SUBJECT: 4.11(g)--Summary Vacation of a Public Service Easement(A-2024-01427)
Recommendation
Authorize and approve the following actions relative to the Summary Vacation of a Public
Service Easement (A-2024-0142'7):
(1) Adopt Resolution summarily vacating a Publie Serviee Easeinent located on Lots 17
through 40 of the Salt Creek Heights Unit 2 Subdivision Map as described in Exhibit A
and depicted in Exhibit B subject to the recordation of new Public Service Easements as
depicted in Exhibit C;
(2) Find the action consistent with the General Plan; and
(3) Find the action categorically exempt from environmental review under the California
Environmental Quality Act Guidelines, pursuant to Section 15035 - Minor Alterations in
Land Use Limitations.
Fiscal Impact
Adopting the Resolution will have no fiscal impact to the City of Redding (City). A11 costs
associated with the processing of this project are paid by the applicant.
Alternative Action
The City Council may choose not to adopt the Resolution and leave the Public Service
Easements in place.
�3ackground/flnalysis
The owner of Lots 17 through 40 has requested the vacation of Public Service Easements (PSEs)
within said lots due to proposed alterations of the building footprint designs. The PSEs were
dedicated to the City of Redding (City) by the recordation and filing of the Salt Creek Heights
Unit 2 field in Book 25 of Maps at Page 11, Shasta County Records. The PSEs proposed to be
vacated will be replaced by new, compatible Public Service Easements as depicted in Exhibit
`C'. The request was coardinated with various City departments and public utility companies.

With the recordation of the new Public Service Easements the PSEs Inay be determined to be
excess and eligible for summary vacation per Streets and Highways Code 8333(c). The summary
vacation is consistent with the General Plan as it will not preclude uses consistent with current
zoning and encourage design consistent with the surroundings.
The resolution has been approved as to form by the City Attorney.
Environmental Review
Staff has reviewed the action and determined that the activity is categorically exempt from
environmental review under the California Environmental Quality Act Guidelines, pursuant to
Section 15305 (Minor Alterations in Land Use Limitations). The Class 5 exemption allows for
minor alterations to land use limitations, as long as the average slope on site is less than 20
percent and would not result in any changes in land use or density. This action will not result in
the creation of any new parcels, nor will it change land use density. In addition, the project area
does not have significant values for wildlife habitat or other environmental resources. The action
has no potential to have a significant impact on the environment.

A RESOLUTION OF THE CITY COUNCIL OF TFIE CITY OF REDDING
SUMMARILY VACATING PUBLIC SERVICE EASEMENTS AS SHOWN ON
SALT CREEK HEIGHTS UNIT 2 SUBDIVSION MAP (ABANDONMENT
APPLICATION A-2024-0142�)
WHEREAS:
A. The Public Service Easements being considered for summary vacation was acquired by dedication
by the Salt Creek Heights Unit 2 Subdivision Map filed in Book 25 of Maps at Page 11, Shasta
County Records and is described in Exhibit"A" and shown on Exhibit "B" attached and made a
part hereof by reference. The owner of Parcels 17 through 40 of said map have asked that the City
vacate these Public Service Easements.
B. The Public Service Easements being considered will be rededicated and can be considered excess.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS
FOLLOWS:
L The recitals set forth above are true,correct and are hereby adopted as findings of fact.
2. Pursuant to Streets and Highways Code $333(c), the City Council determines the Public Service
Easements to be excess.
3, The City Council approves the request to summarily vacate the Public Service Easements as shown
on the Salt Creek Heights Unit 2 Subdivision Map filed in Book 25 of Parcel Maps at Page 11,
Shasta County Records, as described in Exhibit"A" and shown on the attached E�ibit"B" and
subject to the grant of Public Service Easements as shown on the attached E�iibit"C".
4. The vacation of the Public Service Easements is consistent with the General P1an.This action wil]:
not preclude uses consistent with current zoning and will encourage design compatible with its
surroundings.
5. The vacation of the Public Service Easements qualifies as Categarically Exempt from environment
review under the California Enviromnental Quality Act Guidelines Section 15305 — 1Vlinor
Alterations in Land Use Limitations. No changes in land use or density will occur and areas
affected contain an average slope of less than 20%. There is no possibility that this action
will have a significant impact on the environment.
6. The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested by the
Clerk under seal,to be recorded in the Office of the Shasta County AssessorlRecorder.
