SUBJECT: 4.11(a)--Termination of Emergency Repair and Replacement of Substandard
Sewer Pi e and Failin As halt Concrete Pavement on Placer Street Pro'ect
Recommendation
Approve and authorize the following actions:
(1) Adopt Resolution terminating the Emergency Repair and Replacement of Substandard
Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project; and
(2) Find, in accordance with Public Contract Code Section 22050(c)(1), by a four-fifths vote
of the City Council, that the emergency conditions necessitating waiver of colnpetitive
bidding in order to procure immediate repair of the storm drain system has concluded.
Fiscal Impact
The Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalt
Concrete Pavement on Placer Street Project(Project) costs were funded by the City of Redding's
(City) Wastewater, Water, and Streets Divisions. The originally estimated cost of the repairs was
$3,405,000 and the final project construction cost of the repairs is $2,794,556.32.
Altenative Action
The City Council (Council) may choose not ta adopt the attached resolution and provide further
direction to staff.
Backgound/AnaZysis
On May 7, 2024, Council adopted an emergency resolution for the project and authoized the
negotiation of an emergency public works contract. The project includes replacing substandard
sewer pipe, associated infrastructure, failing asphalt concrete and other miscellaneous public
health and safety work on Placer Street and within the Magnolia Area Sewer
Improvements - Phase I project limits.
As of November 16, 2024, Cox & Cox Construction(Contractor) completed all items of work on
Report to Redding City Council January 29,2025
Re: 4.12(a)--Update of Emergency Repair and Replacement of Substandara'Sewer Pipe and
Failing Asphalt Page 2
the project and the Public Works Department subsequently filed the notice of completion with
County of Shasta.
At its September 3, 2024, meeting, Council approved continuation of the emergency resolution
and approved increases to the budget for a total authorized amount of$3,405,000. To date, the
contactor has received payment for all items of work completed, including release of retained
funds, for a total amount of $2,794,556.32. Staff time for contract administration and
construction inspection is currently being reconciled and staff does not anticipate those costs
exceeding the total authorized amount.
At this time, staff recommends that Council terminate the emergency by adoption of the
resolution as all items of repair are complete. Per Public Code 22050(c)(3), the governing body
shall terminate the action at the earliest possible date that conditions warrant. Staff intends to
bring forth to Council a final project acceptance staff report and presentation detailing all costs,
including staff time, for final project acceptance of both the emergency repairs as well as the
Magnolia Area Sanitary Sewer Improvements - Phase 1 project by Apri12025.
The resolution terminating the emergency has been approved by the City Attorney.
Environmental Review
This action is not a project as defined by the California Environmental Quality Act (CEQA) and
no further action is required. On 1VIay '7, 2024, the Council determined that the project is exempt
from environmental review under the CEQA Guidelines, per Section 15269(b)-Emergency
Projects.

SUBJECT: 9.11(f--Emergency Construction Contract to Repair and Replace Substandard
Sewer Pi e and Failin As halt Concrete Pavement on Placer Street
Recommendation
Authorize the following actions relative to the Emergency Repair and Replacement of
Substandard Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project
(Proj ect):
(1) Adopt Resolution, by not less than four-fifths affirmative vote, authorizing the City
Manager to negotiate and award an emergency public works contract for the Project in an
amount not to exceed$2,000,000;
(3) Authorize the City Manager, or designee, to approve construction contingency amounts
up to a total of$300,000;
(4) Authorize the City Manager, or designee, to approve construction management and
inspection amounts up to a total of$175,000; and
(5) Find that the Project is exempt from review under the California Environmental Quality
Act Guidelines, pursuant to Section 15269(b)—Emergency Projects.
Fiscal Impact
The estimated Emergency Repair and Replacement of Substandard Sewer Pipe and Failing
Asphalt Concrete Pavement on Placer Street Project (Project) total cost is $2,475,000. These
costs include construction, construction contingency and staff time for construction management
and inspections. The project will be funded with remaining Magnolia Area Sewer Improvements
Phase 1 funds. Including withheld retention, liquidated damages and uncompleted work items
which is approximately $2,160,000. Supplemental funding of $315,000 wi11 come from the
Wastewater, Water and Streets Division's Fiscal Year 2023-24 budgets which have sufficient
funds appropriated.
Report to Redding City Council May 2, 2024
Re: 9.12(f)--Emergency Repair and Replace Substandard Sewer Pipe and Failing Pavement on
Placer St. Page 2
Alternative Action
The City Council (Council) may choose to not authorize the award of an emergency contract,
and instead have staff prepare plans and specifications to award a contract to the low bidder in
accordance with state and ]oca] contracting procedures. Or, Council could provide alterative
direction to staff.
Background/Analysis
On April l, 2024, Council voted to enter into a Contract Amendment, Settlement Agreement and
Release with the contractor for the Magnolia Area Sewer Improvements Phase 1 project. This
settlement agreement was partially due to the contractor's refusal to make required repairs to
substandard work done on the project. This substandard work has the potential to create public
health and safety issues.
Staff has considered repackaging the project plans and specifications for bidding; however, this
process would likely require a minimum of six months in order to obtain an executed contract
and ultimately provide a contractor with a notice to proceed. This timeline is unacceptable given
the condition of the installed sewer infrastructure and would jeopardize being able to complete
all the repair work, including re-paving Placer Street, prior to the onset of winter. In addition,
current Magnolia Area Sewer Improvement Phase 1 project site conditions present potential
impacts to public health, property and safety. Therefore, staff proposes an einergency contract to
replace the substandard sewer pipe and associated infrastructure, failing asphalt concrete and
minor associated public health and safety work on Placer Street and within Magnolia Area Sewer
Improvements Phase 1 project limits. Staff estimates the work wi11 be complete within four
months of commencement of construction activities.
It is noted that the Public Contract Code (PCC) (Section 20168) provides that the local
government's legislative body may pass a resolution by a four-fifths vote of its members
declaring that the public interest and necessity demand the immediate expenditure of public
money to safeguard life, health and property. Further, the PCC (Section 22050)provides that"in
case of emergency, a public agency, pursuant to a four-fifths vote of its governing body, may
repair or replace a public facility, take any directly related and immediate action required by that
emergency, and procure the necessary equipment, services, and supplies for those purposes
without giving notice for bids to 1et contracts."
It is in the public's interest and necessity to repair the sewer system, pave Placer Street and repair
or replace other associated minor items of work immediately to ensure protection of the public's
health, safety and personal property occurs.
The Resolution has been approved as to form by the City Attorney.
Environmental Review
Staff has determined that the project is exempt from review under the California Environmental
Quality Act Guidelines, pursuant to Section 15269(b) — Emergency Projects. Section 15269(b)
includes emergency repairs to publicly and privately-owned service facilities necessary to
maintain service essential to the public health, safety, or welfare. The emergency repair and
replacement will occur in areas of previous disturbanee, and the repairs are necessary to maintain
service essential to public health.

SUBJECT: 9.11(g)--Consider increase to the Emergency Repair and Replacement of
Substandard Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project
Bud et.
Recommendation
Approve increases to the budget in the amount of $935,000 for the continuation of C-103$7,
Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalt Concrete
Pavement on Placer Street Project and, in accordance with Public Code Section 22050(c)(1),
make a determination by a four-fifths vote that there is a need to continue the emergency work.
Fiscal Impact
The Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalti
Concrete Pavement on Placer Street Project (Project) costs will be funded by the City of
Redding's (City) Wastewater, Water and Streets Divisions. The updated, estimated total project
cost of the repairs is $3,405,000. The additional increase to budget will largely be funded by the
Streets Division ($715,000) due to increased paving costs and Wastewater and Water Divisions
($220,000) due to underground repair increases.
Alternative Action
The City Council (Council) may choose not to authorize an increase to the project budget and
provide alternate direction to staff.
Background/flnalysis
On May '7, 2024, Council adopted an emergency resolution for the project and authoized the
negotiation of an emergency public works contract with Cox & Cox Construction (Contractor).
Staff prepared an initial estimate for the project for the utility repairs and Placer Street paving.
This estimate was prepared relative to the budget that was recaptured from the original
uncompleted project and based on initial negotiations with the contractor, it was anticipated by
staff that additional funds would be required to fully complete the project. Additional costs were
unknown at the time of project commencement and staff recently received the estimated costs to

The table below provides further details of the contractor's progress based on actual work
performed to date as well as the projection of funds to complete the project. Staff is requesting
the following funds:

ContractAdministration, $370,000 $170,000 $0 $370,000 $0
Ins ection, Testin
Construction Contingency $2,100,000 $500,000 $935,000 $3,035,000 $935,000
Totals $2,470,000 $670,000 $935,000 $3,035,000 $935,000
The project proposes to replace substandard sewer pipe, associated infrastructure, failing asphalt
concrete and other miscellaneous public health and safety work, on Placer Street and within the
Nlagnolia Area Sewer Tmprovement Phase I project limits.
Envi^onmental Review
This action is not a project as defined by the California Environmental Quality Act (CEQA) and
no further action is required. On May 7, 2024, the Council determined that the project is
categorically exempt from environmental review under the CEQA Guidelines, per Section
15269(b)-Emergency Projects.

Manager to negotiate and award an emergency public works contract for the Project in an
amount not to exceed$2,000,000;
(3) Authorize the City Manager, or designee, to approve construction contingency amounts
up to a total of$300,000;
(4) Authorize the City Manager, or designee, to approve construction management and
inspection amounts up to a total of$175,000; and
(5) Find that the Project is exempt from review under the California Environmental Quality
