The Pledge of Allegiance to the Flag was led by Airports Manager McCall.
The meeting was called to order at 7:00 P.M. by Vice Mayor Chatfield
with the following Councilmen pres ent: Ander son, Denny, Fulton, and
Chatfield. A.bsent: Mayor Moty

George Dymesich
With the approval of Council, Vice Mayor referred to the
Planning Commission a communication dated December 18th from
George Dymesich requesting consideration for a type of zoning ����
that would permit construction of a 16 story building for senior
citizens, to be located adjacent to the Elks Club.
City of San Leandro
No action was taken by Council re the request of the City of
San Leandro for support of legislation which would require � ��
the presence of safety warning flares in all vehicles. Vice
Mayor Chatfield and Councilman Denny expressed reluctance
to support a measure until they had seen the actual bill.

to seek action to alleviate the problem of litter and waste disposal
created by the sale of products in disposable, non-returnable containers.

MOTION: Made by Councilman Denny, seconded by Councilman Fulton
approving the recommendation of the Finance Director that Bid Schedule
No. 579 , Parking Meters , be awarded to Traffic A.ppliance on their
��;j A.lternate Bid of $99.75 for double meters and $48.30 for single meters,
including California Sales Tax.

POLICE DEPA.RTMENT - Electronic Corrirnunications Control Center
In a memo�to Council dated January 4; 1971 , City Manager Brickwood
stated that because of deviations from advertised specifications on Bid
Schedule No. 582 , Electronic Communications Control Center, the low
bidder and the next lowest bidder are disqualified. Since Motorola's
�G� bid was double the budgeted amount of $5 , 000, it is the recommendation
of the City Manager that all bids be rejected and the City Manager be
authorized to readvertise.
MOTION: Made by Councilman A.nderson, seconded by Councilman
Fulton approving the reconzrnendation of the City Manager that all
bids be rejected on Bid Schedule' No. 582, and the City Manager be
authorized to readvertise.

AWARD OF CONTRA.CT - City Package Insurance
Fina.nce Director Courtney reviewed the proposed Package Insurance
Program as contained in his memo to Council dated December 31 ,
1970. Mr. Courtney stated that the Independent Insurance A.gents
A.ssociation of Shasta County assisted staff with the preparation of
the specifications and that specifications were made available to all
of the agents with offices in Redding who offer this type of coverage.
Bids were opened on December 22nd, and it is the joint recommen-
dation of staff and the Independent Insurance A.gents A.ssociation that
the contract for the City Package Insurance Program be awarded to
Insurance A.ssociates at a net annual premium cost of $71 , 373. Mr.
; Courtney explained that the types of coverage are identical to previous
coverage; however, the City will be self-insured in the.amount of
$300.00 on property damage liability and $1 , 000. 00 on buildings and
contents. A.lthough the annual premium represents a net increase of
appro�mately $23, 000. 00, Mr. Courtney said that recognition should
be given to the fact that, since the award of the last insurance contract,
Twin View A.nnex 1 and 2 have become part of the City; the Clear C reek ���
Sewage Treatment Plant has been constructed and is in operation; the
A.uditorium is now in operation, and the City is operating a complete
, water and sewer system in the Buckeye A.rea, both inside and outside
the City limits, and all of these are added to our building coverage
and our liability coverage, Mr. Courtney urged Council to accept the
recommendation before them.
City Attorney Murphy said that he :concurred fully with the recommen-
dation before Council.
Gary Green, 2930 Kenco A.venue, appeared before Council as a private
citizen and expressed concern over the large increase in the annual
premiitm charge. He mentioned that he had called the City of Chico
and had determined that their annual insurance premium charge for
the year 1969-70 was $19,269 for general coverage of 200-500 thousand
dollars and 100 thousand dollars property damage.
Mr. .Courtney re.plied that it i�s not appropriate to compare R.edding with
the City of Chico as Chico does not operate a water utility, an electric
utility, or garbage and refus:e collection and disposal' service. `
Mr..-.Gr�e�en referred to the.articLe in the.newspaper whi`ch stated -that
Redding is helping to pay for�th�e larger cities: He a>sked Mr^. Nye�
(a member of the firm, Insurance A.ssociates) how the premium � �
charges are determined, whether by underwriters' arbitrary recom-
mendations or from�rate schedules :. He' also= questioned the reasori t�at
there were so few bidder:s: .

Mr. Nye said that the rates are,taken from .rate.books; �and he:mentioned
that many insurance companies refuse to bid on municipal contracts
be caus.e of pa st expe:ri enc�e. - � � ��
Mr; Green also questioned the fee on the binder coverage. - �
Vice. Mayor Chatfield said-that the binder will not result. 'in extra cost
to the City if �Counc;il appr.oves. awarding the bid to-Insurance A.s sociates .
However, if Council does not.�acc:ept the bid, the City will need the
binder and will have to pay an extra charge for the binder as�it will take
at least 30 days to readvertise for bids and award a contract.
Mr. Gr.een said that�an-=increase of $23, 000.00 in annual preriiiums
seem:phenomenal, and he believes the City should seek bid proposals
from other insurance agents in other cities .

Mr. Nye said there were 10 agents who received invitations to bid,
and he believes there were at least 10 insurance companies contacted,
and yet there were only two bidders. He mentioned that insurance
agents in Chico are represented by the same insurance companies as
agents in Redding.
Mr. Michael Giddings, Lake Royal A.partments, who is an insurance
broker, asked if either of the bidders met the specifications. He was
advised that the specifications were not met exactly by either bidder.
Mr. Giddings said that if this were tr.ue, he felt the package program
should be rebid. He also questioned how the binder fee was arrived
at. Mr. Nye said it was calculated on a short° rate basis on the total
premium. Mr. Giddings stated that he did not agree that this was the
proper basis .for calculating a binder fee.
Mr. Huffaker, a local insurance agent, spoke of working with staff in
preparing the specifications and said there are considerations that have
to be taken into account. He stated that three years ago the City re-
ceived an extremely good rate, and it was guaranteed for the full
three years which is quite uncomrrion. Since that time, rates have
increased many, many times and the City's 'insurance cost has not.
Mr. Huffaker said.that there were certain exceptions to the specifi-
cations which were called to the attention of. the low bidder , and it
was the recommendation of the Insurance A.gents Association that if
the specifications could not be met, the bid should be awarded to the
next lowest bidder. The low bidder was given several days in which
to contact his company but he was unable to comply with the specifica-
tions . Mr. Huffaker said that he feels that the business at hand is
that Council has been asked to make a decision. He pointed out that
he did not provide a bid but feels that staff came up with a good
recommendation. He further stated that he would be happy to discuss
the matter with Gary Green after the meeting to try to answer his

There was considerable discussion between Council and staff about
the merits of higher deductibles in order to reduce insurance cost.
In answer to Councilman Anderson's inquiry as to whether it would
be possible to amend or endorse the policy if Council were to award
the contract this evening, he was advised that this would be possible
without cost penalty if changes were made on the policy anniversary
date.
Mr. Denny asked what would happe.n if the City did not get any bids .
City Attorney Murphy replied that the City would be self-insured or
could negotiate with insurance brokers. Mr. Denny then asked if
there are any limits of liability that the citizens of the community
would be liable for in the case of.self-insurance. Mr. Murphy said
he knows of no State law that puts a ceiling .on limits of liability.
Mr. Jack Rodgers of the insurance firm Rodgers and Bryant said that
he had nothing to add except to point out that, although his firm was
the lowest bidder but did not meet the specifications , neither did the
second lowest bidder. He said that if Council should decide to: rebid
the insurance package program, he believes there should be some
clarification of the ground rules .
Mr. Courtney said that the areas where both bidders did not meet
the specifications were not specific coverage areas defined in the
specifications , but they were implied to be included in the specifica-
ti ons .

Councilman.Chatfield asked if both bidders failed .to meet the..
specifications re liability for loss as a result of riot or civil �
commotiori or,:failure to supply water_or _electric power . He
was advised that the bid of the firm of Rodgers and Bryant was
silent in this regard but that later Mr . Rodgers stated that his
i company said they would have to make the same exception as
was..disclosed in.writing by Insurance Associates.
� Mr.. Denny asked if these exceptions, constitute non-conformance,
I and the City. A.ttorney. said that staff took the position that they did.
Councilman Fulton expressed concern that Council had not been
briefed in more detail pr.ior to .this evening as he feels .it is diffi-
cult to make a decision without giving the matter more study.
Mr. Courtney explained that he had started to put the program
together in September and that staff..and members of the Indepen-
dent Insurance Agents A.s sociation had put in many, many hours
preparing the specifications . He also mentioned that originally
the bids were .scheduled to be opened on December 15th but there
had been.a request for a.one week .extension which was :granted by
staff. . This made it impossible to present the ,program.to Council
at its .meeting. of.December2lst. Mr. Courtney said he intends to
start working on the 1974-1977 program the A.pril before the pro-
' posed contract expires in December, 1973,
Council:man Denny said, assuming that in the.opinion of__the ,Committee
or staff.the two bids.were comparable in all respects.other than limits
of liability as stated heretofore, does the Committee make its recom-
mendation on the grounds that Insurance A.ssociates is taking into
account those limits?
Mr. Cour.tney said that the policy. that.Insuranc.e Associate.s offers is
, as-.their bid states,. whereas the policy.offer,ed by Ro.dgers and Bryant
, is not-as the bid states . . -.

, Mr. Murphy added that the. reason the Cornmittee -is_ recommending the
. higher of the two bids is that this bid is an unchanged bid from the day �`�I
' of the bid opening. The other bid has caused two meetings of the
Coxnmittee.,. repeated conferences with the bidding coxnpany, and it is
, the C,ity's.understanding that .the policy we would,receive,.fxom the low
bidder�.would:be substa•ntially different from that specified in the bid
a:s it was presented:. •:�.. .
Mr. Huffaker stated that, as a member of the Committee, the low bid
� of Rodgers� and Bryant was changed ,verbalTy.. at the: opening; and, then
' becaus.e of aome deficlencies ,..separate committee meetings were held
, and Rodger.s and Bryant.were given several days to discuss the matter
! with their carrier and straighten these matters out.. It was the Com-
mittee's f.eeling.that it was "lrke leaving:money:.on�the table and then
i coming,back to.pick it up. " The Committee believes tliat if you are going
� to have a bidding procedure and if ..someone ha.s left money on the table,
they should.not.be allowed. to come_back and pick it up°and still stay
low. The.,Committee felt that this was the.;effe,ct of what was happening.
Ther.•e was discussion as to �the .advisability of approving the contract
on a: one-y.ear basis and then possibly not going.on a package deal in
the future. It was pointed out that the policy could be cancelled at
� its anniversary date without any penalty to the City.

The City Clerk advis ed Council.that a written protest had � -
been received from A.lbert A. Geiger, stating that he does
not want curb and gutter on Parcel 108-210-29�,' Block 6,
Sliasta Gardens Subdivision, Unit 1 , Lot 5`. -Millie G.- IDecker
also`subrnitted a protest on the cost of construction of sidewalk
on her-pr`operty at 1523 Olive Ave'nu:e, as the cost quoted was
$392.00 and the cost cliarged was� $432 .03. - - - -
A.ssistant Civil Engineer Hastings said that the Geiger prvperty
consists of two lots on�Riviera Drive which a're vacant. Curbs
and gutters were complete in this particular block except for
�c;� the Geiger property. Mr. Geiger did not appear before Council
and protest during the first hearing. � ' � ' ���-
` Regarding Mrs . Decker, there was an error inade in the billing
sent to Mrs. Decker,' and Mr. Hastings recomrriended that an
adjustment be made which would reduce the charge to $354:03:
He stated that a favorable bid on the project caused the reduc-
tion from the original quote of $392. 00 to $354. 03. '
George Cole appeared on behalf of Charles Christy, 2334
Californ'ia Street', as Mr. Christy is in Southern Califor'nia:
" Mr: Cole said that Mr. Christy is not complaining about the
price but he does not believe the installation was done properly
because, since the installation of the curbs and gutters, water.
floods into his basement.
�Mr: Hastings explained that the flooding occurred during the
heavy rains when water going into a catch basin apparently '
'� rari into a'drainage clitch on pr operty owned by the Native
�Daughters.. �Mr. Hastings refreshed Council regarding the
� previous hearing on this construction project at which time "
the drainage problem on the property of the Native Daughters
was discussed in detail. The Native Daughters intend to fill
tlie drainage ditch which will correct the flooding problem of
Mr. Christy. The City will block the 18" stub out of the catch
basin until such time as the 18" drainage pipe is extended into
the alley. It was pointed out that the catch basin was installed
at City expense and there was no charge against Mr.- Christy
for the basin. -
Mr . Wright of 2349 California Street questioned the charge of
$10 .75 per lineal foot for curb, gutter, arid sidewalk installed
on the front portion of his property versus $7.00 per lineal
foot charge for similar installation on the back portion of his
� property. He also not�ed that tliere 'was a shortage of 2-1/2 ftt:
of curb and gutter. Mr. Hastings will meet with Mr. Wright
tomorrow morning to discuss the above matter.

a part of these minutes` by reference, it was the recommendation of '
the Plarinin'g Director and staff that the City Council not approve the ;��J�
annexation proceedings re Cascade Blvd•. A.nnex No. 1 for the reasons
� s et forth in said memo.

In a memo to C`ouncil dated December 30 , 1970, the Traffic:.and
Parkirig Commission`set fortli its eridors'ement of all proposal in the
Parkirig Study, 1�970 with the following additiona�l comments: "

conditional upon development of plans which prove
feasibility.

Regarding the proposed parking structures, the Commission
- feels strongly that a system of parking fee collection by atten-
dant will better serve the interests of the mall shoppers by
removing the pressure to return to a ticking meter . If,
however, meters are select ed as the means: of collection,
:the Commission recommends that three-hour meters be used
in the shopper-oriented sections to permit an extended shopping
period.
It is the recommendation of the Traffic Engineer that the parking study,
together with the recommendations of the Traffic and Parking Commission,
be referred to Couneilman Deriny; as the Council-Member designated re-
sponsible for parking departmental activities.
With the approval of Council, Vice>Mayor Chatfield ref:erred the above
matter to Councilman Denny. - . ,

AIRPORT LA.ND USE COMMISSION
MOTION: Made by Councilman A.nderson, seconded by Councilman
Denny ratifying the action taken by Mayor Moty in endorsing Resolution
No. 70-177 of the Board of Supervisors of the County of Shasta finding ;�'y�
that proper land use planning in the vicinity of airports can best be
accomplished by the planning agency presently having jurisdiction.
