The Pledge of A.11egiance to the Flag was led by Personnel Director Reynold s. The invocation was offered by the Reverend A.. L. Thomas , Pastor of Second Baptist Church. The meeting was called to order at 7:00 P, M. by Vice Mayor Chatfield with the following Councilmen present: A.nderson, Denny, Fulton, and Chatfield. A.bsent: Mayor Moty Als.o present were City Manager Brickwood, A.ssistant City Manager Courtney, City Attorney Murphy, Public Works Director A.rness , Planning Director Harris , Personnel Director Reynolds, A.ssistant Civil Engineer Hastings, and City Clerk Brayton. APPROVA.I� ,OF MINUTES MOTION: Made by Councilman Anderson, seconded by Councilman Fulton approving the minutes of the regular meeting of June 4, 1973 and of the special meeting of June 13, 1973, as mailed to each Councilman. The Vote: Unanimous A.yes C OMMUNICA TIONS Dean Trublood and Don Glass A. request, dated June 5, 1973, was received from Dean Trublood and Don Glas s for permits to operate another taxi company in Redding. City A.ttorney Murphy advised Council that it must be shown that public convenience and necessity make expedient the operation of applicant's vehicle or vehicles , and t�i.at the �� 3 A applicant and his vehicle or vehicles are possessed of the necessary City Code qualifications . Vice Mayor Chatfield appointed Councilman Fulton to meet with the City Manager regarding this request. MOTION: Made by Councilman Denny, seconded by Councilman A.nderson that a public hearing be held at 7:30 P.M. , July 16, 1973 to consider this matter. The Vote: Unanimous Ayes . Redding Softball League The City Clerk received a coxnrnunication from the Redding Softball i;eague on June 11, requesting permission to sell beer at the Redding Invitatiorial Softball Tournament to be held on June 15, 16, and 1? at the Softball Field. Council was polled ��5� by telephone regarding this matter and all members indicated approval. MOTION: Made by Councilrnan A.nderson, seconded by Councilman Denny ratifying the action taken by Council in a telephone poll approving the request as outlined above. The Vote: Unanimous A.yes r 90 Donald and Marjorie Way A. communication received from Donald and Marjorie Way, requesting that�the City ordinance be changed with respect � �� to permitting rabbits , chickens , ducks, and geese within the City bounda�ries , was referred to staff for investigation and report bac i to Council. State Division of Highways A communication received from the State Division of Highways, � � L� concerning "Ne�xt -- Signs" on the Freeway, was referred to staff for review and recommendation. Enterprise Pub�lic Utility District Loring Hanson; of CH2M, appeared on behalf of the Enterprise Public Utility District regarding the District's request for City water if the District runs short during the summer. Mr. Hanson estimates there ma.y be a need for one million gallons a day for about 10 days dluring the summer, which is the equivalent of approximately 30 acre feet. Public Works Director A.rness said it is staff's recommendation ��`� that the City of Redding provide domestic water to the Enterprise 33 i Public Utility District at a point located north of Grove Street on Bechelli Lane, subject to the following conditions: 1. Provide water as long as it does not prejudice the capacity of the City of Redding to provide necessary water to the citizens of the City of Redding. 2. The charges for water be based on either the 1966 charges made to the Cascade Community 5ervices District of $50.61 per acre foot, which was reviewed and approved by the Bureau of Reclamation, or a current cost analysis to be prepared by the Department of Finance in accordance with the rules of the U. S. Bureau of Reclama- tion-City of Redding contract. 3. Have the City A.ttorney prepare an agreement (to be signed by the City Manager) between the City of Redding and Enterprise Public Utility District agreeing to the above. i MOTION: Made by Councilman Denny, seconded by Councilman Fulton approvirig the recommendation of the Director of Public Works with the understanding that the agreement containing the firm price will be brought back to Council for approval. The Vote: Unanimous Ayes N.A..A.. C. P. Vernon Lowe, ;representing the N.A.A.. C .P. , appeared before Council concerning the alleged unnecessary force used in the arrest of Mary�A.nn Wesley. Mr. Lowe stated that he.had re- ceived numerous phone calls about similar incidents which have �6� occurred, and he recommended that a Board of Review or a Committee be appointed to consider complaints of this nature. Mr. Lowe said that the local N.A..A. C,P, doe s not complain about the arres't but is concerned .about the unnecessary force used in the arr.est. When asked if this and similar complaints were discussed with the Police Chief, Mr. Lowe said he had talked with Chief Whitmer two or three times but that the persons involved are reluctant to complain to the police for fear of recriminatory action. I � 91 Vice 1VIayor Chatfield said he would hope that existing staff and facilities could be utilized rather than appoint a Committee or Board of Review. He believed that any such complaints should be made to the City Manager, City A.ttorney, or City Clerk. City Manager Brickwood said when this complaint came to his attention he requested the Police Chief to make a complete in- vestigation, and that the investigation report will be submitted to Council. Councilma;n Denny felt that Council could hear such complaints and act upon them, if the matter was not handled properly at staff level; that Council is the proper appeal body. Isaac Lowe reported that an effort was made to contact the City Manager but he was busy, and the Police Chief was out of the City. Leroy Anderson supported Mr. Lowe's request for a Board of Review. He said that he has complete confidence in Mr. Brickwood and would like him to be a member of such a committee, as well as a Councilman, and representatives from minority groups. It is his feeling that such a committee would improve the relation- ship between citizens of Redding and the Police Department. Vice Mayor Chatfield said the request would be taken under consideration and that there would be further discussion on the matter at the time the investigation report is brought to Council. PUBLIC HEA.RING - Rezoning A.pplication RZ-4-73 The hour of 7:30 P. M. having arrived, Vice Mayor Chatfield opened the Public Hearing on Rezoning Application RZ-4-73. The following documents are on file in the office of the Gity Clerk: Affidavit of Mailing - Notice of Public Hearing A.ffidavit of Publication - Notic e of Public Hea ring Planning Commission Recommendation dated 6/12/73 The City Clerk advised Council that no written protests had l � �l been received. Planning Director Harris illustrated on the Vu Graph the area under consideration, which-property is located at 1114 Orange A.venue, across from the Eureka Arcade neighborhood shopping facility, and directly south of an existing s ervice station fronting on Eureka Way. Mr. Harris reviewed the recommendation of the Planning Commission as contained in a memo to Council dated June 12, 1973, which memo is made a part of these minutes by. reference. It is the recommendation of the Commission that the zoning on said property be changed from "R- 1" to the "R-3-F" District, with the site plan review criteria stipulating that the storm drain and alley be improved at the time the lot is developed. Mrs. Catherine A.11en, 1126 Orange A.venue, appeared before Council arid said she is not oppos.ed to a multiple family dwell- ing but does not favor the proposed two-story building. She ' also complained about the traffic in the alley behind her home 92 which she feels is generated from the apartment which faces on Olive A.venue. The alley, which is unpaved, is used as a race �track, according to Mrs . A.11en, and creates a dust problem. She is concerned that, with the construc- tion of another �apartment, the alley traffic will increase. Mrs. A.11en is also concerned that the tenants and guests from the proposed apartment will park in front of her home. I Joe Curto, the Iapplicarit, objected to the condition of the rezoning that the alley be improved at the time the lot is developed. He� said he is'.willing to furnish the pipe for the existing drainage ditch along the north property line, and the City has agreed to place the pipe; however, he feels it is unfair to require him to have the alley blacktopped, in- asmuch as the east-west alley and the north-.south alley which adjoin his property, are not paved. It was called to his attention that he will be using this alley as acc.ess to the apartment parking area and that the alley would be in lieu of a driveway, which he would be required to pave. It was also pointed out that using the alley as access to the parking area would result in a net gain in building area and would aYlow more flexibility in design. Vice Mayor Chatfield noted that as far as permitting a two- story building, this is permissible now in "R-1" Districts. MOTION: Made by Councilman Denny, seconded by Council- man A.nderson that the Public Hearing be closed. The Vote: Unanimous A.yes Councilman Anderson offered Ordinance No. 1129 for first reading. ' PUBLIC HEA.R.ING - Rezoning A.pplication RZ-5-?3 Councilman A.nderson abstained from discussion and voting on this it em. The hour of 7:30 P.M. having arrived, Vice Mayor Chatfield opened the Public Hearing on Rezoning Application RZ-5-73. Planning Director Harris illustrated on the Vu Graph the area under corisideration, which property is located at 145 Masonic A.venue, between the Masonic Temple and Timber Lanes �bowling alley, and reviewed the recorrimen- dation of the Planning Commission as contained in a merrio to Council dated June 12, 1973, which memo is made a part of these minutes by reference. It is the recommendation of the Commission that such property be rezoned from "C-2-P" Central Corrunercial District to "R3-20-F" Multiple Family Residential District with site plan review requirements and "U-F" Unclassified District with site plan review require- ments. The site plan review criteria are to be as follows for the "R3-20�F" District: I 93 l. Landscaping and„screen fence to be installed on property lines where adjoining development is not r esidential. 2, Ten-foot right of way for bicycle path to be pro- vided through the property. 3. ,Street�improvements to be installed at time of. �developrnent. � The area proposed for the"U-F" District is that area in .excess of 20 percent slope, and it is recommended that the "F" site plan criteria stipulate that this area not be used in calculating density for the total parcel. MOTION: Made by Councilman Fulton, seconded by Council- man Denny that the Public Hearing be closed. The Vote: Unanimous Ayes with Councilman Anderson abstaining.
