The Pledge of Allegiance to the Flag was led by Sanitation Superintendent
Towns end.
The meeting was called to order at 7:00 P. M. by Vice Mayor Chatfield
with the following Councilmen present: A.nderson, Denny, and Chatfield.

MOTION: Made by Councilman Anderson, seconded by Councilman Denny
approving the minutes of the regular meeting of July 3, 1972, as mailed
to each Councilman. The Vote: Unanimous A.yes
COMMUNICA.TIONS
Shasta County Department of Public Works
A. communication was received from the Shasta County
Department of Public Works informing Council of the
major widening and rebuilding of Churn Creek Road and �S�
Hartnell Avenue in Enterprise between East Cypress
Avenue and A.rgyle Road now in the planning stage by
th e C ounty.
Redding Museum Building Comrnittee
Councilman Anderson and City Manager Brickwood were
appointed to serve as City representatives on the Redding ���
Museum Joint Building Committee. The County represen-
tatives are Supervisor Keefer and County Executive Officer
Minton.
Redding Elementary School District
In a letter to Council dated July 13 , 1972 , John Clark,
Superintendent of the Redding Elementary School District,
expressed concern regarding the safety of students crossing �/��/
the intersections of East and Placer Streets and Cypress
and Akard, and requested Council to consider the installation
of traffic lights at both locations prior to the opening of school
on September 5.

Traffic Engi�neer Hamilton reported that traffic volumes
on both East4 and Pine Streets have steadily increased and
it is anticipated that, with the re-opening of school and
the completion of some of the mall elements this fall, a
signal installation will be fully justified. As an interim
measure, tlie Traffic Engineer recommended that visibil-
ity at this iritersection be improved by increasing the red
curb "no parking area" to 75 ft, from the Placer Street
curbline on both sides of East Street.
Mr. Hamilt In said that in addition to this intersection,
studies are currently being conducted with respect to
vehicular an�d pedestrian traffic at the intersections of
East and South, East and Yuba, Court and Yuba, and Court
and Shasta Streets, and as soon as sufficient data are com-
piled, recommendations will be brought to Council.
With respect to the intersection of Akard and Cypress, Mr.
Hamilton said that it is recognized that signals are needed
at this inter'section, but to signalize without realignment
of Akard Avenue is not recommended. The project of re-
alignrnent is� large enough that it is hoped that Federal funds,
perhaps TOPICS, will be available to accomplish the project.
Donald Demsher, President of the Board of Trustees of the
School District, spoke of the two periods of the day when it
is difficult for students to cross East Street at Placer, and
expressed the hope that Council could come up with some
solution. I
MOTION: Made by Councilman Denny, seconded by Councilman
A.nderson approving the recommendation of the Traffic Engineer
with respect• to improving visibility at the intersection of East
and Placer Streets, and instructing the City A.ttorney to prepare
the necessary resolution. The Vote: Unanimous A.yes

Shasta County Board of Supervisors - re zoning County property
A communication from the Shasta County Board of Supervisors
`s�� pertaining to zoning of County property located within the City
of Redding was referred to the City Planning Commission.
PINE STREET - re installation of right turn lane
Traffic Engineer Hamilton reported that the Division of Highways has
verbally requested City approval of the installation of a right turn lane
next to the east curb �of Pine Street on the northbound approach to Tehama
Street in order to improve the flow of heavy right turn movement. Mr.
��� � Hamilton stated that in his opinion this turn lane will be a step towards
reduction of congestion on Pine Street and it is his recommendation that
Council prohibit parking on the east side of Pine 5treet for a distance
of 126 feet south of tlie south curb line of Tehama 5treet. The necessary
painting and signing will be accomplished by the Division of Highways .
MOTION: Made by Councilman Denny, seconded by Councilman Anderson
approving the recomrizendation of the Traffic Engineer re installation of
a right turn lane on Pine Street as outlined above, and instructing the
City Attorney to prepare the necessary resolution. The Vote: Unanimous

July 14, 1972
The City Clerk advised Council that no written protests had
been filed, and the Vice Mayor ascertained that there were
no protests from the floor.
Planning Director Harris showed the area under consideration
for rezoning on the Vu Graph and reviewed the Planning Com-
mission RecomtYlendation re RZ-4-72 as contained in a memo
to Council dated July 14, 1972, which memo is made a part of
these minutes by reference. The property under consideration
for rezoning is located at 1145 and 1157 West Street, east of
Eureka Way. The Commission recommended that said property
be rezoned from "R-3" Multiple Family Residential District to
"C-2" Central Commercial District as requested by W. C . Carr .
MOTION: Made by Councilman Anderson, seconded by Council-
man Denny that the Public Hearing be closed. The Vote:

Councilman Denny offered Ordinance No. 1093 for first
reading, an ordinance of the City Council of the City of
Redding amending Section 30-3 of the Redding City Code,
1959 , as amended, relating to the rezoning of certain
real property in the City of Redding. (RZ-4-72)

MOTION: Made by Councilman Anderson, seconded by Councilman

CLAIM FOR DAMAGE - 2nd hearing
Suzanne D. Taylor - Claim filed 6/19/72
Mrs . Taylor appeared before Council in defense of her
Claim filed against the City of Redding for alleged damage /.� �
to her swimming pool. Mrs . Taylor stated that a 10 ft.

wide trench was dug 2 ft. from her swimming pool at
the time the sewer line was installed in the South City
Sewer A.ssessment District, and that when the earth was
replaced after construction was completed, it was not
compacted. � It is he.r belief that after the winter rains ,
the earth settled, thus causing leaks in the swimming
pool. She pointed out that E1 Reno and Cedar Roads both
showed evidence of such settlement and it could also be
noted in the area adjacent to the pool. Mrs . Taylor
commented that, although the damage to the pool, in her
opinion, was the result of the excavation which occurred
in the spring of 1971 , it was not made evident until after
the winter riins, thus the delay in filing the claim for
damage.
Council was �shown cross section drawings of the swimxYiing
pool and its �relationship to the sewer line and trench.
City A.ttorne;y Murphy advised Council that the City's In-
surance Car�rier has denied liability for the following
reasons:
1 . The claim was not filed within the 100 day legal limit.
2. Based on information available to the Insurance Carrier,
any leaks which may exist in the pool were not caused by
installation of the sewer line.
3. If any liability exists, it is the responsibility of the
contra;ctor employed by the City to install the sewer
line. �
It was brought out that the pr.oject was completed on September
14, 1971 , arid the contractor (Gene McLaughlin Construction
Company) is� responsible for any defects in the work and for
any damage resulting therefrom which shall appear within a
period of one year from date of completion.
The City Attiorney advised Council that if it elected to grant
the claim, it would have to be paid out of City funds inasmuch
as the City I�nsurance Carrier has denied liability and is pre-
pared to bac�k up his findings . Mr. Murphy said payment by
the City could be interpreted as a gift of public funds .
It was suggelsted to Mrs . Taylor that she contact the McLaughlin
Construction Company regarding the claim. The possibility of
a small claims action was also mentioned, providing the cost
of repairing;the pool does not exceed $300. 00.
MOTION: Made by Councilman Denny, seconded by Councilman
A.nderson that the Claim for Damage filed by Suzanne Taylor on
June 19 , 1972 be denied. The Vote: Unanimous Ayes
ORDINANCE - re PDI 1-72
MOTION: Made by Councilman Denny, seconded by Councilman
Anderson that full reading of Ordinance No. 1092 be waived, and that
the City Attorney be instructed to scan same. The Vote: Unanimous Ayes

RESOLUTION - Establishing Parking Limit on Portion of Pine Street
MOTION: Made by Councilman Anderson, seconded by Councilman Denny
that Resolution No. 72-62 be adopted, a resolution of the City Council of ����
the City of Redding establishing a two hour parking limit on the east side
of Pine Street between Gold and South Streets.
Voting was as follows:

RESOLUTION - Installation of Stop Sign - Edith St. at Maple St.
MOTION: Made by Councilman Denny, seconded by Councilman A.nderson
that Resolution No. 72-63 be adopted, a resolution of the City Council of
the City of Redding ordering the installation of a Stop Sign against north- �/��
bound traffic on Edith Street at Maple Street.

AWA.RD OF BID - Overhead Distribution Transformers
Council was advised that of the seven bids received on Bid Schedule No.
635 for Overhead Distribution Transformers, the only two which met
specifications were from Hevi-Duty Electric Division of Sola Basic
Industries located in North Carolina and RTE of Portland, Oregon, with
Hevi-Duty the low bidder. Because Redding had had no experience with � ;/�
the Hevi-Duty transformers, responsible personnel in another city who �R
had used this equipment were contacted, and it was learned that 50% of
an order of transformers received from this company developed oil leaks .
It is therefore the recoxnmendation of the City Manager and the Electrical
Superintendent that the bid be awarded to RTE Corporation in the amount
of $27,835 .50, sales tax included, on the basis of the City's past exper-
ience with their product, their service, and their pro�mity to Redding.
MOTION: Made by Councilman Anderson, seconded by Councilman Denny
approving the recommendation of the City Manager and Electrical Super-
intendent that Bid 5chedule No. 635 be awarded to RTE Corporation in
the amount of $27, 835. 50, sales tax included.

AWARD OF BID - Tractor with Elevating Scraper
In a memo to Council dated July 14, 1972, City Manager Brickwood
recomtnended that Bid Schedule No. 637 for Tractor with Elevating ��
Scraper be awarded to Peterson Tractor Company in the amount of
$38, 295 .00, sales tax and trade-in included. A.s the City Manager was
not present, City A.ttorney Murphy explained to Council that, although

Peterson Tractor is not the low bidder, the low bidder, International
Harvester, did not meet specifications in the following substantive
particulars: (1) no service center within 10 miles , and (2) the bidder
did not meet the spec�ifications for a machine with motor of 600 cubic
inches . The next lowest bidder , Top Line Equipment, did not meet
specifications in several instances and, when sales tax is figured in,
their price exceeds that quoted by Peterson Tractor Company.
Paul Crooks, Internaltional Harvester Representative, appeared before
Council and stated that as far as their motor is concerned, it is not
substantially smallerl and they have never had any problems with regard
to it. With respect to the service center , Mr. Crooks said that the
personnel at the International Harvester retail store in Redding are
capable of performing maintenance, and the store would stock parts
specified by the City 'and the City would not be charged unless the
parts were used. !

Council was advised that only one bid was received on Bid Schedule
No. 638 for Special Sanitation Containers. This is the second time
this bid was advertised, Council having rejected all bids the first
time. It is the recomrriendation of the City Manager that the bid
submitted on Bid Schedule No. 638 be rejected, and it is then re-
quested that a resolution be adopted authorizing the City Manager
:�o��- to negotiate with one or more bidders for said containers .

Denny rejecting bids received on Bid Schedule No. 638 for Special
Sanitation Containersi.

HILLTOP DRIVE ANNEX NO. 2
Planning Director Harris reported that the annexation application for
the Hahn property at the intersection of Hilltop and Dana Drives was �
filed with LAFCO on July 10 , 1972, and a public hearing on the annexa- � �J
tion will be held by LA.FCO on A.ugust 9, 1972. Mr. Harris stated that,
in accordance with the request of the property owner , staff has started
proceedings to prezone the subject property so that upon completion of
the annexation, the precise zoning will be in effect.
HANGAR A.ND TIE-DOWN RENTAL FEES - Benton and Redding Mun. Airports
MOTION: Made by Councilman Anderson, seconded by Councilman
Denny approving the recomxnendation of the Airports Commission with
respect to hangar and tie-down rental fees at Benton and Red'ding Muni-

Sewage Treatment Facilities Report for the month of June, 1972 .
LAND ACQUISITION
In a memo to Council dated July 19, 1972, City A.ttorney Murphy
requested Council approval authorizing staff to acquire approximately
2; 000 sq. ft. of land from James Ross, Carolyn J. F'orbes , and J. W. �� �
Trueblood for a pri�e'of $l , 000.00. Such property is required for the
purpose of widening Lake, Boulevard, and Council approval is necessary
because it involves an expenditure in excess of $500 .

In a meino to Council4 dated July 19 , 1972, City Attorney Murphy
advised Council that the District Court of Appeal affirmed the lower
�� � Court Judgment in the case entitled Shasta Pipe & Supply Company
vs . City of Redding. I It is recommended that the City not pursue
any furtlier appelate remedies for the reasons outlined in the afore-
said memo. (

the City Council of the City of Redding authorizing the execution

Vi Klaseen asked Council to give consideratiori to providing bike trails
on Lake Boulevard, noting that even on that portion of Lake Boulevard
which has already been widened it is not safe to ride bicycles .
