SUBJECT: 4.11(h)--Approve Maintenance Agreement with California Department of
Transportation for California Street Bikeway Project and Authorize the City 1Vlanager to Execute
Agreement.
Recommendation
Authorize and approve the following actions related to the City of Redding California Street
Bikeway Project:
(1) Approve Maintenance Agreement with the California Department of Transportation; and
(2) Authorize the City Manager, or designee, to execute the Maintenance Agreement and any
future amendments.
Fiscal Impact
The California Street Bikeway Project (Project) is a $4.53 million project funded through a
combination of funds from the City of Redding (City) and the California Department of
Transportation(Caltrans).
This Project Specific Maintenance Agreement (Maintenance Agreement) obligates the City to
accept operational and maintenance responsibilities for the location and improvements indicated
within the proposed maintenance agreement. Maintenance responsibility wi11 commence
following construction of the proposed bikeway improvements. These planned maintenance
obligations are estimated to be less than$5,000 per year and will be funded by the Public Works'
Streets Division Maintenance fund.
Alternative Action
The City Council (Council) may chaase not to approve the maintenance agreement or authorize
the City Manager to sign the agreement with Caltrans. In such case, the Council could provide
staff with an alternate direction. Without this agreement, Caltrans wi11 not issue an encroachment
permit to the City for the project, and the contractor will not be able to begin construction in the
Caltrans right-of-way until a maintenance agreement is executed. This would also jeopardize
California Department of Housing and Community Development's Affordable I-Iousing and
Sustainable Communities Program grant funding for the project.

Background/flnalysis
A maintenance agreement establishes a generalized plan for the location of shared improvements
in the Caltrans right-of-way and outlines the general responsibilities for right-of-way acquisition,
construction, and maintenance of completed facilities.
This maintenance agreement wi11 incorporate improvements to be constructed with the project.
The project proposes to construct a separated two-way bikeway, also referred to as a cycletrack,
on California Street from Yuba Street to Division Street. The project scope of work includes
constructing curbs, curb ramps, asphalt concrete paving, intersection signal installations, storm
drainage improvements, pavement markings, and other miscellaneous items of work. The City
will need a Caltrans encroachment permit to complete the work in the state right-of-way on
California Street from Yuba Street to Tehama Street. Caltrans will not issue an encroachment
permit for the project until a maintenance agreement is executed.
The limits of the agreement and the generalized plan are shown on the attached maintenance
agreement Exhibit A.
On June 18, 2024, the Council authorized a Cooperative Agreement with Caltrans approving its
contribution to the funding for the project.
The maintenance agreement is approved as to form by the City Attorney and will be executed by
Caltrans following the City's approval.
Envi�onmental Review
This action is not a project as defined by the California Environmental Quality Act, and no
action is required.

WITH CITY OF REDDING
THIS AGREEMENT is made effective this �th day of ,��;����, 2024, by and between the
State of California, acting by and through the Department of Transportation, hereinafter
referred to as "STATE" and the City of Redding; hereinafter referred to as "CITY"; r��d

SECTION I
RECITALS

1 . Cooperative Agreement Number T�� was executed between �ITY and STATE on

referred to as "PROJECT", and

5. �EGAL RE�ATIONS AND RESPONSIBILITIES
5.1 . Nothing within the provisions of this Agreement is intend � create duties or
obiigations to or rights in third parties not parties to thi ement or to affect
the legal liability of a PARTY to the Agreement by im i any standard of care
with respect to the operation and maintenanc ATE highways and local
facilities different from the standard of care imp� by law.
5.2. Neither C1TY nor any officer or employe eof is responsible for any injury,
damage or liability occurring by reason ������ything done or omitted to be done
by, under or in connection with any �� uthority orjurisdiction conferred upon
STATE under this Agreement. It is stood and agreed that STATE shali fully
defend, indemnify and save har CITY and all of their officers and employees
from all ciaims, svits or action , f ery name, kind and description brought forth
under, including, but not li ' to, tortiovs, contractual, inverse condemnation
or other theories or asser ' of liability occurring by reason of anything done or
omitted to be done b under this Agreement.
5.3. Neither STATE n y officer or employee thereof is responsible for any injury,
damage or li occurring by reason of anything done or omitted to be done
by �iTY un ���o'��n connection with any work, authority or jurisdiction conferred
upon �ITY' ,�ler this Agreement. It is understood and agreed that CITY shall fully
defen , emnify and save harmless STATE and all of its officers and employees
fro � laims, svits or actions of every name, kind and description brought forth
u , ,�including but not limited to, tortious, contractuai, inverse condemnation
er theories or assertions of liability occurring by reason of anything done or
itted to be done by CITY under this Agreement.
6. REVAILING WAGES:
6.1 . �abor Code Compliance- If the work performed under this Agreement is done
under contract and falis within the Labor Code section 1720(a)(1) definition of a
"pubiic works"in that it is construction, alteration, demolition, installation, or repair;
or maintenance work under �abor Code section 1771 . CiTY must conform to the

provisions of Labor Code sections 1720 through 1815, and all applicable
provisions of California Code of Regulations found in Title 8, Chapter 8,
Subchapter 3, Articies 1-7. CITY;'agrees to include prevailing wage requirements
in its contracts for pubiic works. Work performed by C1TY'S; own forces is exempt
from the Labor Code's Prevailing Wage reqvirements.
6.2. Requirements in Subcontracts - CITY shall require its contractors to 'n e
prevailing wage requirements in all subcontracts when the work to be ' rrmed
by the subcontractor under this Agreement is a "public works" as def' n �abor
Code Section 1720(a)(1) and Labor Code Section 1771 . Sub racts shali
inciude all prevailing wage reqvirements set forth in CITY"� con t .
7. INSURANCE �

7.1 . SE�F-INSURED - CITY is self insured. CCTY agrees to deli � idence of self-insured
coverage providing general liability insurance, c v e of bodily injury liability
and property damage liability, naming STATE, it ' ers, agents and employees
as the additional insured in an amount of$1 per occurrence and $2 million
in aggregate and $5 million in excess. o rage shail be evidenced by a
certification of self-insurance letter (" � ��� of Seif-Insurance"), satisfactory to
STATE, certifying that �fTY meets the rage requirements of this section. This
�etter of Seif-Insurance shali also i �n y the PROJECT location as depicted in
EXNIBIT A. CITY shall deliver to ST e�'Letter of Self-Insurance with a signed copy
of this AGREEMENT. A copy e executed �etter of Self-Insurance shall be
attached hereto and incor �'""° ��°" e as Exhibit B.

SUBJECT: 4.11(d)--Authorize the Mayor to Execute a Cooperative Agreement with the
California Department of Transportation and Adopt a Budget Resolution for the California Street
Bikewa Project
Recommendation
Authorize the following actions related to the City of Redding (City} Sauth Redding Bikeway
and Pedestrian Trail Project:
(1) Authorize the Mayor to execute a construction funding Cooperative Agreement (Co-op)
with the California Department of Transportation (Caltrans), including any extensions or
amendments; and
(2) Adopt Resolution approving and adopting the 44th Amendment to City Budget
Resolution No. 2023-060 appropriating funds in the amount $2,870,000 for Fiscal Year
2023-24 and;
(3} Authorize the City Manager to execute an oversight cooperative agreement with Caltrans,
including any extensions or amendments.
Fiscal Impact
The City of Redding (City) and the California Departmen�of Transportation(Caltrans)will share
the costs of the California Street Bikeway Project (Project). Caltrans will contribute construction
funds using State I�ighway Operation Protection Program (SI�OPP) construction capital funds in
the amount of$2,8'70,000. Below is a project funding summary table:

Alternative Action
The City Council may choose not to authorize the Mayor to execute the Cooperative Agreement
with Caltrans. This alternative will not allow the City to receive funding from Caltrans. The City
will have to contribute more funding or identify additional funding sources to deliver the Project
to construction. In addition, further delays beyond December 2024 in identifying funding would
jeopardize loss of previously spent and remaining California Department of Housing and
Community Development's (HCD) Affordable Il�ousing and Sustainable Communities (AHSC)
Program grant funding.
Background/Analysis
In October of 2016, HCD awarded the City and K2 Development Company, Inc., (K2) AHSC
Program funding in the amount of$20 million for the Redding Downtown Loop and Affordable
Housing (RDLAH) Project located at 1551 Market Street. The RDLAH Project included
construction of a four-story, mixed-use building and a subterranean parking facility. In addition,
the RDLAH Project included reestablishment of the formerly abandoned street rights-of-way and
reconstruction of pedestrian and bicycle-friendly streets along portions of Market, Yuba, and
Butte Streets known as the Downtown Streets Circulation (DSC) Project; as well as constructing
a separated two-way bikeway on California Street known as the California Street Bikeway
Project. The RDLAH and DSC Projects were completed in February 2021.
The Bikeway Project proposes to construct a separated two-way bikeway, also referred to as a
cycletrack, on California Street from Yuba Street to Division Street. The Bikeway Project work
includes constructing curbs, curb ramps, asphalt concrete paving, intersection signal installations,
storm drainage improvements, pavement markings, and other miscellaneous items of work.
The Bikeway Project has presented many design challenges not anticipated in the grant
application process including complications using standard traf�c control devices (signals) for
the operation of the cycletraek with motor vehicles, identi�cation of excessive pavement
shoulder cross slopes and drainage constraints. In addition, the challenge of constructing a
cycletrack in Caltrans right-of-way for the first time in Caltrans District 2 has required
significantly more collaboration and engineering coordination.
A1ong with the increased design challenges, the Bikeway Project was initially underfunded for
construction. Staff has been able to secure additional construction funding in the amount of$2.8'7
million from Caltrans for construction in the state right-of-way to supplement funds for the
project. The City has been working with Caltrans on the attached construction funding
Cooperative Agreeinent.
In addition, the City and Caltrans are working on a separate project oversight cooperative
agreement required by Caltrans for project review and issuance of an encroachment permit. This
is an administrative agreement and within the City Manager's agreement signature authority.
However, staff is also requesting Council to authorize the City Manager to execute the oversight
cooperative agreement.
The cooperative agreement for the construction funding has been approved to form by the City
Attorney.

Environmentccl Review
This action is not a project as defined by the California Environmental Quality Act(CEQA), and
no action is required at this time. Staff will request a CEQA determination from Council when
the contract is awarded for construction for the California Street Bikeway Project.
