Recommendation
Approve and authorize the following actions relative to the City of Redding Canter Court Sewer
Proj ect:
(1) Adopt the Mitigated Negative Declaration and the Mitigation Monitoring and
Environmental Commitment Program; and
(2) Approve the Canter Court Sewer Project as described, thereby satisfying the requirements
of the California Environmental Quality Act Guidelines §15074.
Fiscal Impact
Approval of the Canter Court Sewer Project (project) along with adoption of the Mitigated
Negative Declaration (MND) and the Mitigation Monitoring and Environmental Commitment
Program (MMP) allows the project to move toward the final design and construction phases.
There is no fiscal impact as a direct result of adopting the MND, MMP, and approving the
project.
The project is estimated to cost approximately $290,475 and as budgeted, wi11 be funded through
the Public Works Wastewater Utility fund.
Alternative Action
The City Council (Cauncil) may choose not ta adopt �he MND and the MMP, and not approve
the project as described. Without approval, the project would not be able to proceed as a City of
Redding (City) project, as it would not be in com�pliance with the California Environmental
Quality Act (CEQA).

Background
This project will replace two, 6-inch sewer siphons along Churn Creek in southeast Redding.
Replacement of the siphons are needed to address the deteriorating and failing pipes. The project
is located on City-owned property west of Canter Court and east of Cambria Drive.
This project consists of the removal and replacement of the two existing 348-foot-long, 6-inch-
diameter concrete-encased sewer siphons. The siphons would be excavated and replaced in the
same alignment. An open-trench method requiring a work area approximately 20-feet wide and
an excavation depth of approximately 12-feet is anticipated be used along the entire length of
pipe to be replaced. The total length of the trench is estimated to be 348-feet in length, including
an estimated 83-foot Churn Creek crossing. The two existing 6-inch-diameter acrylonitrile
butadiene styrene siphon pipes will be removed and replaced with new 6-inch-diameter high-
density polyethylene (HDPE) pipes. Work also includes the removal, replacement, and
rehabilitation of three manholes.
The existing 10- to 12-foot-wide maintenance access road accessed via Cambria Drive wi11 be
improved by adding gravel to create an all-weather maintenance access. Additionally, a 120-
foot-long by 25-foot-wide permanent easement wi11 be obtained to accoinmodate a portion of the
improved maintenance road.
An Initial Study (IS) was prepared to satisfy the requirements of CEQA. It describes why the
Project is being proposed and the potential impacts to the existing environment. The IS shows
that the proposed Project could have a significant effect on biological resources, but with
implementation of mitigation measures, those impacts will be reduced to a level considered less
than significant. The mitigation measures and conservation measures to be implemented are
common practices and include but are not limited to biological pre-construction surveys, in-
water work windows, impact minimization, exclusionary fencing, and erosion control.
Based on the conclusions made in the IS, an MND was prepared. The MND describes the
project, including mitigation measures, and makes the determination that there will be no
significant effect on the environment provided that the defined mitigation measures are
implemented as part of the project. In addition, an MMP has been written and incorporated into
the 1VIND (CEQA Section 21081.6). The MMP wi11 be used by City staff, contractors, agencies,
and monitoring personnel during and after the project to ensure effective implementation of the
adopted mitigation measures outlined in the MN�D.
The IS/MND/1VIMP documents were sent to the State Clearinghouse far a 30-day public review
period and distribution to pertinent state agencies. They were sent to local resource agencies, the
Shasta County Clerk, and posted on the Public Works Department website. A public notice was
also sent to landowners in the vicinity of the project and posted in the local newspaper. No
comment letters were received during the state agency or public review periods.
Environmental Review
Pursuant to CEQA, the City is the lead agency for the project. As the lead CEQA agency, the
Council is authorized to adopt the MND per Redding Municipal Code Section §18.24.070.E and
state law. Upon adoption of the MND and approval of the Project by the Council, a Notice of
Determination will be filed with the Shasta County Clerk's Office and the State Clearinghouse,
completing the environmental review process.

Notice is hereby given that the public is invited to review and camment on the Initial Stucly (IS) and
proposed Mitigated Negative Declaration (TvIND), pursuant ta the California Environmental Quality Act
(CEQA), for the proposec� Canter Court Sewer Praject (project). Tl�e praposed Mitigated Negative
Declaration does not signify approval or disapproval of this project. The City of Redding will co�sider the

Canter Court Sewer Project
PROJECT DESCRIPTION
The City of Reddiug(City)is proposing the Canter Court Sewer Project in the City af Redding, Shasta
County, California. The purpose of the project is to replace two existin�sewer siphons that run under
Churn Creek. Replaeement of these siphons is needed to address age-related deterioration.
The project would consist of the removal and replacement of the two existing 348-faot-long, 6-inch-
diameter conerete-encased sewer siphons aeross Churn Creek. The siphons would be exeavated and
replaced in the same alignmcnt. An open-�rench method requiring a work area appraximately 20 feet wide
and an excavation depth of approximately 12 feet wouid be used along the entire length af pipe to be
replaced. The two existing 6-inch-diameter acrylonitrile butadiene styrene siphon pipes would be
removed and replaeed with new 6-inch-diameter high-density polyethylene pipes in the sazne align�meilt.
New pipe sections would be placed in the trench, fused tagether, and connected to manholes on both ends
of the pipeline. When campleted,the trench would be baekf'illed with slurry and a canerete cap to prevent
erasion during high winter flows. The d'zsturbed s�realn claannel bed and bank would be xeturned to its
original contours and seeded with a locai native seed mix. Work aisa includes the removal of one
manhole, the replacement of one manhole, and the rehabiiitation of a third�nanhole. The old siphon pipes,
the reznoved xn�nhole�naterial, and the exeavated earthen znaterial would be taken ta a landfill,
Construction is expeeted to require one canstruction season(Ju1y 1 through October 31)beginning in
summer 2025.
ENVIRONMENTAL SETTING
The project area is located in a narrow band of open spaee and is cent�red on Churn Crael�, an intermittent
stream. Natural riparian habitat is situated on either side of the stream. The open spaee is bounded by
residential neighborhoads to the east and west. Each neighbarhoad includes a connection road to the open
space and project area.
FINDINGS AND QETERMINATION
The City of Redding eonducted an Initial Study(attached)that determined that the propased prajeet could
have signifieant environm�ntal effects on biaiogical resources. Implementation of specific mitigation
measures identi�ed below will avoid or mitigate the potentially significant environmental effeets
identified, and the preparation of an environmental impact report will not be required. Zf there are
substantial changes that alter the character or impacts of the proposed project,another enviromnental
impact detennination will be necessary.

Prior to approval of the project,the lead agency may conclude, at a public hearing,that certain mitigation
measures identified in the Mitiga�ed Negative Declaration are infeasible or undesirable, In accordance
with California Environmental Quality Act(CEQA) Seetiol� 15074.1,the lead agency may delete those
mitigation measures and substitute other measures that it determines are equivalent or more effeetive. The
lead agency wotzld adopt written findings that the new measure(s}is{are) equivaient or more effective in
mitigating or avaiding potential significant effects and that it would not cause any potentially signi�cant
effect on the environment.
1} Based on the whole recard(ineluding th�Initial Study and any supparting documentation) and the
mitigation measures incorporated into the project,the City of Redding has determii3ed that there is no
substantial evidence tl�at the project will have a significant effect on the environznent.
2) Tha Mitigated Negativa Declaration,with its supparting documentation,reflects the independent
judgment and analysis of the lead agency,which is the City of Redding.
DOCUMENTATION
The attached Initial Study docuinents the reasons to support the above determination.
MITIGATION MEASURES
The following miti�ation measures wili be incorporated into the project to minimize potential effects on
biological resources:
MM-1. All in-water work sha11 occur during July 1 ta Oetober 31 to avoid peak tiines when listed
juvenile anadromous fish would be present.
MM-2.Before dewatering,there wili be a visual inspectian for fish presence. If fish are noted,they will
be herded away fram the work area,using seines if possible, and prevented from returning to the area
using black nets.
M -3.Environmental awareness training for eonstruction persannel will be eanducted by a qualified
biologist prior to onset af work to brief them on how ta reeognize Northwestern pond turtle and the
apprapriate avaidance measures.
MM-4.Twenty-four hours prior to initiation of ground dist�urbance or vegetation removal, a quali�ed
biologist shall perform a pre-eonstruction survey for western pond turtle and their nests. If western pond
turtles are encountered in the project area dnring construction and could be harmed by eanstruction
activities,work will stop immediately in the area and the individual turtles will be allowed to move away
on their awn accord. If a Northwestern pand turtie nest is found, a qualified biologist(in consuitation with
the CDFW and USFWS)w�ll determine the extent of a construetion-free buffer zone to be established
around the nest.
MM-5. If construction or vegetatian remova�oceurs during the nesting season, February 1 through
August 31 for birds and November 1 through July 15 for raptars, a q�alified biologist shall conduet a
preconstruction surv�y to locate aetive nests. Thc pre-construction survey wi11 b�performed no morc than
7 days prior ta the implementation of constuction activities.If a lapse in construction activities occurs for
7 days ar longer, anather pre-construetion survey will be performed. If an active nest is found, a qualified

biologist{in cansultation with the CDFW)will determine the extent of a buffer zone to be established.
around the nest.
MM-6.To the extent practicable,removal of large trees with caviti�s, crevices, or snags shall occur
before bat maternity colonies form(i.e.,prior to March 1}or after young are volant(i.e.,
after August 31}. If construction(including the removal af large trees}oceurs during th�bat
non-volant season(Mareh 1 through August 31), a qualified professional shall conduct a
pre-construction survey of the study area to locate matenuty colonies anc�identify measures
to protect colonies from disturbance. The preconstruction survey will be performed no inore
than 7 days prior to the implementation of construction activities. If a maternity colony is
located within or adjacent to the study area,a dist�urbance free buffer sha11 be established by
a qualified prafessional,in consultation with CDFW,to ensure the colony is protected from
project activities.
MM-'1.To the extent practieable,remaval of riparian brush will occur outside of the maternal
d�nning period(i.e., July 1—April 30), If vegetation reinoval is to occur during the inaternal
denning period(May 1—June 30),a qualified biologist will conduct a preconstructian survey of the study
area to locate maternity dens and identify ineas�res to protect the maternity dens fram disturbance. The
preconstruction survey will be performed no more than seven days prior to the vegetation removal.
MM-8.High visibility feneing, flagging,or markers wi11 be installed along the edges of the worlc zane
near culturally sensitive zone to prevent damage or unauthorized access.

MITIGATION MONITORING PROGRAM CONTENTS
This document is the Mitigation Monitoring and Environmental Commitment Program(MMP/ECP)for
the Canter Court Sewer Project(project). The 1V1MP/ECP includes a brief discussion of the legal basis for,
and the purpose of,the program, discussion, and direction regarding complaints about noncompliance; a
key to understanding the monitoring matrix; and the monitoring matrix.
LEGAL BASIS OF AND PURPOSE FOR THE MITIGATION MONITORING PROGRAM
California Public Resources Code Section 21081.6 requires public agencies to adopt mitigation
monitoring or reporting programs whenever certifying an environmental impact report(EIR) or a
mitigated negative declaration(MND). This requirement facilitates unplementation of all mitigation
measures adopted through the California Environmental Quality Act(CEQA)process.
The MMP contained herein is intended to satisfy the requirements of CEQA as they relate to the Initial
Study/Mitigated Negative Declaration prepared for the project. It�s intended to be used by City of
Redding(City) staff,participating agencies,project contractors, and mitigation monitoring personnel
during implementation of the project.
Mitigation is defined by CEQA Guidelines Section 15370 as a measure that does any of the following:
■ Avoids impacts altogether by not taking a certain action or parts of an action.
■ Minimizes impacts by limiting the degree or magnitude of the action and its implementation.
■ Rectifies impacts by repairing,rehabilitating, or restoring the impacted environment.
■ Reduces or eliminates impacts over time by preservation and maintenance operations during the life
of the project.
■ Compensates for impacts by replacing or providing substitute resources or environments.
The intent of the MMP is to ensure the effective implementation and enforcement of adopted mitigation
measures and permit conditions. The MMP will provide for monitoring of construction activities as
necessary, onsite identification and resolution of enviromnental problems, and proper reporting to City
staff.
In addition to meeting the CEQA MMP requirelnents,this document incorporates environmental
commitments, standard practices,conservation measures, and best management practices(BMPs). The
environmental commitments may be part of the project design, standard contract speci�cations, City
requirements, or conservation measures. These coininitments are part of the project,but they do not
constitute mitigation under CEQA as they have not been incorporated to reduce a potentially significant
impact.

MITIGATION MONITORING/ENVIRONMENTAL COMMITMENT PROGRAM TABLE
The MMP/ECP Table identifies the mitigation measures and commitments proposed for the project.
The tables have the following columns:
■ Mitigation Measure: Lists the mitigation measures identified within the Initial Study for a specific
potentially significant impact, along with the number for each measure as enumerated in the Initial
Study.
■ Environmental Commitment: Lists the commitments identified within the project that are not
related to a potentially significant CEQA impact,but further ensure environmental resource
protection.
■ Timing: Identifies at what point in time,review process, or phase the mitigation measure will be
completed.
■ Agency/Department Consultation: References the City department or any other public agency with
which coordination is required to satisfy the identified mitigation measure.
■ Verification: Spaces to be initialed and dated by the individual designated to verify adherence to a
specific mitigation measure.
NONCOMPLIANCE COMPLAINTS
Any person or agency may file a complaint asserting noncompliance with the mitigation measures and
commitments associated with the project. The complaint shall be directed to the City in written form,
providing specific information on the asserted violation. The City sha11 investigate and determine the
validity of the complaint. If noncoinpliance with a mitigation measure has occurred,the City shall take
appropriate action to remedy any violation.The compliant shall receive written confirmation indicating
the results of the investigation or the final action corresponding to the particular noncomplianee issue.
