M. by Mayor Moty with the following Councilmen present: Chatfield, Denny, Fulton, and Moty. ' APPROVA.L OF MINUTES MOTION: Made by Councilman Denny, seconded by Councilman Fulton approving the minutes of the regular meeting of September 18; 1972 and of the adjourned,regular meeting of September 25, 1972, as xnailed to each Councilman. Dor othy Hopkins In letter s to Council dated September�18 and 23, 1972 , Mrs. Dorothy Hopkins of 1426 Olive Street requested that the alley behind her home be paved, but indicated that she does not use the alley and does not feel she '"' sho�uld sli'are in tlie expense of paving it. Public Works Director A.rness stated the City's policy with respect to paving alleys, which is that if the property owner provides necessary grading, graveling, and inci- dental storm drainage work, the City will furnish and place the asphalt in the alley. In a letter to Mrs. Hopkins dated September 18, Mr . Arness said that the City would prepare the subgrade and place the gravel in advance of paving for an estimated amount of $150. � City Manager Brickwood reported that Councilman Anderson had spoken with Mrs. Hopkins and had reiterated the City's position. MOTION: �Made by Councilman Denny, seconded by Council- man Fulton that Mrs . Hopkins request be denied, and that the Mayor Iwrite Mrs . Hopkins a letter so advising her. A.WA.RD OF BID - Overhead Type Distribution Transformers MOTION: Made by Councilman Chatfield, seconded by Councilman Denny approving the recomrnendation of the City Manager that Bid ����� Schedule No. 650 , Overhead Type Distribution Transformers , be awarded to the second low bidder, RTE Corporation, on their bid of $4,410. 00, since the low bidder , Westinghouse Electric , did not meet specifications . ORDINA.NCE - 're Special Council Meetings Councilman Denny offered Ordinance No. 1102 for first reading, an � �� ordinance of the City Council of the City of Redding amending A.rticle II of Chapter 2 of the Redding City Code, 1959, as amended, by repealing Section 2-48, pertairiing to Special Meetings of City Council. RESOLUTION - re Interim Open Space Plan MOTION: Made by Councilman Chatfield, seconded by Councilman Fulton that Resolution No. 72-82 be adopted, a resolution of the City Council of the City of Redding adopting the Open Space Plan and Pro- gram for the Shasta County and Cities Area Region as the Interim Open Space Plan for the City of Redding. �',�L� Voting was as follows: Ayes: Councilmen - Chatfield, Denny, Fulton, and Moty Noes: Councilmen - None Absent: Councilmen - Anderson Resolution No. 72-82 on file in the office of the City Clerk. CONTINUED PUBLIC HEARING - re Off-Street Parking Requirements The hour I f 7:30 P.M. having arrived, Mayor Moty opened the Continued Public Hearing pertaining to Off-Street Parking Requirements. The following document is on file in the office of the City Clerk: �Q� Planning Commission Recommendation dated 9/29/72 The City Clerk advised Council that no written protests had been filed, and the Mayor ascertained that there were no protests from the floor. Planning Director Harris reviewed the Planning Com- mission Recommendation re off-street parking requirements 143 as contained in a memo to Council dated September 29 , 1972, which memo is made a part of these minutes by reference. Mr. Harris noted that the adoption of these amendments would cons6lidate all of the parking re- quirements into one section of the Code. In discussing these amendments, it was the general consensus of Council that, in some categories, the proposed parking requirements seemed excessive; i. e. , for warehouses and hospitals . It was suggested that the proposed off-street parking requirements be given wide distribution to developers , architects, engineers , hospitals, etc. , and that the public hearing be continued to a later date to give all interested persons an opportunity to be heard on this matter . MOTION: Made by Councilman Denny, seconded by Councilman Chatfield that the Public Hearing pertaining to Off-Street Parking Requirements be continued to 8:00 P.M. , October 24, 1972. The Vote: Unanimous Ayes PUBLIC HEARING - re RZ-8-72 The hour of 7:30 P.M. having arrived, Mayor Moty opened the Public Hearing on RZ-8-72, initiated by the i�.edding Planning Cox7imis sion. The following documents are on file in the office of the City Clerk: � Affidavit of mailing - Notice of Public Hearing Affidavit of publication - Notice of Public Hearing Planning Commission Recommendation dated 9/27/72 The City Clerk advis ed Council that no written protests had been filed, and the Mayor ascertained that there were no protests from the floor. The property under consideration for rezoning is located at the northeast corners of Akard Avenue and Cypress A.venue. Planning Director Harris noted that the area is ��� entirely owned by the State and is dissected by "R- 1" , "R.=2" , "C-2", and "C-3" zoning lines . Mr. Harris re- viewed the recomrriendation of the Planning Commission as set forth in a memo to Council dated September 27 , 1972, which memo is made a part of these minutes by reference. It is the recommendation of the Commission that the property north of the drainage canal be zoned "CO-BR" with F Site Plan Review criteria. It is the opinion of the Commission that such zoning is appro- priate for the mixed use of government agencies in this area and will eliminate the possibility of any coxnmercial development along Locust Street that could have a detri- mental effect on the Garden Tract. In order to retain the continuity of zoning on the Cypress Avenue frontage, the Commission recommends that the property south of the drainage canal that parallels Cypres s Avenue remain zoned "C-2" and "C-3" . MOTION: Made by Councilman Denny, seconded by Councilman Fulton that the Public Hearing be closed. The Vote: Unanimous Ayes I 144 Councilman Fulton offered Ordinance No. 1103 for first reading, an ordinance of the City Council of the City of Redding amending Section 30-3 of the Redding City Code, 1959, as amended, relating to the rezoning of certain real propexty in the City of Redding. (RZ-8-72) C LA.IM FOR. DA.MA.G;ES - 2nd hearing i Gilbert E.I B ell - Claim filed 7/31/72 City Attorney Murphy reviewed the Claim filed by Mr . Bell. � Mr. Bell alleges that on June 15, 1972 an employee of the Sanitation Department left the gate to his yard open, thus allowing his dog to run loose. The dog was subsequently hit by a car on the freeway ne,ar the Civic Auditorium, about 600 yards from the B'ell residence. Mr. Bell incurred veter- inary expense in the amount of $160.25 , for which he wishes the City to reimburse him. Mr. Murpliy said that Mr. Bell had asked that a decision ori this claim be postponed so that he could pr e s ent adclitional evide nc e. Mr. Bell s'aid that he had reguested the postponement as he was to be on vacation and wished to be present at the second hearing on the claim. It was his belief that the matter was to be referred to the City Insurance Carrier but that he had not been contacted by anyone. Mr. Murphy explained to Council that the City is self- insured with respect to a claim of this nature and, if %�3 Council elects to honor the Claim, it will be paid by the City and not by the City Insurance Carrier. The City Insurance Committee has reviewed the claim and recommentls denial in view of the Residential Sanitation Rule which� states: "The City of Redding will not be responsible for the closing of gates or the egress of animals kept within these gates if the container(s) are kept in an i nclo s ed yard." M r. B e l l s�t a t e d t h a t h e h a d n o t s e e n t h e "R e s i d e n t i a l Sanitation Rules" until a copy was given to him after he had filed his claim for damages. He noted that the gate to his yard� is self-closing; however , the gate was forced too far back, causing it to hang up on a flower bed. City Manager Brickwood stated that the "Residential Sanitation Rules" were attached to garbage cans at the time the niw routes were established in 1968. Mr. Bell was asked how long he had resided in Redding at this add'ress and he replied, "Since 1958." Mr . Bell was questioned about a statement made by a visitor in his home to the effect that the dog was not in the yard the night before. Mr . Bell said that he had talked to this gentleman who said he had not made such a statement. Mr. Bell was asked to furnish the name and address of this person so he could be contacted. Polvorosa of the City of San Leandro introduced himself to members of Council and staff and extended greetings from San Leandro Mayor Jack Maltester and City Manager Wesley McClure. He commented favorably on the manner in which the Council meeting was conducted but indicated that Council meetings in San Leandro are � 7�' a bit more lively from an audience standpoint. Mayor Moty said that not all of Redding's Council meetings are as short and quiet as this one. Mr, and Mrs . Polvorosa are vacationing in the area and e�ressed their appreciation to the following persons who have made their vaca- tion so pleasant: Police Chief Robert Whitmer , Sheriff John Balma, Jack Reiser of Humble Oil, Bill and Doris Howell, Monterey Motel, Ernie Merkle, Redding Machine and Engineering, and Cigo Mazzini.
