The Pledge of A.11egiance to the Flag was led by Planning Director Harris. The invocation was offered by Greg Bearce, Intern Pastor of First Baptist Church. The meeting was called to order at 7:00 P. M. by Mayor Moty with the following Councilmen present: Anderson, Chatfield, Denny, Fulton, and Moty. Voting was as follows: Ayes: Councilmen - A.nderson, Chatfield, Denny, Fulton, and Moty Noes: Councilmen - None Absent: Councilmen - None FIRE DEPA.RTMENT - City Manager Request for Additional Personnel In a memo dated August 16th, City Manager. Brickwood requested Council approval of the addition of two firemen above the current Fire Department complement of thirty, which is approved for the 1973-74 budget. Mr. Brickwood explained that the additional personnel is needed to solve staffing problems which, on occasions, cause unsafe procedures to be t 7� used. The request is recommended by the City Manager and the Fire ,i 7� Chief, MOTION: Made by Councilman A.nderson, seconded by Councilman Denny approving the recommendation of the City Manager and Fire Chief re the addition of two firemen above the current Fire Department complement of thirty approved for the 1973-74 budget. CONTINUED PUBLII HEARING - re Westgate 5ub.division The hour of 7:30 P.M, havirig arrived, IVlayor Moty opened the 10� continued public hearing .re Westgate Subdivision 3`��. Planning Director Harris reported that the Council Committee met with the developer of Westgate Subdivision and tentatively V agreed to a solution to the problem concerning approval of said subdivision, and it is the the joint recommendation of the Council Committee, the staff, and the developer that the public hearing be continued to the second meeting in Septerriber "in order that the Council Committee's recommendations can be finalized for sub- mission to Council at that time. 135 MOTION: Made by Coux�cilman Denny, seconded by Councilman A.nclerson that the Conti:nued Public Hearing re Westgate Subdivision be continued to 7:30 P. 2vI. , September 17, 1973. The Vote: Unanimous A.yes PUBLIC HEA.RING - Rezonin€; Application RZ-8-73 The hour of 7:30 P. M. ��aving arrived, Mayor Moty opened the Public Hearing on Rezoning A.pplication RZ-S-73. Notice of Public Hearing Affidavit of Publication - Notice of Public Hearing � �� Planning Commission Recommendation dated 8/16/73 Planning Director Harr:is illustrated on the Vu Graph the area under consideration for rezoning, which is located along Lake Boulevard in the vicinit,y of Quartz Hill Road. The rezoning pertains to an increase in the "ST" zoning (which permits mobilehomes on individ,aal lots) within the area. The Commission initiated the zoning acti��n, although several interested parties had indicated a desire f�r such rezoning in the area. Mr. Harris reviewed the recommendation of the Planning Commission as con- tained in a memo to Council dated A.ugust 16, 1973, which memo is made a part of these minutes by reference. The Map Exhibits attached to said memo illustrate the areas proposed for 'ST" zoning. The City Clerk advised Council that a letter had been received from Mr, and Mrs. Robert K. Blagg, 3145 Quartz Hill Road, in opposition to the rezc>ning. The letter was read to Council. The following persons .appeared b-efore Council in oppo.sition to the rezoning as it is believed that: (1) mobilehomes are not compatible with conventional dwellings; (2) tend to depreciate the value of permanent homes; (3) are taxed in such a manner as to °..have a�detr.imentalceffer.t on;sc:hools;�(4) would create traffic and dust problems in the area because of inadequate access streets. Haggard, 3162 Quartz Hill Road Eugene and Jane Irwin, Summit City, Evelyn and Gilbert Parker, Red Bluff, and Wayne Owen, Happy Valley, who own property in the area proposed for� rezoning, favor such rezoning, noting that several conventional ho�nes have been built in the area although mobilehomes were in close proximity prior to construction. "They believe the two are compatible and discount the theory that mobile- homes depreciate the value of conventional homes . Luke Mutchie, 500 La.ke Boulevard, who said he was neither for or against the rezoning, raised the question re method of taxation of conventional homes vs. mobilehomes, and was advised that mobilehomes are taxed on an 18-year depreciation scale by the State Motor Vehicle Department. n 136 MOTION: Made by Councilman Chatfield, seconded by Councilman A.nderson that the :Public Hearing be closed . The Vote: Unanimous A.yes A. discussion ensued regarding the mobilehomes on Quartz Hill Road whic�h are lawful non-conforming uses. Mr. Harris advised that th�ese rnobilehomes were there prior to annexation. The irregular `oundaries propo.sed for "ST" zoning in the area were also mentioned, and Councilman A.nderson indicated that he would favor considering the four areas individually rather than as; a composite as this would enable Council to_better evaluate any objectionslby property owners . There was also a discussion regarding the possibility of amending the present Code to allow replacement of a mobilehome in .a non-conforming use. The issue of real property tax on conventional homes vs. the Motor Vehicle tax on mobilehomes was discussed by Planni.ng Director Harris, who reported that there has been c.onsiderable debate in the legislature regarding this matter and several bills have been introduced, ..but he _does not believe that any survived committee hearings due to the strong mobilehome lobby. � MOTION: Made by Councilman Chatfield, seconded by Council- man Fulton that Rezoning A.pp.lication R.Z-8-73 be referr.ed back to th,e Planning Com��ti.ssion for restudy, further research, and consideration of "ST" zoning requirements. � + . - Voting was as follows: A.yes: Councilmen - Chatfield, Denny, Fulton,. and.
