contemplated by the NCPA. and are sixnilar in function to the
heretofore approved advance plan study."
MOTION: Made by Councilman Denny, seconded by Councilman Fulton,
authorizing the expenditure by the NCPA. of the pro-rated share originally
authorized by the City of Redding for an A.dvance Planriing 5tudy, to be
spent for purposes outlined in the letter from the City A.ttorney.

RESOLUTION - re Twin View A.nnex No. 2 •
MOTION: Made by Councilman Fulton, seconded by Councilman Denny
that Resolution No. 4442 be adopted, a resolution of the City Council of
the City of Redding withdrawing from the Buckeye Fire Protection District
��, that portion of the District lying within the boundaries of Ci ty of Redding
