� The invocation was offered by the Reverend George Lindsay, Pastor
's of the;Pilgrim� Congregational Church.
The meeting was called to order at 7:00 P.M. by Mayor Denny with
' the following Councilmen present: A.nderson, Demsher, Fulton, Pugh,
and Denny.

Fulton approving the minutes of the adjourned.regular meetings of May
21 , 28, and 29, and the regular meeting of June 2 , 1975, as mailed to

with alcohol and drugs at a previous 4th of July event occurred at the
opposite end �of�the pa•rk and had no connection with Jaycees' festivities.

opinion that it is not in the public intere.st-that permissioz� be; granted
for the sale of beer in the park.

Parks Director Riley advised that at the request of Council, the Recreation

Mayor Denny,said the: Recreation and Parks' Commiss.ion. explored .the
situation in depth. F3owever, they did not submit i-•nformation concerning
problems created liy�the sale of beer. He acknowledg.ed that the Council
is sensitive to both sides of the issue and commended both the Jaycees'
and the A.sphalt Cowboys' as being worthwhile or.ganization�s,. He ,is.,;mindful
, of the pos.sibility of penalizing an or.derly gro:up because of,another group

that might create problems. He said a policy cannot be applied
selectively or discriminately. He asked .Chief Whitmer _if he felt a

Chief Whitmer, stated that the sale of beer in the park will not affect the
Police.Depa�rtment one wap or the,other on the few,'days that beer might
be sold in the park, He has no qualms about. recorz�nending the sale of
beer in the park in these instanc,es . � He stressed his opini.on that if the
sale of��beer is pxohibited, then the consumption, of beer should also be

prohibited.
City A.ttorney Murphy advised that ,no evidence had been presented showing
that irregularities have occurred-in the past because of the sale of beer by
either organiz.ation. A, disturbance on July 4th coul.d have been the result
of drinking elsewhere..� In his opinion, the question is whether consumption
of beer should� be allowed in the park, if. the sale of beer is .to be prohib�ted=;

Planning Director Harris showed the area in question on the

a part of these minutes by reference.
In summary; Mr. & Mr.s. Frank Shuman are. appea�ling the ruling
of the Planning Commission that a full .environmental impact report
should be prepared prior to consideration of the rezoning request.

, Mrs.. Marjor`ie Shuman appeared and stated�that according to law,
she can remove all the structures on her_ property. and con;struct
a new building with twenty-nine parking spaces. However, in the
interest of preser�Ting the historically beautiful home which was
built in 1895.at 1506 West St. , she would like to convert the home
to office units , but she plans to restore the exterior a.ppearance
' of the� home to the authentic styling as when it was built by
Sheriff Sylvester Hull. To�offset the expense of this , she would
' - also like to conver..t the two existing cottages facing Butte Street

to offices, and provide the required parking. '
, Planning Director Harris reiterated the fact that �other applications
for rezoning in the area have been filed and that s_taff would like
to study land' use and planning and. prepare an environmental
impact report for the total neighborhood. �At the_ conclusion of the
� �pre�sentation, Mr. Harris sug�gested that the City Council authorize
� city staff to prepare a combined environmental impact r.eport
covering the Shuma.n property as well as other applications, including
the area from Willis St. to West St. and Eureka Way to Placer St.
He advised that the process would require from thirty-five to forty-
five days beyond the normal time for .rezoning procedure. The
cost of the EIR would be absorbed by the city.
