A.ssistant City Manager Courtney advised Council that he has been in contact with the Insurance Company and said that there is considerable confu,sion of fact regarding the condition of the Chevvy II that was wrecked; however , he has askecl that the claim be settled and he feels it will be � within a week. The Vote: Unanimous Ayes HENDERSON ;ROAD A REA A NNEXA.TION Associate Planner P,erry advised Council that the Planning Commission considered the proposed Henderson Road Area Annexation at its regular meeting of May 27, �1975. During the course of the discussion, several residents of the Wilshire Drive area expressed opposition to annexation of property owners not desiring to become a part of the City. Staff- suggested that an informal public meeting be held to discuss the pros and cons of the issue and to assist in defining annexation boundaries prior to formal submittal to the Local Agency Formation Commission. � It is suggested that Council authorize commencement of annexation � proceedings,by minute order and that staff be.directed to,meet with �� the residents prior to defining.,a precise annexation boundary and to assist the petitioner� on preparing the application to LAFCO. � Mr. Perr,y.. stated that just.before. 5:00 P.M. this evening he had re- ceived. petitions .signed by 35 per.s.ons ,in the a.rea who are opposed to the annexation. . . . .. _ Mayor Denny requested the City Attorney to review the procedure regarding this annexation, if Council approves the recommendation. City Attorney Murphy advised the audience that�what staff has recom- mended to Council this evening goes beyond what is�required by law ' in the annexation process. Normally after Council receives petitions requesting annexation, they authorize staff to assist the petitioners in preparing an application to submit to LAFCO, and it goes before � _ .. __. _ _._ - - 81 LAFCO for their public hearing and consideration, and they act on the application. They ma,y modify the boundaries; they may deny the application, or they may grant it witliout amendment. After that a formal petition is circulated by property owners. A protest hearing is,then held by Counc,il and, .if protest is made by property owners of more than one half of the land value of the territory pro- posed to be annexed, further proceedings shall not be taken. Follow- ; ing the protest hearing, there is an election, and a majority of the registered voters living in the area must vote in favor of the annexa- tion for the annexation to carry and be successful. All of these steps lie ahead of the action recommended this evening. May.or Denny noted that the.Local Agency Formation Commission normally_ meets on the second Wednesday evening of the month at 7:00 P. M. , and probably the earliest date'that this application would be considered would be July 9. MOTION: Made by Councilman Pugh, seconded by Councilman Demsher ' approving the recommendation of staff. . The Vote; Unaniinous Ayes Stanford Scott asked if the City would take over P. G. & E, electric utilities. He was advised that it generally,- takes two years for a take- over of P. G. & E, utilities by the City. Don Linn asked what perceritage of registered voters is required to appr ove an annexati on. Mr. Murphy replied that a s imple ma j or�ity of the registered voters must favor annexation for the annexation to be successful. He further stated that a formal petition for annexation � must be signed by 25% of the qualified electors_residing within the territory proposed to be annexed. ' Councilman Fulton asked about the possibility of the City moving up /�.��- � on the PUC,.priority list. � Both Councilman Demsher and i:he Public Works Director were � � pessimistic about Redding receiving funds for an.overpass in the near future. .Councilman Demsher .feels it would be wise to devise a traffic pattern that would least inconvenience citizens until the City is in a position to go for_ward. with an overpass. .. . , Councilmari Fulton spoke of the'possibility of a `bond eTection�to fund an ove "rpass. The City Attorney stated that it would require a G.O. The Vote� Unanimous Ayes ROLLING HILLS SUBDIVISION ,UNIT NO, 5 Public Works Director A.rness reported that improvements in the Rolling Hills Subdivision Unit No. 5 are currently being constructed by the devel:oper and he has placed on file with the City a time cer- ��C� � tificate.of. deposit from the Bank of America in the amount of $2.0;000 to guarantee the completion of all improvements and the payment of all inspection fees to the City. It is recommended that Council approve the final subdivision map by minute order. The Vote: Unanimous Ayes WESTERN LIQUID ASPHALT CASES City A.ttorney Murphy reported that the City has received a partial settlement in the Western Liquid Asphalt Cases class action carried `,�j�v on by the Attorney General, Redding's share of the Douglas and ARCO settlerrients is $3,524.02. There is $8-1/2 million remaining in escrow, and Mr: Murphy expects the City will receive an additional amount of $7500 to $8000. � ORDINA.NCE - Pertaining to Sprinkler System Service Councilrnan.Pugh offered Ordinance No. 1186 for first reading, an ��� ordinance of the City Council of the City of Redding amending Chapter � 29 of the Redding.
