The Pledge of A.11egiance to the Flag was led by Planning Director Harris . The invocation was offered by the.Reverend Leo Jordan, Pastor of the Calvary Baptist Church. The meeting was called to order at 7:00 P. M. by Mayor Moty with the following Councilmen present: A.nderson, Chatfield, Denny, Fulton, and Moty. Absent: None A.lso present were City Manager Brickwood, City A.ttorney Murphy, Finance Director and Personnel Director Courtney, Public Works Director A.rness , Planning Director Harris , Superintendent Street Division Galusha, A.ssociate Civil Engineer Mathis, Associate Planner Owen, Traffic Engineer Hamilton, Airports Manager McCall, and City Clerk Brayton. A.PPROVAL OF MINUTES MOTION: Made by Councilman Chatfield, seconded by Councilman Fulton approving the rninutes of the regular meeting of March 19, 1973 as mailed to each Councilman. The Vote: Unanimous Ayes COMMUNICA.TIONS Martin Luther King, Jr. Memorial Center A. communication from Art Taylor, Chairman of the Board of Directors of the Martin Luthe�r King, Jr. Memorial � � 7 Center, concerning future funding of the Center, was re- ferred to staff and the Committee on Revenue Sharing Funds for consideration at Budget Sessions . Willard Woodward A. communication was received from Willard Woodward concerning the unsightliness of the City's overhead electrical distribution system and recommending that the City electrical rates be increased to start immediately undergrounding procedures for the City's major distribu- tion system and to actively enco.urage undergrounding assessment districts.for neighborhoods who wish to partici- ��3� pate. Mayor Moty stated that he is heartily in favor of under- gro.unding utilities but commented that, even if the City were to undertake such a program, it has no power over the Pacific Telephone Company to require it to underground its facilities , except in new subdivisions. The PUC has placed a limit of 2% of the Telephone Company's revenues to be allocated to undergrounding its facilities . This limit applies only where existing overhead facilities would be undergrounded and does not include new construction. The Mayor noted, however, that electrical rates will probably be increased because the City has been advised that it will be paying more for its electric power as of January 1 , 1974. Councilman Denny said that in this regard, the Northern California Power A.gency has, through Counsel, requested from the Bureau of Reclamation all pertinent information substantiating the proposed increase in wholesale power - rates to insure that all users of Federal power are paying equivalent rates. 48 A.sphalt Co,wboys In a letter received by the City Clerk on March 23, the Asphalt Cowboys requested that the Royal West Shows be permitted to show in Redding at the Posse Grounds on March 28 to April 1, 1973, in lieu of the dates pre- viously approved for April 25 to 29, 1973. �� � The City Clerk polled Council Members by telephone and received approval of the request:. MOTION: , Made by Councilman Anderson, seconded by Councilman Fulton ratifying the action taken by Council in a telephone poll approving the request. The Vote: Unanimous A.yes Pro-A rt In a letter to Council dated March 14, Pro-Art (Professional Art Show and Sales) requested permission to conduct a Pro-A.rt Show in the Redding Mall from A.pril 19 through A.pril 22, 1973. The City Manager and City Attorney submitted a memo to Council dated March 2? containing tlieir views of this request. ��� MOTION: Made by Councilman Anderson, seconded by Councilman Chatfield that Pro-A.rt be advised to submit their request to the Redding Redevelopment,A.gency as the City has no jurisdiction to issue such permit, ina'smuch as the City has not formally accepted the Mall and has not yet established policy relating to sales and exhibits within the Mall. Planning Director Harris reviewed the recommendation of the Planning Commission as contained in a memo to Council dated Mar.ch 29, 1973 , which memo is made a part of these minutes,by reference. It is the recommen- dation of the Commission that the Gene.ral Plan be amended in the area along the nor.th side of the Sac ramento River between Market Street and Interstate 5 , and adjoins the property dn the north that was the subject of a previous General Plan amendment approved by Council. The area under consideration was shown on the Vu Graph, and the proposed density configuration was pointed out. The amendment will allow the property owners to develop under the Planned Development District, and defines more precisely the steep slope and greenways. MOTION: Made by Councilman Denny, seconded by Councilman Fulton that the Public Hearing be closed. The Vote: Unanimous A.yes RESOLUTION MOTION: Made by Councilman Chatfield, seconded by Councilman Fulton that Resolution No. 73-34 be adopted, a resolution of the City Council of the City 'of Reclding amending the General Plan of the City of Redding by adopting General Plan A.mendment GPA.-1B-?3, amending the Plan as to that area bounded by North Market Street, Interstate 5 Freeway, Lake Boulevard East and the Sac ramento River. ,Voting was as follows: ' " A.yes: Councilmen - A.nderson, Chatfield, Denny, Fulton, and Moty Noes: Councilmen - None Absent: Gouncilmen - None Resolution No. 73-34 on file in the office of the City Clerk. GRA.DE SEPA.RA.TION STUDY Councilman Fulton reported that the Council Committee had met on several occasions to�review the proposed Grade Separation and Traffic Study by Clair Hill. This proposal will have an estimated maximum cost of $50, 000. Councilman Fulton said he questions the advisability of such a comprehensive study which goes considerably beyond a grade separation study andlactually is a traffic study of the greater downtown Redding area with a grade separation study included. � Councilman Chatfield, also a member of the Council Committee, said Jf � he feels the Committ'ee needs guidelines from Council as to how complete <<� a study should be mai e . Clair Hill reviewed the proposal and said he first thought a limited traffic study would be adequate but, upon considering the impact a grade separa- tion will have on traffic throughout the City, he believes a more compre- hensive traffic study is es sential. Mr. Hill said that his cost estimates for the study include right of way acquisition estimates which could be eliminated from the study. This would result in a cost savings of about $7,500. However, because of the development east of the Sacramento River, it is his feeling that the study should be extended to include Hilltop Drive, which would bring the cost back to approximately $5.0, 000. He noted that the cost figure does not include the preparation of the Environ- mental Impact Report. � � 51 In reply to Mayor Moty's question, Louis Mlcoch, Senior Project Engineer for the Clair Hill firm, said that the traffic model could be used by,the City traffic division in solving future traffic problems at a minimal cost. Mayor Moty.said he agrees that an underpass or overpass is desirable but questions whether it is worth the cost involved, which is estimated at $2 million. He feels it is essential to determine the .benefits, and would hope that any study would show the benefits . Councilman Fulton indicated that in his opinion there is no question about the need for a grade separation south of Eureka Way, but that the proposal for a comprehensive traffic study is making the project untenable because of the cost involved. Councilman A.nderson commented that the City does have a traffic problem and,if the study will help solve the problem in addition to determining the need for an underpass or overpass , he would favor such a study. . Councilman.Chatfield concurred with:Councilman Anderso.n. Councilman Denny recommended that action on the study be deferred until the Traffic Engineer makes some traffic studies of a rather superficial nature, and Council could then review the studies in connection with the total budget for the next fiscal year. Councilman Chatfield believes that studies by staff,over a short period of time would be meaningless and he recommends that the City pro- ceed without delay so that college students can be utilized in the study. The Mayor said he would prefer to consider the matter at budget sessions . City Manager Brickwood advised that the preliminary budget would be submitted to Council by. May ?, 19.73.. With the approval of Council; the Mayor tabled action on this matter until after receipt of the preliminary budget on May 7. It will then be considered at budget sessions. Vi Klaseen feels that the traffic study should include consideration of public transportation. Howard Fritz, 2475 W.aldon Str.eet, again recornrnended that the grade separation be an underpass , and that the location be at Gold Street. PUBLIC WORKS PLANNING REPORTS Public Works Director Arness submitted the Public Works Planning �jO Reports for April, 1973. RECONSTRU.CTION.OF BUTTE ST.REET. EAST A.ND YUBA STREET EAST MOTION: ..1Vlade by Councilrnan Denny, seconded by Councilman Anderson approving the recommendation of the Department of Public Works that all bids be,rejected on Bid Schedule No. 67.0, Reconstruction of Butte Street East and Yuba Street East, and authorizing the Director of Public ��� Works to have the work performed by force account. Wells, Sr. In a memo to Council dated�March 29, 1973 , Public Works Director A.rness recommended that Council grant an encroachment permit for J. M. Wells, Sr. , granting him permission to construct a driveway access to his property situated on the north side of Overhill Drive and just west of Mary Street. Mr. A.rness e�lained that the Superintendent �jC of Streets'does not have the autliority to grant an encroachment for the construction' of a driiveway access within public right of way which would be for the exclusive �use of a property owner. MOTION: Made by Councilman Fulton, seconded by Councilman A.nderson apprbving the eric'roachme'nt permit for J. M. Wells, Sr. for a driveway access for.the exclusive vehicular use of the property owner, but reserving pedestrian use for the general public, with the form of permit subject to the approval of the City Manager and City A.ttorney. The Vote: Unanimous A.yes ORDINANCE - re Dogs in Public Parks and Malls Councilman Denny offered Ordinanc'e No . 1119 for first reading, an ordinance of the City Council of the City of Redding amending Chapter �,�� 5 of the Redding City Code, 1959, as amended, by repealing Section 5-11 and substituting therefor a new Section 5- 11 , pertaining to dogs in public parks and malls.
