Redding, California A.ugust 23, 1976 12:00 Noon The meeting was called to order at 12;00 Noon by Mayo.r Fulton with the following Councilmen present: Demsher, Gard, Pugh, and Fulton. Absent: Councilman Anderson A.lso present were City Manager Brickwood, Assistant City Manager Courtney., City A�ttorney Murphy, Public Works Director A.rness , Planning and Community Development Director Harris, Personnel and Labor Relations Director Reynolds, A.ssociate Civil Engineer Mathis , and City Cler°k Brayton. CONFLICT OF INTEREST CODE - Set Public Hearing MOTION: Made by Councilman Demsher, seconded by Councilman Pugh that a Public Hearing be set for 7:30 P.M. on September 20, 1976 at the Civic Auditorium to consider a Conflict of Intere st Code for ���`� Members of the Redding City Council. The Vote: Unanimous Ayes LITIGA.TION - City of Santa Clara vs . Thomas Kleppe, individually and as Secretary of the Interior, et al MOTION: Made by Councilman Demsher, seconded by Councilman Pugh J ,/� authorizing the Mayor to enter into a contract for the employment of l ����' / special counsel re the law suit City of Santa Clara vs. Secretary of the Interior, authorizing the issuance of a present check in the sum of $5,710.48 payable to the City of Palo A.lto, and instructing the City Attorney to prepare the necessary appropriations resolution for a subsequent meeting to provide for future participation this year to the maximum extent of $15,000. 00. The Vote: Unanimous Ayes GENERAL RELEASE - Johns-Manville Sales Corporation MOTION: Made by Councilman Pugh, seconded by Councilwoman Gard �/� � approving the General Release of Johns-Manville Sales Corporation re l use and installation of Johns-Manville materials on the Civic A.uditorium, and authorizing the IVIayor to execute said Release on behalf of the City. The Vote: Unanimous Ayes REDDING REGIONA.L WA.STEWATER SYSTEM Public Works Director A.rness briefly reviewed his memorandum to Council dated August 20, 1976 concerning (1) a proposed contract be- tween CH2M Hill and the City of Redding to perform Step II engineering design services for the City of Redding re Redding Regional Wastewater / System, (2) a grant offer from the U. S. Environmental Protection �Y��� A.gency in the amount of $1,093,500. , and (3) a grant offer from the State Division of Water Quality in the amount of $182,250. It is the � recommendation of the Department of Public Works that Council accept the two grant offers and approve the CH2M Hill contract, subject to the addition: �. of the following amendment, and that the City Manager be authorized to sign said contract and grant applications: Amendment to CH2M Hill Contract "To the extent applicable, the Engineer agrees to indemnify the City of Redding against any loss arising out of reduction in grant eligible funds as a result of an EPA or 5tate Division of Water Quality audit determining tha the Engineer's cost for its work is unreasonable. That any reductions in City of'Redding grant funds would be applied in like manner to the compensation due the Engineer for the Step II work." MOTION: Made by Councilman Pugh, seconded by Councilman Demsher approving the recommendation of the Depar.tment of Public Works as aforestated. The Vote: Unanimous Ayes 158 RESOLUTION - Pertaining to Paid On Call Firemen Program MOTION: Made by Councilman Demsher, seconded by Councilman Pugh that Resolution No. 76-97abe adopted, a resolution of the City f � (..� Council of the City of.Redding amending Resolution No. 76-86 by � substituting a new Exhibit A(2), pertaining to the paid on call fire- men program. Voting was as follows: � Ayes: Councilmen;- Demsher, Gard, Pugh, and Fulton Noes: Councilmen '- None Absent: Councilmen - Anderson Resolution No . 76-9�is on file in the office of the City Clerk.
