SUBJECT: 4.11(g)--Accept Improvements and Adopt Resolution Accepting the Streets in the

Recommendation
Accept the improvements in Silverstone Subdivision Uniti 3 (AMND-2020-01135/5-2019-00280)
as satisfactorily complete; and adopt Resolution accepting the Silverstone Subdivision Unit 3
(AMND-2020-01135/5-2019-00280) streets for maintenance and operation.
Fiscal Impact
There will be cumulative impacts to the Public Works Department due to the increase in public
street infrastructure requiring annual maintenance, especially the asphalt pavement. The project
will generate an incremental increase in State of California gas-tax funds based on population
and point-of-origin sales; however, the increase in these revenues falls short of the anticipated
annualized maintenance cost.
In addition, there will be an incremental increase in the City of Redding (City)utility costs due�o
the additional infrastructure. Generally, except for the Storm-Drain Utility, sufficient revenue is
generated by monthly use charges to offset any increase in annual maintenance costs. The Storm-
Drain Utility is pressed with increasing requirements that current rates do not cover.
Alte�native Action
The City Council (Council) may choose not to accept the improvements. Under this alternative,
the City would be inconsistent with a long-standing policy of maintaining streets and
infrastructure following the completion of the improvements in accordance with City standards.

Background/Analysis
The developer, Sierra Pacific Land and Timber Company, has satisfactorily completed the
instal]ation of all improvements in Unit 3 of the Silverstone Subdivision, (AMND-2020-
01135/5-2019-00280). The subdivision is located south of Rancho Road and Shasta View Drive.
A map showing the location of the subdivision is attached.
The Silverstone Subdivision Unit 3 was approved by the Planning Commission on September 22,
2020, and all conditions of the map have been fulfilled. The fmal map for the subdivision was
approved by the Council on August 20, 2024. All improvements have been satisfactorily
completed, and a11 required fees have been paid. This subdivision was also required to form a
landscape maintenance district, which has been formed.
The developer has completed all the conditioned improvements for the Silverstone Subdivision
Unit 3. It is prudent to accept the improvements and adopt a resolution accepting streets for
maintenance and operation.
The resolution has been approved to form by the City Attorney.
EnviNonmental Review
On April 5, 2005, Council held a public hearing and adopted Resolution 2005-048 certifying the
completeness and adequacy of EIR-01-03, thereby satisfying the requirements of the California
Environmental Quality Act. No further action is required.

WHEREAS,improvements have been satisfactorily completed in Silverstone Subdivision,
Unit 3, AMND-2020-00135/5-2019-00280; and
WHEREAS, the City Council has considered the recommendation of the Public Works
Department that the streets in Silverstone Subdivision,Unit 3,AMND-2020-00135/5-2019-00280,
be accepted into the City street system for maintenance and operation by the City;
NOW, THEREFORE,IT IS RESOLVED by the City Council,pursuant to the authority
provided in Section 1806 of the California Streets and Highways Code, that the streets in
Silverstone Subdivision,Unit 3,AMND-2020-00135/5-2019-00280 as shown on the map attached
and incorporated herein— are accepted into the City street system for maintenance and operation
by the City.

SUBJECT: 4.11(e)--Approve Final Map and Execute Subdivision Agreement for Silverstone
Subdivision, Unit 3 (AMN�D-2020-01135, 5-2019-00280)
Recommendation
Authorize the Mayor to execute a Subdivision Agreement with Sierra Pacific Land and Timber
Company; and approve the final map for Silverstone Subdivision, Unit 3 (AMN�D-2020-
01135/5-2019-00280), thereby, instructing the City Clerk to file the map with the Shasta County
Recorder.
Fiscal Impaet

Background/Analysis
The Silverstone Subdivision, Unit 3 (AMND-2020-01135/5-2019-00280) was approved by the
Planning Commission on September 22, 2020. Attached is a map showing the subdivision, which
is located south of Rancho Road and Shasta View Drive.
The developer, Sierra Pacific Land and Timber Company, has submitted the final map and all
other required data which has been checked and approved by various City Departments. Relevant
subdivision map conditions of approval have been met with the exception of some portions of
roadway conditions (placing asphalt concrete, striping, pouring curb/gutter/sidewalk, centerline
monument survey, street name signs, utility manholes, street lights and valve grade adjustments).
The developer has agreed to the execution of a Subdivision Agreement, has committed to
completing these conditions, and has submitted a related security in the amount of$157,805 for
the remaining work. The developer has been informed that no occupancy permits wi11 be granted
for residences constructed on lots until a11 related Subdivision Agreement conditions have been
met.
The agreement has been approved as to form by the City Attorney.
Envi�^onmental Review
On Apri1 5, 2005, Council held a public hearing and adopted Resolution 2005-048 certifying the
completeness and adequacy of EIR-01-03, thereby satisfying the requirements of the California

Prit�r to the comrnencement of wark hereunder Subdivider shall notify City Engineer in
writing of the date fixed by Stiibdivider for commenceinent tllereof; so that City Engineer'
shall b�able to prc�vide services of inspection.
4. (?ccup�ncy
1'�irs�iant to Section 17.26.010 ofthe Redding Municipa[Code,occupancy af structt�res shall
nat be per�nitted uritil a11 public impl-ovement� associated with the subdivisic�n have been
duly accepted by City Cti�.zncil.
5. 'Tirne of Essence-Extension
Time is of the essence of this agreement; provided, that in the event good cause is shown
therefor; the City Councii may extend the tii�ne for cornpletian of the ilnprovements
hereunder. Any sL�ch extension may be granted witho�it natice ta the Subdivider's surety,
and extensic�ns so granted silall not relieve the surety's liability on the bond to secure the
faitl�ful per•formance of this agreement. The City Cc�un�i1 shall be the sole and final jLidge as
t€�whether or not good cause has been sha�vn ta entitle Subdivider to an extensian.
b. Repairs and Rep[a�em�nts
Subdrvider shall replace, or have replaced, ar repair or have repaired,as the case may be,a�l
pipes and manurnents shown on the Map which ha�e been destroyed ar damaged, and
S�,lb�ivider shall i•eplace or have r�placed, rep�ir or have repaired,as the case may be,or pay
to the owner the entire cost of replacemeilt c�r repairs; of any and all property dai�naged or
destroyed by reason �f any work done hereunder whether such property be awned by the
United States ar any agency thereaf, or the State of California, or any ageney ar palitical
si�bdivisic�n thereof,or by tlle City or by any pt�blic or private corporatioil, or by any persan
wharnsoever ar by any coznbination of such owners,Any s�zch repair t�r replacernent shall
be to the satisfaction, and subject t�the appraval, of City Engineer:

Subdivider shall give personal st�perinter►dence to the�vork of said improvement, or haVe a
co�npetent forem�n a�:superintendent, satisfactory ta City Engineer on the u�ark at all tilnes
during progress, with attthc�rity to act for�ubdivider.
lU.Inspe�tion by City
S��bdivider shall at all tirnes maintain proper fa�ilities,and pravide saFe access for inspection
by City Engineer to all pacts�af tl�e work,and ta the shaps wherein t11e wark is rn preparatian.
Subdivider shall be liable for the payment af a11 inspection fees and other fees rec�uired by
the Clty of Redding within thirty(�0}days of invoice.
11: �antract�ecurity
Concui~rently with the execution hereaf; Subdivider shall fiu:nish orle of the follawing: (1)
A band or bands in the siim of at least 100'perce��t of the estitnated cast of the iznproveinents
relnaining to be constructed, plcis a contingency cost rlat to exceed 10 percent af the
i�nprovement costs, pl�zs an estimated inflation factor based on the change in the
Co��str�uction Cost Index over the averaged previous three years' changes as published in the
Engineering News Record, plLis an additional arnount�f 50 percent of the estimated costi of
improveinents securing payment tQ the contractor, or(2) and instrument of credit from an
approved financial institutian in the sarne amot�nt, or (3} cash depasit in the same amount.
As tc� (1) or(2), both the issuer and the form shall be satisfactory to City Attorney.
12.Hold I�[armless Agreement
S«bdivider hereby agrees to, volunteers and shall, hold City, its elective and appointive
boards, commissions, officers, agents; and employees, harmless frorn any liability ft�i-
darna;e or claims for damage for personal injtiry, including death; as �rell as from claims
far property damage which may ar�se from Subdivid�r's ar Subdivider°s contractars; sub-
contractors;a�ents;or ernployees'aperatians under this agr�ement,whether such operatiorts
be by St�bdivider or by any of St�bdivider's cantractars, �ubcontractors, ar by any one or
more persans directl�or ir�rdirectlY elnployed by;or acting as a�ent far Subdivider or any of
Subdivider's contractars or sl�bcontractors. Subdivider agrees to, and sha11, defend City and
its �lective and appointive boards, co�nmissians, officers, agents, and employees from any
suits oi•actions at law or in eql�ity far damages caused, or alleged to have been caused, by
reason af any of the aforesaid operatic�ns; provided as follows.

darnages,fines,pe��alties;and elairns for damages of every kind suffered,or aiteged
to have been suffeied, by reason of any of the afot•esaid operatiai�s refet�red ta in
this patagraph, 1�egardless of whether or nat City has prepared, supplied; or
approved of, plans andlor specificatiions for the subdivisian, �r regar�dless of
r�vhether or not s�tch insciranee policies shali have been deter:mined to be applicable
to any of such dainages or claims for damages.
�3. �ubdivid�r's In�ur�nce
Subdivider shall not com�nence wark under this agreernent until Subdivider shall have
obtained all ins�ir•ance reql�ired under tl�is paz:agr�ph and such instiral�ce shall have been
approved by FZisk M�nager as to for�n, amcrunt; and carrier nor shall Subdivider allaw any
cantractar or subcotltt-actor to cotnmence work on his contract or subcantract until all similar
ii7surance required of the cc�ntractor c�r slibcontractar shall ha�ve been st� obtained and
approved. All requirements herein provided shall appear either in the body of the insurance
pQ]icies or as endor�ements and shall specif ically bind the insurance carrier:. Subdivider sllall
procure and mair�tain far the duration of the agreement insurance against claims for inj«ries
ta persons or darna�;es to propei:ty which Inay arise froln ar ii� connectial� with the
per�ormance of tl�is �greement by the subdivider, its abents, representatives, ecnployees or

Minimuin Scape and Limits of Insc�rance
Caverage shall be at least as broad as:
a. Insurance Services �ffice Commercial General Liability coverage (occurrence
form CG 4001), with li�nits no less than $1,000,000 per occurrence/$2,000,,000
general aggregate for bod'tly injury,personal injury and praperty darnage,
b. Insurat�ce Servic�s Uffces forin nutnber CA 000� (Ed. 1/87)covering Automabile
Liability, owned, non-awned, and hired, wit[z limits no less than $1,OOD,000 per
accident far•bodily injury and propei��darnage.
c; Workers' Gompensatian insurance as required by the State of Cal`rfornia, with
statutory lirnits, and Employers' Liability insurance, with limits no less than
$I,�OO,Q00 per bodily injury or disease;
Ded�ictibles and 5elf-Ins�trance l�etentions
Any deductibles or self-insat•ed retentions shall be declared tc�and approved by th� City.

The general liability and automohile pc�licies are to contain ar be endar�ed tc� contain the

a. The City, its afficers, afficials, ernployees and voluntee�-s are t� be cavered as
additional insureds as respects: liabi�ity arising otit of ar in connection with the
pe��fo��inance of this abreement by or an behatf of the subdivider; prernis�s awned;
occcipied or used by the subdivider; and a��totnabiles owned, Ieased; hired or
borrowed by the subdividee. The coverage shall contain no speeial 1i�nitiatic,ns c�f
the scope af'protectic�n afforcled ta tlze City, its of�cers, officials; employees; and
valLinteers��.
b: The Subdivider's insurance shatl be primary inscirance as respects the City, its
officers, officials, emplc�yees and volunteers. Any insl�rance or self-insc�rance
maintained by the City, its officer�, officials; emplayees and volunteers shall be
excess af the insuranee of the subdivider and shall not contribute with it,
c, The subdivider's insurance shall apply se�arately to each insuied against whoi�r
claim is made or st,tit is braught, except vvith respect to the limits of the insurer's
liability.
d. Each insui•ance policy required by this clai�se shall be endarsed to state that

r:eferred to herein, Subdivider sha1� without deiay and withaut any cost to City; repair or
replace ar recc�nstruct any defective ar otherwise unsatisfactory part ar parts of the work or
structure. Should Subdivider fail ta act promptly ar ii1 acc�rdance with this req��irement; or
shc�uld the exigencies of the case require repairs o�• replacements ta be rnade befare
S�ibdivider can be not'rfied, City may, at its c�ption, make the necessary repairs or
replacetnents or perform the necessary work and SLibdivider shall pay to City the actl�al cost
�f such repairs plus fifteen(15}percent.

Neither Subdivider nor any of Subdivider:"s agei�ts or contractars are, or shall be considered
to be, agent� of City in ccrnnection with the perforinance of Sub�livider`s obligations under

17. �ost of Engineering and Inspection
SLlbdivider shall pay to Citythe acttial cost for all en�ineering, inspection,and other services
fi.�rnished by City in connection with the Subdivisiot�, plus the applicable overhead charge
in effect at the tirne_ City wi(1 f�u-nish a statelnent of all chacges for services perfarmed by
City upan request, and Subdivider shall cc�inplete payment af such charges within ten (10�
days after receipt fihereof. Said costs shall be paid in full by the Subdivider prior ta
acceptanc�by the City of the Map�r improvements.
18. Notice of Sreach and Default
If Subdivider refii�es or fails to obtain pro�ecution c�f the woek,c�r�any'severable part thereaf,
with such diligence as will insure its�otnpletian within the time specified,or anyextensions
thei-eof, or fails ta obtain campletiinn c�f said work within such tilne, ar if the �ubdivider
should be adjudged a bankrupt, or Subdivider should inake a general assignment for the
benefit of Subdivider"s creditars, or if a rec�iver shcruld be appointed in the event of
Sut�dividei•'s insolvency, or if Subdivider or any of S�ibdivider's contractc�rs,subcontractors,
a�,ents, or einployees should vialate any of the provisians of thi� a;reement, City Engineer
