The Pleclge of A.11egiance to the Flag was led by Planning Director Harris . The invocation was offered by the Reverend A.. L. Thomas , Pastor of the 5econd Baptist Church. The meeting was called to order at 7:00 P. M. by Mayor Moty with the following Councilmen present: A.nderson, Chatfield, Denny, Fulton, and Moty. Also present were City Manager Brickwood, City A.ttorney Murphy, Finance Director and Personnel Director Courtney, Public Works Director Arness , Planning Director Harris , Associate Planner Owen, Police Chief Whitmer, Personnel Officer �.eynolds, Traffic Engineer Hamilton, Electric Division Superintendent Mix, and City Clerk Brayton. APPROVA.L OF MINUTES MOTION: Made by Councilman Denny, seconded by Councilman Fulton approving the minutes of the regular meeting of December 18, 1972 , as mailed to each Councilman. The Vote: Unanimous Ayes COMMUNICATION5 California Taxpayers' Association The communication received from the California Taxpayers ' A.ssociation, dated December 21, 1972 , re use of Revenue �;� � Sharing Funds to reduce property taxes, is to be filed for consideration with other revenue sharing funds priority items. Shasta County Department of Public Works A. communication from the Shasta County Department of Public Works regarding a proposed new highway crossing of the Sacramento River to be located between the Bechelli Lane //� � interchange with Interstate 5 and the east terminus of South Bonnyview Road, was referred to staff with the request that an appropriate response be prepared and submitted to Council for approval at the meeting of January 15th. Shasta County Department of Public Works A. communication was received from the Shasta County Department of Public Works advising of the proposed replace- ment of the Clear Creek Bridge on Placer Road. It was ��� j, determined that this bridge is not within the planning area of �� the City of Redding; however, Council requested that a letter be sent to the Shasta County Department of Public Works thanking them for keeping the City advised of such projects. The V ote: Unanimou s A.y e s ORDINANCE - Pertaining to Licenses Generally MOTION: Made by Councilman A.nderson, seconded by Councilman Fulton that full readi�ng of Ordinance No. 1107 be waived, and that the City Attorney be inst`ructed to scan same. i City A.ttorney.Murphy reviewed Section 17.46 of Ordinance No. 1107 pertaining to renters of real property, pointing out that there had been discussion regarding this Section at first reading of the Ordinance The point in controversy is the requirement of a business license from persons owning commercial property. It was explained that business licenses are require�d under the pr.esent. law from landlords renting four or more commercial units but not. from landlords renting less than four commercial.uni`s; that the amended section would require business licenses from any person renting 4,000 or more square fe.et of com- mercial floor space within the City, regardless of the number of'.tenants. Mayor Moty and Councilman A.nderson commented that it is not proper to impose such a license fee, inasmuch as the tenant (or tenants) ��� occupying such commercial space are required to have a business license which, in thiir opinion; amounts to double taxation. It is the belief of Councilman Denny that persons in the business of renting property, wliether it be residential or commercial, should pay a business license fee similar to that required of any other type of business . Councilman Chatfield indicated agreement with Council- man Denny. MOTION: Made by Councilman Denny, seconded by Councilman Fulton that Ordinance No. 1�107 be adopted, an ordinance of the City Council of the City of .Redding amending Chapter ]:7 of the Redding City Code, 1959, as amended, by repealing Sections 17-1 , 17-5 , 17-6 , 17-7, 17-9, 17- 10, 17-.12 , 17-16, 17-20, 17-22, 17-23, 17-26, 17-28, 17-29, 17-30, 1?-31, 17-33; 17-37, 17-40, 17-42, 17-46, and 17-50, and substituting therefor,new Sections 17- 1, 17-12, 17=16, 17-20, 17-23, 17-26, 17-28, 17-29�, 17-30, 17-31, 17-42, 17-46, and 17-50, per- taining to licenses generally. Voting was as follows: Ayes: Councilmen - A.nderson, Chatfield, Denny, Fulton, and Moty Noes: Councilmen - None Absent: Councilmen - None Ordinance No.. 1.113 on file in the office of the City Clerk. , RESOLUTION - in appreciation of services of Gene Dais MOTION: Made by Councilman A.nderson, seconded by Councilman Fulton that Resolution No. 73-1' be adopted as follows: /c'J� A 12.ESOLUTION OF THE CITY COUNCIL OF THE CITY OF R.EDDING IN APPRECIA.TION OF THE SERVICE5 OF GENE DAIS TO THE CITY OF R.EDDING, UPON THE OCCASION OF HIS, �.ETIREMENT WHEI�.EA.S, Gene Dais, the Superintendent of the Electric Utility Division of the City of Redding, has announced his retirement effective December 29, 1972, and { 4 WHEREA.S, Gene Dais has rendered 42 years of faithful and distinguished public service to the City of Redding in its Electric Utility, and � WHEREA.S, Gene Dais has served as Superintendent of the Electric Utility Divi'sion of the Public Works Department of the City of Redding from Dec�ember 16, 1956 to Decernber 29 , 1972 , and during these 16 years , under his administrative leadership, the City Electric Utility has more than doubled in size and has operated both efficiently and profitably, and � WHEREA.S, Gene Dais was one of those primarily responsible for converting the City's electric system, so that it could receive electric energy at 60 KV rather than 12 KV, which resulted in a very substantial energy s�vings to the City, and WHEREA.S, Gene Dais -was also one of those primarily responsible for the City's acquisition of the California Street sub- station of Pacific Ga,s and Electric Cornpany and the total modification of the Gity's power distribution network to a modern 12 KV system, and WHEREA.S, the City Council of the City of Redding is most appreciative of the long and distinguished service of Gene Dais to the City of Redding, and+ deems it most fitting and proper that its apprecia- tion of his services i e preserveel upon the official records of this City, NOW, THEREFOIZE, BE IT RESOLVED by the City Gouncil of the City of R.eddin�g that this resolution of appr'eczation honoring Gene Dais be spread uponJthe minutes of this meeting, and tliat a suitable copy of this resolution be prepared, certified by the City Clerk, and delivered to him upon the occasion of his retirement dinner on January ��)0 6, 1973. Mayor Moty appointed Councilman Fulton to work with Councilman Chatfield on this project and sugge�sted that their first report to Council should be of an investigative type: The Mayor gave Councilman Fulton a copy of a Grade Separation Study made for the City in 1964 by Clair A.. Hill & A.s s ociates. �G 7 Councilman A.nderson commented that recently the delays caused by trains moving`through Redding h'ave .been longer and sugge sted that, because the problem is created by Southern Pacific, perhaps a cost sharing agreement could be entered into between Souther.ri'Pacific and the City on�any uriderpas s or overpas s. ' City Manager Brickwood stated that early in December Southern Pacific notified the City that there would be a slow down of its trains mo.ving through Redding for a period of 60 to 75 days because of replacing ties in the�Sacramento River bridge. He noted that this will continue for another month to six weeks. Trains are _rolling at about 6 to 7 miles ari hour , whereas the normal speed is 25 miles an hour or better. tZEDDING DOWNTOWN MA.LL MOTION: Made by Councilman Denny, secbnded by Councilman Chatfield authorizing the Redding ttedevelopment A.gency to accept ��� the contract work on the Redding Downtown Mall as substantially com- plete and to file Notice of Completion, r eleasing to the contractor all but 10 per cent of the contract price at the time of such acceptance. Because of the rate of increase, it is the recornmendation of the Department of'Public Works that Council not adopt'the amended figure at this meeting but hold the item over for Couricil Committee review prior to the January 15 meeting. It is also recommended that the current $678.05 fee be utilized during the� interim period. The Vote: Unanimous Ayes LAND ACQUISITION In a memo to Council', dated December 27 , 1972, City A.ttorney Murphy requested Council approval authorizing staff to acquire 25 ,460 square feet of property ,beloriging to Paul W. Merritt at a price of $800. 00 A.cquisition of this property is necessary for the Lake Boulevard ��=5p widening project scheduled to begin this spring, and Council approval is required on individual acquisitions in excess of<.$500. � I MOTION: Ma.de by Councilman A.nderson, seconded by Councilman Chatfield authorizing�staff to acquire the Paul W. John Hoeflich, 944 State Street, A.pt. D, recommended that two drainage ditches under the Southern Pacific railroad tracks, south of 5outh Street, be modified by the Southern Pacific and the City for. use as pedestrian underpasses. He stated that he has been using these ditches for some time and that it is much safer than crossing over the tracks. The modification would include installing a platform ��i `� in the ditches above the water line that exists during the rainy season and constructing steps at either end, thus making the ditches usable for older people in the area. Vi Klaseen also spoke in favor of ped- estrian underpasses . Mayor Moty asked Councilmen Fulton and Chatfield to investigate this possibility in conjunction with their. investigation of a South Street underpass, Galen Lewis, President of the '_2edding Jaycees , spoke on behalf of that organization in urging that the City proceed with construction of an underpass at either Placer or South Street.
