Redding, California July 27, 1973 12:00 Noon The meeting was called to order at 12:00 Noon by Mayor Moty with the following Councilmen present: A.nderson, Chatfield, Denny, .and Moty. A.bsent: Councilman Fulton. A.lso present were City Manager Brickwood, A.ssistant City Manager Courtney, City A.ttorney Murphy, Public Works Director A.rness , Planning Director Harris , Director of Personnel and Labor Relations Reynolds, Sanitation Superintendent Townsend, and City Clerk Brayton. A.PPEA.L RE USE PERMIT FOR 5KA.TING RINK A. communi�cation was received from K. Maurice Johannes sen dated July 25, 1973, referring to an administrative decision conflicting with the proposed location of the skating rink building on the site, UP-16-73. Planning Director Harris reviewed his memo to Council dated July 26, 1973, which memo is made a part of these minutes by reference. The memo details the chronological events leading up to the site plan criteria proposed by the Planning Staff with respect to UP-16-73. Mr. Johannessen objected to Condition 3 of the use permit and appealed to the Planning Commission, the Planning staff's administrative interpretation of such condition, which pertains to location of the building on the site. Mr. 1 �� Harris noted that failure of the Planning Comzriis sion to approve Mr. Johannessen's proposed location of the building constituted confirmation of the Planning Staff's position and that Mr. Johannessen is now appeal- ing staff's administrative interpretation. It is staff's position that the revised plan would better integrate the development with the A.uditorium and Park area, and also that the largest of the oak trees could be pre- served. Mr. Harris stated that the proposed location of the building confflrms closely to the original plot plan submitted by Mr. Johannessen. Mr. Johannessen thanked Council and staff for taking time for this pro- ject. He showed Council two plot plans that were submitted to the Plan- ning Commission and stated that, although the final plan was modified somewhat, no changes were made from the original proposal as to location. He noted that six trees would have to be cut if his site location were used; however, seven or eight trees would be lost if staff's recomxnendation were implemented. Mr. Johannessen said that drainage and wind-driven rains would be detrimental if the building were located as proposed by the Planning staff. He also indicated that by placing the building as he has proposed, there will be adequate room for a building to house an ice skating rink at the other end of the property at a later date. City A.ttorney Murphy noted that the date on Mr. Johannessen's copy of the original plot plan was March 27, 1973, whereas the Planning Commis- sion approval was given on March 19. Mr. Johannessen said many plot plans had been prepared but the location of the building was always basically the same. He did admit, however, that the plot plan approved by the Recreation and Parks Commission showed the building location approxi- mately as Planning staff had recommended. George Greenleaf, who is a member of the Planning Commission, noted that, although he was not present at the last meeting of the Commission and therefore did not vote on the is sue, he asked that the record be made clear that there has never been any comment, telephone call or communi- cation to the Planning Commission trying to "kill the project" . This statement was made with respect to an article in the Record Searchlight. It was the consensus of Council that: (1) the developer should be allowed to place his building on the site at his own discretion, providing the zoning and set-back requirements are met; (2) it should be the responsibility of the Planning Commission to establish the criteria and that such responsi- bility should not be delegated to staff; (3) that the staff concern with the general aesthetics and environment of the Civic A.uditorium was proper. i 720 � I i MOTION: Made by Councilman Anderson, seconded by Councilman Chatfield approving the site as selected by Mr. Johannessen.
