The Pledge of Allegiance to the Flag was led by Planning Director Harris.
The invocation was offered by the Reverend Robert Balsley, Pastor of
First Baptist Church.
The meeting was called to order at 7:00 P.M. by Mayor Moty with the
following Councilmeri present: Anderson, Denny, Fulton, and Moty.

Also present were City Manager Brickwood, City A.ttorney Murphy,
Planning Director Harris , A.ssistant City Engineer Lang, A.ssociate
Civil Engineer Mathis, A.ssociate Planner Owen, and City Clerk

A.PPROVA.L OF MINUTES
MOTION: Made by Councilman Fulton, seconded by Councilman Denny
approving the minutes of the regular meeting of April 2, 1973, as
mailed to each Councilman. The Vote: Unanimous Ayes
COMMUNICA.TIONS ,
Joelene C. Henriques
A communication, dated March 29, 1973, was received
from Joelene Henriques appealing the action taken by the
Planning Comrriission on March 19th regarding the permit
for a skating rink or arena on the property lying between
the Civlc A.uditorium and Highway 299•
In a memo� to Council dated A.pril 2, City Attorney Murphy
stated that Ordinance No. 814 clearly states, "There shall
be no administrative appeal from the decision of the
�'Z� Planning Commission," (with respect to conditional use
permits), and it is the opinion of the City Attorney that
no such aiministrative appeal should be granted.
Mayor Moty and Councilmen Denny and Fulton, who were
on the Council when Ordinance No. 814 was adopted, con-
curred that it was the intent of Council at that time to deny
the right of appeal from the Planning Commission with
respect to�use permits. It was therefore determined that
Mr s. Henrique s had no right of appeal to Council and that
her only recourse was to pursue the matter through the
courts . C�ity Attorney Murphy is so to inform Mrs .
Henrique s�.
Building and Construction Trades Council
No action was taken on the request of the Northeastern Cali-
fornia Building and Construction Trades Council for Council
to adopt a resolution calling upon President Nixon to rescind
�3� the moratorium on federally assisted low and moderate in-
come housing.

Mayor Moty noted that on national is sues it has been Council
policy not to take a stand as a Council group, but rather to
request all those who are interested to write their senators
and congressman individually.

California Regional Water Quality Control Board
A. communication dated A.pril 6, 1973 from the California �3�
Regional Water Quality Control Board, Central Valley
Region, pertaining to major was-te discharge requirements,
was referred to staff.
Petition re Roaring Twenties Pizza Farlor
A. petition was received, signed by 34 residents living in
the immediate vicinity of the Roaring Twenties Pizza / -��
Parlor, alleging that it is operating as a public nuisance.

This matter was tabled, based on the recommendation of
Police Chief Whitmer, inasmuch as the A.lcoholic Beverage
Control office has taken steps to investigate the allegation.
City Manager Brickwood is to keep Council informed.
Rodeo Week A.ctivities
A communication was received from the Asphalt Cowboys
listing the proposed schedule of Rodeo Week activities and �3,
requesting Council approval re use of certain streets during
Rodeo Week. Resolution No. 73-38 was submitted for
Council consideration.

NORTHERN CALIFORNIA POWER A.GENCY
Councilman Denny reviewed his memo to Council dated A.pril 12 , 1973 ,
re the NCPA Joint Exercise of Powers A.greement, which memo is made
a part of these minutes by reference. The primary goal of the NCPA is
to obtain supplementary power for public agencies . It is the recommen-
dation of Mr. Denny that, by minute order:
1) A rate case special assessment in the sum of $2, 373.75
be authorized�and apprbved�for eXpenditure. /� ��
2) The revised NCPA A.greement be approved and the Mayor
be authorized to execute same for and in behalf of the City of Redding,
and �
3) That an NCPA. capital improvement special assessment in
the sum of $4,368.00 for the City of Redding be approved and authorized
as an expenditure.

approving the recommendation re NCPA as stated hereinbefore. The

The City Cle rk advis ed Council that one lette r of protest

A.ssistant City Engineer Lang reported that the low bid on
this project was approximately. l5°jo over the Engineer's
Estimate and results in individual assessments increasing
approximately 21% over those shown on the petition. It is
therefore the recommendation of the Department of Public
Works that the public hearing be continued until 7:30 P.M.
May 7, 1973 in order that the Department may contact the
individual property owners and determine what course of
action they prefer to pursue.

Assistant City Engineer Lang submitted an outline of boundaries of the
proposed Eastside Road Water A.ssessment District, noting that a
petition has been filed with the City Clerk containing signatures of

Department of Public Works be authorized to complete the engineer-
ing and proceeclwith Special BondCounsel.

and providing for a quarterly permit use of off-street parking meters
in ten hour zones only and expressly excepting the north section of

RESOLUTION - Permit Parking for Certain Merchants in the Mall
City Attorney Murphy submitted Resolution No. 73-45 for Council
consideration. Mr. Murphy reported that this resolution provides ��y�
parking spaces on City parking Lots Nos. 8, 9 , 10, 11, and 12 for
Ma1L merchants whose business requires the use of a vehicle through-
out the business day for either the movement of service per;sonnel or "��0,3
merchandise pick up and delivery. He further explained that the
permit fee of $50 .00 per quarter is a mean average generated by
staff rather than a modal average. The Traffic and Parking Com-
mission favored a permit fee of $100 per year, whereas some
members of staff and Council favored fees of varying amounts up
to $300 per year.

Mayor Moty stated that he would not vote in favor of the resolution
if the permit fee were less than $300 per year. This wbuld provide
an annual retu 'rn of 10% on the $3', 000 'inv.estment per park'irig space.
Councilman''Denny said he eoncurred with the Mayor, at least for a
trial period, but if the usage is large, he thinks the fee should be
higher. ,
MOTION: Made by C�ouncilman A.nderson, seconded by Councilman
Denny that Resolution No. 73-45, as amended, be adopted, a resolu-
tion of the City Council of the City of Redding pertaining to parking
spaces on City parkirig lots nos . 8, 9,' 10, 11, and 12 on a quarterly
basis to merchants with defined needs whose principal business loca-
tions are withiri the R.edding Mall, pursuant to the provi.sions of
Section 18-59. 1 of the Redding City Code.

pertaining to violations of parking regulations and application for,

certain exceptions made.

City Council of the City of Redding approving right of way certifica-

Lake Boulevard between State Highway 273 and Keswick Dam Road
and authorizing its exiecution by the Mayor.

RESOLUTION -'Grant of Easement to Pacific Gas and Electric Company
MOTION: Made by Councilman Denny, seconded by Councilman
Anderson that Resolution No. ?3-47 be adopted, a resolution of the City
Council of the City of Redding approving grant of easement to Pacific
�/� Gas and Electric Company for electrical facilities to serve the control
tower at Redding Municipal A.irport, and authorizing the execution of
said easement by the Mayor.
