Recommendation Authorize and approve the following actions: (1) Offer an Ordinance amending Redding Municipal Code (RMC) Title 2 (Administration and Personnel), to modify, Chapter 2.04.010 (City Council Compensation), increasing the monthly salary, for first reading by title only and waive the full reading; (2) Authorize the City Clerk to publish the ordinance in accordance with law; and (3) Find that the action is exempt from environmental review under the California Environmental Quality Act (CEQA) Guidelines, pursuant to section 15061(b)(3) — Common Sense Exemption. BackgNound/Analysis Effective January 1, 2024, the California Legislature updated the salary limits for city council members in general law cities, These salaries are primarily set by ordinances adopted by the council, pursuant to authorization and limits set by statute. Under Government Code section 36516, councils may set salaries at or below specified limits based on the population of their city. Salaries may only exceed these limits: (1) if submitted to and approved by the voters at any municipal election; or(2)by charter. As of January 1, 2024, those limits are: (A) $950 per month, for a city of population of 35,000 or less; (B) $1,275 per month, for a city of population over 35,000 and less than 50,000; (C) $1,600 per month, for a city of population over 50,000 and less than 75,000; (D) $1,900 per month, for a city of population over 75,000 and less than 150,000; (E) $2,550 per month, for a city of population over 150,000 and less than 250,000; and Report to Redding City Council November 15,2024 Re: 9.14(a)--Offer City Council Compensation Ordinance for First Reading by Title Only Page 2 (F) $3,200 per month, for a city of population over 250,000. These limits increase by an amount equal to inflation from January l, 2024, based on the California Consumer Price Index, with a maximum adjustment of 10 percent per year. Alternatively, a new ordinance can authorize an increase beyond the inflation-adjust limit if it would provide a raise of no more than five percent per year above the last salary approved by ordinance. Based on Redding's population, the maximum salary that the City Council can enact without voter approval is $1,900 per month. If the City Council desires to set a new salary within this limit, it must do so by ordinance. Unlike most ordinances, both the first and second reading must occur at a regular meeting. Moreover, the ordinance cannot provide for any automatic future increases. Once adopted, the increased salaries will phase into effect as each council seat begins a new term. The $1,900 maximum salary is inclusive of any benefits that the City Council receives in excess of the balance of City of Redding unrepresented employees. Therefore, depending on the action taken by the City Council, the Employment and Benefit Policies for Unrepresented Employees may need to be updated to reflect the change. Environmental Review This is not a project defined under the California Environmental quality Act, and no further action is required. AN ORDINANCE OF THE CITY OF REDDING AMENDING REDDING MUNICIPAL CODE TITLE 2 (ADMINISTRATION AND PERSONNEL), CHAPTER 2.04.010 (COMPENSATION) TO REVISE TI3E STIPEND FOR MEMBERS OF THE CITY COUNCIL TFIE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Redding Municipal Code Title 2 (Administration and Personnel), Chapter 2.04.010 (Coinpensation), is amended to read as follows: 2.04.010 Compensation. Each member of the City Council sha11 be entitled to a stipend(salary) and benefits as follows: A. Each member shall receive a salary of one thousand nine hundred dollars ($1,900.00)per month; B. Each City Council Member shall be eligible to participate in the health, welfare and retirement programs of the City. 1. A City Council Member may choose to become a part of the City's health care plan. The City will pay the percent of the premium that it pays for unrepresented employees as outlined in the Employment and Benefit Policies for Unrepresented Employees. 2. If a Council Member chooses to cover a spouse or family member, they may do so, however, the Council Member will reimburse the City for any additional costs of any selection in excess of self-coverage only as indicated above. Section 2. Severability. If any section, subsection, sentence, clause or phrase of these ordinances is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision sha11 not affect the validity of the remaining portions of the ordinances. The City Council of the City of Redding hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. Section 3. The passage of this ordinance is not a"project" according to the definition in the California Environmental Quality Act,and therefore is not subject to the provisions requiring environmental review. Section 4. This Ordinance shall take effect thirty(30) days after the date of its adoption, and the City Clerk sha11 certify to the adoption thereof and cause publication according to law.
