Recommendation Authorize and approve the following: (1) Refer Redding 1Vlunicipal Code Chapters 18.43 (Standards for Specific Land Uses*), 18.60 (Use Classifications), and 18.61 (List of Terms and Definitions), to the Planning Commission for the update, revision and clarification of the definitions, categories, and zoning of adult businesses and activities; and (2} Direct staff to prepare recommendations for the Planning Commission; and prepare an ordinance based on the Planning Commission's direction for future consideration by the City Council. Fiscal Impact There is no fiscal impact associated with the presentation. Alte�native Action The City Council (Council) could request additional information or provide staff alternative direction. Backg�ound/Analysis On November 5, 2024, during Item Na 12, the Council direeted the City Attorney to return with a presentation and analysis on the City of Redding's zoning regulation pertaining to adult businesses. The City Attorney has completed review and will be providing a brief presentation regarding the current zoning ordinances pertaining to adult businesses. A more thorough legal analysis is provided separately via privileged memorandum. "Adu1t Business Establishments," as that term is defined in Chapter 18.60, is a land use classif.tcation that applies to: [e]stablishments whose preponderant business is the offering of materials, products, and/or services that have sexual arousal, sexual gratification, and/or sexual stimu]ation as their dominant theme and which are not customarily open to the general public because they exclude minors by virtue of their age as a prevailing business . . . If a use meets this definition of an "Adult Business Establishment," it may only operate in areas designated for Heavy Commercial zoning and is required to obtain and comply with a use permit. Additionally, Chapter 18.61 contains a separate definition for "Adult Entertainment Business or Activity,"which includes: An establishment that is not customarily open to the public but only to one or more classes of the public and that normally excludes any minor by reason of age. Such establishments usually charge a fee for a service or sale item to be purchased. It is a business that is characterized by emphasis on depicting, describing or relating to "specified sexual activities" or "specified anatomical areas" . . . Any use that meets this definition of"Adult Entertainment Business or Activity" is subject to a number of additional restrictions including specific setbacks, architectural requirements, and operational limitations. After review of the code, it appears that the similarity of the terms "Adult Business Establishment" and "Adult Entertainment Business" may invite a certain level of confusion, and some of the other language in the ordinance also appears outdated. Although the City Attorney's Office has not conducted a thorough historical review, the last ordinance addressing these businesses appears to be from 2005. That ordinance appears to have been a comprehensive update and re-adoption of the zoning code, so there is a significant likelihood that the current sections were carried over verbatim from an even older ordinance. Given this, the City Attorney recommends that the Council refer the relevant sections of the code to the Planning Commission for update and direct staff to prepare recommendations for the Commission to consider. Such updates would not prevent existing lawful businesses from continuing in their current location and form but would allow clarification of the ordinances while revisiting whether any adjustments to the substantive restrictions would be appropriate. Environmental Review This is not a project defined under the California Environmental Quality Act, and no further action is required.
