SUBJECT: 4.11(i)--Approve the Fifth Amendment to Consulting and Professional Services
Contract(C-7355) for the Girvan Road Brid e at Olne Creek Re lacement Pro'ect
Recommendation
Authorize the following actions relative to Consulting and Professional Services Contract (C-
7355) for the Girvan Road Bridge at Olney Creek Replacement Project:
(1) Approve the Fifth Amendment to the Consulting and Professional Services Contract (C-
7355) with Morrison Structures, Inc. in the amount of $301,848.28 for a total not to
exceed fee of$1,101,484.11;
(2} Authorize the City Manager to execute the Amendment; and
(3) Authorize the City Manager to approve additional contract amendments not to exceed
$40,000.
Fiscal Impact
The total project cost of the Girvan Road Bridge at Olney Creek Replacement Project (Project) is
estiinated at approximately $8.5 million dollars. The Project is 88.53 percent funded by the
Federal Highway Bridge Program, with the remaining 11.47 percent being funded by the City of
Redding's (City) Transportation Impact Fee fund or the Streets Division Maintenance fund. The
total project cost includes a consultant contract with 1Vlorrison Structures Inc., (1Vlorrison) to
provide bridge design services through construction. This amendment wi11 increase Morrison's
consultant con�ract by$301,848.2$.
See table below for a summary of amended costs to Morrison's consultant contract (table only
inc]udes amendments that adjusted the contract amount).

Alternative Action
The City Council (Council) may choose not to authorize the amendment and provide staff with
an alternate direction. Without the proposed amendment, Morrison wi11 not be able to complete
the bridge design or provide services during the construction phase of the project. This
alternative would delay or likely eliminate the replacement of this bridge and jeopardize federal
funding.
BackgNound Analysis
In August 2017, an engineering and environmental services contract was executed with Morrison
for the project. In December 2019 Council approved an amendment to increase the project
funding for additional environmental tasks. In addition, in March 2020, and again in December
2022, administrative amendments were executed to update the end date of the contract. At that
time, the project had almost completed the environmental phase and the consultant began
working on obtaining necessary temporary construction easements and the final design.
Over the course of the Preliminary Studies Phase and the Preliminary Engineering and Design
for the project there has been a substantial increase in professional services required, mostly
associated with the extended project duration and environmentaUcultural concerns. As the
consultant is approaching the end of the environmental phase they have estimated that the project
will extend until 2027 for construction completion. For Morrison to continue to provide the
services originally outlined in the contract, as we11 as the additional environmental studies being
required by the California Department of Transportation (CalTrans), throughout design, bidding
and construction, additional funds are required as requested in this amendment. The amendment
has been approved as to form by the City Attorney.
The Girvan Road bridge was constructed in 1960 and is currently designated as "functionally
obsolete"per Caltrans' Bridge Inspection Reports. This designation is largely due to the amount
of traffic using the bridge and the lack of shoulders, pedestrian facilities, and turning movement
capacity. The Project will replace the existing 32-foot-wide 2-lane bridge with a 54-foot-wide
bridge that includes two 12-foot travel lanes, two 8-foot shoulders, and two 7-foot Type 26
sidewalk barriers. These improvements meet the requirements of both the American Association
of State Highway and Transportation Officials and the City.
Envi�onmental Review
This action is not a project as defined by the California Environmental Quality Act (CEQA). As
the environmental studies and design progress staff will prepare CEQA documentation for future
Council approval.

This Fifth Amendment ("Fifth Arnendment"} is tnade and ent�red into by and betvveen the C3ty of
Redding, a municipal corporatian, {"City"} and Nic�rrison Structures, Inc., ("Consult�nt") {collectively
the "Parties"and individually a"Party").
RECITALS
WHEREAS, the Parties have previously entered into Consuiting and Frofessional Service Contract an
August 22, 2017, for the purpase o�Girvan Road Bridge at C�lney Creek Replacetnent Project {C-735S)
and amended this cantract on �'ebruary 9, 2018, {"F'irst Arnendrnent"}, and I3ecernber �0, 2�1�},
{"Second Amendment"}, and March 17, 2020 ("Third Amendment"), and December 8, 2022, ("Foui-th
Am�ndment") (collectively referred herein as the <`Contract"); and
WHEREAS, the Parties desire to amend the Contract to (1}add tasks tc�the Scope of Work,
NC►W, THEREFORE, the Parties for good and valuable consideratit�n, the;receipt and sufficiency of
which is here6y acknowledged, here6y agree �as fcrllowst
I. Subsection A af Section 1 afthe Contract is hereby amended and replaced in its entirety to read
as follows:
Subsecti�an 1(A), Subject to the terms and cc�nditiails sef forth in this �ontract, Consultant shall
provide to City the services described in Exhibit A, Exhibit A-1, and Exhibit A-2, attached apld

II, Subsection B c�f Section 2 of the Contract is hereby amended and replaced in its ent'rrety to read
as follows:
Subsection 2(B). In addition to the allowable incurred costs City will pay the Consultant a fixed
�'ee of$51,2�2.54. The fixed'fee is nonadjustable far the term of the contract,except in the event
of a significant �hange �n the scc�pe of wai�k and such adjustment is rrtade by corttract
amendment.
IIL Subsection I af S�cfion 2 of the Contract is hereby �mended and replaced in its entirety to read

I. Consultant and any subconsultant shall permit City, the State of�alifc�rnia, and the
Fed�ra�I-�ighway Administratic�n("FHt�A"},iffederal participating funds are used in
this Contract, to review and inspect the praject activiti�s and files at all reasc�nable
times du�ing the performance periad c�f this Contract includin�review and inspection
on a daily basis.
SECTIC}N 2. CC1MP'ENSAfiIt)N AND REIMBTJRSEMENT C1F Ct}STS
A. The methad of payment for this contract vvi11 be based on actual cost plus a fixed fee,
City wilZ reimburse �onsul#ant for actuai costs (including labor cc�sts, empioyee
benefts, travel, equipment rental costs, overhead az�d other direct cc�sts) incurred by
Consultant in perfc�rmance of the wc�rk. Consultant will not be reimbursed far actual
cc�sts that exceed the estima#ed wage rates,employee benefits,travel,equiprnent rental,
t�verhead, and ather estimated casts set fc�rth in the appraved Consultant's Cc�st
Frt�pasal,unless additic�nal reimbursement is pravided for by contract amendsnent.In
nt�event,wiil Consultant be reimbursed for overhead costs at a rate�hat exceeds City's
apprc►ved overhead rate set fc�rth in the Cost Proposal.In the event,that City determines
th�t a change tc� the work from that specified in the Ct�st Prc�pc�sal and cc�ntract is
required, t�te contract time or actual cc�sts reimbursable by City sha11 be a�justed by
cc,ntract amend�nent tc� accc�mmc�date the changed work. The maYimum total c4st as
specified in Paragraph "I" shall not be exceeded, uniess authorized by contract

B. In addition to the ailowable incurz•ed costs City wi�l p�y the Consultant a fixed fee c�f

event of a significant change in the scope of work and such adjustment is made by
contract amendment,
C. Reimbursement for transpc,rtation and subsistence ct�sts shall not �xceed the rates
specified in the appraved Cc�st Prapc�sal.
D. When milestone cost estim�t�s are included ir�the approved Cost Pxoposai,�onsultant
sha11 obtain p�ior written apprc�val for a revised mi�estone cost estimate from the
�ontract Administrator befc�re�xceeding such cc�st estimate.

E. Progress payments will be made monthly in arrears based on services provided and
allowable incurred costs. A prc�rate portic�n af Consultant's fixed fee will be included
in the monthly progress payments.If Consultant faiis to submit the required deliverable
items according ta the schedule set fi�r in the Statement of Wc�rk, City sha�l have the
right to de�ay�ayment ar terrninate this Con#ract in ac�ordance with the provisic�ns of
Secti�►n 3 "T�rm and Terminatir�n".
F. No payment wil�be made prior to appraval c�f any work,nar for any work perfc�rmed
prioar tc,appraval of this contract.
G. No retainage wi�l be h�ld by �ity f`rt�m progress payments due Consultant, Any
retainage held by �onsultant or subconsu]tants f��,m progress payments due
subconsuitants sha11 be promptly paid in full to subcc�nsultants within thirty (30}
calenda.r days after the subcc�nsultant's work is satisfactorily completed. Federal law
{49 CFR26.29}ret�uires that any delay c�r postpc�nement of payment over the thirty(3f�}

If Consultant elects to keep the equipinent, fair ma.rket value sha11 be determined at

At the optic�n af the City,either:the insurer shall reduce or e�iminate sueh deductibles
or self-insur�d retentior�s as respects the City,its elected officials,c�ff'icers,employees,

losses and related investigations, claims administratic�n and defense expenses.
D. The General Liabi�ity shall contain or be endorsed tc�contain the fc�llc�wing prc�visions:

adequate certi�cates af insurance and endc�rsements required have not been provided,
or nat been provided in a timely manner.
G. The reqt�irements as to tile types an�limits of insurance cc�verage ta be maintained by
Ccrnsuitant as required by Sectic�n 5 c�fthis Cc�ntract,and ariy appraval of said insurance
by City, are not intended tca and wiil not in any manner iimit or qualify the Iiabilities
and c�bli�atic�ns othen�vise assumed by Cc�nsultant pursuant to t�is Contraet,including,
without limitation,provisic�ns cc�nce�ning indeznnificatic�n.
H. �fany policy of insurance required by this Sectic�za is a"claims made°'poiicy,pursuant
ta Cc�de of Civ�l Pracedure§342 and Gouernment Code§945.6,Ct�nsu�tant shall keep
said insurance in effect for a peric�d of eighteen (18)znonths aft�r the terminatic�n of
thi�Cc�ntract.
I. If any dam�ge, incluc�ing death, personal injury c�r property damage, c�ccurs in
connection with the performance afthis Cc�ntract,Consultant sha�I immedzately notify

�. The Consultant's obligation tc� defend, indemnify and hold harmless shall not i�e
excused because of the Consultant's inability to evaluate�iabi�ity.The C+�nsultant shaii
respand within thirty {30) catendar days tc� the tender af any claim for defense and
indemt�ity by t�te City,uniess this time has been extended in writing by the Ciry. If the
Coz�suitant fails to accept or reject a tender af defense and indemnity in writing

D. The obligation to indemnify,Prote�t,defend,and hc�id harm�ess set forth in this Sectic�n

applicable.The pc�licy limits of said insurance pc�licies do not act as a limitation upc►n
the amc�unt of indemnification to i�e pr�avided by Contractor.
E. City shall have the right to approve +�r disapprove the Iegal counsel retained by
�e�nsuitant pursuant tc� this Sectic�n to represent Ci�y's in#erests. City shall be
reimbursed fc�r all costs and attc�rn�y's fees incuur�rred by City in enfc�rcing the obligations
set forth in this Sec�ion.
SE�TI�C}N 7. MISCELLANE()LTS TER:M�AND CUNI�ITIUNS
A. This Contra�t shall �e deemed tc► haue been entered into in Redding, Ca�ifarn.ia. Alt
questie�ns r�gardin�the validity,interpr�tation or performance of any af its terrns or af
ariy ri�hts or obligations c�fthe parties to this Contract shall be governed by Califc�rnia
law. If any claizn, at law c�r otherwise, is made by either party to this Cc�ntract, the
prevai]ing partY sh�.]l be�ntitled tc� its ct�sts and reasonabte attorneys`fees.
B. This dt�cumer�t, ineluding all exhibits, ca�tains the entire agreement between the
parties and sup�rsedes whateve�arat or written understanding each may have had prior

principle c�f law set forth in Civil Cade§ 1654 that cantracts are canstrued against the
drafter shall not apply.

which a jury trial has been waived with any other action in which a jury trial cannot be
or has not been waived.
H. In the event c�f a conflict be#we�n the term and conditians af the body of#his Contract
and thc�se of any e�hibit or attachme�t�ereto,the terms and cond itiflns set forth in the
b4dy of this Contract shall prevail. In the event of a conflict between the terms and
conditions of any two or more exhibits or attachments hereto, those prepared by City
shall prevail over those prepared by Consultant.

Consartant to practice its professic�n. Consultant represents and warrants to City that
Consu�tant shall,at its sale ccast and expense,keep in effect or c�btain at a�l times during
the term of this Coz�tract any licenses,p�rmits and approvals that are legally required
for Consultant to practice its profession.
I�. Cc�nsultant shall, de�ring the entire term crf this Contract, be construed tc� be an
independent co�tractor and nc�thing in this Contract i� int�nded, nor sha11 it be
cpnstrued, to create an ernplc�yerlemplt�yee relationship, association, joint venture
relationship,trust ax partnership c�r to allc�w City to exercise discretion ar cc�ntrc�l over
the professiana� manner in which Cvnsultant performs under this Cc�ntract. Any and
al1 t�es imposed on Consultant's income, imposed or assessed by reason of this
Cc�ntract or its perfarmance, includin�but not�imited ta sales ar use taa�es, shall be
paid by Cc�nsultarit. Consultant shall be responsible for any taxes or penalties assessed
by reason of any claims that Consultant is ara ernpiayee of City. Consultant sha11�c�t
be eligible for coverage und�r City's wt�rkers' campensation insurance p1an, b�nefits
under the Public Emptoyee Refiirement System ar be eligibie for any other City benefit,

a cc�py ofthis Contract and Consultant shall have an affirrnative duty ts�assure that said
independent contractars and su�contr�ctors comply with the same and agree tc� be
baund by its terms.Consultant shall be the responsible party with respect to all actions
af its independent contractcars and subcc�ntractors,and shall abtain such insurance and
indemnity provisians frc�m its contra�tors and subcontractors as City's Risk Ma,nager
shall determine to be necessary.
N. Ct�nsultau�t shali perfc�rm all services required pursuant tc�this�ontract in th�rnanner
and according to the standards t�bserved by a competent practitic�ner of Consultant's
prafession. All prod�cts of whatsc��ver nature which Consultant delivers tc� City
pursuant to this Contract shall be prepared in a prafessional manner and conform to the
stant�rds of quality normally observed by a person practicing the prc�fess�on of
�onsultant aiad its agents, emplt�yees and subcantractors assigned to perform the
services eontemplated by this�antract.

CFR, Part 31 ar�d other related laws and regulatic�ns. In the instance of a CPA ICR
Audit Workpaper Review, it is Ct�nsultant's respansibility to ensure federal, state,or
Ic�cal gvvernment officials are allowed full access to the CPA's warkpapers includ'zn�
makiz�g copies as necessary.The cc�ntract,cost prc�pc�sa�,and ICR shall be adjusted by
Cc�nsultant and approved by Cit�'s Cantract Administra#or ta confarm tc�the audit or
revie�v recommendations. Consultant agrees that individual terms c�f costs identified
in the audit report shali be incorporated into the contract by this reference if directed
by City at its sc�le discretion. Refusal by Consultant to incorporate audit c�r review

that is not disposed of by agreement shall be submitted in writing and decided by City's

traveling public from injury and damage from such vehicles,

this project by others, except only such use as may be authorized in writing by

administration and Xegal staff and for testimany,if nec�essaty,at depositior�s and at tr�ai

B. Consultant's personnel that City considers essential tt� assist in defendin� agains#

Consultation or testimony will be reimbu�sed at the same rates,including travel cc�st�

canstruction prc�cess on 41ney Creek. In support ofthis effort,Morrison Structures will coordinate Pacific
Hydrolc��gic as necessary by providing technical suppcsrt and bridge configuraticrn alternatives. The
hydraulic design services and report wili include at a rninirnum:

* Identify changes in the water surface elevatians as a result of the project and pc�tential scvuring

Task 7: Utility Coordinatian
Ivi4rrison 5tructures' subconsuitant Omni Means will perform subsurface utility eng�neering in
conformance with ASCE 38-02 and Caltrans Pc�licy on high and low�risk undergraund facilities tc�identify
perssibie conflicts. The utilities include but are not �izzaited ta: PG&E, REU, Redding Munieipal Utzlities
{RMU),AT&T, and �harter. Marrison Structures shall have responsibili�y �ar the cac�rdination with each
utility, including the relocation of utilities as needed to eiiminate a delay in tY►e design pr€�ject and wili
plan �c�r all associated utilities in the design cafthe project.
The fallowing activities will be provid�d by �mni- Means. Tlae existence of overhead power and
telecommunications ]ines, domestic water, sewer, gas, and underground electrical lines make aetive
management af the atility caordination a critical task.
Prepare and Submit"UtilityA" Letters. Omni-Means will pre�are and send "Utiiity A" letters and�aase
plans tn the various utility purveyors in the project area after the City has approved the"UCility A"mailing
package. The base plans wfll be marked as "A Plans" and the transmittal letter will identify this as a City
prc�ject.
Prepare Ut�lity Canflict Maps and Relocation Letters, Omni-Means shall prepare utility cor�flict maps
ft�r use by the City attd the utility companies in deterrnining tiability{cost st�are) of the utiiity rel�catic�ns.
The maps will be sent to each utility wiCh the required Relocation Letter.The Relocati�n letter will follow
Caltrans farrnat, but will be modifi�d tc� request different times for the draf� reloeatian plan, costs and
liability claims to allow the right of way acquisitions to proceed concurrently with the utility relocation
liability determination.
Preliminary Utility Relocation Plan�oordinatit�n.Thi�task addresses coordination of the preliminary
utility rel4catit�n.plans with the praposed prs�jec�'�plans. The af�'ected utility company will compiete their
rel�cation plans with input frarn Omni-Means. Utility relocations are assum.ed to be campieted prior to
c4nstruction, or by the uti�ity purveyors' own forces. As such, relocation plans �or e�ectrical, CATV, and
caz�txznunzeation facilities will c�ot be included as work items in t�e project's cantract document�; instead,
the relc�cated utilities will be shown as in-place on the plans. If it is necessary to perForm st�me of the
utility relocations siznultaneously with project con:struction, coordination of the phasing af utility

will then be deveioped by considering the required bridge length and height, founc�ation
requirements,and other engi��ering,envirc�nmental,and econarnic considerati�ns.
A General Plan o�'the selected bridge a�ternative for the site wiil be prepared along with a General
Plan Estimate and submitted to the City fc�r apprc�val.

standards. Design live loading wi11 be HL 93 with `Low-Bc��r' and P-15. Seismic design will be in

� Participate in pre-bzd zneetings for prospective bidders to answer cc�ntractor and suppiier
technical ques�ic�ns,
• Review t�f technical cantractor and supplier submittals,
• Coordinate through the City responses tc� contractor and supplier technical questit�ns
during bidding and prepare any addenda required,
� Prouide any drawiz�gs,modiFications and clarifications during the bidding period,
• Attend alI pre-constructior�conferences,
• Pr�vide ongoing consultation and interpretation afcontra�t documents as required,
• Assist the City with submittal reviewsl preparation of ehange arders, and response tc�
ret�uests far information related to technical design issues encountered,

Girvan Road Bridge at Olney Creek Replacement Project
The Consulting and Professional Services Contract C-7355("Cantract")dated August 22,2017,and
amended February 9, 2018, between the City of Redding, California, ("City") a municipal
corporation, and Morrison Struciures, Ine., ("Consultant") is hereby amended as follows:
SECTION l.A is amended to read in its entirety as follo�vs:
A. Subj ect to the terms and conditions set forth in this Contract,Consultant shall provide to Ciiy
the services described in Exhibit A, and Exhibit A-1, attached and incorporated herein.
Consultant shall provide the services at the time,place and in the manner specified in Exhibit
A and Exhibit A-l. All Consultant personnel listed as members of the project team in the
attached exhibits shall remain on project unless prior approval for the change in personnel
has been granted by City's Contract Administrator.
The Exhibit A-1 attached to this Second Amendment is incorporated into the Contract dated August
22, 2017, and amended February 9, 2018, as Exhibit A-1.
SECTION 2.B is amended to read in its entirety as follows:
B. In addition to the allowable incurred costs City will pay the Consultant a fixed fee of
$25.210,31. The fixed fee is nonadjustable for the terrn of the contract, except in the event
of a significant change in the scope of work and such adjustment is made by contract
amendment.

RATIONALE FOR AMENDMENT2
1. Additional project management time associated with cultural resources findings
and increased compiexity of new technicai studies to support Section 106
compliance. '
2. identification of a known prehistoric resource, CA-SHA-961, within the project
area of potential effects (APE) has resulted in the need for additional Section 106
compliance documentation (e.g., Phase II Investigation).
3. City's request to inciude archeologicai monitoring during construction.
4. Changes to the California Environmental Quality Act (CEQA) initial
Study/Mitigated Negative Deciaration checklist since 2014 that will now need to
be addressed.
AMENDED SCOPE OF SERVICES
The following additional professional services wili be provided underTasks 1, 2, and 10 of
Exhibit A Scope of Services of the contract C-7355.
Task 1 -Project Management Review and Scheduling
Morrison Structures will provide contract management and quality control for
CEQA/NEPA Documentation and cultural resources Section 106 added technical
studies regarding Phase 2 archaeologicai investigation and reports.
Task 2-Environmenta/Documentafion, Permitfing, and Coordination with Ca/trans
Given the recent changes made by the Office of Planning and Research to the CEQA
guidelines checklist since 2014, the compiexity of the CEQA initial Study/Mitigated
Negative Declaration (IS/MND) has increased from what was originaliy anticipated in
the initiai scope of work and cost estimate. Additional cultural investigation (Phase 2
archaeological investigation) and reports, are required. Morrison Structures with
subconsuitant Stantec Consulting Services (Stantec) wiil compiete the Section 106
additional Phase 2 archaeological investigation task consistent with the current CEQA
guidelines.
Stantec will subcontract with Pacific Legacy, Inc., to assist with project compliance
under Section 106 of the Nationa) Historic Preservation Act, in conformance with the
"First Amended Programmatic Agreement Among the Federal Highway Administration,
the Advisory Council on Historic Preservation, the California State Historic Preservation
Officer, and the California Department of Transportation Regarding Compliance with
Section 106 of the National Historic Preservation Act as it Pertains to the Administration
of the Federai-Aid Highway Program in California," (2014) (Caltrans Section 106 PA�.
Specifically, Pacific Legacy wiil conduct a Phase II Investigation to evaluate potential
for the proposed project to affect a known prehistoric site, CA-SHA-961. The Phase 2
investigation consists of the following subtasks:
Native American Outreach - In coordination with Morrison Structures, Stantec, the City,
and Caltrans, Pacific Legacy will coordinate with Native American Tribes (Wintu Tribe of
Northern Califomia, Redding Rancheria, and Winnemem Wintu). Two Native American
cultural advisor will be employed by Pacific �egacy as a monitor for the Phase 2
investigations.
Draft and Final Archaeoloqical Evaluation Proposai- Pacific Legacy will prepare an
Archaeological Evaluation Proposal (AEP) foilowing Caltrans' Standard Environmental
Reference (Volume 2) format. The AEP wiil expiain the purpose of the investigation, the
phased approach to fieidwork, site context, reference the Archaeological Survey
Report (ASR) background sections, research topics that might be addressed by
archaeological fieidwork (research design�, the methods of excavation, the types of
laboratory and special studies that are likely to be conducted, and will provide decision
thresholds that should be used to assess when the goals of the study have been met, a
curation plan, and Native American coordination.
A draft work pian in portable document format (PDF) will be submitted to the City, and
Caltrans' Professional Qualified Staff (PQS) assigned to the project for review. Pacific
Legacy will ensure that review comments are responsively addressed to prod�ce a finai
and acceptabie AEP.
Phase 2 Invesfi ation - Pacific Legacy will conduct a Phase 2 investigation of the APE
following methods provided in the approved AEP. The fieldwork will be guided by an
experienced and professionally qualified archaeological Field Director who meets the
Secretary of Interiors standards set forth at 36 CFR Part 61. Field work will be attended by
two Native American monitors whose identity will be determined through consultations
between Caltrans, the City and the interested tribes.
Prior to the Phase 2 field work, pre-field activities will also inciude Underground Service
Alert (USA) marking and notification to identify buried utilities, arranging for
archaeologic excavation crew, and organizing hotel reservations, car rental, and
portable toilet rental.
The field investigation will entail manual excavation of 10 shovel probes (SPs) that
measure 0.5 x 0.5 m excavated in 20 cm increments to maximum depths of 80 cm, if
archaeological materials are discovered to such depths and the soil conditions ailow. A
maximum of 2.0 cubic meters is proposed for SP excavation. All recovered cultural
materials from SP excavation will be collected. SPs will assist in defining the extent of the
site and identify areas for larger excavation units.
Phase 2 investigation wiii also inciude excavation of 1.0 x 1.0 m controi �nits (CUs) in 10
cm increments. A minimum of 2.0 cubic meters with a maximum of 5.0 cubic meters is
proposed for control unit excavation. All soils will be processed through '/, inch mesh. A
4-galion sample from each level wiil be screened through YB inch mesh to recover
microdebitage and other small constituents. Soil samples may be taken from features or
�nits as warranted to recover potential macrobotanical remains. Archaeological
materials recovered from the CUs will be coilected and bagged according to
provenience. Upon completion of excavation, the control units will be backfilled, and
the topography of the ground surface restored to near original condition.
Archaeologicai fieid methods will meet standards of the profession for excavation,
recovery, recording, treatment af artifacts, and restoration of excavation locations to
their pre-excavation appearance. �
Since there is potential for human buriais to be encountered during the Phase 2
investigation, Pacific Legacy has budgeted for the use of forensic canines to inspect
areas of the APE to detect if human remains are present. The presence of human
remains can indicate high archaeological and cultural values that can positively
determine the Nationai Register eligibility of the site. Forensic canines have been
proven cost effective and accurate in identifying human burials.
Upon completion of fieldwork, recovered materials will be taken to the EI Dorado Hills,
California, Pacific Legacy office for processing and cataloging. Materials wiii be
processed in accordance with standard procedures for the specific material type.After
processing and cataloging, selected rnaterials will be submitted for specialized
analyses. Based on extant information, we assume that the collection will consist largely
of fiaked stone debitage and tools. Analyses wiii be drawn as necessary from the
following: flaked stone debitage; morphological analysis of formed tools; groundstone;
faunal remoins; floral (paleobotanical) remains; obsidian hydration and geochemical
sourcing; and radiocarbon assays. These and other potential analyses will be selected
in cons�itation with the City and Caitrans.Sample sizes will be limited to amounts
considered necessary to establish whether there is a potential for addressing imporfant

Draft and Finai Archaeological Evalvation Report IAER) - An AER will be prepared that
foilows the guidance of Caitrans Standard Environmental Reference (SER), Volume 2,
Cultural Resources. The AER provides the basis for determining whether a site is eligible
for inclusion in the NRHP or is a historical resource under CEQA. The AER describes the
fieidwork, data analyses undertaken, and the conciusions derived from them,
demonstrating that the site does—or does not—possess the additional information
potential to address significant research questions to meet Criterion D of the NRHP
criteria of evalvation. It also may conclude that the portion of the site in the APE—does
or does not—contribute to that potential. The AER will conform to the guidance of the
SER, Exhibit 5.5 which describes the appropriate format and content of an AER.
The existing site record for CA-SHA-961 will be updated on California Department of
Recreation 523 forms to document the Phase II investigation. The updated site record
wili be inGuded with the AER.
A draft AER in PDF format will be submitted to the City, and Caitrans' Professional
Qualified Staff (PQSj assigned to the project. Pacific Legacy wiil ensure that review
comments are responsively addressed to produce a final and acceptable AER.
Historic Propertv Survev Rebort (HPSRZ- After compietion of the Phase 2 AER, Pacific
Legacy will prepare the HPSR for the project. The HPSR will be prepared on the Caltrans
HPSR form and foilow guidance of the SER, Exhibit 2.6 which describes the appropriate
format and content of a HPSR. The HSPR will be subject to two rounds of review. For the
first review a PDF version of the draft HPSR wiil be provided to the City for their review.
Agreed upon revisions will be made following the City review and a second draft HPSR
report will be provided to the City for submittai to Caltrans for their review. Following
Caltrans review, the draft HPSR will be updated to a finai version HPSR addressing
Caitrans review comments and provided to the City.
Preaare Findinq of Effect Document- Pacific Legacy wiii prepare a Finding of Effect
(FOEj to assess the project effects on archaeological site CA-SHA-961. The FOE will
analyze and address the preferred project and alternatives, incl�ding some that may
have been considered, but rejected. A draft of the FOE wili be prepared and submitted
in PDF format for initial review and approval by the City. Pacific Legacy will then
incorporate agreed upon revisions and provide an updated draft FOE to the City for
submittal to Caitrans for review and approval. Pacific Legacy will review and respond
to Caitrans comments and prepare a final FOE.
Prepare Environrnentally Sensitive Area Action Plan - Pacific Legacy will prepare an
Environmentally Sensitive Area (ESA) Action Plan to document the presence of CA-SHA-
961 and provide measures for active protection during construction. The ESA Action
Plan wili foilow Caltrans guidelines and include the following: summary of the
project/proposed undertaking; description of the avoided site; description of the
avoidance measures that will be impiemented, and summary of key parties'
responsibilities. A draft ESA Action Pian will be prepared and submitted in PDF format for
initial review and approval by the City. Pacific Legacy will then incorporate the the
City's revisions and provide a draft ESA Action Plan to the City for submittal to Caltrans
for review and approval. Pacific Legacy will review and respond to Caltrans comments
and prepare a final ESA Action Plan.
Preperre Late Discoverv Pian -A late discovery pian (LDP) wili be prepared following
Caltrans standards shouid a potentiai for discovery of cultural resources during
construction be likely. The document will provide an outline of the process that will be
implemented in order to resolve adverse effects to resources which may be
encountered during construction activities. The document will be prepared and
submitted in PDF format for initial review by the City. Pacific l.egacy will then
incorporate the City's revisions and provide a draft LDP for the City's submittal to
Caltrans for review and approval. Pacific Legacy will review and respond to Caltrans
comments and prepare a final LDP.
Task 10-Assistance During Bidding& Construction
Conduct Archaeoloaical Construction Monitoriny - Pacific Legacy will provide a
qualified archaeologist to monitor all project-related ground-disturbing activities in and
near site CA-SHA-961. It is assumed that monitoring will occur in the year 2022 and 2023
construction seasons with 20 days of monitoring estimated for each construction
season. Two Native American monitors are budgeted for fulltime monitoring. The
archaeologicai monitor may temporarily halt construction to inspect discoveries of
archaeological material to assess the potential significance of the discovered
archaeologicai materials. Materials determined to be isolated or extremely low-density
deposits consisting of non-formal constituents only (e.g., flaked stone debitage) wili be
determined not significant and construction activities may proceed. Construction will
be haited if features (e.g., burial, hearth, house pitj or if significant cultural deposits are
discovered. Protocols for dealing with features or significant cultural deposits will be
established in the �ate Discovery Plan.

Contract (C-7355) for the Gixvan Road Bridge over Olney Creek Project
Recommendation
Ratify the Second Amendment to Consulting and Professional Services Contract (G7355) with
Morrison Structures, Inc. in the amount of$302,397, for a total not to exceed fee of$799,636,
for engineering services for the Girvan Road Bridge at Olney Creek Replacement Project; and
authorize the Mayor to execute the amendment.
Fiscal Impact
The Girvan Road Bridge Replacement project (project) is 88.53 percent funded by the Federal
�Iighway Bridge Program (�IBP), and the remaining 11.47 percent is funded by the City of
Redding's (City) Transportation Impact Fee (TIF) fund. The total project cost is estimated at
approximately $3.3 million to $4.3 million dollars.
Alternative Action
The City Council (Council) may choose to not authorize the Mayor to execute this contract
amendment. This alternative would delay or eliminate construction of the replacement bridge
and jeopardize federal funding.
Background/Analysis
The Girvan Road Bridge over Olney Creek was constructed in 1960 and, per California
Department of Transportation (Caltrans) bridge inspection reports, is currently designated as
functionally obsolete. The project will replace the existing 32-foot-wide 2-lane bridge with a 54-
foot-wide bridge that includes two 12-foot lanes with eight-foot shoulders and seven-foot-wide
Type 26 sidewalk barriers on each side. These improvements meet the requirements of both the
American Association of State�Iighway and Transportation Officials (AASHTO) and the City.

The total project cost for replacing the Girvan Road Bridge is expected to be $3.3 million to $4.3
million, which includes design, environmental clearance and permitting, right-of-way,
construction and contingencies, and construction management.
In August 2017, an engineering and environmental service contract was executed with Morrison
Structures, Inc. During the course of environmental field studies, Caltrans determined that the
project would require subsurface testing, laboratory analysis, Tribal consultation, Native
American monitoring, and specialized cultural report preparation for compliance with the
National Environmental Policy Act(NEPA).
On February 9, 2018, the first amendment was executed for an administrative update. The
consultant's environmental sub-consultant company changed ownership from North State
Resources to Stantec.
Staff is requesting approval of the second amendment which would provide additional funding
for environmental tasks in the contract including:
• Additional project management associated with cultural resource findings and increased
complexity of new technical studies to support Section 106 compliance;
• Additional cultural Section 106 compliance documentation (Phase II Investigation); and
• Archeological monitoring during construction and changes to the California
Environmental Quality Act (CEQA) initial study that will need to be addressed due to
cultural resource findings.
