City Council, Regular Meeting

The Pledge of Allegiance to the Flag was led by Traffic Engineer
Hamilton.
The invocation was offered by the Reverend George Lindsay, Pastor of
Pilgrim Congregational Church.
The meeting was called to order at 7:00 P. M. by Mayor Moty with the
following Councilmen present: A.nderson, Chatfield, Denny, Fulton,
and Moty.
Also present were City Manager Brickwood, City A.ttorney Murphy,
Finance Director and Personnel Director Courtney, Public Works
Director Arness , Planning Director Harris , Traffic Engineer Hamilton,
Police Chief Whitmer, Parks Director Blaser , A.ssistant Planner Owen,
and City Clerk Brayton.
A.PPROVA.L OF MINUTES
MOTION: Made by Councilman A.nderson, seconded by Councilman
Fulton approving the minutes of the regular meeting of March 20 , 1972,
as mailed to each Councilman. The Vote: Unanimous A.yes
COMMUNICATIONS
Manzanita Parents Club
In a letter dated March 21, 1972, the Manzanita Parents
Club thanked Council for making the services of the /�L��
Redding Museum Leage available to Redding residents .
The League recently conducted an art workshop at the
Manzanita School.
Reddin� Jaycees
The Redding Jaycees , represented by Donald Sass and
Jim Hathaway, requested Council permission to move
the carnival portion of their Fourth of July Celebration
from Lake Redding Park to Caldwell Park. This would o���
consist of sack races , frog jumping, etc. ; an exhibition
to be put on by the Firemen's A.ssociation; and possibly
pony rides . The fireworks display would still be con-
ducted from the Diestelhorst Bridge .
Council had no objection but advised the Jaycees that
their proposal should be submitted to the Parks and
Recreation Commission.
Rodeo Week A.ctivities
Communications were received from the A.sphalt Cowboys
and the Downtown Merchants A.ssociation requesting Council
approval re parking privileges and the use of certain streets
during Rodeo Week. Resolution No. 72-32 was submitted
for Council consideration.

MOTION: Made by Councilman Denny, seconded by Councilman
Anderson that Resolution No. 72-32 be adopted, a resolution of
the City Council of the City of Redding pertaining to the Shasta �:�7
County Sheriff's Posse Annual Rodeo Week Celebration.
Voting was as follows:

A communication was received from Reverend and Mrs.
��� James relating the good service they had received from
the Profe s sional A.mbulanc e S ervic e.
State Department of Public Works
A. communication from the State Department of Public
Works , dated March 23, 1972 , set forth Redding's share
of the apportionment of California's federal TOPICS
funds for fiscal years 1971-72 and 1972-73.

Public Works Director Arness is to determine if it is
necessary �for Council to provide the Department of
Public Works with a resolution of intent to obligate
the apporti�onments .
Mrs. Cora1 Caldwell
A communication was received from Mrs . Coral Caldwell,
855 Lakeview Drive, regarding the continued annoyance
of loud music from rriusic groups in Lake Redding Park.
City Manager Brickwood advised Council that several
ideas are being implemented which staff believes will
solve the p�roblem to everyone's satisfaction; i. e. , the
present application form for park use will be changed
to include ].anguage as regards noise level; the Parks
Director now has a decibel meter which will be used to
ascertain that the amplifiers are set within reasonable
noise levels; and staff is checking into a self-monitoring
device which is on the market which allows the music
��.r� groups to determine when the noise level is too great,
and if they don't abide by this device the police will take
action.
Mrs. Caldwell commented that she is not opposed to use
of the park by the music groups if the music can be kept
at a level where it is not an annoyance to nearby residential
areas . She said she would welcome City staff checking the
noise level in her backyard when the music groups are
playing.
John Otten, 837 Cypress , a young man who plays in a
music group, said he believes it would help if the placement
of the groups in the park were changed. It is his feeling that
the water acts as a reflector and thus the music is carried
upwards to the homes on the hill across the river. Dave
Moyer coxrimented that the Police Officer who was called
said that he could only hear the music faintly from his car
parked on the other side of the river . Dave Glasgow noted
that the grbups usually play for a total of 2 hours and have
audiences up to 600 people. It is free entertainment which
the audiences enjoy and it is also good for the musicians .
The young men agreed to cooperate with staff with respect
to trying out different locations in the park.
Staff is to report back to Council at the A.pril 17th meeting.

PUBLIC HEARING - A.bandonment of Portions of Market, Butte, and Yuba Sts .
The hour of 7:30 P.M. having arrived, Mayor Moty opened
the Fublic Hearing re abandonment of portions of Market,
Butte, and Yuba Streets .

The City Clerk advised Council that no written protests had been
received, and the Mayor ascertained that there were no protests
from the floor. ���
Planning Director Harris showed on the Vu Graph the portions
of Market, Butte, and Yuba Streets proposed to be abandoned
to permit construction of improvements as part of Midtown
Project No. 1.
MOTION: Made by Councilman Denny, seconded by Councilman
Fulton that the Public Hearing be closed. The Vote: Unanimous

RESOLUTION - Ordering Vacation and Abandonment
MOTION: Made by Councilman Denny, seconded by Councilman
A.nderson that Resolution No. 72-33 be adopted, a resolution of
the City Council of the City of Redding ordering the vacation and
abandonment of portions of Market Street, Butte Street, and Yuba
Street in the City of Redding.

RESOLUTION - Parking Limitation on Court Street
MOTION: Made by Councilman Anderson, seconded by Councilman
Fulton that Resolutior� No. 72-34 be adopted, a resolution of the City
Council of the City of Redding establishing a two hour parking limit
on both sides of Court Street between Placer and Sacramento Streets.

RESOLUTION - Establishing Loading Zone on Sheridan Street
MOTION: Made by Councilman A.nderson, seconded by Councilman
Chatfield that Resolution No. 72-35 be adopted, a resolution of the
City Council,of the City of Redding establishing a yellow loading zone
50 feet long on the north side of Sheridan Street at the gate to the
�`�`� Crestwood Convalescent Hospital.

TURTLE BA.Y A.REAI - re Protection of Birds and Wildlife
Councilman Fulton reported that the Council Committee is in general
support of the request of the Wonderland Garden Club and R. C. Spaid
and other petitioners to protect wild birds and other wildlife in the
Turtle Bay - Kutras Park area, and that staff is preparing appropriate
ordinances to accomplish the desired purposes . It is intended that such
ordinances will be presented to Council for consideration at the meeting
'�j�,�(��Q of April 17.
Lucille .W.eTLer appea�red before Council and stated that the Wonderland
Garden Club's intere�st is in the establishment of a Bird Sanctuary and,
te receive� recognition by the A.udobon "5ociety and�be placed�on Galifornia
�riaps of recogriized bird sanctuaries,"a sign mus;t be.:po:ste.cl dec:laring�
the area a bird sanctuary. The Wonder-land_Gar:den Clu�b will fu�rnish•the
sign and will have it designed to conform to standards required by the
City.

AWARD OE BID - Pad Type Distribution Transformers
MOTION: Made by Councilman Chatfield, seconded by Councilman
Anderson accepting the recoxnrnendation of the City Manager that ���
Bid Schedule No. 618 for Pad Type Distribution Transformers be
awarded to R T & E Corporation on their low aggregate total bid of
$8,592. 15, tax included.

REZONING APPLICATION - RZ-10-71
Planning Director Harris reported that the Planning Corr�zission held
an adjourned meeting on March 31st to consider Rezoning Application
RZ- 10-71 which was referred back to the Commission by Council for
further consideration. Mr. Harris stated that, after considering the
testimony of the previous Comxnission hearings , the information con-
sidered by Council, and additional data submitted to them at the meeting � ��
of March 31st, it was the'recommendation of the Planning Comrriission,
by a vote of 3 to 1, that the Rezoning Application be denied. The reasons
for this recorninendation are:
1. The representatiori macle to 'Council that the flood plain
line had been moved was erroneous . The State did move
the line to the east, but not in the area where it crosses
this property.
2. At the meeting of the Planning Commission the applicant
indicated his interest in operating the travel trailer facility
with closure based upon notification by State A.gencies --
two hour notification. Planning Comrnission Members
were concerned with sizch shbrt notice and had previously
discussed the pos sibility of limiting occupancy to a specified
time period where there was some degree of assurance that
the area would not be flooded.
3. The Cornmission was concerned with the potential problem
of polluting the River, where utilities would be required to
each trailer pad.
4. In addition, the Commission was concerned with approving
additional land for this use (C2-CT) when there is considerable
land in the area thus zoned which has not been used.
Public Works Director Arness was asked if he had any concern about
pollution if the rezoning were approved. He replied that with the
materials and techniques available today, he felt there would be no
problem of pollution.
Councilman Chatfield expressed concern about the problem which might
be created as far as rescue is concerned, in the event of flooding in the
area.
Councilman Fulton said he would be disinclined to approve 'the rezoning
because the flood plain line goes through the property and because of
the danger of pollution. '
Councilman A.nderson said he did not feel that Council would be doing
anyone a favor to encourage development on property subject to
inundation.

The question was rai,sed as to whether Council could instruct the
Planning Commission to apply certain criteria when a use permit
is issued; such as, limiting the use of the trailer park to the months
of May through October. �
Mr. Harris replied that he could recall one instance where guidelines
were suggested by Council, but pointed out that rezoning cannot be
conditioned. City Attorney Murphy stated than an ordinance must
first be adopted and then criteria may be recommended re issuance
of a use permit. A.lso, a question exists as to whether criteria
recommended by Council for issuance of a use permit would be
binding upon the Commission. However , Council could appeal the
action of the Commission re issuance of a use permit and Council
would have final jurisdiction. . .
John Williams , Manager of the Park Marina Trailer Park, noted
that the A.rmy Corps of Engineers does not object to development
of the land to the east of the flood plain line for mobile travel
trailers , based on two hour notification in the event of flooding.
He stated that the travel trailers could be self evacuated in most
instances and the Trailer Park would have vehicles available to
/�,/ move them if it were necessary. Mr. Williams feels there is no
`f- danger of pollution.; �He explained the proposed,developrnent,
pointing out the need to develop the land in a perimeter design around
the existing restrooms .
MOTION: Made by Councilman Denny, seconded by Mayor Moty to
accept the report of the Planning Commission and to proceed with
enactment of an ordinance to approve the requested rezoning.

A.nderson to reconsider the action taken by Council at its meeting of
March-20,, 1972 pertaining to Rezoning Application RZ- 10-71 . `

After more discussi In Members of Council agreed that t�hey would
suppo•rt rezoning the area west of the flood plain line to C2-CT and,
if the flood line were.moved to the east, the remaining property
could be reconsidered at that time.

MOTION: Made by Gouncilman Chatfield, seconded by Councilman
Fulton that only that portion of the property under consideration lying
west of the flood plai�n line be rezoned from C-2-P to C2-CT, and the
City A.ttorney be inst�ructed to prepare the necessary ordinance. The

Mr. Williams -stated that.although they would prefer to have. all ;of the
property under consideration zoned C2-CT, he feels the above decision
by Council is a fair compromise. , ,
MA.LL REROUTING - Highway 273 �
Traffic Engineer Hamilton reported that the Traffic and Parking
Commission has recommended a trial rerouting be arranged, ,desig-
�G� C nating Shasta Street one way westbound to California Street, and
Tehama Street one way eastbound from California Street.

Mr. Don Vincelle, Chairman of the Traffic and Parking Commission,
was present and suggested the the proposed new traffic pattern be
tried for a �three-week period. He noted that both the Departrrient of
Public Works and Herb Miles of the State Division of'Highways had
written letters in opposition to such a trial.
Mayor Moty reported that he had spent many hours with City staff
and members of State Agencies in considering the proposed rerouting
of traffic around the mall and that, originally, he had favored the
routing suggested by the Traffic and Parking Commission, but he had
been convinced that it was not feasible because of the "stacking"
pr oblems on Sha sta Str eet.
Traffic Engineer Hamilton showed slides on the Vu Graph depicting
the flow of traffic down Market Street, turning west on Shasta Street
(with Shasta one way west from Market to California). Mr . Hamilton
said that routing studies show that the use of Shasta Street would re-
sult in intolerable congestion at Shasta and California Streets -- that
Shasta would not be able to handle the influx of cars from Market
Street as well as the through traffic going west on Shasta Street.
Council Members were in general concurrence that although the
present routing is not entirely satisfactory and Council should keep
an open mind, it is a little premature to recommend to the State
Division of Highways that a change be made at this time.
Hugh Griffin, Division of Highways Traffic Engineer , told Council
' that the State is not locked into any route; however, this particular
route recommended by the Traffic and Parking Commission was
studied previously and it was felt that it would not work for the
reasons set forth by Mr. Hamilton.
No action was taken by Council with respect to this matter .
PARKING LOT NO. 5
Traffic Engineer Hamilton submitted the recommendation of the
Traffic and Parking Corr�nission that the direction of traffic flow ��� �
in Pa rking Lot No. 5 b e r eve r s ed, to pr ovide the ability to travel
northward from Placer to Yuba Streets. This would help restore
somewhat the loss of northbound avenues west of the Mall.
RESOLUTION - re Parking Lot No. 5
1VIOTION: Made by Councilman Anderson, seconded by Councilman
Denny that Resolution No. 72-36 be adopted, a resolution of the City
Council of the City of Redding authorizing and directing the redesign
of Parking Lot No. 5 so that all traffic through the Lot shall be one
way northbound.

LICENSE A.GREEMENT - re installation of underground conduits across
P. G. & E. property
MOTION: Made by Councilman Denny, seconded by Councilman Fulton �
approving the License Agreement between the City of Redding and the
Pacific Gas and Electric Company, granting to the City the right to ��,�
install underground conduits across P. G. & E. property, and author-
izing the Mayor to sign said agreement on behalf of the City. The Vote:
