Z{�25-t}1� RESOLUTION Ct�NFI IN�G EXISTEl�I�E (7►F A LOCAL EMER+GEI�T4CY �HE A5, Gt�vernment Code secti�an 8642 provides that whenever a state c�r Iocal emergency exists, the governing bcrdy ofthe local govemmental entity shall meet as soon as possible;;and WHE AS, Redding Municipal Code sections 9,12.03C1, and 14.24.02�, generally empower the City Manager, as Director of Emerg�ncy Services, tc� proclaim the existence or threa�en�d existence of a local emergency when the City is affected or likely to be affected by a public calamity and the City Cc�uncil is not in session5 and W�IE AS, Redding Municipal Cc�de section 9.12.030(C) provides that the decisic�n of the City Manager tt� declare a locaZ emergency must be ratified by the City Gouncil within seven (7} calendar days of th� City Manager's action ar it s�iall haVe no further force or effect; and WHEREAS, R�dding Municipal Cade section 4.22.120 and P'ublic Contract Cade sectians 20168 and 22050 allow the City Cauncil to e�pend public monies withc�ut competiti�e solicitation when safeguarding life, health, ar safety wi11 nt�t permit delay; �nd EFtEA�, the City M�nager, as L}irector of Emergency `Servicea of the City of Redding, praclaimed the existence of a local emergency, as defined in Government Code section 8558(c),within the City on the 11th day of February, 2t?25, as evidenced by the Pr�ciamation of the I�irectflr of Emergenc� Services attached and incarporated herein; and E AS;the Proclamation ofthe Director of Emergency Services dated February 1 l,2025,was ser�t to the County�►irector of Emergency Services on February 11, 2C}25; and WHE AS, conditions c�#'extreme peril to the safety c�f persans and prc�perty have arisen within the City which were caused by flooding caused by severe winter storms which began on February 2, 2�25, and �HEREAS, the flooding has continued through increased releases from Shasta Dam inundating and dan�aging land, raads, trails and other facilities, in particular the callapse of a 120" culvert acr�ss the access rc�ad t� the Reginato Bc�at Ramp whieh prc��ides river access to public s�fety agencies, an F�bruary 9, �025, at which time the City Council of the City of Redding was nr�t in session; and E AS,there is immediate need to repair tir replace the �20"culvert that failed at the entrance to the Reginato Sc�at Ramp as this ramp serves as a critical entry point fc�r river access fc�r public s�fety agencies tc� effectuate river rescues and ta acce�s areas along th� river that are otherwise inaccessible. Additionally, river guides and other river related businesses utilize this ramp extensively and prolanged closure will cause significant ecanomic hardship as well as impeding lifesaving efforts by the R.edding Pc�lice Departrnent and the Shasta Cuunty Sheriff; and WHE AS,the Baard of�upervisor"s for the County af Shasta ratified a proclamation af a Local Emergency far �hasta Caunty on February 1l, 2fl25, anci direeted that the prc�clamation be sent tc� the Governr�r af the State of California and the Secretary of the +Office of Emergency Services requesting they proclaim the County c�f Shasta to be in a state of emergency; and W�IE A�,the conditions caused by the flc�ading are beyond the cantrol af the services,personnei, equipment and facilities of the City of Redding, and WHE A�,the City Ccruncil hereby finds that the afQresaid conditians of extreme peril did warrant and necessitate the proclam�tion af the existence af a local emergency, 1�10W, THE F() ,IT IS HE BY PRt�CLAIIY�ED AND � ERED as follows: 1. The recitals s�ated abave are true, correct, and are adopted herein. 2. The Prc�clamation of the Directar t�f Emergency Services dated February 11, 2025, is hereby confirmed and ratified. 3. That, pursuant to Government Code section �630{�}, a local emergency withiz� the meaning of Governrnent Cc�de section 8558(c}exists within the jurisdictional limits of the City c�f R�dding. 4. That, pursuant to Public Contract Code section 20I68 and 22050, the public inter�st�nd riecessity d�mand th�immediate expenditure of public rr�oney to safeguard life,health and property,the 1oca1 emergency will n�t permit a delay resulting from a ct�mpetitive solicitation fc�r bids; immediate actic�n is necessary to respond ta the lc�cal emergency, and the City Manager is authc�rized to repair or replace a public facility, take any directly related and immediate action required by the Ic�cal emergency;and procure the necessary equipment, services and supplies for those purpt�ses without giving notice fc�r bids tc� let contracts, 5. That,pursuant to Public Contract Code section 22050(c�(1}, the �tate of local ernergency shall �e deeTned to continue tcr exist until its termination is proclairned by a resolutian adapted by a fourth- fifths vote af the City Council. 6.
